Pursuant to Decree No. 91/2002/NĐ-CP dated November 11, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
At the proposal of the Director of the Vietnam Geological and Mineral Resources Agency and the Head of the Organizational Cadre Department,
DECISION:
Article 1. Position and Functions
The Vietnam Geological and Mineral Resources Agency is an organization under the Ministry of Natural Resources and Environment, with the function of assisting the Minister in state management of geology and mineral resources, including basic geological surveys, basic geological surveys on mineral resources, mineral activities, protection of mineral resources, and organizing the implementation of basic geological surveys and basic geological surveys on mineral resources, assessing potential mineral resources, and discovering mines throughout the country.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Submit to the Minister draft regulatory legal documents for managing activities of basic geological surveys, basic geological surveys on mineral resources; state management of minerals and protection of mineral resources; procedures, norms, economic-technical standards in geological and mineral surveys;
2. Submit to the Minister strategies, plans for development, long-term, five-year, and annual plans regarding basic geological surveys, basic geological surveys on mineral resources;
3. Statistics and inventory of reserves and quality of mineral resources; delineate areas with harmful minerals, areas with unexploited minerals that need protection, areas with restricted mineral activities, and areas for tendering mineral activities;
4. Participate and coordinate with provincial People's Committees, central cities, and relevant ministries and sectors in delineating areas prohibited or temporarily prohibited from mineral activities; develop strategies, plans for exploration, exploitation, processing, and utilization of minerals according to the division of labor by the Ministry;
5. Submit to the Minister regulations on authority, procedures for issuing, extending, revoking, allowing return of mineral activity permits, and allowing transfer of mineral activity rights for inheritance; regulations on tendering mineral activities;
6. Submit to the Minister decisions on issuing, extending, revoking, allowing return of mineral activity permits, allowing transfer of mineral activity rights, approving mining areas for residual mineral extraction within the Ministry’s jurisdiction;
7. Submit to the Minister approval of project proposals and reports on results of basic geological surveys, basic geological surveys on mineral resources;
8. Organize and direct subordinate units of the Agency to implement tasks and plans for basic geological surveys, basic geological surveys on mineral resources, including geological mapping and mineral surveys, environmental geology, hydrogeology, engineering geology, urban geology, rural geology, marine mineral geology, disaster geology, geothermal studies, and assessment of mineral resource potential, mine discovery. Implement scientific and technological programs, projects, and topics, apply scientific and technological progress to geological and mineral surveys and state management of minerals; Provide geological and mineral samples according to current regulations; confirm the legality of geological and mineral samples and non-commercial minerals exported abroad according to legal provisions;
9. Register, compile data and results of geological and mineral surveys and mineral activities; store, manage, and protect state data and information on geology and minerals according to legal provisions; provide geological and mineral materials according to current regulations; confirm the legality of geological and mineral samples and non-commercial minerals exported abroad according to legal provisions;
10. Promote, disseminate, guide, and inspect agencies, organizations, and individuals in implementing legal provisions on minerals; provide professional, technical guidance on geology and minerals to provincial Departments of Natural Resources and Environment and subordinate units of the Agency;
11. Lead inspections of basic geological surveys, basic geological surveys on mineral resources, and mineral activities; coordinate with the Ministry's Inspectorate to resolve or resolve disputes, complaints, and accusations in basic geological surveys, basic geological surveys on mineral resources, and mineral activities according to their jurisdiction; respond to organizations and individuals on matters related to geology and minerals according to the Ministry's assignment;
12. Implement international cooperation programs and projects; participate in international activities in the field of geology and minerals according to the Ministry's assignment; Male 13. 16. Manage and use effectively state financial resources and assets assigned; manage construction investment projects according to legal provisions and the Ministry's assignment;
17. Manage organizational structure, staffing, and training and professional development for officers, civil servants, and employees of the Agency according to the Ministry's classification;
18. Statistically report regularly and urgently on the implementation of assigned tasks;
a) The leadership of the Vietnam Geological and Mineral Resources Agency includes the Director and several Deputy Directors.
19. Performing other tasks assigned by the Minister.
Article 3. Organizational Structure
The Director is responsible to the Minister for assigned tasks and is legally accountable for all activities of the Agency; establishes work regulations and manages the Agency's operations; defines functions and tasks of subordinate units of the Agency;
Deputy Directors are responsible to the Director for the areas of work they are assigned.

e) The Vietnam Geological and Mineral Resources Department is a Level II budget entity, having its own seal and being entitled to open accounts at the state treasury and banks. Each mineral resources inspection office and each affiliated public service unit has its own seal and is entitled to open accounts in accordance with regulations.
Article 4. Effectiveness and Responsibility for Implementation
This Decision shall take effect fifteen days from the date of publication in the Official Gazette and shall replace Decision No. 14/2003/QĐ-BTNMT dated January 9, 2003 issued by the Minister of Natural Resources and Environment.
The Director of the Vietnam Geological and Mineral Resources Department, the Head of the Cadre and Civil Servant Affairs Department, and the Heads of the subordinate agencies and units under the Ministry are responsible for implementing this Decision./.
