1. The objectives of the competition shall be implemented in accordance with Clause 2, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Competitions and Awards 2013.
2. The principles of competitions and awards shall be implemented in accordance with Article 1 of Circular No. 07/2014/TT-BNV dated August 29, 2014 of the Ministry of Home Affairs guiding the implementation of certain provisions of Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing the implementation of certain provisions of the Law on Competitions and Awards and the Law Amending and Supplementing Certain Provisions of the Law on Competitions and Awards, Decree No. 39/2012/NĐ-CP dated April 27, 2012 of the Government amending and supplementing certain provisions of Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government, and Decree No. 65/2014/NĐ-CP dated July 1, 2014 of the Government detailing the implementation of the Law Amending and Supplementing Certain Provisions of the Law on Competitions and Awards 2013 (hereinafter referred to as Circular No. 07/2014/TT-BNV).
Chapter II
AWARDS FOR COMPETITIONS, FORMS OF RECOGNITION, PRINCIPLES AND METHODS OF ASSESSMENT
Section 1
MOVEMENTS OF COMPETITIONS, AWARDS FOR COMPETITIONS
Article 4. Forms and contents of organizing competition movements
1. The forms and contents of organizing movements of competitions shall be implemented in accordance with Clause 1, Clause 2 of Article 2 and Article 3 of Circular No. 07/2014/TT-BNV.
2. When organizing thematic movements of competitions (or in phases), units within the Sector shall develop plans and report to the Ministry's Competition and Award Council.
Article 5. Organization and activities of competition blocs
1. Competition blocs shall be organized and divided based on selecting units within the Sector with similar functions and tasks or those geographically close to ensure rationality in competitive activities and commendation. The competition blocs of the Ministry of Planning and Investment shall be divided as follows:
a) Units under the Ministry comprising 04 blocs (Annex 3);
b) Departments comprising 09 blocs (Annex 4);
c) Management Boards comprising 09 blocs (Annex 5);
d) Units under the General Statistics Office comprising 04 blocs (Annex 6);
đ) Statistics Offices comprising 10 blocs (Annex 7).
2. Activities of competition blocs
a) Annually, organize signing of competition pledges; establish specific competition criteria; elect bloc leaders and deputy leaders; select and honor outstanding units for commendation;
b) The bloc leader is responsible for drafting plans to organize bloc activities; chair and coordinate the organization of mid-term and final reviews of the competition movement; exchange experiences, promote and disseminate new models and exemplary cases within the bloc.
Article 6. Commendation Titles
1. For collectives including: "Advanced Labor Collective"; "Outstanding Labor Collective"; "Ministry Flag of Merit"; "Government Flag of Merit" awarded once at the end-of-year summary.
2. For individuals including: "Advanced Worker"; "Model Worker at the Grassroots Level"; "Model Worker at the Ministry Level"; "National Model Worker" awarded once at the end-of-year summary.
3. Bestowal and awarding of commendation titles:
a) Collectives and individuals under the Ministry shall be bestowed the commendation titles stipulated in Clause 1 and Clause 2 of this Article;
b) Departments and Management Boards shall be bestowed the "Ministry Flag of Merit" title and evaluated according to their respective competition blocs.
Article 7. Standards for Commendation Titles for Individuals
1. The title "Advanced Worker" shall be awarded to individuals meeting the standards prescribed in Article 5 of Decree No. 65/2014/ND-CP dated July 1, 2014 of the Government detailing the implementation of the Law Amending and Supplementing Certain Provisions of the Law on Competitions and Rewards 2013 (hereinafter referred to as Decree No. 65/2014/ND-CP). Among these, the standard for satisfactorily completing tasks is based on the results of assessing and classifying officials, civil servants, and public employees as stipulated in Decree No. 56/2015/ND-CP dated June 9, 2015 of the Government on Assessing and Classifying Officials, Civil Servants, and Public Employees (hereinafter referred to as Decree No. 56/2015/ND-CP).
