Pursuant to Decree No. 62/2013/NĐ-CP dated June 25, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;1Pursuant to Decision No. 33/2015/QĐ-TTg dated August 10, 2015 of the Prime Minister on housing support policies for poor households according to the poverty standard during the period 2011-2015 (the Housing Support Program for Poor Households under Decision No. 167/2008/QĐ-TTg Phase 2);

Considering the proposal of the Director of the Real Estate Market Management Department;1The Minister of Construction issues this Circular guiding the implementation of Decision No. 33/2015/QĐ-TTg dated August 10, 2015 of the Prime Minister on housing support policies for poor households according to the poverty standard during the period 2011-2015 (the Housing Support Program for Poor Households under Decision No. 167/2008/QĐ-TTg Phase 2)."b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."This Circular guides the determination of beneficiaries, conditions, methods of support, and the organization and implementation of housing support for poor households in rural areas or poor households residing in villages, hamlets, villages, communes, wards, or settlements (collectively referred to as villages) directly under towns, urban districts, or communes directly under district-level cities, provincial-level cities, as provided for in Article 2 of Decision No. 33/2015/QĐ-TTg dated August 10, 2015 of the Prime Minister on housing support policies for poor households according to the poverty standard during the period 2011-2015 (hereinafter referred to as Decision No. 33/2015/QĐ-TTg).ỗ a) Households eligible for support in constructing houses (including new construction or repair and upgrading of existing houses) as stipulated in Article 2 of Decision No. 33/2015/QĐ-TTg.No.b) Relevant organizations and individuals.1Article 2. 2. The support must ensure democracy, transparency, fairness, and compliance with laws and state policies.uProvincial-level People's Inspection Office; reason 3. House construction support must be appropriate to local realities, customs, and traditions of each ethnic group, region, and province, preserving the cultural identity of each ethnic group; it should be integrated with local new rural development planning.

4. Implementing support based on the principle that the State provides support through preferential loans, community assistance, and household participation to construct houses meeting the prescribed standards and quality; combining with other central and local investment and support programs to enhance policy effectiveness.No. 5. After receiving support, households must construct new houses or repair and upgrade their existing houses. Support for house construction shall only be provided to households that have land for housing. Article 1. Scope of Regulation and Applicability

This Circular provides guidance on determining the target groups, conditions, methods of support, and the organization and implementation of housing support for poor households in rural areas or poor households residing in villages, hamlets, villages, communes, wards, villages, or phum (collectively referred to as village) directly under towns, townships; communes directly under provincial cities, in accordance with Article 2 of Decision No. 33/2015/QĐ-TTg dated August 10, 2015 of the Government on housing support policies for poor households according to the poverty standard for the 2011-2015 period (hereinafter referred to as Decision No. 33/2015/QĐ-TTg).

a) Households eligible for support in constructing housing (including new construction or repair and upgrading of existing housing) as stipulated in Article 2 of Decision No. 33/2015/QĐ-TTg.

b) Relevant organizations and individuals.

Article 2. Principles of Support

1. Support shall be provided to each household to construct housing in accordance with the specified target group, ensuring the area and quality of housing as prescribed in Decision No. 33/2015/QĐ-TTg.

2. The provision of support must ensure democracy, transparency, fairness, and clarity, complying with laws and state policies.

3. Construction of housing must be appropriate to practical conditions, customs, and traditions of each ethnic group, region, and locality, preserving the cultural identity of each ethnic group; it should be integrated with local new rural development planning.

4. Support shall be implemented based on the principle that the State provides support through preferential interest rate loans, community assistance, and household participation to build housing meeting the prescribed standards and quality; combining with other central and local investment and support programs to enhance policy effectiveness.

5. After receiving support, households must construct new housing or repair and upgrade their existing housing. Support for housing construction shall only be provided to households that have land for housing. For households without land for housing or who have land but are located in areas frequently affected by natural disasters, landslides, and unsafe conditions, local authorities shall allocate suitable land (consistent with planning) for these households before implementing housing construction support.

