CIRCULAR

Guidelines for implementing hazardous and dangerous allowances and in-kind subsidies for civil servants, public officials, and workers in the radio and television sector

Decree No. Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary systems for cadres, civil servants, public officials, and armed forces personnel;
Decree No. Decree No. 205/2004/NĐ-CP dated December 14, 2004 of the Government stipulating the wage scale and allowance system in state-owned enterprises;
Decree No. Decree No. 187/2007/NĐ-CP dated December 25, 2007 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
After receiving written opinions from the Ministry of Labor, Invalids and Social Affairs and the Ministry of Home Affairs;
The Ministry of Information and Communications hereby issues the following guidelines:

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

These Circulars regulate the hazardous and dangerous allowances and in-kind subsidy systems in the radio and television sector.

Hazardous and dangerous allowances, and particularly hazardous and dangerous allowances, apply to individuals engaged in occupations or jobs with hazardous and dangerous conditions in the radio and television sector where such hazards exceed normal levels not included in their salaries.

Article 2. Applicability

This Circular applies to:

1. Cadres, civil servants (including probationary civil servants), and public officials under state budget who receive wages based on the wage scales issued pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government;

2. Management public officials, professional public officials, administrative public officials, service public officials, and workers of enterprises who receive wages based on the wage scales issued pursuant to Decree No. 205/2004/NĐ-CP dated December 14, 2004 of the Government.

Chapter II
OCCUPATIONS AND JOBS ELIGIBLE FOR HAZARDOUS AND DANGEROUS ALLOWANCES

Article 3. Level 1, coefficient 0.1 shall be applied to civil servants, public officials, and workers performing the following jobs:

1. Operating, controlling, and repairing radio transmitters with power less than 50KW.

2. Operating, controlling, and repairing television transmitters, FM radio transmitters, microwave transmitters, operating satellite signal transmission stations with power less than 5KW.

3. Recording, editing in studio, recording, editing rooms, directing sound and image on mobile broadcasting vehicles (mobile broadcasting).

4. Operating, controlling, and repairing generators with power from 20KVA to less than 500KVA.

5. Recording, dubbing, music recording, audio signal transmission, television signal transmission in studio (Studio).

6. Managing film archives, tapes, preserving, copying materials on magnetic tapes, video discs, audio discs, technical processing of archival documents, operating film projectors, repairing and restoring film.

7. Journalists, program editors organizing radio and television programs, directing, editing programs on mobile broadcasting vehicles.

8. Radio announcers, program directors leading programs in studios, editing rooms.

9. Controlling national radio and television studios.

10. Installing, repairing antenna wire, anchor points for antenna towers at radio and television stations with total power of 100KW or more.

11. Installing, operating, and repairing power supply systems for radio and television stations and technical centers.

12. Installing, operating, and repairing power supply systems for radio and television stations and technical centers.

Article 4. Level 2, coefficient 0.2 shall apply to civil servants, officials, and employees performing the following tasks:

1. Operating, controlling, and repairing radio transmitters with power under 50KW, television transmitters, microwave transmitters with power under 5KW installed in tunnels, underground buildings.

2. Operating and repairing central air conditioning equipment at technical centers for broadcasting and television.

3. Operating, controlling, and repairing FM radio transmitters, television transmitters, satellite signal transmission devices, microwave transmitters in mountainous areas, border regions, and islands.

4. Repairing and maintaining antenna towers, installing signal receiving and transmitting equipment, radiating antennas on towers at heights from 50m to under 100m.

5. Operating, controlling, and repairing generators with power from over 500KVA to under 1000KVA.

6. Operating and repairing generators with power from 200KVA to 500KVA at heights of 1000m.

7. Measuring, inspecting frequency, power, quality of radio transmitters, television transmitters, amplifiers, and standards of radio communication equipment.

8. Operating and controlling digital radio transmitters with power under 15KW, digital television transmitters with power under 5KW.

Article 5. Level 3, coefficient 0.3 shall apply to civil servants, officials, and employees performing the following tasks:

1. Operating, controlling, and repairing radio transmitters with power from 50KW to under 200KW, FM radio transmitters, television transmitters with power from 5KW to under 40KW; digital radio transmitters with power from 15KW up to under 50KW.

2. Operating and controlling digital television transmitters with power 5KW or more, digital radio transmitters with power 50KW or more.

3. Repairing and maintaining antenna towers, installing radiating antennas, signal receiving and transmitting equipment on towers at heights from 100m to under 200m.

4. Installing, repairing, maintaining, and welding optical cables of signal transmission systems and cable television.

Article 6. Level 4, coefficient 0.4 shall apply to civil servants, officials, and employees performing the following tasks:

1. Operating and controlling repair of television transmitters with power 40KW or more.

2. Operating and controlling radio transmitters with power from 200KW or more, FM radio transmitters, television transmitters with power 10KW or more installed at heights of 1000m or more.

3. Repairing and maintaining antenna towers, installing antennas, signal receiving and transmitting equipment on towers at heights above 200m.

4. Operating, controlling, and repairing generators with power over 1000KVA.

Chapter III
OCCUPATIONS AND JOBS ENTITLED TO SUBSIDY IN KIND

Article 7. Occupational titles and jobs in the field of broadcasting and television entitled to subsidy in kind

The occupations and jobs stipulated in Articles 3, 4, 5, and 6 of this Circular shall be entitled to subsidy in kind according to the provisions of Joint Circular No. 10/2006/TTLT-BLDTBXH-BYT dated September 12, 2006, issued by the Ministry of Labor, Invalids and Social Affairs and the Ministry of Health, amending and supplementing Clause 2, Section II of Joint Circular No. 10/1999/TTLT-BLDTBXH-BYT dated March 17, 1999, issued by the Joint Circular of the Ministry of Labor, Invalids and Social Affairs and the Ministry of Health guiding the implementation of the subsidy in kind system for workers working in conditions with hazardous and toxic factors.

Chapter IV
METHODS OF CALCULATION AND ORGANIZATION FOR IMPLEMENTATION

Article 8. Method of calculation and payment of allowances

1. In rooms with multiple transmitters of different powers, the total power of the transmitters shall serve as the basis for calculating the allowance.

2. Hazardous and dangerous allowances, and the subsidy in kind shall be calculated based on actual working time in places with hazardous and dangerous factors; if working less than 4 hours in a day, it shall be counted as half a workday, and if working 4 hours or more, it shall be counted as a full workday.

3. Hazardous and dangerous allowances shall be paid together with monthly salary and shall not be used to calculate contributions or benefits under social insurance.

4. The subsidy in kind must be organized for workers to eat and drink on-site immediately during their rest breaks between shifts.

5. The cost of purchasing items for the subsidy shall be recorded in regular expenses.

Article 9. Sources of funds for payment

1. Subsidies for hazardous and dangerous conditions and material allowances for subjects under agencies and units fully funded by the State budget shall be paid from the State budget according to the current budget classification within the annual budget assigned to the agencies and units.

2. Subsidies for hazardous and dangerous conditions and material allowances for subjects under agencies implementing personnel quotas and administrative management expenses and for subjects under public service units implementing self-financing regimes shall be paid from the allocated funds and self-financed resources by the agencies and units.

3. For enterprises included in the unit labor cost and accounted for in production costs or circulation fees.

Article 10. Implementation Organization

1. This Circular takes effect from June 1, 2010.

2. During implementation, if any issues arise or difficulties occur, units shall promptly report them to the Ministry of Information and Communications for consideration and resolution within their authority./.