2. The title "Model Worker at the Grassroots Level" shall be awarded to individuals meeting the standards prescribed in Clause 1 of Article 4 of Decree No. 65/2014/ND-CP. Among these, the standard for excellently completing tasks is based on the results of assessing and classifying officials, civil servants, and public employees as stipulated in Decree No. 56/2015/ND-CP.
The ratio of election shall not exceed 15% of the total number of individuals receiving the "Advanced Worker" title (as stipulated in Article 5 of Circular No. 07/2014/TT-BNV); the election ratio of leaders is 30% of the total number of leaders. If there is an excess over half, one additional vote can be cast.
3. The title "Model Worker at the Ministry Level" shall be awarded to individuals meeting the standards prescribed in Clause 1 of Article 14 of Decree No. 42/2010/ND-CP dated April 15, 2010 of the Government detailing the implementation of certain provisions of the Law on Competitions and Rewards and the Law Amending and Supplementing Certain Provisions of the Law on Competitions and Rewards (hereinafter referred to as Decree No. 42/2010/ND-CP).
4. The title "National Model Worker" is awarded to individuals meeting the criteria specified in Article 3 of Decree No. 65/2014/ND-CP.
Article 8. Criteria for commendation titles for collectives
1. The title "Advanced Labor Collective" shall be awarded to collectives meeting the criteria stipulated in Clause 1 of Article 28 of the Law on Commendation and Reward 2003.
2. The title "Outstanding Labor Collective" shall be awarded to collectives meeting the criteria prescribed in Clause 1 of Article 27 of the Law on Commendation and Reward 2003.
3. The title "Ministry Flag" shall be awarded to collectives meeting the criteria stipulated in Article 26 of the Law on Commendation and Reward 2003.
a) Quantity, general provisions:

b) Based on the results of annual tasks, the Minister shall decide the specific quantity upon the proposal of the Ministry's Commendation and Reward Council.

Article 9. Types of rewards
Implemented according to the provisions of Article 10 of Circular No. 07/2014/TT-BNV.
Article 10. Forms of reward
1. Forms of reward within the authority of the Minister
a) Certificate of Merit from the Minister;
b) Commemorative Medal "For the Cause of the Planning and Investment Sector"; Commemorative Medal "For the Cause of Vietnam's Statistics".
2. Forms of reward by unit heads at delegated levels: Certificate of Merit.
3. Application of forms of reward
a) Ministry units shall implement according to the provisions of Clause 1 of this Article (units without delegated levels); Clause 1 and Clause 2 of this Article (delegated level units);
b) Departments and Management Boards shall implement according to the provisions of Clause 1 of this Article.
Article 11. Reward criteria
1. Certificate of Merit from the Minister
a) Awarded to individuals meeting one of the criteria stipulated in Clause 1 of Article 24 of Decree No. 65/2014/NĐ-CP. In cases where an individual has consistently completed their duties before retirement but has not been awarded a "Certificate of Merit from the Minister" during their career, they may be considered for commendation;
b) Awarded to collectives meeting the criteria specified in Point 2, Clause 39, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Commendation and Reward 2013.
2. Quantity, evaluation
a) Ministry units shall be evaluated and decided by the Ministry's Commendation and Reward Council;
b) Departments and Management Boards shall evaluate based on a ratio of 05 rooms (equivalent levels) being evaluated for 01 room (equivalent level) and 30 individuals being evaluated for 01 individual. If the remainder exceeds half, an additional 01 will be evaluated;
c) Evaluation groups:
Groups with fewer than 6 units shall evaluate 01 certificate of merit;
Groups with 06 to 09 units shall evaluate 02 certificates of merit;
Groups with 10 units or more shall evaluate 03 certificates of merit.
3. Commemorative Medals
a) Commemorative Medal "For the Cause of the Planning and Investment Sector" shall be implemented according to the provisions of Circular No. 05/2012/TT-BKHĐT dated October 19, 2012 issued by the Ministry of Planning and Investment;
b) Commemorative Medal "For the Cause of Vietnam's Statistics" shall be implemented according to the Regulation attached to Decision No. 768/QĐ-BKHĐT dated June 17, 2013 issued by the Ministry of Planning and Investment.
