Decision No. 08/2007/QĐ-BKHCN promulgates criteria for determining scientific and technological organizations engaged in basic research, strategic research, and policy research to serve state management. Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/NĐ-CP;
Pursuant to Decree No. 115/2005/NĐ-CP dated September 5, 2005 of the Government stipulating the self-management and self-responsibility mechanism of public scientific and technological organizations;
Considering the proposal of the Director of the Personnel Organization Department.
DECISION:
Article 1. Issued together with this Decision is the "Criteria for Determining Scientific and Technological Research Organizations Engaged in Fundamental Research, Strategic Research, and Policy Services for State Management" to serve the implementation of Decree No. 115/2005/NĐ-CP dated September 5, 2005 of the Government stipulating the self-management and self-responsibility mechanism of public scientific and technological organizations.
Article 2. For newly established public scientific and technological organizations, these criteria set forth in Section I and Section II of the issued Regulation will be temporarily applied. After three years from the date of establishment, the competent authority will fully apply all criteria to classify these scientific and technological organizations.
Article 3. Ministries, sectors, localities shall base on the criteria issued with this Decision to determine and compile lists of subordinate public scientific and technological organizations engaged in fundamental research, strategic research, and policy services for state management, approve restructuring plans and enhance operational efficiency of these scientific and technological organizations in accordance with the provisions of Decree No. 115/2005/NĐ-CP of the Government.
Article 4. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
Article 5. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of State-owned Enterprise Councils, Chairmen of People's Committees of provinces and centrally governed cities, Heads of public scientific and technological organizations, and related agencies are responsible for implementing this Decision./.
