GUIDELINES ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF DISTRICT HEALTH CENTERS IN PROVINCES AND DIRECTLY-GOVERNED CITIES

Pursuant to DecreeNo. 75/2017/ND-CP dated June 20amend1. PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

This Circular guides the functions, tasks, powers, and organizational structure of District Health Centers, including those in districts, urban districts, towns, and cities under provinces, centrally governed cities (referred to collectively as District Health Centers).

This Circular applies to District Health Centers, including those located in areas where there are general hospitals at Level II or higher.

Article 2. Legal Status

1. A District Health Center is a public health service unit directly subordinate to the Department of Health, having legal personality, its own office, seal, and separate bank accounts opened at the State Treasury and banks in accordance with the law.

2. The District Health Center is subject to direct guidance and management regarding organization, human resources, operations, finance, and physical infrastructure by the Department of Health; it receives professional guidance on specialized techniques and business practices from provincial and central health units, and is subject to state administration by the People's Committee of the district in accordance with the law.

Chapter II

FUNCTIONS, TASKS, POWERS

Article 3. Functions

1. The District Health Center has the function of providing specialized technical services for preventive healthcare, medical examination and treatment, rehabilitation, food safety, population control, and other healthcare services as prescribed by law.

2. In administrative units where there are general hospitals at Level II or higher, the District Health Center still performs the function of medical examination and treatment to provide outpatient medical services, screening examinations, consultation services, other healthcare services as prescribed by law, and manages the activities of commune health stations, community health centers (if any), and village health workers within its jurisdiction.

Article 4. Tasks and Powers

Clause 1. Implement activities providing professional and technical services related to preventive healthcare:

a) Implementing activities to prevent and control infectious diseases, HIV/AIDS: monitoring, early detection, vaccination, preventive treatment, implementing measures to combat epidemics and mitigate their consequences; preventing and controlling factors that cause the emergence and spread of diseases;

b) Implementing activities to prevent and control non-communicable diseases: controlling and preventing risk factors, monitoring, early detection, managing, and implementing measures to prevent and control non-communicable diseases;

c) Implementing community nutrition activities, environmental sanitation, school health, occupational health, prevention and control of occupational diseases, accidents and injuries; monitoring the quality of water used for drinking and daily life, protecting the environment for healthcare facilities, and preventing harmful factors to health as prescribed by law;

Point d. Organize and implement health examinations, classification of health status, regular health check-ups for workers, and health check-ups for military service obligations as prescribed by law.

Clause 2. Implement activities providing professional and technical services related to medical examination and treatment, rehabilitation:

Point a. Provide first aid and emergency care;

b) Conducting medical examinations, treatments, and rehabilitation according to the license for medical examination and treatment and the scope of specialized activities approved by the competent authority for self-referred patients, referred patients, and patients transferred back from higher-level medical facilities for continued observation, treatment, care, and rehabilitation;

c) Performing techniques, procedures, surgeries, and referrals in accordance with the law;

Point d. Organize and manage drug substitution therapy for opiate addiction, treatment for other types of addiction, and HIV/AIDS treatment as prescribed by law;

d) Conducting medical forensic examinations as prescribed by law; participating in forensic medical examinations when requested;

3. Implementing activities to provide services related to reproductive health care:

a) Implementing activities to provide maternal and child health care, adolescent and youth reproductive health care, male reproductive health care, and elderly reproductive health care;

Point b. Perform gynecological techniques and procedures and implement contraceptive methods as prescribed;

Point c. Prevent and control sexually transmitted infections, reproductive tract cancers, and congenital diseases.

Clause 4. Implement activities providing professional and technical services related to food safety:

a) Implementing activities to prevent and control food poisoning in the area; investigating, monitoring, and handling cases of food poisoning and foodborne illnesses;

Point b. Guide and supervise food production and trading establishments, food service businesses, and street food vendors within the territory in ensuring food safety according to the law;

c) Participating in assessing the conditions of food production and trading establishments in the area according to the division of responsibilities; participating in inspections and checks on food safety and performing other tasks related to food safety as prescribed by law and according to the division of responsibilities.

