Article 1. Position and Functions
The Inspectorate is subject to direct management and direction by the Minister of Aquatic Resources, while also being directed and guided by the Government Inspector General regarding work, organization, and inspection business.
The Inspectorate has its own seal and a Treasury account at the State Treasury in accordance with the provisions of the law.
Article 2. Duties and Authorities of the Inspectorate
1. To take the lead or participate in drafting normative legal documents as required for state management of aquatic resources;
2. To inspect the implementation of policies and laws and tasks by organizations and individuals directly managed by the Minister of Aquatic Resources;
3. To inspect compliance with specialized aquatic resources laws by organizations and individuals within the scope of state management of aquatic resources; To impose administrative penalties according to the law on handling administrative violations;
4. To coordinate with Inspectors of other Ministries, Departments, local authorities at all levels, and related agencies during the inspection process and in implementing preventive, blocking, and combating activities against illegal acts within the scope of assigned duties and authorities;
5. To recommend competent state agencies to suspend or revoke decisions that contravene national legal documents or specialized legal documents issued by the Ministry of Aquatic Resources;
6. To assist the Minister of Aquatic Resources in receiving citizens, handling complaints and denunciations in accordance with the law; To implement tasks of prevention and combat against corruption, thrift, and waste prevention as stipulated by the law;
7. To coordinate with relevant agencies to organize training and upgrading of specialized inspection skills for Inspectors and Collaborators of the Aquatic Resources Inspectorate;
8. To monitor, inspect, and urge the implementation of conclusions, recommendations, and decisions on inspection work and administrative violation handling decisions of the Inspectorate;
9. To report regularly and report inspection results to the Minister of Aquatic Resources and the Government Inspector General;
10. To perform other tasks assigned by the Minister of Aquatic Resources.
Article 3. Duties and Authorities of the Chief Inspector
1. To lead and direct inspection work for the Inspectorate; to guide and instruct inspection work and specialized inspection business for Provincial Inspectorates;
2. To develop annual inspection programs and plans for the Inspectorate to be submitted to the Minister of Aquatic Resources for approval and to organize their implementation;
To direct and instruct subordinate units of the Ministry of Aquatic Resources, Provincial Aquatic Resources Departments, and Departments responsible for assisting provincial and centrally-administered city People's Committees in managing aquatic resources to develop and implement annual inspection programs and plans for their respective units;
3. To submit to the Minister of Aquatic Resources for decision or decide within his authority the establishment of Inspection Teams, appointment of Inspectors, and summoning of Collaborators to conduct inspections in accordance with the law;
4. To recommend the Minister of Aquatic Resources to temporarily suspend the execution of decisions made by organizations and individuals directly managed by the Ministry of Aquatic Resources when there is evidence that such decisions violate the law or affect the inspection process;
5. To recommend the Minister of Aquatic Resources to coordinate with other Ministries, Departments, and provincial People's Committees to resolve overlapping inspections and checks conducted by Inspection Teams on units under the management of the Ministry of Aquatic Resources;
6. To impose administrative penalties according to the law on handling administrative violations;
7. To monitor, inspect, and urge the implementation of conclusions, recommendations, and decisions on inspections within the responsibility of heads of units under the management of the Ministry of Aquatic Resources;
8. To provide guidance on specialized inspection business for Provincial Inspectorates; to check the responsibility of heads of subordinate units of the Ministry of Aquatic Resources and Provincial Aquatic Resources Departments in implementing legal regulations on inspection work, complaint resolution, and anti-corruption measures;
9. To report to the Minister of Aquatic Resources and the Government Inspector General on inspection work within his responsibility;
10. To perform other tasks assigned by the Minister of Aquatic Resources.
1. The Inspectorate shall have a Chief Inspector, not more than three Deputy Chief Inspectors, and specialized departments.
Article 4. Organizational structure of the Inspectorate of the Ministry
a) The Chief Inspector shall perform duties and powers as stipulated in Article 3 of this Decision and shall be responsible before the Minister of Aquatic Resources, the Government Inspector General, and the law for organizing, managing, directing, and operating the Inspectorate to fulfill its assigned functions and tasks.
b) Deputy Chief Inspectors shall assist the Chief Inspector in directing the implementation of certain tasks of the Inspectorate and shall be responsible before the Chief Inspector for the tasks delegated by him in accordance with the law.
c) The Chief Inspector shall be appointed, relieved, or dismissed by the Minister of Aquatic Resources after consultation with the Government Inspector General. Deputy Chief Inspectors shall be appointed, relieved, or dismissed by the Minister of Aquatic Resources upon the recommendation of the Chief Inspector.
d) The Inspectorate shall have Heads of Departments and Deputy Heads of Departments. Appointments, reliefs, and dismissals shall be carried out according to the分级任务如下:

2. Departments under the Inspectorate:
a) Department of Consolidation and Complaint Review;

c) The Professional Inspection Department. The Inspector General of the Ministry shall specify the specific functions and duties of the Departments under the Ministry's Inspectorate.
3. The staffing of the Ministry's Inspectorate belongs to the administrative staffing of the Fisheries Ministry, decided annually by the Minister of Fisheries.
Article 5. Effective Date
This Decision takes effect 15 days after its publication in the Official Gazette and replaces Section VIII of Decision No. 09/2003/QĐ-BTS dated August 5, 2003, issued by the Minister of Fisheries on the regulations concerning the functions, tasks, authorities, and organizational structure of the Departments, Inspectorate, and Office of the Fisheries Ministry. All previous provisions that conflict with this Decision are hereby abolished.
Article 6. Responsibility for Implementation
The Inspector General of the Ministry, Heads of Departments, Bureaus, Office, agencies, units under the Fisheries Ministry, Directors of Provincial Fisheries Services, and Directors of Departments responsible for assisting provincial People's Committees in managing fisheries affairs at the central level are responsible for implementing this Decision.