Article 3. Determination of the Subjects to be Supported for Housing

1. The subjects to be supported for housing under Decision No. 33/2015/QĐ-TTg must ensure they meet all of the following conditions:

a) They are poor households (according to the poverty standard prescribed in Decision No. 09/2011/QĐ-TTg dated January 30, 2011 of the Prime Minister on issuing the poverty household standard applicable for the period 2011-2015), currently residing and having permanent residence registration at the local level, included in the list of poor households managed by the People's Committee of the commune at the time when Decision No. 33/2015/QĐ-TTg comes into effect, and are independent households established for at least five years from the date of establishment until the effective date of this Decision.

b) Households without housing or with housing that is too temporary, dilapidated, leaking, at risk of collapse, and unable to improve their housing on their own.

c) Households not yet supported for housing from state support programs and policies, other political and social organizations; in cases where they have been supported for housing through other state support programs and policies but the housing has collapsed or severely deteriorated due to natural disasters such as typhoons, floods, landslides, earthquakes, and fires, and there is no capital available for repair or reconstruction. Households that have been supported for housing through other state support programs and policies for eight years or more up to the effective date of Decision No. 33/2015/QĐ-TTg, but now the housing is deteriorated, leaking, and at risk of collapse.

2. In cases where households listed in the project's list to be supported for housing loans but have escaped poverty during the implementation of the policy, they still belong to the beneficiaries of the policy and can borrow from the Social Policy Bank.

3. Poor households that borrowed from the Social Policy Bank and other credit institutions to build housing from January 1, 2013 to the effective date of Decision No. 33/2015/QĐ-TTg, but still meet the conditions stipulated in Clause 1 of this Article, remain eligible for support under Decision No. 33/2015/QĐ-TTg and can borrow to repay the loan taken out for housing construction.

Article 4. Procedures for Establishing and Approving Lists of Poor Households to be Supported for Housing Construction

1. The village head organizes meetings to disseminate the main contents of the housing support policy for poor households to the residents; organize evaluations and propose lists of poor households eligible for housing support based on the list of poor households approved and managed by the People's Committee of the commune according to the results of the poverty survey and review at the end of 2014 (as per Decision No. 09/2011/QĐ-TTg dated January 30, 2011 of the Prime Minister on issuing the poverty household standard applicable for the period 2011-2015). The meeting must include representatives of at least 50% of the households in the village and the participation of representatives of the local government and the People's Council. ((in accordance with Model I attached to this Circular).

The evaluation follows the principles of democracy, transparency, fairness, and clarity. Households proposed for support must be agreed upon by over 50% of the participants in the meeting (through raising hands or secret ballot). Villages guide households listed as eligible for the policy to submit loan application forms for housing support and commit to building houses (in accordance with Model II attached to this Circular).

2. The list of poor households proposing to be supported for housing construction in the village is arranged in order of priority as prescribed in Decision No. 33/2015/QĐ-TTg and made public in the village. For households with two or more priorities, the higher priority is selected. For households with the same level of priority, support is implemented in the following order:

a) Households with damaged, leaking housing (constructed with cheap, low-quality materials) at risk of collapse and unsafe;

b) Households without housing (households without separate housing, currently living with parents or staying with others, renting housing - except those renting state-owned housing);

c) Households with a large number of members.

3. The People's Committee of the commune reviews, consolidates, and sends the list of poor households eligible for housing construction support to the People's Committee of the district, including clearly listing households with loan needs and those without loan needs. In cases where households belonging to the policy but without loan needs, the People's Committee of the commune should establish a list for the households to sign confirming they have been informed but are not participating in the policy (in accordance with Model III attached to this Circular).

4. The People's Committee of the district compiles and approves the list, reporting it to the People's Committee of the province. During the implementation process, if there are cases requiring adjustments to the list, they must be re-approved and reported immediately to the People's Committee of the province.

5. The People's Committee of the province organizes the establishment and approval of the Project to Support Housing for Poor Households according to the poverty standard for the period 2011-2015 in the area(in accordance with Appendix VIII attached to this CircularNo. (See Appendix VIII attached hereto); sending the Project to the Ministry of Construction, the Ministry of Planning and Investment, the Ministry of Finance, and the Social Policy Bank for consolidation and reporting to the Prime Minister, while also sending the Project to the provincial Social Policy Bank as a basis for lending.

