CIRCULAR
Regulations on the List of State Secrets of Confidential Level in the Inspection Sector
Pursuant to the Ordinance on Protection of State Secrets No. 30/2000/PL-UBTVQH10 dated December 28, 2000 of the Standing Committee of the National Assembly;
Pursuant to the Decree No. 33/2002/NĐ-CP dated March 28, 2002 of the Government detailing the implementation of the Ordinance on Protection of State Secrets;
Pursuant to Decree No. 106/2014/NĐ-CP dated November 17, 2014, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;
After reaching consensus with the Government Inspector General, the Minister of Public Security promulgates the List of State Secrets of Confidential Level in the Inspection Sector.
Article 1. The List of State Secrets of Confidential Level in the Inspection Sector includes the following information and documents:
1. Directives from high-ranking Party and State leaders on inspection work, receiving citizens, handling complaints and denunciations, and preventing and combating corruption that have not been or will not be disclosed.
2. Plans for conducting inspections, plans for verifying complaint contents, plans for verifying denunciation contents; reports on inspection results, reports on verification of complaint contents, reports on verification of denunciation contents; draft conclusions of inspections, draft decisions on handling complaints, draft conclusions on denunciation contents; other information and documents related to inspection activities, receiving citizens, handling complaints and denunciations, and preventing and combating corruption that have not been or will not be disclosed.
3. Operational measures during the course of inspection activities and complaint and denunciation resolution.
4. Names, addresses, signatures of complainants and other information that could reveal the identity of complainants that have not been or will not be disclosed.
5. Contents of cooperation with foreign countries or international organizations regarding inspection, complaint and denunciation resolution, and prevention and combating corruption that have not been or will not be disclosed.
6. Personnel files of officials, civil servants, employees, and Party members under the Government Inspectorate; personnel files related to planning, appointment, dismissal, transfer, rotation, and disciplinary actions of the Heads of Inspectors of Ministries, central agencies, and provincial and municipal inspectorates directly under the central government that have not been or will not be disclosed.
7. Technical design documents for computer networks and internal databases of the Inspection Sector; encryption keys, passwords, and conventions for ensuring security and safety in the use and application of information technology within the Inspection Sector.
8. Documents and materials of the Inspection Sector using information and documents listed in the State Secrets List of other agencies and organizations.
Article 2. Effective Date
This Circular takes effect from March 16, 2015, and replaces Decision No. 588/2004/QĐ-BCA(A11) dated June 25, 2004 of the Minister of Public Security on the List of State Secrets of Confidential Level in the Inspection Sector.
Article 3. Responsibility for Implementation
1. The Government Inspectorate and the Ministry of Public Security shall be responsible for guiding and supervising the implementation of this Circular.
2. Ministries, ministerial-level agencies, agencies directly under the Government; People's Committees of provinces and centrally-administered cities, and other relevant agencies, organizations, and individuals shall be responsible for implementing this Circular./.
