THE MINISTER OF INDUSTRY AND TRADE

Pursuant to Decree No. 189/2007/ND-CP dated December 27, 2007, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;

Pursuant to Decree No. 92/2006/NĐ-CP dated September 7, 2006 and Decree No. 04/2008/NĐ-CP dated January 11, 2008 of the Government on amending and supplementing certain articles of Decree No. 92/2006/NĐ-CP on the establishment, approval, and management of overall socio-economic development planning;

Pursuant to Decision No. 0278/2002/QĐ-BTM dated March 19, 2002, Decision No. 1953/2004/QĐ-BTM dated December 30, 2004 of the Ministry of Trade (now the Ministry of Industry and Trade), and Decision No. 45/2008/QĐ-BCT of the Ministry of Industry and Trade on adjusting and supplementing the planning scheme for gasoline service stations along the Ho Chi Minh Highway Phase I;

Pursuant to Decision No. 0969/QĐ-BCT dated February 24, 2009 of the Ministry of Industry and Trade approving the outline and budget of the project "Adjustment and supplementation of the planning scheme for gasoline service stations along the Ho Chi Minh Highway Phase I to 2015, with orientation to 2025";

Considering the report No. 0065/PEC dated January 25, 2010 of PetroVietnam Technical Services Corporation;

At the proposal of the Director of the Planning Department,

DECISION:

Clause 4 of Article 6Approving "Adjustment and supplementation of the planning scheme for gasoline service stations along the Ho Chi Minh Highway Phase I to 2015, with orientation to 2025", with the main contents as follows:

1. Development Orientation

- Ensuring sufficient and safe supply of gasoline for vehicles traveling along the Ho Chi Minh Highway, while meeting the requirements for economic and social development and ensuring national defense security of localities along the highway.

- Ensuring quality of commercial services, consumer benefits, and improving business efficiency. Combining gasoline sales with other commercial services, forming static traffic points as part of the infrastructure of national highways.

- Encouraging all domestic economic sectors to participate in investment and business, prioritizing state-owned enterprises to ensure fuel supply in all situations.

2. Development Objectives

General Objective:

Building along the Ho Chi Minh Highway a modern network of service stations that fully meet the demand for gasoline for vehicles traveling on the road and localities along the highway. Modernizing and enhancing the convenience of comprehensive services in retail gasoline sales, reaching the level of neighboring countries. Resolutely eliminating small, poorly designed service stations and those violating construction site requirements.

Specific Goals:

- Determining the number of gasoline service stations along the Ho Chi Minh Highway Phase I to meet the task of supplying gasoline for vehicles on the highway and the economic and social development needs of localities along the highway.

- Addressing existing issues in the distribution of service stations, fire safety, and environmental hygiene.

- Ensuring design standards for service stations according to specified criteria.

- Mobilizing various sources of capital from different economic sectors to invest and operate.

- Helping businesses proactively plan new construction and renovation of gasoline service stations.

- Facilitating management and supervision of the implementation of the planning scheme at all levels and sectors.

3. Development Orientation

- The planning of the network of service stations must be consistent with related plans: the Ho Chi Minh Highway planning, industrial development planning along the Ho Chi Minh Highway, and the overall socio-economic planning of localities through which the highway passes.

- Constructing service stations according to unified scale, modern technology, ensuring fire safety and environmental hygiene.

- The planning of the network of service stations must be scientific, meeting the best and most efficient needs for gasoline usage.

4. Planning for Development

4.1. Criteria for Building Service Stations

1. Regarding Area and Scale

- Type I station: must have a minimum of 6 fuel pumps (1-2 nozzles each) accompanied by overnight accommodation facilities, parking lots, and other commercial services. The land area (excluding non-operational land adjacent to the road edge) must be at least 5600m², with a frontage width of approximately 70m or more.²- Type II station: must have a minimum of 4 fuel pumps (1-2 nozzles each) accompanied by other commercial services. The land area (excluding non-operational land adjacent to the road edge) must be at least 3000m², with a frontage width of approximately 60m or more.

- Type III station: must have a minimum of 3 fuel pumps (1-2 nozzles each). The land area (excluding non-operational land adjacent to the road edge) must be at least 900m², with a frontage width of approximately 30m or more.²At locations far from supply sources and difficult transportation conditions, additional storage capacity for fuel reserves against natural disasters can be added from 50 to 100m³.

2. Distance Criteria²- Distance between two Type I stations ≥ 40km

- Distance between two Type II stations ≥ 20km³.

- Distance between Type III stations and Type I and II stations:

+ In urban areas: ≥ 2km

+ Outside urban areas: ≥ 5km

3. Location Criteria

- Consistent with construction planning of relevant ministries, sectors, and localities. Convenient for connecting infrastructure works: transportation, electricity, water supply, telecommunications to minimize investment costs and ensure business efficiency.

