Issuing "National Technical Regulation on Lighting Products using LED Technology"

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;
Pursuant to Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain provisions of the Law on Standards and Technical Regulations and Decree No. 78/2018/NĐ-CP dated August 16 the 5 year 2018 of the Government amending and supplementing some articles of Decree number 127/2007/NĐ-CP;
Pursuant to Decree No. 95/2017/NĐ-CP dated August 16, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;
At the proposal of the General Director of the Standardization, Measurement and Quality Control Agency and the Director of the Legal Department;
The Minister of Science and Technology issues this Circular to promulgate the "National Technical Regulation on Lighting Products using LED Technology"”.
Article 1. This Circular includes the National Technical Regulation on Lighting Products using LED Technology (QCVN 19:2019/BKHCN).
Article 2. This Circular shall take effect from December 31, 2019
Products specified in the Appendix attached to QCVN 19:2019/BKHCN that are produced domestically or imported before the date stipulated in Clause 1 and Clause 2 of Article 4 of this Circular may continue to be circulated in the market until June 1, 2022.
Article 4. Implementation timeline for QCVN
1. As of June 1, 2020, lighting products using LED technology that are produced domestically or imported and specified in the Appendix attached to QCVN 19:2019/BKHCN must meet safety requirements and electromagnetic interference (EMI) limits set out in Sections 2.1.1; 2.1.2; 2.1.3 and 2.2.1 of QCVN 19:2019/BKHCN before being circulated in the market.
3. Enterprises, organizations, and individuals producing or importing lighting products using LED technology are encouraged to apply the provisions of QCVN 19:2019/BKHCN from the date this Circular takes effect.
Article 5. Implementation
1. The Director of the General Department of Standardization, Metrology, and Quality Control shall be responsible for organizing guidance and implementation of this Circular.
2. The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairmen of People's Committees of provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Circular.
3. During implementation, if any difficulties arise, agencies, organizations, and individuals should promptly report them in writing to the Ministry of Science and Technology for guidance or research on amendments and supplements as necessary./.