Article 5. Methods for Building Housing

1. Technical and Quality Requirements for Housing

a) The People's Committee of the province shall direct relevant agencies to research and design at least three typical housing models suitable for the customs and traditions of each locality (accompanied by cost estimates and main material projections). Localities shall organize the introduction of these design models for people to refer to and choose from. Respect the wishes of the people, do not compel households to build housing according to the model designs. Depending on specific conditions, people may build based on experience and tradition, fitting their economic and living conditions, but must ensure minimum criteria regarding area and quality as stipulated in points b and c of this Clause. In addition to model designs, localities shall provide specific guidance for cases of repair and upgrading of housing.

b) New housing or repair and upgrade of existing housing must ensure a minimum usable area of 24 square meters (for single individuals without support, housing with a smaller usable area of at least 18 square meters may be built).

c) Housing must meet the "three hard" standards (hard floor, hard frame-wall, hard roof); the lifespan of the house must be ten years or more. The parts of the floor, frame, and roof of the house must be made from high-quality materials, not temporary, easily damaged, or flammable materials. Specifically:

- "Hard floor" refers to the house floor made from materials that increase the hardness of the floor such as cement-sand mortar, concrete, tile.

- "Hard frame-wall" includes the frame, column, wall system including the supporting foundation. Depending on specific conditions, the frame and columns can be made from reinforced concrete, steel, wood; walls can be constructed from bricks, stones, or durable wood; foundations can be made from reinforced concrete or bricks, stones.

- "Hard roof" includes the roof support system and roofing. Depending on specific conditions, the roof support system can be made from reinforced concrete, steel, wood. The roof can be made from reinforced concrete, tiled, or covered with high-quality sheets such as galvanized iron, fiber cement.

Depending on actual conditions, parts of the house can be made from locally available equivalent quality materials, ensuring usage duration. The People's Committees of provinces or authorized Construction Departments shall specify local material types (if applicable), report to the Ministry of Construction for consideration and decision.

2. Organization of Housing Construction

a) Households listed to receive support for building new housing or repairing and upgrading existing housing must submit loan application forms and commit to constructing housing (in accordance with Model II attached to this Circular), propose selection of house models and construction methods;

b) For households in difficult circumstances (elderly, alone, disabled) who are unable to construct housing themselves, the People's Committee of the commune shall direct the Communist Youth Union and other organizations in the locality to organize the construction of housing for these groups;

c) Households must inform the People's Committee of the commune when they complete tasks in stages (completion of the foundation for those building new houses, completion of 30% or more of the work volume for those repairing and improving existing houses) or completion of the entire project for acceptance by the Social Policy Bank to disburse loans;

d) The People's Committee of the commune has the responsibility to monitor, supervise, and assist households during the construction of new housing or repair and upgrade of existing housing; establish records confirming stage completion and project completion acceptance (according to Appendix IV and Appendix V attached to this Circular).

Article 6. Implementation Organization

1. Responsibilities of Central Ministries and Sectors

a) The Ministry of Construction is the permanent agency, leading and coordinating with the Ministries of Planning and Investment, Finance, Labor, Invalids and Social Affairs; the Social Policy Bank to synthesize, follow up, urge, inspect, resolve issues within their authority or submit to the Prime Minister for consideration and resolution of issues beyond their authority;

b) Ministries and sectors: Planning and Investment, Finance, State Bank of Vietnam, Government Ethnic Committee shall base on the contents of Decision No. 33/2015/QĐ-TTg and this Circular to coordinate with the Ministry of Construction to implement according to their assigned functions and responsibilities by the Government;

c) The Social Policy Bank shall perform its tasks according to Decision No. 33/2015/QĐ-TTg, based on central budget funds, the Social Policy Bank shall mobilize 50% of the total loan capital to meet the borrowing needs of policy beneficiaries. After receiving the consolidated list of poor households completing construction phases from the People's Committee of the commune, the Social Policy Bank shall process loan disbursement for poor households registered for housing loans according to regulations; provide detailed guidance on loan application procedures to ensure simplicity, clarity, ease of implementation, and processing time for loan disbursement shall not exceed three working days from the date the Social Policy Bank receives complete loan application documents.