- Ensuring the distance between stations according to criterion 2.

- Ensuring requirements for fire safety and environmental hygiene (according to national construction standards generally and design standard TCVN-4530-1998: Gasoline service stations - Design requirements) and other related standards.

- Along sections of roads coinciding with expressways, when there is a solid median strip, stations should be staggered on both sides of the road.

4.2. Planning for Service Stations

1. Period 2010-2015

+ Building approximately 100 new stations, including:

- Building approximately 12 Type I stations, 46 Type II stations. (List and construction sites see Appendix No. 01).

- Building 42 Type III stations (List and construction sites see Appendix No. 02).

The number of newly constructed gasoline service stations may be adjusted by ±10%.

- Construct approximately 12 type I stores, 46 type II stores. (See Appendix No. 01 for the list and construction locations).

- Construct 42 type III stores. (See Appendix No. 02 for the list and construction locations).

The number of newly constructed fuel stores may be adjusted by approximately plus or minus 10%.

+ Renovate and upgrade the architectural construction to ensure neatness, safety in fire prevention and control, and environmental standards for 96 stores, ensuring that these stores will meet Class III store standards by 2015 (see Appendix No. 03 for the list).

+ Relocate 55 existing stores (see Appendix No. 04 for the list).

2. Phase 2016 – 2025

+ Orient towards constructing approximately 30 new stores, including:

- Constructing 3 new Class I stores and 18 new Class II stores (refer to Appendix No. 01 for the proposed construction sites).

- Constructing 9 new Class III stores (refer to Appendix No. 02 for the proposed construction sites).

+ Continue renovating and upgrading the architectural construction of stores to ensure they meet Class III store standards by 2020.

4.3. Capital Investment Requirements

Total investment capital: 761 billion VND, equivalent to 45,738,000 USD

Where:

Period 2010-2015: 565 billion VND, equivalent to 34,025,000 USD

Period 2016-2025: 196 billion VND, equivalent to 11,713,000 USD

4.4. Land Use Requirements

Total land use requirement: 396,000 square meters².

5. Main Solutions and Policies

5.1. Main Solutions

- Solution on capital: Utilize 100% self-balanced funds or credit from enterprises to construct petroleum retail stores.

- Solution on land: Organize bidding for land use rights for enterprises. In key areas, prioritize state-owned enterprises (such as Petrolimex) to construct petroleum retail stores to ensure energy security.

- Solution on management of petroleum retail stores: Strictly implement government regulations on petroleum business operations, particularly Decree No. 84/2009/NĐ-CP dated December 15, 2009, regarding conditions for petroleum business operations. Firmly cease operations of stores that do not comply with planning, lack a Business Condition Certificate, violate setback requirements, fail to meet store criteria, do not ensure fire safety and environmental protection, and affect social order. Strengthen market inspection and supervision, and strictly handle violations in petroleum business operations.

- Solution on environmental protection: Determine appropriate locations and sites according to planning; adhere to economic and technical standards and environmental hygiene standards in design and construction of stores: have spill containment, leak detection, and vapor recovery equipment; establish and enforce strict inspection and penalty regulations for environmental pollution violations; assign responsibilities and coordinate management between central and local departments in directing and supervising environmental protection activities of petroleum retail stores.

6. Implementation organization.

The Ministry of Industry and Trade shall be responsible for announcing and monitoring the implementation of the plan after approval.

2. Entrust Vietnam Oil and Gas Corporation (Petrolimex) to lead and coordinate with localities along the first phase of the Ho Chi Minh Highway to implement the construction of Class I and Class II stores according to the lists in Appendices 1 and 2 attached to this Decision. During implementation, if encountering difficulties, report to the Ministry for resolution.

3. People's Committees of provinces along the first phase of the Ho Chi Minh Highway:

- Direct the Department of Industry and Trade to cooperate with relevant local departments to consider approving the construction of new Class III stores within their jurisdiction as listed in Appendix No. 2 of this Decision.

- Direct the Department of Industry and Trade to cooperate with relevant local departments to review and monitor the renovation and upgrading of stores within their jurisdiction as listed in Appendix No. 3 of this Decision.

12/2025/TT-BNNMT dated June 19, 2025 issued by the Minister of Agriculture and EnvironmentPetroleum retail stores along the first phase of the Ho Chi Minh Highway that were previously approved by the Ministry of Industry and Trade and the former Ministry of Commerce but are not included in the appendices attached to this Decision shall continue to operate.

Article 3. This Decision takes effect 15 days from the date of signing.

Article 4. The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments and Bureaus under the Ministry, People's Committees of provinces along the first phase of the Ho Chi Minh Highway, and related organizations and individuals are responsible for implementing this Decision.
