Amending and supplementing certain Articles of Circular No. 10/2020/TT-BTP dated December 28, 2020 issued by the Minister of Justice guiding the recording, use, management, and storage of Adoption Registers, sample documents, and adoption files has been amended and supplemented promulgating and guiding the recording, use, management, and storage of Adoption Registers, sample documents, and adoption files

BASED ON Decree No. 19/2011/NĐ-CP dated March 21, 2011, of the Government detailing the implementation of certain provisions of the Adoption Law; BASED ON Decree No. 24/2019/NĐ-CP dated March 5, 2019, of the Government amending and supplementing certain provisions of Decree No. 19/2011/NĐ-CP dated March 21, 2011, of the Government detailing the implementation of certain provisions of the Adoption Law;

Pursuant to Decree No. 19/2011/NĐ-CP dated March 21, 2011 of the Government detailing the implementation of certain provisions of the Law on Adoption; Decree No. 24/2019/NĐ-CP dated March 5, 2019 of the Government amending and supplementing certain articles of Decree No. 19/2011/NĐ-CP dated March 21, 2011 of the Government detailing the implementation of certain provisions of the Law on Adoption;

Pursuant to Decree No. 98/2022/NĐ-CP dated November 29, 2022, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Pursuant to Decree No. 45/2020/NĐ-CP dated April 8, 2020, issued by the Government on implementing administrative procedures in an electronic environment;

Pursuant to Decree No. 42/2022/NĐ-CP dated June 24, 2022 of the Government stipulating the provision of information and online public services by state agencies in the digital environment;

AT THE PROPOSAL OF THE Head of the Adoption Department;

The Minister of Justice issues this Circular to amend and supplement certain articles of Circular No. 10/2020/TT-BTP dated December 28, 2020 of the Minister of Justice promulgating and guiding the recording, use, management, and storage of Adoption Registers, sample documents, and adoption files

Article 1. Amending and supplementing certain articles of Circular No. 10/2020/TT-BTP dated December 28, 2020 of the Minister of Justice promulgating and guiding the recording, use, management, and storage of Adoption Registers, sample documents, and adoption files

1. Amending Point c and adding Points d and e to Clause 1 of Article 3 as follows:

"c) 16 sample documents for international adoption registration (Annex 3);
d) Content of interactive electronic forms for online adoption registration (Annex 5);
e) Electronic version of the Certificate of Domestic Adoption (Annex 6)."

2. Amending and supplementing Clause 2 of Article 4 as follows:

"2. The printing and issuance of the Adoption Registration Book, original copies with content and original blanks without content of the Certificate of Domestic Adoption, Decision on International Adoption, Permit for Foreign Adoption Organizations' Activities in Vietnam, and Certificate of International Adoption in accordance with Hague Convention No. 33 shall be carried out in accordance with the relevant laws."

Article 2. Supplementing, replacing, and abolishing certain provisions of Circular No. 10/2020/TT-BTP dated December 28, 2020 of the Minister of Justice promulgating and guiding the recording, use, management, and storage of Adoption Registers, sample documents, and adoption files

1. Adding Annexes 5 and 6.

2. Replacing the phrase "Adoption Bureau" in Clause 3 of Article 7 with the phrase "Ministry of Justice".

3. Replacing forms and annexes as follows:

a) Replacing the Sample Register for Issuing, Extending, and Amending the Permit for Foreign Adoption Organizations' Activities in Vietnam in Annex 1 with the Sample Register for Issuing, Extending, and Amending the Permit for Foreign Adoption Organizations' Activities in Vietnam issued together with this Circular.

b) Replacing Annexes 2, 3, and 4 with Annexes 2, 3, and 4 issued together with this Circular.

4. Abolishing the phrase "Adoption Bureau," in Clause 5 of Article 2 and Clause 1 of Article 5.

Article 3. Implementation Provisions

1. This Circular takes effect from November 30, 2023.

2. For domestic adoption registration files, international adoption registration files, and files for issuing, extending, and amending the Permit for Foreign Adoption Organizations' Activities in Vietnam received by competent authorities before the effective date of this Circular but not yet resolved, the adoption-related documents already included in these files will continue to have legal validity according to Circular No. 10/2020/TT-BTP.