4. Certificates of Merit from the heads of delegated units under the Ministry shall be implemented according to the provisions of Clause 42, Article 1 of the Law Amending and Supplementing Certain Provisions of the Law on Commendation and Reward 2013.
Section 3
PRINCIPLES AND METHODS OF EVALUATION
Article 12. Principles for Evaluation
1. The evaluation and awarding process shall be conducted at the end of each year's work, a campaign, a special period of competition, a comprehensive survey, or upon discovering exemplary individuals or deeds.
2. Units that have been operational for twelve months or more may be considered for the title "Advanced Labor Collective."
3. The meeting to evaluate and award shall be held when at least eighty percent of the total number of cadres, civil servants, public officials, and workers, or members of the Competition and Award Council of the unit, are present.
4. The title "Model Competitor at the Grassroots Level" shall be voted on by secret ballot with a ratio exceeding seventy percent of the votes cast.
5. The titles "Model Competitor at the Ministry Level," "National Model Competitor," and other honors bestowed by the State must be reviewed and voted on by secret ballot by the Competition and Award Council of the Ministry, with a voting ratio of ninety percent or higher among the total number of council members. In case of absent members, their opinions shall be solicited through ballots.
6. The titles "Model Competitor at the Grassroots Level," "Model Competitor at the Ministry Level," and "National Model Competitor" shall only be evaluated and awarded after the individual has received a decision recognizing an innovation or scientific topic from the grassroots-level Innovation Council or the Ministry-level Innovation Council.
Article 13. Methods for Evaluation
1. For units without hierarchical levels, the evaluation and awarding shall be conducted within the unit and then submitted to the Ministry's Competition and Award Council for review and decision.
2. For units with hierarchical levels, the evaluation and awarding shall first be conducted within the unit, followed by the head of the unit reviewing and deciding on awards within their authority, and then submitting to the Ministry's Competition and Award Council for review and decision on awards within the Ministry's and State's authority. For the General Statistics Office, the evaluation and awarding shall be carried out according to the regulations of the Statistics sector.
3. For the leadership of the Ministry, the Party Cadre Management Board and the Minister shall review and decide.
4. For the heads of units under the Ministry, the Ministry's Competition and Award Council shall review and decide.
5. For Departments, Management Boards, and competition groups, meetings for evaluation and awarding shall be organized and then submitted to the Ministry's Competition and Award Council for review and decision.
Chapter III
AUTHORITY TO DECIDE, BESTOW, PROCEDURES AND FILES AND PROCEDURE FOR PROPOSING AWARDS
Article 14. Authority to Decide on Awards
1. The Minister shall decide to bestow the following commendation titles and forms of reward: "Advanced Labor Collective," "Excellent Labor Collective," "Ministry-Level Flag of Competition," "Advanced Worker," "Grassroots-Level Model Competitor," "Ministry-Level Model Competitor"; "Certificate of Merit from the Minister," Commemorative Medal "For the Cause of Planning and Investment in Vietnam," Commemorative Medal "For the Cause of Statistics in Vietnam."
2. The heads of units with hierarchical levels under the Ministry shall decide to bestow the titles "Advanced Labor Collective," "Advanced Worker," "Grassroots-Level Model Competitor," and the form of "Letter of Praise."
Article 15. Organization of Award Presentation
1. The ceremony for presenting awards shall be carried out in accordance with the provisions of Government Decree No. 145/2013/NĐ-CP dated October 29, 2013, concerning the organization of commemorative days, ceremonies for presenting and receiving awards and commendation titles; diplomatic rituals and welcoming foreign guests.
2. In cases where separate reception ceremonies are organized, the unit shall submit to the Minister for approval and coordinate with the Department of Competition and Award to organize the presentation ceremony in accordance with the prescribed procedures.