Clause 5. Implement activities providing professional and technical services related to population:

a) Implementing activities to provide pre-marriage health counseling, prenatal and newborn screening, family planning services;

b) Organizing and coordinating inter-sectoral activities to implement population work activities aimed at adjusting birth rates, controlling population size, regulating gender imbalance at birth, improving population quality, and caring for the elderly in line with population aging in the area as prescribed by law.

6. Conducting tests, imaging diagnostics, and functional examinations to serve the specialized technical activities of the Center and the needs of the people; organizing the implementation of biological safety measures in laboratories and radiation safety in accordance with the law.

7. Provide medical services for disaster response and recovery, and emergency medical situations.

8. Promoting information about the policies of the Party and the laws of the State, organizing advisory, educational, communication, and mobilization activities to encourage the participation of the people in health protection, care, improvement, population work, and development activities in the area.

9. Managing and guiding professional activities:

a) Implementing the establishment of health records for residents in the area;

b) Directly managing and directing specialized technical activities of commune health stations, community health centers, and midwifery houses (if any);

c) Guiding, inspecting, supervising, and supporting specialized technical activities of healthcare facilities under agencies, schools, industrial farms, factories, and village health workers, traditional birth attendants, and population cooperation members.

10. Training and professional development:

a) Implement training and professional development for the cadre of officials under their management authority in accordance with the provisions of the law;

b) Conduct training and update knowledge on specialized fields and professional skills for village health workers, traditional birth attendants, population cooperation officers, and other subjects as prescribed by the competent authority at the local level.

11. Carry out the reception, supply, storage, distribution, and use of medicines, contraception devices, vaccines, medical supplies, chemicals, and equipment for professional activities in accordance with the provisions of the competent authority at the local level and the law.

12. Implement health and population projects and programs in accordance with the provisions of the competent authority at the local level; carry out military-civilian healthcare integration based on actual conditions and the law.

13. Enter into contracts with social insurance agencies to organize health examinations and medical treatments covered by health insurance at the District Health Center and affiliated healthcare units in accordance with the law.

14. Conduct and participate in scientific research and technological development; apply scientific and technological advancements in professional activities.

15. Implement statistical systems, reporting; establish, compile, and provide information for the basic health and population data database in accordance with the law.

16. Manage human resources, finance, and assets according to the delegated authority and the law.

17. Perform other tasks and powers assigned by the Director of the Department of Health and the Chairman of the People's Committee at the district level.

Chapter III

ORGANIZATIONAL STRUCTURE, PERSONNEL, AND FINANCIAL RESOURCES

Article 5. Organizational Structure

1. Leadership of the District Health Center

a) The District Health Center has a Director and Deputy Directors in accordance with the law;

b) The appointment, reappointment, removal, transfer, commendation, disciplinary action, dismissal from position, retirement, and implementation of policies for the Director and Deputy Directors of the District Health Center shall be carried out according to the delegated authority or the authorization of the Chairman of the Provincial People's Committee and the law. The specific duties of functional departments within the District Health Center shall be determined to ensure full compliance with the law.

2. Functional Departments of the District Health Center

b) Planning and Operations Department (including quality management and social work areas);

c) Population, Communication, and Health Education Department;

d) Nursing Department;

đ) Finance and Accounting Department.

Based on the nature, characteristics, and actual needs of each locality, the competent authority decides on the establishment and restructuring of functional departments within the District Health Center; specifies the specific duties of these departments to ensure full compliance with the law.

3. Specialized Departments of the District Health Center

a) Disease Control and HIV/AIDS Department;

b) Public Health Department;

c) Food Safety Department;

d) Reproductive Health and Obstetrics Department;

đ) Outpatient Department/Multi-specialty Clinic;

e) Emergency and Intensive Care Department;

g) Internal Medicine Department;

h) Surgery Department;

i) Anesthesiology and Intensive Care Department;

k) Pediatrics Department;

l) Traditional Medicine and Rehabilitation Department;

m) Oral and Maxillofacial - Ophthalmology - Otorhinolaryngology Department;

n) Laboratory Department;

o) Diagnostic Imaging Department;

p) Infectious Diseases Department;

q) Infection Control Department;

r) Pharmacy, Medical Equipment, and Supplies Department;

s) Nutrition Department;

t) Counseling and Substance Abuse Treatment Department.

