Pursuant to Decree No. 70/2010/NĐ-CP dated June 22, 2010 of the Government detailing and guiding the implementation of certain provisions of the Atomic Energy Law regarding nuclear power plants;
Pursuant to Decree No. 20/2013/NĐ-CP dated February 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Article 1. Scope of Regulation
This Circular stipulates the contents of the Safety Analysis Report in the approval dossier for nuclear power plant construction investment projects (hereinafter referred to as the SAR-IAP).
The requirements and guidelines for design, systems, and safety analysis set forth in this Circular shall be understood as requirements and guidelines appropriate to the level of detail of the basic design at the project investment approval stage.
Article 2. Applicability
This Circular applies to organizations and individuals involved in preparing and reviewing the Safety Analysis Report for nuclear power plant construction investment projects.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
1. The applicant organization is an organization with legal personality under the law that submits the application dossier for approval of nuclear power plant construction investment projects.
2. Operating mode of nuclear power plants includes startup, operation at rated power, partial rated power operation, reactor shutdown, and fuel reloading.
3. Cold shutdown is the shutdown state of the reactor after the cooling process when the reactor coolant system pressure equals atmospheric pressure and the temperature is below 100°C.
4. Best estimate modeling is the modeling used in deterministic safety analysis to ensure that the analysis results are most consistent with reality, with the aim of ensuring safety.
5. Structures, systems, and components related to safety are structures, systems, and components (collectively referred to as items) which, if damaged in combination with a single failure assumption, may lead to radioactive release outside the site or require reactor shutdown to maintain a safe state.
6. Safety systems are systems designed to safely shut down the reactor, remove residual heat from the core, or limit consequences when abnormal conditions or accidents occur within the design basis. Safety systems and items related to safety are collectively referred to as important safety items.
7. Common-mode failures are failures of two or more structures, systems, and components occurring in the same manner or under the same mode due to a single cause or event.
8. Design-basis accidents are accidents considered as conditions for design to ensure that the nuclear power plant can withstand such accidents when they occur, so that fuel damage and radioactive material release remain below the limits set by the competent authority.
9. Design-basis threats is a description of the attributes and characteristics of potential threats to security emanating from inside and outside the nuclear power plant.
10. Safety culture is the overall characteristics and behavior of organizations and individuals focused on prioritizing safety and human protection as the top priority.
11. Conservative assessment is the use of computational programs, models, input data, and assumptions to provide the best possible safety assessment based on what is known. The degree of conservatism is proportional to the level of uncertainty and the overall importance of the assessment to safety review.
Article 4. Contents of the Safety Analysis Report
1. The Project Safety Analysis Report (PSAR) in the approval dossier for investment projects shall include twelve (12) contents: general introduction; general description of the nuclear power plant; safety management; site evaluation; general design aspects; main system descriptions of the nuclear power plant; safety analysis; radiation protection; emergency response; environmental aspects; radioactive waste management; decommissioning and end-of-operation issues.
2. The contents of the Project Safety Analysis Report are detailed in the Appendix issued together with this Circular.
Article 5. Dossier for Requesting Review of the Safety Analysis Report
1. The licensing applicant shall submit six (6) sets of dossiers (printed copies) in Vietnamese (one original set, five photocopies) and five (5) sets of dossiers (printed copies) of the Project Safety Analysis Report and the request for review translated into English to the Radiation and Nuclear Safety Agency under the Ministry of Science and Technology.
2. In addition to printed copies, the licensing applicant shall submit electronic versions (Vietnamese and English) of the Project Safety Analysis Report.
3. The Radiation and Nuclear Safety Agency shall check the validity of the dossier within fifteen (15) days from the date of receipt of the dossier and has the right to request the project investor to supplement necessary documents.
4. The Radiation and Nuclear Safety Agency shall organize the review of the Project Safety Analysis Report within six (6) months from the date of receipt of complete valid dossiers or the date of receipt of supplementary documents as stipulated in Clause 3 of this Article.
5. During the review process of the Project Safety Analysis Report, the licensing applicant shall be responsible for explaining and supplementing the dossier when requested by the Radiation and Nuclear Safety Agency.
Article 6. Effectiveness
1. This Circular takes effect from July 10, 2014.
2. During the implementation, if there are any difficulties, agencies, organizations, and individuals should promptly reflect them to the Ministry of Science and Technology for consideration and resolution./.
