CIRCULAR

Regulations on Inspection Team's Logbook

______________ 

Pursuant to the Inspection Law No. 56/2010/QH12 dated November 15, 2010;

Pursuant to the Decree No. 86/2011/NĐ-CP dated September 22, 2011 of the Government detailing and guiding the implementation of certain provisions of the Inspection Law;onPursuant to the Decree No. 07/2012/NĐ-CP dated February 9, 2012 of the Government on agencies assigned to perform specialized inspection functions and specialized inspection activities;

Pursuant to Circular No. 05/2014/TT-TTCP dated October 16, 2014 of the Government Inspectorate on organization, operation, work relations of Inspection Teams and procedures and formalities for conducting inspections;1At the proposal of the Director of the Legal Department of the Government Inspectorate, this Circular stipulates regulations on the Inspection Team's Logbook.

Based on Decree No. 83/2012/NĐ-CP dated October 9, 2012, of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;

This Circular stipulates the model of the Inspection Team's Logbook; issuance, recording, management, printing, and distribution of the Inspection Team's Logbook.aThis Circular applies to Heads of state administrative agencies, Heads of state inspection agencies, Heads of agencies assigned to perform specialized inspection functions, Leaders of Inspection Teams, Group Leaders within Inspection Teams (if any), and members of Inspection Teams. MODEL OF INSPECTION TEAM'S LOGBOOK, ISSUANCE, RECORDING, MANAGEMENT AND PRINTING AND DISTRIBUTION OF THE INSPECTION TEAM'S LOGBOOK Article 3. Model of the Inspection Team's Logbook

Xé t1. The Inspection Team's Logbook is rectangular in shape with a width of 21 cm and a length of 29.7 cm.policies,

Cover and pages of the Inspection Team's Logbook. a) Cover 01 has a red background with two yellow lines of text. The top line reads "Logbook" in slanted regular font with underline, size 26. The bottom line reads "INSPECTION TEAM" in bold Times New Roman font, size 36. Below these two lines is the emblem of the inspection sector, diameter 7 cm, positioned 12.5 cm from the top edge and 6 cm from both right and left edges. b) Cover 02 has a white background with a matte finish for recording information about the Inspection Team, including:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

- The agency conducting the inspection;

Article 2. Applicability

- The decision number establishing the Inspection Team;

Chapter II

- The name of the Leader of the Inspection Team;

- Deputy Leader of the Inspection Team (if any);

- Names of members of the Inspection Team;

- Supervisory Group of the Inspection Team or supervisor of the Inspection Team;

- Year of the inspection.

c) Subsequent pages of the Inspection Team's Logbook are white paper with ruled lines. On the left side of each page header is the black text "Inspection Team's Logbook" in bold regular font, size 14. Below this text, 0.3 cm away, there is a continuous black line 12 cm long. Below this line, 1 cm away, there is the text "day...month...year..." in bold italic Times New Roman font, size 14.

d) Pages of the Inspection Team's Logbook are numbered sequentially from 01 to the end, excluding cover pages.

đ) Between two pages, there is a watermark of the inspection sector's emblem, diameter 7 cm (embossed, faint).

3. The Inspection Team's Logbook used by the Government Inspectorate has a maximum thickness of 100 pages, the Logbook used by provincial inspectorates and municipal inspectorates has a maximum thickness of 70 pages. The Logbook used by county inspectorates and departmental inspectorates has a maximum thickness of 50 pages. The Inspection Team's Logbook can be divided into types of 35 pages, 50 pages, 65 pages, 75 pages, and 100 pages. Depending on specific conditions and circumstances, inspection agencies may choose appropriate types of logbooks to print and distribute efficiently and economically.

4. The Inspection Team's Logbook shall be implemented according to the Model issued together with this Circular.

- Full name of the inspection team member;

- Supervision group of the inspection team or the supervisor of the inspection team;

- Year of conducting the inspection.

c) The subsequent pages of the Inspection Team's Logbook are white paper with ruled lines. On the left side of the top of each page, there is a black printed line reading "Inspection Team's Logbook" in bold, regular font, size 14. Below this line at 0.3 cm is a continuous black line measuring 12 cm long. Below this line at 1 cm is a slanted bold line reading "day...month...year...", in the Times New Roman font, size 14.

d) The pages of the Inspection Team's Logbook are numbered sequentially from 01 to the end, excluding the cover page from being numbered.

đ) Between two facing pages, there is an embossed emblem of the inspection sector, with a diameter of 7 cm (debossed, light gray).

3. The Inspection Team's Logbook used for the Government Inspectorate's inspection team has a maximum thickness of 100 pages, the Inspection Team's Logbook used for the Ministry-level Inspectorate, provincial-level Inspectorate's inspection team has a maximum thickness of 70 pages. The Inspection Team's Logbook used for the district-level Inspectorate, department-level Inspectorate's inspection team has a maximum thickness of 50 pages. The Inspection Team's Logbook can be divided into types of 35 pages, 50 pages, 65 pages, 75 pages, and 100 pages. Depending on specific conditions and usage situations, the inspection agency selects the appropriate types of logbooks to print and distribute to ensure economy and effectiveness.