Based on the nature, characteristics, and actual needs of each locality, the competent authority decides on the establishment and restructuring of specialized departments within the District Health Center to ensure suitability with job requirements; specifies the specific duties of these departments to ensure full provision of professional services and techniques in accordance with the law.

For districts currently having general hospitals of Class II or higher, the arrangement of inpatient beds in specialized departments within the District Health Center for outpatient and inpatient care should meet actual needs and conditions, as advised by the Center Director and submitted for consideration and decision by the competent authority at the local level.

4. Healthcare Units under the District Health Center

a) Commune Health Stations: Implemented in accordance with Circular No. 33/2015/TT-BYT dated October 27, 2015, issued by the Minister of Health, guiding the functions and responsibilities of commune health stations;

b) Regional Multi-specialty Clinics, Maternity Homes (if any): Carry out tasks as prescribed by the competent authority based on actual needs at the local level and in accordance with the law.

Article 6. Human Resources

1. The number of staff at the District Health Center is determined based on job positions according to the functions, tasks, and scope of operations of organizations as stipulated in Article 5 of this Circular and within the total number of staff of public service units of the province or centrally-administered city approved by the competent authority.

2. Based on functions, tasks, organizational structure, and job position list, the District Health Center develops a job position plan for approval by the competent authority; annually builds a professional career structure, determines the number of staff, reports to the competent authority for review and decision in accordance with the law to ensure the fulfillment of assigned tasks.

Article 7. Financial Sources

1. Revenue from public service activities.

2. Fees retained for expenditure as prescribed by laws on fees and charges.

3. State budget support for costs not included in the price or fee of public service activities.

4. Other revenues as prescribed by law (if any).

5. State budget allocation to ensure regular activities related to preventive health, food safety, population control; non-regular tasks (if any), including: Funding for scientific and technological tasks; funding for national target programs; other programs, projects, and plans; matching funds for projects decided by the competent authority; investment capital; funding for purchasing equipment for public service activities approved by the competent authority; funding for urgent tasks assigned by the competent authority.

6. Grants and donations in accordance with the law.

Chapter IV

IMPLEMENTING PROVISIONS

Article 8. Effective Date

1. This Circular takes effect from July 15, 2021.

2. Circular No. 37/2016/TT-BYT dated October 25, 2016, issued by the Minister of Health guiding the functions, tasks, powers, and organizational structure of District Health Centers, urban district health centers, town health centers, and provincial city health centers under centrally governed cities, and Part II of Circular No. 05/2008/TT-BYT dated May 14, 2008, issued by the Ministry of Health guiding the functions, tasks, and organizational structure of population and family planning agencies at local levels shall cease to be effective from the date this Circular takes effect.

Article 9. Cross-References

In case the referenced documents in this Circular are replaced or amended, they shall be applied according to the replaced or amended documents.

Article 10. Responsibilities for Implementation and Organization

1. Provincial People's Committees and People's Committees of centrally governed cities shall be responsible for:

a) Directing the Department of Health and People's Committees at the district level to implement this Circular in their respective localities;

b) Directing the People's Committees at the district level to take responsibility for investing in and constructing physical facilities for healthcare units within their jurisdiction according to the division of labor and levels of authority, and coordinating with the Department of Health to strengthen healthcare and population work in their respective areas.

2. Departments of Health of provinces and centrally governed cities shall be responsible for:

a) Serving as the focal point for organizing the implementation of this Circular in their respective localities;

b) Taking the lead and coordinating with the Department of Home Affairs to submit to the Provincial People's Committee for approval plans to improve the organizational structures of district health centers within their province in accordance with actual conditions at the local level as stipulated by law and guided by this Circular;

c) Issuing regulations on the specific functions, tasks, powers, and organizational structures of district health centers within their province in accordance with guidance provided in this Circular and in line with actual needs and conditions, either through their own authority or by submitting them for approval by the Provincial People's Committee.

During the implementation process, if any issues arise, difficulties or obstacles occur, it is requested that relevant agencies, organizations, and individuals promptly report to the Ministry of Health (Department of Cadres and Civil Servants) for consideration and resolution./.
