CIRCULAR

Regarding the guidance on implementing Decision No. 149/2002/QĐ-TTg dated December 28, 2000 of the Government on certain preferential policies for members of voluntary youth teams participating in rural and mountainous area developmentrural areas, mountainous regions 

Implementing Decision No. 149/2000/QĐ-TTg dated December 28, 2000 of the Government on certain preferential policies for members of voluntary youth teams participating in rural and mountainous area development; after exchanging and reaching consensus with relevant ministries and agencies and considering the opinions of the Central Committee of the Communist Youth Union of Ho Chi Minh at Circular No. 381/TƯĐTN dated May 3, 2002 and Circular No. 685/TƯĐTN dated June 18, 2002, the Ministry of Home Affairs guides the implementation of certain preferential policies for members of voluntary youth teams as follows:

I. SUBJECTS AND CONDITIONS FOR IMPLEMENTING PREFERENTIAL POLICIES

1. The subjects entitled to certain preferential policies stipulated in Article 1 of Decision No. 149/2000/QĐ-TTg dated December 28, 2000 of the Government (hereinafter referred to as Decision No. 149/2000/QĐ-TTg) include current members and those who have completed their voluntary service (hereinafter referred to as voluntary members) of the following organizations:

a. Voluntary youth teams participating in rural and mountainous area development organized by the Central Committee of the Communist Youth Union of Ho Chi Minh pursuant to Decision No. 354/QĐ-TTg dated February 28, 2000 of the Government on organizing voluntary youth teams participating in rural and mountainous area development;

b. Voluntary medical youth teams participating in rural and mountainous area development organized by the Central Committee of the Communist Youth Union of Ho Chi Minh pursuant to Decision No. 1169/QĐ-TTg dated August 30, 2001 of the Government on organizing voluntary medical youth teams participating in rural and mountainous area development;

c. Voluntary youth teams participating in rural and mountainous area development under other projects decided by the Prime Minister.

2. The subjects entitled to preferential policies guided by this Circular must meet one of the following conditions:

a. Currently performing the contract signed with the direct agencies organizing the voluntary teams participating in rural and mountainous area development.

b. Confirmed by the direct management agency of the voluntary member as having completed the mission (in special cases due to illness, accidents, and other reasons that prevent completion of the entire contract period, they must complete at least half of the specified time).

3. During the service period, if a voluntary member violates discipline and is dismissed (forced to terminate the contract) according to the Labor Code, they shall not be entitled to the preferential policies guided by this Circular.

II. PREFERENTIAL POLICIES FOR VOLUNTARY MEMBERS:

1. During the service period, voluntary members are entitled to the following preferential policies:

a. Participate and enjoy social insurance and health insurance benefits as prescribed by law.

b. The State provides funding equivalent to 15% of the monthly living allowance to pay for social insurance and 2% of the monthly living allowance to pay for health insurance.

c. Provided with personal protective equipment as prescribed.

d. Exempted from compulsory military service during the voluntary service period.

e. Exempted from public welfare labor duties during the voluntary service period.

f. If a voluntary member currently serving is martyred in one of the circumstances prescribed in Clause 6, 7 of Article 11 of Decree No. 28/CP dated April 29, 1995 of the Government detailing and guiding the implementation of certain provisions of the Ordinance on Preferential Treatment for Revolutionary Activists, Martyrs, and Families of Martyrs, War Invalids, and Persons Contributing to the Revolution, or injured in one of the circumstances prescribed in Clause 4, 5 of Article 25 of Decree No. 28/CP dated April 29, 1995 and Joint Circular No. 16/1998/TTLT-BLĐTBXH-BQP-BCA dated November 25, 1998 of the Ministry of Labor, Invalids and Social Affairs, the Ministry of Defense, and the Ministry of Public Security guiding certain points regarding the recognition and resolution of rights for martyrs and families of martyrs, war invalids, and persons treated as war invalids, then they will be considered for recognition as a martyr or for application of policies and benefits similar to those for war invalids.

2. After completing the voluntary service, voluntary members are entitled to the following preferential policies:

a. The Central Committee of the Communist Youth Union of Ho Chi Minh issues a certificate stating "Completed Voluntary Service for Rural and Mountainous Area Development" and presents commemorative items as prescribed in Clause 1, Article 1 of Decision No. 149/2000/QĐ-TTg.

b. The State provides a subsidy equivalent to two months' living allowance based on the monthly allowance received during the voluntary service period.

c. Voluntary members returning to their place of origin (the locality where the voluntary member registered to participate in rural and mountainous area development) are assisted by the People's Committee of the province or centrally governed city (hereinafter referred to as the province) to stabilize their lives according to the specific capabilities and conditions of each locality.

d. For voluntary members who wish to stay long-term in the locality where they served, the People's Committee of the province directs relevant departments to find ways to implement the following preferential policies:

- Encouraging the recruitment of voluntary members to work in grassroots administrative bodies, state administrative and public service agencies, and local economic organizations, prioritizing those with professional qualifications while ensuring the autonomy of agencies and units in hiring employees.

- Depending on the specific conditions of each locality, creating favorable conditions to support housing, production means, and other living conditions to help voluntary members quickly stabilize their lives.

e. In cases where volunteer members bring their families to settle or establish households and settle in new economic zones, projects for planned settlement in border communes, or on islands, they shall be entitled to additional support for relocation in accordance with current regulations.

f. They shall be granted preferential points when applying for civil service positions according to Clause 5.2, Section 2 of Circular No. 04/1999/TT-TCCP dated March 20, 1999, issued by the Government Organizational and Cadre Affairs Board (now the Ministry of Home Affairs) guiding the implementation of Decree No. 95/1998/NĐ-CP dated November 17, 1998, of the Government on the recruitment, utilization, and management of civil servants.

When recruited as civil servants, they shall implement the probationary period and appointment to rank as follows:

- Volunteer members who are recruited into a civil servant position corresponding to their specialty during the volunteer period shall have their entire volunteer service time counted as the probationary period and shall receive 100% of the initial salary coefficient of the appointed rank.

- Volunteer members who are recruited into a civil servant position not corresponding to their specialty during the volunteer period must follow the probationary period regulations stipulated in Decree No. 95/1998/NĐ-CP dated November 17, 1998, of the Government on the recruitment, utilization, and management of civil servants and shall receive 100% of the initial salary coefficient of the recruited rank during the probationary period.

- Volunteer members who are recruited as civil servants and promoted to a rank shall have their first salary increase occur one year earlier than the current regulation.

Volunteer members participating in entrance examinations for college and university programs shall enjoy preferential policies under the second priority group according to the current regulations of the Ministry of Education and Training regarding admissions to universities, colleges, and vocational high schools.

Volunteer members participating in postgraduate training programs shall have one point added (on a ten-point scale) to their basic subject examination score and one point added (on a ten-point scale) to their foreign language examination score.

III. IMPLEMENTATION:

1. The subjects benefiting from the policies outlined in this Circular shall begin implementation from the date the Decision No. 149/2000/QĐ-TTg takes effect.

2. Ministries, agencies at the level of ministries, and People's Committees of provinces and centrally-administered cities are responsible for organizing and directing the implementation of the provisions set forth in this Circular.
