Guidelines for implementing the cultural education program
for learners at educational facilities and correctional schools

Pursuant to the Education Law adopted by the National Assembly, tenth session, seventh meeting on June 14, 2005;
Pursuant to Decree No. 85/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 136/2003/NĐ-CP dated November 14, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
Pursuant to Decree No. 76/2003/NĐ-CP dated June 27, 2003 of the Government stipulating and guiding the specific application of measures involving placement in educational facilities;
Pursuant to Decree No. 142/2003/NĐ-CP dated November 24, 2003 of the Government stipulating the application of administrative handling measures involving placement in correctional schools;
Pursuant to Decree No. 52/2001/NĐ-CP dated August 2, 2001 of the Government guiding the implementation of judicial measures involving placement in correctional schools;
The Ministry of Education and Training and the Ministry of Public Security issue guidelines for implementing the cultural education program for learners at educational facilities and correctional schools as follows:
I. SCOPE OF REGULATION AND APPLICABLE OBJECTS
1. These guidelines guide the implementation of the cultural education program in educational facilities and correctional schools; the responsibilities of management agencies, educational facilities, and correctional schools.
2. These guidelines apply to learners currently studying at educational facilities and correctional schools under the management of the Ministry of Public Security.
II. SPECIFIC PROVISIONS
1. Cultural education program at educational facilities
a) Learners who cannot read will follow the literacy program issued by the Ministry of Education and Training;
b) Based on their specific conditions and learner needs, the Director of the educational facility decides on organizing classes for other groups.
2. Cultural education program at correctional schools
a) For primary education:
Implement the literacy program and continuing education after learning to read as prescribed by the Ministry of Education and Training for learners who cannot read or have not completed the primary education curriculum.
b) For lower secondary education:
Implement the supplementary lower secondary education program issued by the Ministry of Education and Training for learners who have a certificate of completion of the primary education curriculum or have not completed the lower secondary education curriculum.
c) For upper secondary education:
Implement the supplementary upper secondary education program issued by the Ministry of Education and Training for learners who have a lower secondary school graduation certificate or have not completed the upper secondary education curriculum.
The Principal of the correctional school bases decisions on organizing classes according to the supplementary upper secondary education program on the specific conditions of the school and learner needs.
3. Regarding textbooks
a) Textbooks of the literacy program and continuing education after learning to read as prescribed by the Ministry of Education and Training;
b) Textbooks of the supplementary lower secondary education and supplementary upper secondary education programs are the same as those used in general education.
4. For learners at correctional schools who have discontinued or dropped out midway but lost their records, the Principal of the correctional school organizes a written test to assess knowledge in Literature and Mathematics. Based on the test results, the Principal decides on appropriate class placement for cultural education. This decision replaces previous academic records in the graduation examination file for lower secondary school.
5. Evaluation and classification of cultural education for learners shall be carried out in accordance with the regulations of the Ministry of Education and Training.
6. Management and use of various types of records related to cultural education of learners in educational facilities and correctional schools shall be conducted in accordance with the regulations of the Ministry of Education and Training.
7. Recognition and issuance of literacy certificates shall be carried out in accordance with the regulations of the Ministry of Education and Training regarding literacy standards and universal primary education.
8. Recognition of completion of the literacy program and continuing education after learning to read shall be carried out in accordance with the regulations of the Ministry of Education and Training.
9. Learners who complete the supplementary lower secondary education program and meet the conditions set by the Ministry of Education and Training may be considered for issuance of a lower secondary school graduation certificate. Based on the learner's academic performance, the district or county Department of Education and Training issues the lower secondary school graduation certificate.
10. Learners who complete the supplementary upper secondary education program and meet the conditions set by the Ministry of Education and Training may take the graduation exam and if they meet the graduation requirements, they will be issued an upper secondary school graduation certificate. The Director of the Department of Education and Training issues the upper secondary school graduation certificate.
III. RESPONSIBILITIES OF MANAGEMENT AGENCIES, EDUCATIONAL FACILITIES AND CORRECTIONAL SCHOOLS
1. The Ministry of Public Security (Prison Management Bureau, Educational Facilities, Correctional Schools) is responsible for:
a) Directing, guiding, and inspecting the organization of cultural education for learners at educational facilities and correctional schools;
b) Monitoring, compiling information, and reporting on the situation and results of cultural education for learners and teacher needs to propose additional staffing to ensure sufficient cultural education teachers for learners at educational facilities and correctional schools;
c) Cooperating with the Ministry of Education and Training to research and propose timely policies and solutions to improve the quality and effectiveness of cultural education for learners.
2. The Ministry of Education and Training is responsible for directing and guiding provincial Departments of Education and Training to organize the implementation of the cultural education program for learners at educational facilities and correctional schools.
3. Provincial Departments of Education and Training are responsible for:
a) Managing and directing the implementation of the cultural education program; organizing exams and issuing upper secondary school graduation certificates for learners at correctional schools; directing district or county Departments of Education and Training to organize the examination and issuance of lower secondary school graduation certificates for learners in accordance with the regulations of the Ministry of Education and Training;
b) Assigning cultural education teachers for learners upon request from the Director of the educational facility or the Principal of the correctional school when the educational facility or correctional school does not have enough cultural education teachers;
c) Creating favorable conditions for cultural education teachers at educational facilities and correctional schools to participate in professional development courses organized by the provincial Department of Education and Training.
d) Create conditions for individuals who have left educational institutions and reformatory schools to continue their cultural education at educational institutions within the national education system.
4. Responsibilities of educational institutions and reformatory schools:
a) Develop plans and organize cultural education for students; promptly request provincial/municipal departments of education and training under the central government and local education and training offices to assist in organizing cultural education classes for students according to the prescribed content, curriculum, and time schedule;
b) Budget funds and pay salaries to teachers assigned by the provincial/municipal department of education and training or local education and training office to teach cultural subjects to students; provide adequate classrooms and teaching equipment for cultural education;
c) Appoint staff to monitor the organization of cultural education classes; promptly compile and report on the results of cultural education and learning activities periodically and when required to the immediate supervising authority;
IV. IMPLEMENTATION
1. This Circular takes effect fifteen days from the date of publication in the Official Gazette.
Previous regulations that conflict with this Circular are hereby abolished.
2. Any difficulties encountered during implementation should be promptly reported to the Ministry of Education and Training and the Ministry of Public Security for study and resolution./.