2. Responsibilities of Provincial People's Committees and Municipal People's Committees under the Central Government

a) Strengthen the Provincial Poverty Reduction Policy Implementation Steering Committee to direct the implementation of policies to support poor households in building housing; assign the Construction Department as the permanent agency to lead the implementation of housing support policies for poor households in accordance with Decision No. 33/2015/QĐ-TTg;

b) Organize the establishment and approval of housing support programs for poor households according to the poverty standard for the 2011-2015 period in the locality in accordance with Clause 5, Article 4 of this Circular;

c) Implement housing support policies for poor households in the locality in accordance with regulations, adapting to local conditions, ensuring correct targeting, purpose, and effectiveness. Depending on actual conditions, decide to provide additional support from the local budget to improve the quality of housing for households beyond the central government's support fund;

d) Direct related agencies, local authorities at all levels to cooperate with organizations and associations in the locality, mobilize community support and assistance for poor households in building housing;

e) Report quickly monthly (in accordance with Appendix VI attached to this Circular) and report annually (in accordance with Appendix VII attached to this Circular) the results of implementation shall be submitted to the Ministry of Construction for consolidation and reporting to the Prime Minister;

g) Prepare the capital plan for implementing the policy (including all sources of capital), report on progress, and annual disbursement results to be sent to the Ministry of Construction, the Ministry of Planning and Investment, the Ministry of Finance, the State Bank, and the Social Policy Bank as the basis for consolidating the loan capital plan;

h) Direct the dissemination and popularization of the policy supporting poor households in building houses through local mass media such as newspapers, radio stations, posters, banners, leaflets. Publicize openly the criteria and beneficiaries of the policy;

i) Issue regulations guiding the contents of this Circular, ensuring compatibility with the characteristics and conditions of the locality, effectively implementing the policy supporting poor households in building houses.

3. Responsibilities of the People's Committees of districts;

a) Strengthen the Steering Committee at the district level to direct, inspect, and urge the implementation of Decision No. 33/2015/QĐ-TTg;

b) Aggregate and approve according to authority the list of poor households supported in building houses within the territory in accordance with Clause 4, Article 4 of this Circular;

c) Regularly inspect and supervise the implementation, ensuring that the policy reaches each poor household facing housing difficulties eligible for support under Decision No. 33/2015/QĐ-TTg; prevent waste and corruption; ensure that poor households have houses after receiving support as stipulated; take measures to prevent unauthorized transfer of houses; prepare a quick report on the implementation results to be sent to the Department of Construction before the 20th day of each month for consolidation and reporting to the Ministry of Construction and relevant ministries and agencies;

4. Responsibilities of Commune People's Committees

a) Strengthen the Poverty Reduction Board at the commune level to implement the Policy;

b) Review and aggregate the list of households eligible for loan support and those with loan needs to submit to the People's Committee at the district level for aggregation and approval in accordance with Clause 3, Article 4 of this Circular;

c) Organize acceptance and confirmation of completed construction volumes by phase (completion of foundation for new construction households or completion of 30% of construction work for households renovating and upgrading existing houses) and confirmation of completion of the project for use as the basis for disbursement and repayment of loans as prescribed. Each type of record shall be made in three copies: one copy retained by the household head, one copy sent to the district-level Financial and Planning Office, and one copy by the commune-level People's Committee as the basis for compiling the list of poor households completing construction volumes by phase to be sent to the Social Policy Bank for loan disbursement, not exceeding three working days;

d) Prepare completion files for each household supported in borrowing to build houses including:

- Extract the list of poor households borrowing to build houses; - Loan application form and commitment to build houses;

- Record confirming house construction completion by phase and record confirming completion of house construction for use;

- Loan vouchers for house construction.

e) The People's Committee at the commune level directs and supervises households to use borrowed funds for house construction purposes, ensuring that houses must be fully constructed for use; mobilize organizations and groups such as the Vietnam Fatherland Front, Women's Union, Farmers' Association, Veterans' Association, Ho Chi Minh Communist Youth Union to assist poor households in building houses; maximize community and household resource mobilization, utilizing and exploiting local materials such as sand, gravel, pebbles, wood to reduce house construction costs;

5. The Real Estate Management Agency has the responsibility to assist the Minister of Construction in guiding, urging, and inspecting the implementation of support for poor households in building houses; consolidate and report on the implementation situation periodically and propose amendments and supplements to be submitted to the Minister of Construction for consideration and issuance within his authority or reported to the Prime Minister for consideration and decision;

Article 7. Implementation Provisions

1. This Circular takes effect from February 16, 2016.

2. Ministries, ministerial-level agencies, People's Committees at all levels, organizations, and individuals related to this matter are responsible for its implementation. In the course of implementation, if any difficulties arise, they are requested to promptly reflect them to the Ministry of Construction for amendment and supplementation or report to the Prime Minister for consideration and decision./.
