CIRCULAR

REGULATIONS ON SPECIALIZED TRAINING, PROFESSIONAL SKILLS, AND UNIFORMS FOR THE FOREST PROTECTION FORCE OF FOREST OWNERS

Pursuant to Decree No. 15/2017/NĐ-CP dated February 17, 2017 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decision No. 44/2016/QĐ-TTg dated October 19, 2016 of the Prime Minister on the forest protection force of forest owners;

At the proposal of the Director General of the Forest Administration;

The Minister of Agriculture and Rural Development issues this Circular stipulating specialized training, professional skills, and uniforms for the forest protection force of forest owners.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

PROFESSIONAL TRAINING AND UNIFORMS

Article 2. Applicability

1. Forest owner; the forest protection force of the forest owner.

2. Organizations and individuals related.

Chapter II

a) Basic knowledge of laws related to forest management and protection;

b) Patrol and inspection techniques for forest protection;

c) Methods for preparing initial records for violations of laws in the field of forest management and timber management;

d) Fire prevention and firefighting techniques for forests;

đ) Other professional and vocational skills.

b) Training content must be regularly updated to ensure compliance with regulations and meet practical requirements.

3. Training Formats

a) Initial training shall be applied to individuals who have not yet received vocational training in forest management and protection and shall comply with the provisions of Clause 1 and Clause 2 of this Article;

b) Advanced training shall be applied to those who have participated in initial training; advanced training content shall update and supplement knowledge or provide other professional and vocational training according to the needs of the forest owner.

Article 4. Organization of Vocational Training for Forest Management and Protection

1. Forest owners are responsible for organizing professional training for their dedicated forest protection forces. By the fourth quarter of each year, forest owners are required to submit training demand applications to the Provincial Forest Protection Service under the central government or the Regional Forest Protection Service (hereinafter referred to collectively as the Forest Protection Service). The application includes:

a) A request letter specifying the time, location, budget, and proposed training content;

b) Advanced training shall be applied to those who have participated in initial training; the content of advanced training shall update, supplement knowledge or provide other specialized training, professional skills according to the needs of the forest owner.

2. The Forest Protection Service is responsible for coordinating with forest owners to organize professional training for dedicated forest protection forces; it shall implement the following tasks:

1. The forest owner shall organize specialized training and professional skills training for its forest protection force. In the fourth quarter of each year, the forest owner shall register training needs to be sent to the Provincial Forest Protection Service under the provincial or centrally governed city People's Committee or the Regional Forest Protection Service (hereinafter referred to as the Forest Protection Service). The application file includes:

b) Coordinate with forest owners to develop joint training plans for dedicated forest protection forces in the area;

c) Assign staff or invite lecturers to compile materials and conduct training;

d) Issue certificates of completion of the training course according to

Article 5. Professional training on management and use of support tools

The forest owner shall request the competent public security authority to organize training, issue, renew, reissue certificates for the use of support tools and management certificates in accordance with Circular No. 19/2016/TT-BCA dated June 2, 2016 of the Ministry of Public Security; Joint Circular No. 01/2014/TTLT-BNNPTNT-BCA dated January 22, 2014 of the Ministry of Agriculture and Rural Development and the Ministry of Public Security on equipping, managing, and using military weapons and support tools for the Forest Protection Force and the forest protection force of forest owners, and current regulations of the law on the management and use of weapons and support tools.

The budget for professional and vocational training for specialized forest protection forces shall be borne by the forest owner in accordance with Article 9 of Decision No. 44/2016/QĐ-TTg dated October 19, 2016 of the Prime Minister regarding the specialized forest protection forces of the forest owner or from other lawful sources of support.

The cost of specialized and professional skills training for the forest protection force of forest owners shall be borne by the forest owner in accordance with Article 9 of Decision No. 44/2016/QĐ-TTg dated October 19, 2016 of the Prime Minister on the forest protection force of forest owners or from legitimate sources of support.

Chapter III

This Circular takes effect from May 16, 2017.

Article 7. Uniforms of the forest protection force of forest owners

1. The uniforms of the forest protection force of forest owners include:

a) Winter and summer uniforms made according to a unified model;

b) Emblem "FOREST PROTECTION" attached to the hat;

c) Emblem "FOREST PROTECTION" attached to the sleeve;

d) Accessories accompanying the uniform.

2. Quantity and service life

3. Depending on actual conditions and climate in each area, the forest owner decides to distribute uniforms to the forest protection force of forest owners in appropriate quantities and service lives.

