Pursuant to Decree No. 86/2002/ND-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 43/2003/NĐ-CP dated May 2, 2003 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Fisheries;

Considering the proposal of the Director of the Cadre and Civil Service Department,

DECISION:

Article 1. Position and Functions

The Directorate of Aquatic Resources Exploitation and Protection is an organization assisting the Minister in implementing specialized state management over the exploitation and protection of aquatic resources, ensuring the sustainability of aquatic resources and the development of fisheries, and ensuring safety for people and vessels engaged in fishing activities.

The Directorate has its own seal and is authorized to open accounts at State banks and treasuries.

International trade name: The National Directorate of Aquatic Resources Exploitation and Protection, abbreviated as: NADAREP.

The headquarters of the Directorate is located in Hanoi City.

Article 2. Tasks and Authorities

1. Proposing, drafting, and submitting to the Minister draft strategies, plans for development, long-term plans, annual plans, programs, and projects on the exploitation, protection, and development of aquatic resources, flood prevention, typhoon resistance, and search and rescue operations.

2. Proposing and submitting to the Minister draft regulatory legal documents on the exploitation, protection, and development of aquatic resources as assigned by the Minister.

3. Implementing regulatory legal documents according to the functions and tasks assigned.

4. Supervising and inspecting the implementation of regulatory legal documents, strategies, plans, projects, and proposing amendments, supplements, or new drafts of regulatory legal documents on the exploitation, protection, and development of aquatic resources, ensuring safety for people and vessels engaged in fishing activities.

5. On fishery exploitation:

a. Implementing state management over fishery exploitation activities conducted by people and vessels both domestically and internationally, within inland waters and on Vietnam's maritime zones, including various fishing methods, vessels, objects, seasons, and prohibited and restricted fishing areas; allocating and分级回复

b. Implement state management over the issuance and revocation of licenses and certificates for domestic and foreign organizations and individuals engaged in fishing activities within the assigned sector in accordance with the provisions of the law.

6. Regarding registration and inspection of fishing vessels:

a. Manage and guide the implementation of vessel registration and safety equipment inspection work. Coordinate with relevant agencies and units to implement registration and technical safety inspections for equipment requiring strict safety standards in the fisheries industry such as boilers, pressure vessels, refrigeration equipment;

b. Conduct inspections of production conditions in accordance with the law for mechanical manufacturing facilities serving fisheries exploitation; shipbuilding and repair facilities; facilities manufacturing and installing equipment requiring strict safety standards in the fisheries industry.

7. Regarding fishery port management:

Implement state management over the operations of fishery ports, berths, and anchorage areas for fishing vessels, ensuring safety for people and vessels engaged in fishing activities.

8. Regarding protection of aquatic resources:

a. Inspect and supervise the implementation of lists of aquatic species that need protection, lists of prohibited import and export aquatic species (except for aquatic seedlings); conservation of seedlings, gene pools, and aquatic biodiversity; protection of inland and marine conservation areas in accordance with the law;

b. Inspect and supervise the protection of natural habitats of aquatic species.

9. Regarding inspection and supervision:

Organize inspections, supervision, control, and coordinate with other sectors and levels in combating violations of laws on fisheries exploitation and resource protection in accordance with the law;

Handle violations of laws within the jurisdiction and manage and guide the handling of such violations in the fisheries sector in accordance with the law;

Take the lead in resolving disputes regarding fisheries exploitation and resource protection within the jurisdiction;

Coordinate with related agencies to handle foreign vessels engaging in illegal fishing activities in Vietnam's maritime zones.

10. Regarding flood prevention and search and rescue coordination:

Actively participate in flood prevention and search and rescue coordination in the fisheries sector;

Assist the Ministry in coordinating with other Ministries, Departments, Provincial People's Committees, and Central City People's Committees to organize and direct flood prevention, search and rescue operations, and ensure safety for people and vessels engaged in fishing activities, maintaining maritime security and order.

11. Organize the implementation of legal education and publicity on fisheries exploitation and resource protection.

12. Organize professional training for fisheries inspection and resource protection staff, vessel registration, and inspection staff within the fisheries exploitation and resource protection system.

13. Participate in research and application of results from projects, standards, procedures, regulations, and new technological advancements in fisheries exploitation and resource protection to enhance operational capabilities in fisheries exploitation, protection, and development.

14. Implement international cooperation on fisheries exploitation and resource protection in accordance with the law.

15. Provide services related to fisheries exploitation, protection, and development in accordance with the law.

16. Manage and utilize labor, assets, and finances of the Bureau and its subordinate units in accordance with the law.

Uniformly manage professional technical expertise, business operations, and outcomes of organizational systems under the Bureau's local jurisdiction.

17. Perform other tasks assigned by the Minister.

Article 3. Organizational Structure

The organizational structure of the Fisheries Exploitation and Resource Protection Bureau includes:

1. The Department Office;

2. Department of Resource Protection and Aquatic Environment;

3. Department of Exploitation Management and Fishery Ports;

4. Department of Fishing Vessel Inspection and Fisheries Machinery;

5. Flood Prevention and Search and Rescue Coordination Office;

6. Central Fisheries Resource Protection Inspectorate;

7. Technical Service Center for Fisheries Exploitation and Resource Protection.

Article 4. Effective date

This Decision shall take effect fifteen days after its publication in the Official Gazette; all previous regulations conflicting with this Decision are hereby repealed.

Article 5. Responsibilities for Implementation

The Director of the Fisheries Exploitation and Resource Protection Bureau is responsible for coordinating with related agencies and units to develop Regulations on the organization and operation of the fisheries exploitation and resource protection management system to be submitted to the Minister for decision.

The Head of the Ministry’s Office, the Director of the Fisheries Resource Exploitation and Protection Department, the Heads of the Departments, Bureaus, the Inspectorate of the Ministry, the Heads of the units under the Ministry, the Directors of the Fisheries Departments, and the Directors of the Departments of Agriculture and Rural Development that manage fisheries are responsible for implementing this Decision./.
