Joint Circular No. 08/2005/TTLT-BTP-BTC guiding the implementation of the management and distribution system for Enforcement Officer cards, uniforms, and insignias for civil servants engaged in civil enforcement work.

I. OBJECTS ELIGIBLE FOR DISTRIBUTION OF UNIFORMS, INSIGNIA, AND BADGES

1. The objects eligible for distribution of uniforms and insignia for use when performing official duties are civil enforcement officers and staff engaged in civil enforcement work at local enforcement bodies and staff of the Civil Enforcement Department under the Ministry of Justice.

2. The objects eligible for distribution of badges to serve when performing official duties are staff appointed to the position of civil enforcement officer (including civil enforcement officers at military regions).

II. STANDARDS AND SERVICE LIFE OF UNIFORMS AND INSIGNIA

The service life of uniforms and insignia distributed according to the provisions of Article 35, 36, and Article 37 of Decree No. 50/2005/NĐ-CP of April 11, 2005 of the Government on the authorities managing civil enforcement, civil enforcement bodies, and staff engaged in civil enforcement work, specifically as follows:

III. PRINCIPLES AND LEVELS OF DISTRIBUTION FOR EACH TYPE OF UNIFORM, INSIGNIA, AND BADGE

1. Principles:

The distribution and management of uniforms, insignia, and badges for civil enforcement officers and staff engaged in civil enforcement work shall be carried out according to the following principles:

a) The issuance and use of uniforms, insignia, and badges must comply with the purposes and objects as stipulated by law and regulations of the Ministry of Justice;

b) Uniforms damaged or lost due to objective reasons will be replenished by the issuing body. Other damages or losses caused by individuals will be their responsibility;

c) In cases where staff terminate employment, retire, or transfer to other positions before the end of the service life of the uniforms provided, there is no need to recover them;

d) Strictly prohibit the use of funds for making uniforms, insignia, and badges for staff for improper purposes contrary to regulations.

2. Levels of Distribution:

a) Annually, the Minister of Justice shall set the price range for purchasing each type of uniform specified in Section II of this Circular;

b) The types of insignia and badges for civil enforcement officers shall be determined by the Minister of Justice within the annual budget allocation.

IV. ORGANIZATION OF THE MANUFACTURE AND DISTRIBUTION OF UNIFORMS, INSIGNIA, AND BADGES

1. Each year, based on the objects eligible for uniforms, the quantity and types of uniforms and insignia reaching the end of their service life, the heads of provincial and municipal civil enforcement bodies and the Director of the Civil Enforcement Department under the Ministry of Justice shall prepare the budget estimate together with the annual budget and submit it to the Ministry of Justice for consolidation into the overall sectoral budget according to the relevant chapters, types, items, and sub-items of the state budget classification sent to the Ministry of Finance as prescribed. Funds for manufacturing badges for civil enforcement officers, uniforms, and insignia for staff engaged in civil enforcement work shall be allocated within the scope of the budget approved by the competent authority for civil enforcement bodies.

2. Uniforms, insignia, and badges for civil enforcement officers and staff of local civil enforcement bodies and the Civil Enforcement Department under the Ministry of Justice shall be distributed in physical form, specifically as follows:

a) The Civil Enforcement Department under the Ministry of Justice shall directly distribute badges for civil enforcement officers, kepi hats, insignia attached to hats, shoulder straps, lapel pins, and helmets for enforcement officers to civil enforcement officers and staff across the country;

b) The Director of the Civil Enforcement Department under the Ministry of Justice and the heads of provincial and municipal civil enforcement bodies shall be responsible for manufacturing and distributing the remaining uniforms (excluding those specified in point a, clause 2 of this section) to each staff member of the Civil Enforcement Department and local civil enforcement bodies according to the regulations of the Minister of Justice. For uniforms such as leather shoes, leather belts, leather sandals, socks, raincoats, and leather briefcases that cannot be purchased centrally, the Director of the Civil Enforcement Department under the Ministry of Justice and the heads of provincial and municipal civil enforcement bodies may consider and decide to provide funds for staff to purchase these items themselves based on the purchase price, standards, and models prescribed by the Minister of Justice.

3. The Director of the Civil Enforcement Department under the Ministry of Justice and the heads of provincial and municipal civil enforcement bodies must ensure the distribution of uniforms, insignia, and badges in accordance with the prescribed principles; maintain records for the management and distribution to each staff member according to the unified model attached to this Circular.

4. The settlement and finalization of the budget for the manufacture and distribution of uniforms, insignia, and badges for staff of the Civil Enforcement Department under the Ministry of Justice and local civil enforcement bodies shall be carried out in accordance with the State Budget Law and current guiding documents.

V. EFFECTIVENESS OF THE CIRCULAR

1. This Circular shall take effect 15 days from the date of publication in the Official Gazette and replace Circular Joint No. 1385/TT-LT dated October 11, 1997 of the Ministry of Justice and the Ministry of Finance on guidelines for the distribution and management of uniforms for civil enforcement staff.

2. During implementation, if any issues arise, please report to the Ministry of Justice and the Ministry of Finance for study and resolution.
