Circular No. 08/2013/TT-BGTVT amends and supplements certain provisions of QCVN 17:2011/BGTVT on pollution prevention norms for inland waterway vessels. This Circular applies to inland waterway vessels and takes effect from November 1, 2013.

Circular Amending and Supplementing Certain Provisions of QCVN 17:2011/BGTVT - National Technical Regulation on Pollution Prevention Rules for Inland Waterway Vessels issued together with Circular No. 70/2011/TT-BGTVT dated December 30, 2011

The Minister of Transport hereby promulgates this Circular amending and supplementing certain provisions of QCVN 17:2011/BGTVT - National Technical Regulation on Pollution Prevention Rules for Inland Waterway Vessels issued together with Circular No. 70/2011/TT-BGTVT dated December 30, 2011.

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;
Based on Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions
Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
AT THE REQUEST OF THE DIRECTOR OF THE VIETNAM MARINE INSPECTION AUTHORITY AND THE HEAD OF THE SCIENCE AND TECHNOLOGY DEPARTMENT;
Article 1. Amend and supplement certain provisions of QCVN 17:2011/BGTVT - National Technical Regulation on Pollution Prevention Rules for Inland Waterway Vessels issued together with Circular No. 70/2011/TT-BGTVT dated December 30, 2011 of the Ministry of Transport.
1. Point 1.5.15 Section 1.5. Definitions, Chapter 1. General Provisions, Part I. General Provisions - shall be amended and supplemented as follows:
"1.5.15 Treated water includes treated wastewater and treated oil-water mixture. Treated wastewater is wastewater that has been treated to meet the requirements of QCVN 14:2008/BTNMT - National Technical Regulation on Domestic Wastewater; Treated oil-water mixture is an oil-water mixture that has been processed through an oil-water separator or other equipment ensuring that the oil content does not exceed 15 parts per million (15 mg/l)"
2. Point 2.1.2, Chapter 2. Requirements for Structural and Equipment Design, Part 3. Structure and Equipment for Preventing Pollution from Wastewater, Section II. Technical Regulations - shall be amended and supplemented as follows:
"2.1.2. Tanks must be made of steel or composite materials suitable for shipbuilding with slow flame spread properties or equivalent materials. Tanks can be integrated with the hull or separated. The inner surface of the tank must be smooth and coated with protective paint or equivalent measures to withstand the impact of wastewater. For tanks with a capacity greater than 0.2 cubic meters, the bottom of the tank must have a slope towards the suction pipe. The tank must have a securely fastened lid that is easy to open and close for inspection and cleaning."
Director of the Office of the Ministry, Inspector General of the Ministry, Directors of the Inspection Bureau of Vietnam, the Inland Waterways of Vietnam, Heads of Departments under the Ministry of Transport, Directors of Provincial Departments of Transport, Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
Article 2. Effective Date
This Circular takes effect from November 1, 2013.
Article 3. Implementation Organization
The Head of the Ministry’s Office, the Inspector General of the Ministry, the Directors of the Departments: Vietnam Inspection, Vietnam Inland Waterways, the Heads of the Bureaus under the Ministry of Transport, the Directors of the Departments of Transport of the provinces, the Heads of the agencies, organizations, and individuals related to this Circular shall be responsible for its implementation./.