Article 8. Principles for managing and using uniforms

1. Uniforms shall be issued to individuals directly performing forest protection duties and who have been recruited or have a labor contract with the forest owner for at least 24 consecutive months.

2. The forest protection force of forest owners may only use uniforms for forest protection tasks and must not misuse them to violate the law.

3. The style and color of the uniforms of the forest protection force of forest owners must follow the unified model prescribed in this Circular.

Article 9. Funding

The funding for issuing uniforms for dedicated forest protection forces shall be borne by the forest owners in accordance with Article 9 of Decision No. 44/2016/QĐ-TTg dated October 19, 2016 of the Government Chairman on dedicated forest protection forces of forest owners.

Article 10. Details of Uniforms

1. Autumn-Winter Men's Clothing

a) Outer Coat

Color: heather green;

Style: button-up coat with a K-shaped collar, four buttons; front has two outside pockets with a flap pocket in the middle, the bottom corner of the flap pocket is rounded, the top corner of the flap pocket is pointed, the back has a slit and a pleat; shoulder straps are attached to wear insignia; sleeve design is like a suit jacket with a cuff, the left sleeve has the "FOREST PROTECTION" symbol; plastic buttons matching the fabric color are sewn on; inside lining matches the outer color, the front of the coat is laminated with mex mùng.

b) Inner Shirt

Color: white;

Style: long-sleeved shirt, when worn, the shirt is tucked into pants, with a wing collar for a tie, the front left side has one pocket at the bottom, the upper pocket inside has a pen holder, seven plastic buttons of white color are sewn on the placket, the sleeves have cuffs, the top corner of the cuff has a sharp cut; the back has shoulder pads, each side has a pleat.

c) Pants

Color: heather green;

Style: European-style pants with a separate waistband, two diagonal pockets; the front has two pleats on each side; the zipper is made of plastic matching the fabric color, the waistband has a hook and loop fastener, the back has pleats and two welt pockets, plastic buttons are sewn on, the waistband has six belt loops.

2. Autumn-Winter Women's Clothing

a) Outer Coat

Color: heather green;

Style: button-up coat with a K-shaped collar, four buttons; front has two under pockets with a flap pocket in the middle, the bottom corner of the flap pocket is rounded, the top corner of the flap pocket is pointed, the back has a slit and a pleat; shoulder straps are attached to wear insignia; sleeve design is like a suit jacket with a cuff, the left sleeve has the "FOREST PROTECTION" symbol; plastic buttons matching the fabric color are sewn on; inner lining matches the outer color; the front of the coat is laminated with mex mùng.

b) Inner Shirt

Color: white;

Style: long-sleeved shirt, when worn, the shirt is tucked into pants, with a wing collar for a tie, the front has a waist pleat and a side pleat, six plastic buttons of white color are sewn on the placket, the back has a waist pleat on each side, the sleeves have square cuffs.

c) Pants

Color: heather green;

Style: European-style pants with a separate waistband, no pleats in the front, two diagonal pockets on each side, the zipper is made of plastic matching the fabric color, the waistband has a hook and loop fastener inside, the back has pleats on each side of the waistband.

3. Down Jacket

a) Men's Down Jacket

Color: heather green;

Style: three-layer down jacket with a button-down collar; front has two upper pockets with flaps, the middle of the pocket has a flap pocket, the bottom corner of the flap pocket is rounded, the top corner of the flap pocket is pointed, there are two diagonal pockets below; shoulder straps are attached to wear insignia; sleeve has a cuff, the wrist has a thumb loop, the sleeve opening has a wrist band; the back has shoulder pads, the sides have side pleats, there is a drawstring and a plastic zipper on the waistband; the inside has down filling in the front, back, and sleeves, the front has two zippered inner pockets, the inside of the sleeve opening has a wrist band; the inside placket has a zipper, the outside has four plastic buttons matching the fabric color, the left sleeve has the "FOREST PROTECTION" symbol.

b) Women's Down Jacket

Color: heather green;

Style: three-layer down jacket with a button-down collar; front has two diagonal pockets below the waist; shoulder straps are attached to wear insignia; sleeve style is like a suit jacket with a cuff; the back has a cupped waist, the waist has an elastic band, there is a size-adjustable button on the waist; the inside has down filling, the front has an inner pocket, the inside of the sleeve opening has a wrist band; the placket has a zipper, four plastic buttons matching the fabric color are sewn on the outside; the left sleeve has the "FOREST PROTECTION" symbol.