Article 16. Procedures for Commending and Awarding
1. General provisions on procedures for commending and awarding shall be implemented in accordance with Article 53 of Decree No. 42/2010/ND-CP and Clause 1 of Article 1 of Decree No. 39/2012/ND-CP dated April 27, 2012 of the Government amending and supplementing some articles of Decree No. 42/2010/ND-CP dated April 15, 2010 of the Government detailing the implementation of certain Articles of the Law on Competition and Rewards and the Law Amending and Supplementing Some Provisions of the Law on Competition and Rewards (hereinafter referred to as Decree No. 39/2012/ND-CP).
2. Levels of Commending and Awarding
a) The Minister shall submit to the Prime Minister in accordance with Clause 47 of Article 1 of the Law on Competition and Rewards 2013;
b) Units under the Ministry:
The head of the unit without authority to submit shall submit to the Ministry's Competition and Reward Council for consideration and decision on rewarding collectives and individuals under their management;
The head of the unit with authority to submit shall submit to the Ministry's Competition and Reward Council for consideration and decision on rewarding collectives and individuals under their management within the scope of authority of the Minister and the State level;
The Department of Foreign Investment is responsible for submitting to the Ministry's Competition and Reward Council for consideration and decision on rewarding individuals from the Ministry working at overseas representative offices of Vietnam during their term of office;
c) Departments and Management Boards shall submit to the Ministry's Competition and Reward Council for consideration and decision to present "Certificates of Merit from the Minister" to departments, equivalent levels, and individuals under their management;
d) The Head of the Competition Group shall submit to the Ministry's Competition and Reward Council for consideration and decision to present the title "Flag of Excellence at the Ministry Level" and "Certificates of Merit from the Minister" to members of the group;
đ) Commendations outside the Sector and international commendations shall be handled by relevant units within the Sector preparing files for submission to the Council for consideration and decision.
Article 17. Documents for Proposing Commendation and Awards
1. For units under the Ministry
a) A letter of proposal along with a list of proposed commendations (one copy, Model No. 1a);
b) An excerpt from the minutes of the meeting for assessing commendations (one copy, Model No. 1b);
c) Reports on achievements of the collective and individual proposed for commendation:
Commendation at the Ministry level one copy (Collective Model No. 01, Individual Model No. 02 issued together with Decree No. 39/2012/ND-CP). For the title "Model Worker at the Grassroots Level" and "Model Worker at the Ministry Level", there must be a decision recognizing inventions and scientific research topics;
Commendation by the Prime Minister three copies (Collective Model No. 01, Individual Model No. 02 issued together with Decree No. 39/2012/ND-CP);
Commendation by the President four copies of reports on achievements (Collective Model No. 01, Individual Model No. 02 issued together with Decree No. 39/2012/ND-CP).
2. For Departments and Management Boards
a) A letter of proposal along with a list of proposed commendations (one copy, Model No. 1a);
b) An excerpt from the minutes of the meeting for assessing commendations (one copy, Model No. 1b);
c) Report on achievements of the collective (department, equivalent level) and individual proposed for commendation one copy (Collective Model No. 01, Individual Model No. 02 issued together with Decree No. 39/2012/ND-CP). For the Director of the Department and the Head of the Management Board, there must be confirmation from the Provincial People's Committee.
3. For the Competition Group
a) A letter of proposal along with a list of proposed commendations (one copy, Model No. 1a);
b) An excerpt from the minutes of the meeting for assessing commendations (one copy, Model No. 1b);
c) Report on achievements of the collective receiving the "Flag of Excellence at the Ministry Level" and "Certificates of Merit from the Minister" (Model No. 01 issued together with Decree No. 39/2012/ND-CP) and must have confirmation from the Provincial People's Committee.
4. Simplified commendation procedures shall be implemented in accordance with Clause 1 of Article 85 of the Law on Competition and Rewards 2003.
5. For units with obligations to pay state budget revenues, they shall implement in accordance with Clause 2 of Article 1 of Decree No. 39/2012/ND-CP.