4. The Inspection Team's Logbook shall be implemented according to the Model attached to this Circular.

Article 4. Issuing and Recording the Inspection Team's Logbook

1. Issuing the Inspection Team's Logbook

a) The Inspection Team's Logbook shall be issued by the person who decides to conduct the inspection when issuing the inspection decision.

Where the Inspection Team is established by the Head of the State Management Agency through a decision, the Inspection Team's Logbook shall be issued by the Head of the Inspection Agency at the same level as the Head of the State Management Agency for the Inspection Team.

b) Each Inspection Team shall be issued one copy of the Inspection Team's Logbook. If the Inspection Team is divided into groups, the Inspection Team's Logbook may be issued to each group, as decided by the Head of the Inspection Agency.

If the Inspection Team's Logbook is not used, the Head of the Inspection Team shall be responsible for handing it over to the Office of the Agency or the specialized unit tasked with issuing the logbook to the Inspection Team.

If additional issuance of the Inspection Team's Logbook is required due to the needs of the inspection or if the Inspection Team's Logbook is lost or damaged for objective reasons, supplementary issuance or reissuance of the Inspection Team's Logbook shall be carried out according to the provisions of Article 6 of Circular No. 05/2014/TT-TTCP dated October 16, 2014, issued by the Government Inspectorate on the organization, operation, work relations of the Inspection Team, and procedures for conducting an inspection.

2. After the inspection decision is made, the Head of the Inspection Agency shall be responsible for directing the Office of the Agency or the specialized unit to issue the Inspection Team's Logbook to the Inspection Team.

The Inspection Team's Logbook issued to the Inspection Team must bear the stamp of the agency issuing the Inspection Team's Logbook. The stamp must be affixed between two pages of the Inspection Team's Logbook.

The Office or specialized unit tasked with issuing the Inspection Team's Logbook must maintain a record of the issuance of the Inspection Team's Logbook. When issuing and receiving the logbook, there must be a signature from the Head of the Inspection Team.

3. The recording, responsibility for recording, and contents recorded in the Inspection Team's Logbook shall be implemented according to the provisions of Article 5 of Circular No. 05/2014/TT-TTCP dated October 16, 2014, issued by the Government Inspectorate on the organization, operation, work relations of the Inspection Team, and procedures for conducting an inspection.

Article 5. Managing the Inspection Team's Logbook

1. The Head of the Inspection Team or Group Leader (in cases where the Inspection Team is organized into groups) shall be responsible for managing the Inspection Team's Logbook along with other documents during the inspection process.

The management and use of the Inspection Team's Logbook shall be conducted like the inspection file according to the provisions of Article 39 of Circular No. 05/2014/TT-TTCP dated October 16, 2014, issued by the Government Inspectorate.

2. The Inspection Team's Logbook is one of the documents of the inspection. At the end of the inspection, the Inspection Team's Logbook shall be kept in the inspection file and handed over to the authority responsible for managing the inspection file.

Article 6. Printing and Distributing the Inspection Team's Logbook

1. Annually, based on work requirements and the needs of agencies and units as stipulated in Clause 2, Clause 3, and Clause 4 of this Article, the Head of the National Inspection Agency shall organize the printing and distribution of the Inspection Team's Logbook according to the template guidelines of the Government Inspectorate.

2. The Chief Inspector General of the Government Inspectorate shall be responsible for organizing the printing and distribution of the Inspection Team's Logbook for the Inspection Teams of the Government Inspectorate.

3. The Chief Inspector of the Ministry shall be responsible for organizing the printing and distribution of the Inspection Team's Logbook for the Ministry's Inspection Team, specialized inspection agencies under its management, and the Provincial Inspectorate (if requested by the Provincial Inspectorate).

For vertically structured national inspection agencies with inspection units located in regions and localities, the Head of the superior inspection agency shall be responsible for organizing the printing and distribution of the Inspection Team's Logbook for subordinate inspection units under their management.

4. The Chief Inspector of the Province shall be responsible for organizing the printing and distribution of the Inspection Team's Logbook for the Provincial Inspectorate, the Municipal Inspectorate, the County Inspectorate, and specialized inspection agencies under the management of the locality.

For Municipal Inspectorates, they may register with the Ministry Inspectorate for the printing and distribution of the Inspection Team's Logbook for their own inspection agency.

Chapter III

IMPLEMENTATION

Article 7. Funding for printing the Inspection Team's Logbook

Clause 1. The funding for printing the Inspection Team's Logbook shall be provided from the state budget and included in the annual regular operating budget of the state inspection agency responsible for printing and distributing the Inspection Team's Logbook.

Clause 2. The state inspection agencies specified in Article 6 of this Circular shall be responsible for managing and using the funding for printing and distributing the Inspection Team's Logbook in accordance with the provisions of the law.

Article 8. Effective Date

Clause 1. This Circular takes effect from February 1, 2016.

Clause 2. During implementation, if there are difficulties, obstacles, or new issues arising, relevant agencies, organizations, and units shall promptly report to the Government Inspectorate for study, amendment, and supplementation to ensure compliance.
