JOINT CIRCULAR
Guidelines for funding the implementation of Decision No. 65/2005/QĐ-TTg dated March 25, 2005 of the Prime Minister on approving the Project "Caring for Orphaned Children without Guardianship, Abandoned Children, Severely Disabled Children, Victims of Agent Orange and Children Infected with HIV/AIDS based on Community Support from 2005 to 2010".

Pursuant to Decision No. 65/2005/QĐ-TTg dated March 25, 2005 of the Prime Minister on approving the Project "Caring for Orphaned Children without Guardianship, Abandoned Children, Severely Disabled Children, Victims of Agent Orange and Children Infected with HIV/AIDS based on Community Support from 2005 to 2010" (hereinafter referred to as the Project "Caring for Children in Particularly Difficult Circumstances based on Community Support from 2005 to 2010").
After receiving comments from the Population, Family and Children Commission; the Ministry of Finance and the Ministry of Labor, Invalids and Social Affairs have issued guidelines for funding the implementation of the Project as follows:
I. OBJECTS OF ASSISTANCE UNDER THE PROJECT
The children eligible for assistance under these guidelines are those under 16 years old, including:
1. Orphaned children without guardianship, abandoned children: As defined in Point 1, Section 1, Part A of Circular No. 18/2000/TT-BLĐTBXH dated July 28, 2000 of the Ministry of Labor, Invalids and Social Affairs guiding the implementation of certain provisions of Decree No. 07/2000/NĐ-CP dated March 9, 2000 of the Government on social relief policies.
2. Severely disabled children: These are children who suffer from deficiencies in one or more body parts or functions manifesting in various forms of disability, reducing their ability to function, making daily life, study, and work difficult.
3. Children who are victims of chemical toxins: These are children suffering from deformities or disabilities due to the consequences of chemical toxins.
4. Children infected with HIV/AIDS: These are children who have been officially diagnosed by authorized health authorities as being infected with HIV/AIDS.
II. CONTENT AND EXPENSES FOR ACTIVITIES UNDER THE PROJECT
1. Publicity activities aimed at raising awareness and responsibility among the public and officials:
- Expenses for publicity through mass media (radio, television, press): In accordance with current state regulations.
- Expenses for producing, reproducing, and distributing various types of communication products provided to localities: Calculated based on the actual number of products produced.
- Expenses for organizing contests promoting assistance to children in particularly difficult circumstances approved by competent authorities.
- Prizes for writing competitions about assisting children in particularly difficult circumstances decided by the Minister of Labor, Invalids and Social Affairs or the Chairman of the People's Committee of provinces and centrally-administered cities. Prize amounts: Category A: 300,000 VND per article; Category B: 200,000 VND per article; Category C: 100,000 VND per article.
2. Supporting children in particularly difficult circumstances to learn trades and find employment:
a) Trade training support: Children aged 13 and above who are subjects of this project, in good health and willing to learn a trade, are introduced by labor authorities to vocational training centers for short-term training and receive one-time financial support for training fees. The duration of training is based on the actual months of training for each trade but does not exceed four months, with a minimum level of support as follows:
- Support for vocational training centers accepting children as subjects of the Project: 300,000 VND per child per month.
- Support for food, accommodation, and travel expenses of children: 240,000 VND per child per month.
b) One-time support for those who secure employment after completing training: Minimum amount is 1,000,000 VND per child.
Specific levels of support for training and securing employment are determined by the Chairman of the District People's Committee upon proposal by the Department of Civil Affairs - Labor, Invalids and Social Affairs but must not be lower than the minimum level.
3. Pilot program to transfer children currently cared for in state welfare institutions to community-based care through foster families or individual caregivers:
Children From welfare institutions to the family of the child or the community through foster families or individual caregivers, they will receive support according to the provisions of Joint Circular No. 10/2004/TTLT-BLĐTBXH-BTC dated June 28, 2004 of the Ministry of Labor, Invalids and Social Affairs and the Ministry of Finance regarding the implementation of Decision No. 38/2004/QĐ-TTg dated March 17, 2004 of the Prime Minister, specifically:
- Minimum support amount is 200,000 VND per child per month.
- For children under 18 months old, the minimum support amount is 270,000 VND per child per month.
One-time support for welfare institutions implementing the pilot program to transfer children to the community, up to 500,000 VND per child for transportation, mobilizing families or individuals to take in children, providing guidance on care, and purchasing gifts for children.