Article 18. Time for submitting commendation dossier
1. Units under the Ministry:
a) Commendations within the authority of the ministry: Before January 15th each year;
b) National-level commendations: Within ten days from the date of the Minister's decision, relevant collectives and individuals shall complete and submit their dossiers to the Department of Mobilization and Commendation;
c) For the General Statistics Office: The first round before December 31st; the second round before February 5th each year.
2. Departments and Management Boards: Before January 31st each year.
3. Competition and Commendation Groups: Before February 15th each year.
4. Commendations for outstanding achievements and special topic commendations: Within fifteen days from the date of achieving outstanding results or completing the special topic work. For the Five-Year Census, the dossier shall be submitted ninety days after completion; for the Ten-Year Census, it shall be submitted one hundred eighty days after completion.
5. Commendations for dedication over time: Before July 31st each year.
6. Commendations for other cases: The review period and the time for signing the commendation decision is fifteen working days from the date of receiving the commendation proposal dossier.
7. In addition to submitting the dossier in writing as prescribed, units shall also send the electronic dossier in Word format to the email address: [email protected].
Article 19. Management and storage of commendation dossiers
1. Units within the sector are responsible for managing and storing commendation dossiers according to current regulations.
2. It is encouraged to apply information technology in the management and storage of commendation dossiers.
Chapter IV
COMPETITION AND COMMENDATION COUNCIL, INNOVATION COUNCIL
Article 20. Authority to establish Competition and Commendation Councils and Innovation Councils at all levels
1. The Minister decides to establish the Competition and Commendation Council of the Ministry to direct competition and commendation activities throughout the sector; the Innovation Council at the ministerial level to assist the Minister in reviewing, recognizing, and evaluating the impact of innovations and scientific research topics.
2. Heads of units with delegated authority decide to establish Competition and Commendation Councils to direct competition and commendation activities; the Innovation Council at the grassroots level to assist unit heads in reviewing, recognizing, and evaluating the impact of innovations and scientific research topics of the unit.
Article 21. Principles of operation, tasks, and powers of Competition and Commendation Councils and Innovation Councils at all levels
1. Competition and Commendation Councils and Innovation Councils at all levels operate based on the principle of democratic centralism and make decisions by majority vote. In case of equal opinions among members of the Competition and Commendation Councils and Innovation Councils, the opinion of the Chairman of the Council is the deciding opinion.
2. The principles of operation, tasks, and powers of the Competition and Commendation Council and Innovation Council at the ministerial level are implemented according to the operational regulations of the Council stipulated by the Minister.
3. The principles of operation, tasks, and powers of the Competition and Commendation Council and Innovation Council of units with delegated authority are stipulated by the heads of these units.
Article 22. Responsibilities of the Standing Body of the Competition and Commendation Council of the Ministry
1. Implementing the tasks specified in Decision No. 450/QD-BKH dated April 9, 2009 of the Minister of Planning and Investment regarding the functions, tasks, and organizational structure of the Department of Mobilization and Commendation.
2. Based on the conclusions of the Competition and Commendation Council of the Ministry, the Minister:
a) Submits to the Minister for signing the Decision on commendation within the authority;
b) Completes the dossier to submit to the Prime Minister for national-level commendations.
3. Notifies the proposing unit to supplement and perfect the dossier that does not comply with regulations.
4. Upon receipt of the commendation decision, within ten working days, must excerpt the decision, make certified copies, and send the decision to units within the sector, while simultaneously publishing it on the "Ministry of Planning and Investment Electronic Portal".
Chapter V
FUND FOR COMPETITION AND REWARD
Article 23. Sources, allocation levels, and management of the Competition and Reward Fund
1. The sources and allocation levels of the Competition and Reward Fund shall be implemented in accordance with the provisions of Article 67 of Decree No. 42/2010/ND-CP and Circular No. 71/2011/TT-BTC dated May 24, 2011, issued by the Ministry of Finance guiding the establishment, management, and utilization of the Competition and Reward Fund.
