CIRCULAR

Regulations on the list of products exploiting and using information

in the National Population Database

Pursuant to the Law on Identity Cards dated November 20, 2011;

Based on the Residence Law dated November 13, 2020;

Pursuant to Decree No. 137/2015/NĐ-CP dated December 31, 2015 of the Government detailing certain provisions and measures for implementing the Law on Identity Cards;

Pursuant to Decree No. 37/2021/NĐ-CP dated March 29, 2021 of the Government amending and supplementing certain articles of Decree No. 137/2015/NĐ-CP dated December 31, 2015 of the Government detailing some provisions and measures for implementing the Law on Identity Cards;

Pursuant to Decree No. 47/2020/NĐ-CP dated April 9, 2020 of the Government stipulating management, connection, and sharing of digital data of state agencies;

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

1. Amending and supplementing Clause 2 and Clause 3 of Article 3 as follows:

The Minister of Public Security promulgates this Circular regulating the list of products exploiting and using information in the National Population Database.

Article 1. Scope of Regulation

This Circular regulates the list of products exploiting and using information in the National Population Database.

Article 2. Applicability

1. The managing agency of the National Population Registry.

2. Agencies, organizations, and individuals specified in Article 2 and Article 8 of Decree No. 137/2015/NĐ-CP dated December 31, 2015 of the Government detailing some provisions and measures for implementing the Law on Identity Cards, as amended and supplemented by Decree No. 37/2021/NĐ-CP dated March 29, 2021.

Article 3. Products exploiting and using information in the National Population Database

1. Products exploiting and using information in the National Population Database include SMS messages, electronic texts, and paper texts provided by the agency managing the National Population Database to agencies, organizations, and individuals.

2. The list of products exploiting and using information in the National Population Database (based on the quantity of information) includes:

a) Verification of citizen information through SMS messages, electronic texts, and paper texts (code SPDC01);

b) SMS messages responding to requested information exploitation results (code SPDC03);

c) Electronic texts responding to exploitation information results via the public service portal (code SPDC03);

d) Electronic texts responding to exploitation information results via software applications (code SPDC04);

đ) Paper texts responding to requested information provision results (code SPDC05);

e) Statistical results in electronic texts and paper texts (code SPDC06);

g) Statistical and analytical results in electronic texts and paper texts (code SPDC07);

h) Statistical, analytical, and predictive results in electronic texts and paper texts (code SPDC08).

Article 4. Effective date

This Circular takes effect from March 14, 2022.

Article 5. Responsibilities for Implementation

1. The Director of the Administrative Police Department under the Ministry of Public Security shall be responsible for guiding, inspecting, monitoring, and urging the implementation of this Circular.

2. Heads of units under the Ministry of Public Security, Provincial Police Chiefs, Chief of Municipal Police Departments directly under the Central Government, and related agencies, organizations, and individuals shall be responsible for implementing this Circular.

3. During the implementation of this Circular, if there are difficulties or obstacles, local police units, agencies, organizations, and individuals related to the matter shall report to the Ministry of Public Security (through the Administrative Police Department) for timely guidance./.
