DIRECTIVE
On strengthening investment appraisal work
Investment appraisal work has been regulated under Article 20 of the Investment and Construction Management Regulation issued together with Decree No. 52/1999/NĐ-CP dated July 8, 1999 of the Government; the Ministry of Planning and Investment issued Circular No. 01/2000/TT-BKH dated January 10, 2000 to guide its implementation. However, this work has not received sufficient attention from ministries, sectors, and localities, thus limiting its effectiveness; some ministries, sectors, and localities have yet to organize its implementation.
In order to strengthen investment and construction management, ensure effective investment, and improve the quality of projects, the Prime Minister requests ministries, sectors, localities, and project sponsors to strictly implement the investment appraisal work stipulated in Decree No. 52/1999/NĐ-CP dated July 8, 1999, paying particular attention to the following tasks:
1. Project Proponents:
- Organize the implementation of projects, prepare and submit periodic reports on project implementation to the agency designated for investment appraisal oversight for monitoring, supervision, evaluation, and support in project management. The report content shall follow the guidance provided in Circular No. 01/2000/TT-BKH dated January 10, 2000 of the Ministry of Planning and Investment;
- Promptly report to the competent authority deciding on investment and the agency organizing investment appraisal about any difficulties encountered during project implementation; propose solutions for the agency organizing investment appraisal to compile, analyze, evaluate, and submit to the competent authority for resolution;
- Be responsible for all arising issues due to untimely handling and non-compliance with investment appraisal regulations; the competent authority will not resolve project investment adjustments when the project does not undergo investment appraisal.
2. Direct managing agencies of project sponsors:
- Monitor and urge project sponsors to fully comply with investment appraisal regulations;
- Compile the situation of project implementation, identify difficulties, collaborate with the investment appraisal agency to resolve issues to expedite project deployment progress.
3. Ministries, sectors, and localities:
- The Ministry of Planning and Investment serves as the lead agency assisting the Government in overseeing, guiding professional matters, inspecting the organization and implementation of investment appraisal work, directly conducting investment appraisal for Group A projects, and periodically compiling reports to the Prime Minister to address common investment issues.
- Ministries, sectors, and localities should not establish new specialized organizations but must immediately designate departments responsible for ongoing investment appraisal duties.
The Prime Minister requests ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, chairpersons of provincial people's councils under central cities, chairpersons of boards of general corporations, and directors of enterprises to direct and organize the implementation of this Directive effectively. The Ministry of Planning and Investment will compile and report to the Prime Minister in July 2002 on the results of implementing this Directive by ministries, sectors, localities, and units.
