THE MINISTER OF SCIENCE AND TECHNOLOGY

Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/NĐ-CP;

Considering the proposal of the Director of the International Cooperation Department and the Director of the Organization and Cadres Department,

DECISION:

Article 1. This Decision promulgates the Regulation on the Organization and Operation of the International Cooperation Department under the Ministry of Science and Technology.

Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette and replaces Decision No. 549/QĐ-TCCB dated October 8, 1993 of the Minister of Science, Technology and Environment (now the Ministry of Science and Technology) promulgating the Charter on the Organization and Operation of the International Relations Department.

Article 3. The Head of the Office, the Directors of the Organization and Cadres Department, the International Cooperation Department, and the Heads of related units shall be responsible for implementing this Decision.

REGULATIONS

Organization and operation of the international cooperation department

PART I

FUNCTIONS, TASKS, AND POWERS

Article 1. The International Cooperation Department is a unit directly under the Ministry of Science and Technology with the function of assisting the Minister in managing international cooperation activities nationwide in the fields of state management of the Ministry as prescribed by law.

Article 2. The International Cooperation Department has the following main tasks and powers:

1. Submitting to the Minister proposals, policies, and measures aimed at soliciting and promoting international cooperation in science and technology with countries, international organizations, non-governmental organizations, foreign individuals and organizations, as well as individuals and organizations of overseas Vietnamese.

2. Drafting and submitting to the Minister guidelines, five-year plans, and annual plans, programs, and projects of international cooperation in the field of science and technology. Balancing needs and proposing budgetary funds from the state budget allocated for international cooperation to implement international cooperation plans, programs, and projects in science and technology, mobilizing and consolidating domestic and foreign funding sources to support the Ministry's international cooperation activities.

3. Studying, drafting, and submitting to the Minister draft regulatory legal documents on the management of international cooperation in the fields of state management of the Ministry.

4. Being the focal point for managing all international cooperation activities of the Ministry.

5. Assisting the Minister in preparing and organizing negotiations, signing, and joining international treaties, organizing the implementation of international treaties already signed or joined within the fields of state management of the Ministry.

6. Guiding ministries, sectors, localities, and institutions in proposing and implementing international cooperation programs and projects in science and technology.

7. Supervising and urging ministries, sectors, localities, and institutions in the implementation and evaluation of results of international commitments in science and technology.

8. Organizing the management of conferences and seminars in the field of science and technology involving participation and sponsorship from countries and international organizations according to current regulations of the State.

9. Coordinating with the Organization and Cadres Department to submit to the Minister decisions regarding the network of representatives of the Ministry in science and technology abroad, the dispatch of representatives of the Ministry to countries and international organizations, and managing these representatives professionally.

10. Coordinating with the Ministry's Office to perform diplomatic reception duties serving the leadership of the Ministry.

11. Managing the organization, cadres, assets, files, and documents according to the division of authority and regulations of the Ministry.

Chapter II

ORGANIZATIONAL STRUCTURE

Article 3. The International Cooperation Department operates under the chief executive system combined with collective discussion.

The Director of the International Cooperation Department is responsible to the Minister for the entire organization and operation of the Department.

Deputy Directors of the International Cooperation Department assist the Director, are assigned to direct certain aspects of work by the Director, and are responsible to the Director for the tasks assigned.

In the absence of the Director, a Deputy Director designated by the Director will act on behalf of the Director to manage and resolve the Department's affairs within the Director's authority.

Article 4. Specialists of the International Cooperation Department work directly under the Director or Deputy Director according to internal arrangements, and may be divided into working groups based on specific requirements.

The division of working groups or departments and the specific tasks of each group or department are decided by the Director of the International Cooperation Department.

Chapter III

WORK RELATIONSHIPS

Article 5. The Director of the International Cooperation Department manages all activities of the Department based on the Regulation on the Organization and Operation of the International Cooperation Department.

Article 6: The Director of the International Cooperation Department implements the working system and relations with heads of subordinate units of the Ministry according to the Ministry's working regulation and other provisions issued by the Minister.

Article 7. The International Cooperation Department coordinates with scientific and technological management agencies and international cooperation management agencies of ministries, sectors, and localities in performing international cooperation tasks within the fields of state management of the Ministry.

The International Cooperation Department strengthens and develops relationships with foreign representative offices and international organizations according to government and ministry regulations.

Chapter IV

IMPLEMENTING PROVISIONS

Article 8. The Director of the International Cooperation Department coordinates with the Director of the Organization and Cadres Department to implement this Regulation.

Article 9. Any amendments or supplements to this Regulation shall be coordinated by the Director of the International Cooperation Department with the Director of the Organization and Cadres Department and submitted to the Minister of Science and Technology for consideration and decision.
