Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 71/2006/NĐ-CP dated July 25, 2006 of the Government on port management and maritime channels;
Pursuant to the opinion of the People's Committee of Quảng Trị Province at Official Letter No. 2415/UBND-CN dated October 11, 2006;
Considering the proposal of the Director of the Legal Department and the Director of the Vietnam Maritime Administration.

Article 1
1. Now announcing the port waters within the jurisdiction of Quảng Trị Province, including:
a) The water area before the port bridge of the Cửa Việt Sea Port.
b) The water area of the port channel, branch port channel, pilot reception area, quarantine area, anchorage area, transshipment area, and storm shelter area of the sea port specified in point a of this clause.
2. Other water areas before the port bridge, wharf, anchorage area, transshipment area, and storm shelter area are announced according to the provisions of the law.
Article 2. The scope of the port waters within the jurisdiction of Quảng Trị Province is measured according to the highest tidal level and is specifically defined as follows:
1. The boundary towards the sea: limited by straight lines connecting the following points with coordinates:
CV1: 16°54’30”N, 107°11’06”E;0CV2: 16°55’30”N, 107°11’06”E,0CV3: 16°53’30”N, 107°11’06”E;
CV4: 16°53’54”N, 107°11’54”E,0CV5: 16°51’54”N, 107°11’54”E.02. The boundary along the Thạch Hãn River: the water area limited from point CV1 and CV5 running along both banks of the Thạch Hãn River to a straight line crossing the river 150 meters downstream from the Cửa Việt Bridge.
The pilot reception area, quarantine area, anchorage area, transshipment area, and storm shelter area for vessels entering the Cửa Việt Sea Port within the jurisdiction of Quảng Trị Province are defined as follows:0CV5: 16°51’54”N, 107°11’54”E.01. The pilot reception area and quarantine area: the water area limited by a circle with a radius of 0.5 nautical miles, with the center located at the coordinates:

Article 4. The Quảng Trị Maritime Port Office shall be responsible for:02. Anchorage area: in the water area opposite the water area before the Cửa Việt port bridge.01. Performing its duties and powers as prescribed by the Vietnam Maritime Code and related laws regarding maritime activities in the waters of ports within the jurisdiction of Quảng Trị Province.
2. Based on actual conditions such as weather, waves, draft, and tonnage of vessels, designating specific locations for vessels to receive pilots, undergo quarantine, and anchor in the water areas specified in Article 3 of this Decision; in case of typhoons, if necessary, the Quảng Trị Maritime Port Office will move vessels to suitable areas to ensure maritime safety, maritime security, and prevent environmental pollution.
Article 3.
Outside the water areas defined in Articles 2 and 3 of this Decision, the Quảng Trị Maritime Port Office shall also be responsible for state management of maritime safety and maritime security in the sea areas within the jurisdiction of Quảng Trị Province.
This Decision takes effect fifteen days after its publication in the Official Gazette and revokes Decision No. 4466/2002/QĐ-BGTVT dated December 31, 2002 of the Minister of Transport on the waters of ports within the jurisdiction of Quảng Trị Province and the responsibility area of the Quảng Trị Maritime Port Office.
160The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of the Departments under the Ministry, the Directors of the Vietnam Maritime Administration, the Vietnam Inland Waterways Administration, the Director of the Quảng Trị Provincial Department of Transport, the Director of the Quảng Trị Maritime Port Office, and the Heads of relevant agencies, organizations, and individuals are responsible for implementing this Decision./.0Hồ Nghĩa Dũng
2. Anchorage area: in the waters opposite the waters before the Cửa Việt wharf.
Article 4 The Quảng Trị Maritime Port Office shall be responsible for:
1. Performing its tasks and powers as prescribed by the Vietnamese Maritime Code and relevant laws concerning maritime activities in the waters of coastal ports within the jurisdiction of Quảng Trị Province.
2. Based on actual conditions regarding weather, waves, wind, draft, and tonnage of vessels, designate specific locations for vessels to pick up and drop off pilots, undergo quarantine, and anchor in the waters specified in Article 3 of this Decision; in case of typhoons, if necessary, the Quảng Trị Maritime Port Office shall reposition vessels to suitable areas to ensure maritime safety, maritime security, and environmental protection from pollution.
Article 5
Outside the waters defined in Articles 2 and 3 of this Decision, the Quảng Trị Maritime Port Office shall also be responsible for state management of maritime safety and maritime security in the sea areas within the jurisdiction of Quảng Trị Province.
Article 6
This Decision shall take effect fifteen days from the date of publication in the Official Gazette and revoke Decision No. 4466/2002/QĐ-BGTVT dated December 31, 2002, of the Minister of Transport on the waters of coastal ports within the jurisdiction of Quảng Trị Province and the responsibility area of the Quảng Trị Port Office.