4. Establishing model community-based homes for caring for children in particularly difficult circumstances at the commune level:
Depending on specific requirements, conditions, and local budget capacity, the Chairman of the District People's Committee approves the pilot project "Community Home" for the period 2005-2007 (after obtaining opinions from the provincial People's Committee and the Ministry of Labor, Invalids and Social Affairs) and expands the model during the period 2008-2010; implement in accordance with the specific conditions of each locality as stipulated in the Project.
a) Construction and repair costs for community homes:
- Central budget supports the construction of the "Community Home" model during the pilot phase from 2005 to 2007 (allocated in the budget of the Ministry of Labor, Invalids and Social Affairs), maximum 200,000,000 VND per home per province, including:
+ Support for construction, repair, and upgrading of community homes.
+ Costs for purchasing beds, wardrobes, televisions, and essential personal items for children.
- Local budget support according to the Decision approving the pilot project "Community Home" of the District People's Committee.
b) Sources of funding for the care of children in "Community Homes" include:
+ Mobilizing organizations, enterprises, and individuals both domestically and internationally;
+ Local budget support of at least 200,000 VND per child per month.
c) Children in community homes enjoy education and healthcare benefits according to current state regulations, similar to those for children cared for in welfare institutions.
d) Expenses for part-time and volunteer staff managing the "Community Home" model from the local budget.
5. Pilot the transition from the current method of caring for children in difficult circumstances in state social welfare facilities to a "small family unit" model at centralized social welfare facilities:
The content and level of expenditure for the "small family unit" model shall be examined and decided by the Chairman of the People's Committee of provinces and centrally governed cities for implementation during the pilot phase from 2005 to 2007, and for expansion during the period from 2008 to 2010; implementation shall be carried out in accordance with each locality as stipulated in the Project.
6. Train staff involved in caring for children in difficult circumstances and inspect, summarize, and evaluate the implementation of the activities outlined in the Project.
The expenditure levels shall be applied according to Circular No. 118/2004/TT-BTC dated December 8, 2004, issued by the Ministry of Finance, which stipulates the regulations on travel expenses and conference expenditures for administrative agencies and public service units nationwide.
III. PROCEDURES AND DOCUMENTS FOR RESOLUTION OF SUPPORT
To receive support as prescribed in this Circular, families with children, guardians, or the children themselves in difficult circumstances must submit a request. The request must be confirmed by the village head, commune chief, or ward chief, then sent to the People's Committee of the commune for consideration (Annex 01 attached).
Based on the request submitted by the family or the child, the People's Committee of the commune will consider and provide recommendations, then send them to the People's Committee of the district (through the Civil Affairs Department - Labor, Invalids, and Social Affairs Office) for resolution.
The Civil Affairs Department - Labor, Invalids, and Social Affairs Office will review and compare the files of children within the scope of the project they manage; if the conditions are met, they will present to the Chairman of the People's Committee of the district for a decision to provide support to the children.
For children infected with HIV/AIDS, based on the child's file and the test report from the competent health authority, the Civil Affairs Department - Labor, Invalids, and Social Affairs Office will process the procedures to present to the Chairman of the People's Committee of the district for a decision to provide support to the children according to the prescribed regulations.
IV. IMPLEMENTATION
1. The funding for implementing the Project as prescribed in this Circular shall be allocated in the annual state budget estimate according to the current state budget allocation levels and mobilized from organizations and individuals both domestically and internationally as provided by law.
Local People's Committees are responsible for integrating central government supplementary funds aimed at localities to implement Decision No. 19/2004/QĐ-TTg dated February 12, 2004, of the Prime Minister; vocational training for disabled persons according to Circular No. 19/2005/TTLT-LĐTBXH-TC-KHĐT dated May 19, 2005, of the Joint Circular of the Ministry of Labor, Invalids, and Social Affairs - Ministry of Finance - Ministry of Planning and Investment, using local resources to implement the Project.
The preparation, allocation, execution, and settlement of the Project's funding shall comply with the State Budget Law and the guiding documents for the implementation of the State Budget Law..
2. As for social assistance policies, medical aid, education combined with community mobilization to support and substitute care for children in difficult circumstances, these continue to be implemented according to the current regulations of the State.
3. The Department of Labor, Invalids, and Social Affairs shall take the lead and be responsible for coordinating with relevant agencies to assist the People's Committee of the province in organizing and implementing annual activity plans locally, coordinating the activities of the Project in accordance with the approved content of the Project.
4. The Department of Finance shall be responsible for allocating funding for the Project according to the approval decision of the local People's Committee; coordinating with the Department of Labor, Invalids, and Social Affairs and relevant agencies to monitor and supervise the use of Project funding in the locality according to their assigned functions and tasks.
V. IMPLEMENTATION PROVISIONS
1. This Circular shall take effect fifteen days after its publication in the Official Gazette. Previous provisions that conflict with this Circular shall be abolished.
2. In the course of implementation, if there are difficulties, please promptly reflect them to the Joint Ministries for study and resolution./.