4. Spring-Summer Men's Outfit

a) Jacket

Color: heather green;

Style: hemmed, belted, standing collar, front has two chest pockets with flaps, the middle of the pocket has a flap pocket, the bottom corner of the flap pocket is rounded, the top corner of the flap pocket is pointed, seven plastic buttons matching the fabric color are sewn on the placket; shoulder straps are attached to wear insignia; the back has a pleat on each side; the sides have a belt slit, plastic buttons are sewn on. Long sleeves have round cuffs, the top corner of the cuff has a sharp cut; short sleeves have the sleeve opening turned inward; the left sleeve has the "FOREST PROTECTION" symbol.

b) Pants

Color: heather green;

Style: European-style pants with a separate waistband, two diagonal pockets, the front has two pleats on each side, the zipper is made of plastic matching the fabric color, the waistband has a hook and loop fastener, the back has pleats, two welt pockets, plastic buttons are sewn on, the waistband has six belt loops.

5. Spring-Summer Women's Outfit

a) Jacket

Color: heather green;

Style: hemmed, belted, front has two shoulder pleats, chest has two outside pockets, the middle of the pocket has a flap pocket, the bottom corner of the flap pocket is rounded, the top corner of the flap pocket is pointed, plastic buttons matching the fabric color are sewn on the placket; the back has shoulder pads, each side has a pleat, the sides have a belt slit, plastic buttons are sewn on; shoulder straps are attached to wear insignia. Long sleeves have round cuffs, the top corner of the cuff has a sharp cut; short sleeves have the sleeve opening turned inward; the left sleeve has the "FOREST PROTECTION" symbol.

b) Pants

Color: heather green;

Style: European-style pants with a separate waistband, no pleats in the front, two diagonal pockets on each side, the zipper is made of plastic matching the fabric color, the waistband has a hook and loop fastener inside, the back has pleats on each side of the waistband.

6. Accessories

a) Forest Protection Emblem: Circular background color light blue, diameter 85 mm, center has a red star with yellow leaves on both sides, above the star is the text "FOREST PROTECTION";

b) Rank Badge: Circular background color light blue, diameter 35 mm, center has a red star, on both sides of the star are golden ears of corn, below is a wheel of justice with the text "FOREST PROTECTION";

c) Name Plate: Rectangular shape, dimensions 18 x 70 mm, made of metal, background color light blue, on the left is the forest protection emblem, on the right is the name of the wearer;

d) Rank Insignia

Material: woven thread, color light blue;

Polygonal shape; length 130 mm, width at the top 45 mm, width at the bottom 55 mm. The top has a gold pin with the letters BVR, the bottom has a red horizontal stripe 5 mm wide. The rank insignia has three stripes for a Forest Protection Team Leader, two stripes for a Forest Protection Officer with over five years of service, and one stripe for a Forest Protection Officer with less than five years of service;

e) Shoulder Board: Parallelogram shape, dimensions 55 x 32 mm, color light blue, inside has a plastic core, in the middle is a metal badge in silver color, the back has a pin to attach to the collar;

f) Soft Cap: Heather green color, visor cap style, the top of the cap has eight seams along its length, each side of the cap has three mesh panels. The front has a hard visor in a half-moon shape, above the visor is a place to attach a star. The back has a plastic strap matching the fabric color to adjust the size;

g) Hard Helmet: The core is made of synthetic plastic; the helmet cover is heather green; the chin strap is made of leather or recycled plastic.

h) Uniform jacket: Dark heather gray color, pre-sewn potato shape style, with zipper for adjusting width according to user requirements;

i) Belt: Made of leather or synthetic material, dark brown color, 35 mm wide; type with a fixed internal clasp, gold color, with the letters "BVR" printed in the center of the buckle;

k) Leather shoes: Low-cut style, black color, lace-up; men's shoes have a 3 cm sole height, women's shoes have a 5 cm sole height;

l) Forest walking shoes: Made of green heather fabric, high-top style, lace-up;

m) Socks: Cotton material, green heather color.

7. This Circular accompanies models of uniforms and accessories that go with the uniforms.

Chapter IV

IMPLEMENTING PROVISIONS

Article 11. Effective Date

This Circular takes effect from May 16, 2017.

Article 12. Responsibility for Implementation

1. The Director of the Forestry General Department shall be responsible for directing specialized agencies to inspect and urge the implementation of this Circular.

2. Directors of Provincial Departments of Agriculture and Rural Development under central municipalities shall be responsible for directing subordinate units and forest owners to organize the implementation of this Circular.

3. Forest owners, relevant organizations, and individuals shall be responsible for implementing this Circular.

4. In the course of implementation, if there are difficulties or obstacles, heads of agencies, units, and forest owners shall report them to the Ministry of Agriculture and Rural Development for timely guidance./.
