Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to the Law on Product Quality dated November 21, 2007;
BASED ON THE STANDARDS AND TECHNICAL REGULATIONS LAW dated July 12, 2006;
ences to the Ordinance on Livestock Breeds dated March 24, 2004;
BASED ON THE VETERINARY LAW dated March 24, 2004;
THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT REGULATES THE CONDITIONS FOR CERTIFICATION ORGANIZATIONS OF VIETGAHP IN DAIRY CATTLE, SWINE, POULTRY AND BEE FARMING AS FOLLOWS:
Article 1. 1. Principles, criteria, and allocation standards for state budget investment capital development phase 2016-2020 serve as the basis for planning medium-term and annual investment plans from the state budget for the period 2016-2020 at the national level, at all levels, and in all sectors and units using state budget funds. They also serve as the basis for managing, supervising, inspecting, and auditing the implementation of medium-term and annual investment plans.
THIS CIRCULAR REGULATES THE CONDITIONS FOR CERTIFICATION ORGANIZATIONS OF VIETGAHP IN DAIRY CATTLE, SWINE, POULTRY AND BEE FARMING. THIS CIRCULAR APPLIES TO STATE AUTHORITIES; DOMESTIC ORGANIZATIONS AND INDIVIDUALS; FOREIGN ORGANIZATIONS AND INDIVIDUALS RELATED TO THE DESIGNATION OF CERTIFICATION ORGANIZATIONS OF VIETGAHP IN DAIRY CATTLE, SWINE, POULTRY AND BEE FARMING.
Article 2. CERTIFICATION ORGANIZATIONS OF VIETGAHP IN DAIRY CATTLE, SWINE, POULTRY AND BEE FARMING MUST SATISFY THE FOLLOWING CONDITIONS:
1. HAVE LEGAL PERSONALITY, REGISTERED BUSINESS ACTIVITY, WITH CLEARLY DEFINED TASKS OF INSPECTION, EVALUATION, AND CERTIFICATION OF VIETGAHP.
2. HAVE EVALUATION STAFF WITH A DEGREE OF BACHELOR OR HIGHER IN ANIMAL BREEDING AND VETERINARY SCIENCE, AND AT LEAST THREE YEARS OF PROFESSIONAL EXPERIENCE IN THE FIELD OF CERTIFICATION; POSSESS A VIETGAHP TRAINING CERTIFICATE IN DAIRY CATTLE, SWINE, POULTRY AND BEE FARMING ISSUED BY THE NATIONAL LIVESTOCK SERVICE.
3. HAVE DETAILED PROVISIONS ON PROCEDURES, PROCEDURES, INSPECTION, ISSUE, EXTENSION, WARNING, SUSPENSION, AND REVOCATION OF THE VIETGAHP CERTIFICATE FOR SPECIFIC PRODUCTS ACCORDING TO THE REGULATIONS OF THE CERTIFICATION REGIME FOR ESTABLISHMENTS IMPLEMENTING GOOD ANIMAL FARMING PRACTICES (VIETGAHP) FOR DAIRY CATTLE, SWINE, POULTRY AND BEE FARMING AS ISSUED WITH DECISION NO. 121/2008/QĐ-BNN DATED DECEMBER 17, 2008 BY THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT. ORGANIZATIONS THAT HAVE BEEN CERTIFIED TO MEET THE TCVN 7457-2004 OR ISO/IEC GUIDE 65:1996 STANDARDS ARE GIVEN PRIORITY CONSIDERATION FOR DESIGNATION AS CERTIFICATION ORGANIZATIONS.
Article 3. THIS CIRCULAR SHALL TAKE EFFECT FORTY-FIVE DAYS FROM THE DATE OF SIGNATURE.
Article 4. THE HEAD OF THE MINISTRY’S OFFICE, DIRECTOR OF THE NATIONAL LIVESTOCK SERVICE, HEADS OF UNITS UNDER THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT, DIRECTORS OF PROVINCE AND CITY DEPARTMENTS OF AGRICULTURE AND RURAL DEVELOPMENT, AND RELEVANT ORGANIZATIONS AND INDIVIDUALS ARE RESPONSIBLE FOR ENFORCEMENT OF THIS CIRCULAR./.