2. The Department of Competition and Rewards shall take the lead and coordinate with the Ministry's Office to manage the Competition and Reward Fund in accordance with current regulations.
3. The Ministry of Planning and Investment encourages organizations and individuals to support and contribute to supplementing the Competition and Reward Fund.
Article 24. Utilization of the Competition and Reward Fund
1. To provide cash rewards or purchase gifts for collectives and individuals working at units under the Ministry that have been awarded by the President of the State, the Prime Minister, or the Minister.
2. To cover expenses for printing certificates, commendation letters, medals, commemorative plaques, badges, competition flags, and commendation frames.
3. Each year, twenty percent of the Ministry’s Competition and Reward Fund shall be allocated for organizing and directing competition movements, including the following tasks:
a) Organizing meetings of the Competition and Reward Council;
b) Developing, launching, and implementing competition movements throughout the industry and participating in activities of the inter-ministerial competition blocs;
c) Directing, inspecting, and supervising the implementation of competition movements and reward work;
d) Conducting training on competition and reward procedures; organizing signing ceremonies for competition agreements; summary and conclusion meetings; experience-sharing sessions; publicity, commendation, and promotion of exemplary models;
đ) Other expenditure items as decided by authorized persons.
4. The Competition and Reward Funds of subordinate units under the Ministry shall be utilized as follows:
a) To provide cash rewards for collectives and individuals within the unit that have been awarded by higher authorities;
b) To provide cash rewards for collectives and individuals within the unit that have been awarded by the unit head within their authority;
c) To cover expenses for organizing competition movements and activities serving competition and reward work.
5. The calculation of rewards shall be carried out in accordance with the provisions of Articles 70, 71, 72, 73, 74, 75, and 76 of Decree No. 42/2010/ND-CP.
Article 25. Principles of Reward Distribution
Implemented in accordance with the provisions of Clause 2 of Article 68 of Decree No. 42/2010/ND-CP.
Chapter VI
RIGHTS AND OBLIGATIONS, INSPECTION, VIOLATION HANDLING,
SETTLEMENT OF COMPLAINTS AND REPORTS ON COMPETITION AND REWARD
Article 26. Rights and obligations of collectives and individuals in competition and reward
Implemented in accordance with the provisions of Articles 77, 78, and 79 of Decree No. 42/2010/ND-CP.
Article 27. Inspection of competition and reward work
1. The Department of Competition and Rewards shall be responsible for inspecting competition and reward work at units within the industry in accordance with current regulations.
2. Heads of units within the industry shall be responsible for inspecting competition and reward work at their respective units.
3. The head of the competition bloc shall be responsible for inspecting competition and reward work within the bloc according to the terms of the signed competition agreement.
Article 28. Handling violations and settlement of complaints and reports
Implemented in accordance with the provisions of Articles 80, 81, 82, 83, and 84 of Decree No. 42/2010/ND-CP.
Chapter VII
IMPLEMENTING PROVISIONS
Article 29. Implementation and effectiveness
1. Heads of units under the Ministry, directors of Departments, and heads of Management Boards shall be responsible before the Ministry's Competition and Reward Council and the Minister for competition and reward work within their jurisdiction.
2. Units within the industry shall annually be responsible for summarizing, concluding, evaluating, rewarding, and submitting reports to the Standing Committee of the Ministry's Competition and Reward Council; promoting good examples and deeds in competition movements to nurture and expand exemplary models; combating and criticizing violations of laws on competition and reward.
3. This Circular shall take effect forty-five days from the date of signature and replace Circular No. 06/2012/TT-BKHĐT dated October 19, 2012, issued by the Ministry of Planning and Investment guiding competition and reward work in the Planning and Investment sector.
4. The Standing Committee of the Ministry's Competition and Reward Council shall be responsible for coordinating with units within the industry to implement this Circular.
5. During the implementation process, if there are difficulties, agencies and units shall report to the Ministry of Planning and Investment for research, amendment, and supplementation to ensure appropriateness./.
