Pursuant to Decree No.85/2016/ND-CP July 1, 2016 Government Decree on ensuring the security of information systems according to levels;

At the proposal of the Minister of Information and Communications;

The Prime Minister issues this Decision on the Special-Purpose Data Transmission Network for Party and State Agencies.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decision stipulates principles of operation; organization, management, and operation; services and applications; connection; information security assurance; quality; funding for the provision and use of services of the Special Data Network for use by Party and State organizations (hereinafter referred to as the Special Data Network).

Article 2. Applicability

1. Central-level Party and State organizations, the Vietnam Fatherland Front, and member political-social organizations; Provincial Party Committees, Municipal Party Committees, People's Councils, and People's Committees of centrally governed cities as specified in Appendix I attached hereto.

2. Local-level Party and State organizations, the Vietnam Fatherland Front, and member political-social organizations as specified in Appendix II attached hereto.

3. The Central Post Office.

4. Organizations and enterprises related to the provision of Special Data Network services.

Article 3. Explanation of Terms

In this Decision, the following terms shall be understood as follows:

1. The Special Data Network is a network connecting Party and State organizations, organized and managed uniformly to ensure quality, safety, and confidentiality of information for the exchange and sharing of data between Party and State organizations.

2. The backbone network is a system of intermediate networks serving to relay connections between internal networks, data centers, and information systems of using organizations with each other. The backbone network includes the following components:

a) Regional center is a system comprising data centers, network equipment, security devices, transmission channels, and auxiliary systems installed to relay connections between the Northern, Central, and Southern regions and within a region;

b) Backup center is a regional center serving to ensure information security and restore connections and services in case of incidents affecting the regional center;

c) Urban network is a system comprising network equipment, security devices, transmission channels, and auxiliary systems installed to relay connections for central-level Party and State organizations in Hanoi, Da Nang, Ho Chi Minh City, and up to the regional center;

d) Provincial center is a system comprising network equipment, security devices, transmission channels, and auxiliary systems installed to relay connections for local-level Party and State organizations and up to the regional center;

đ) Connection gateways are network devices, security devices, or other equivalent devices providing interfaces for connections between provincial centers, urban networks, and end-user devices of the access network.

3. The access network is a system comprising terminal equipment and transmission channels serving connections from internal networks, data centers, and information systems of using organizations to the backbone network. The access network includes Level I access network with a scope of connection from the central level to the provincial level and Level II access network with a scope of connection from the provincial level to the commune level.

4. The network operation and maintenance center is a center comprising station infrastructure, hardware and software systems, and auxiliary systems installed to operate, monitor, and control access to the backbone network and access network within a region.

5. The national network management center is a center comprising station infrastructure, hardware and software systems, and auxiliary systems installed to manage, operate, monitor, and control access to the backbone network and access network nationwide.

6. Using organizations are Party and State organizations, the Vietnam Fatherland Front, and member political-social organizations at the central and local levels.

Article 4. Principles of Operation of the Specialized Data Transmission Network

The Special-Purpose Data Transmission Network shall be established and maintained in accordance with the following principles:

1. Uniformity in organization, management, connection, and ensuring information security.

2. Ensuring quality, security, and confidentiality of information.

3. Connecting, interlinking, and sharing data between Party and State agencies on the Specialized Data Transmission Network.

4. The Specialized Data Transmission Network shall be centrally monitored and controlled.

Chapter II

PROVISIONS ON THE SPECIAL-PURPOSE DATA TRANSMISSION NETWORK

Article 5. Organization, Management, and Operation

1. The Specialized Data Transmission Network has a scope of connection from central to commune level, providing services for the agencies specified in Clause 1 and Clause 2 of Article 2 of this Decision.

2. The Specialized Data Transmission Network shall be organized and managed as follows:

a) The main network directly managed by the Central Post Office includes three regional centers, three urban networks, and gateways in Hanoi, Da Nang, and Ho Chi Minh City; three backup centers; provincial centers and gateways in provinces and centrally-administered cities.

b) Access network: Level I access network directly managed and operated by the Central Post Office through centralized management platforms at the network operation center to provide services for the agencies specified in Clause 1 of Article 2 of this Decision; Level II access network directly managed and operated by specialized information technology units of ministries, sectors, and localities, or leased from telecommunications enterprises to provide services for the agencies specified in Clause 2 of Article 2 of this Decision.

c) The network operation center in Hanoi and three network operation centers in Hanoi, Da Nang, and Ho Chi Minh City are directly managed and operated by the Central Post Office.

Article 6. Services and Applications

1. Services provided on the Specialized Data Transmission Network include:

a) Virtual private network services;

b) Video conferencing services;

c) Specialized Internet access service provided to the Central Party Office, the Government Office.

d) Other services as prescribed by the Ministry of Information and Communications.

2. Applications on the Specialized Data Transmission Network include:

a) Applications serving Party agencies.

b) Applications serving e-Government and digital government.

c) Applications serving the National Assembly.

d) Applications serving government directives and operations.

e) Other applications serving Party and State agencies.

Article 7. Connection

1. Components of the Specialized Data Transmission Network connect with each other using transmission infrastructure, ensuring redundancy for connections within the main network and from the main network to Level I access network.

2. Agencies and organizations using services specified in Clause 1 and Clause 2 of Article 2 of this Decision connect with each other through the main network.

3. The Specialized Data Transmission Network connects with other telecommunications networks and information systems to serve e-Government and digital government.

4. Ensuring uniformity of IP address resources and routing.

Article 8. Ensuring Information Security

1. The Specialized Data Transmission Network and connected information systems are secured according to the levels prescribed in Decree No. 85/2016/ND-CP dated July 1, 2016 of the Government on securing information systems by level and relevant laws.

2. Data centers, information systems, and gateways must check for information security assurance and fix security vulnerabilities (if any) before connecting to the Specialized Data Transmission Network; regular checks are conducted as prescribed by the Ministry of Information and Communications.

3. The Specialized Data Transmission Network is monitored for information security and centrally controlled access to end devices of the access network through the use of centralized management platforms and systems.

4. Internal information systems and networks of agencies and organizations using services must share computer, server, and other IT device monitoring information participating in the Specialized Data Transmission Network with the network operation center.

Article 9. Quality

1. Specialized Data Transmission Network services must meet technical quality standards and service quality standards as prescribed by the Ministry of Information and Communications.

2. The Specialized Data Transmission Network must ensure continuous service provision for 24 hours a day and 7 days a week, including holidays and Tet.

3. The Specialized Data Transmission Network must be regularly inspected, reviewed, evaluated, and upgraded to ensure service quality.

Article 10. Funding for Operation and Service Provision of the Special-Purpose Data Transmission Network

1. The central budget ensures funding for investment, modernization, upgrading, and maintaining the operation of the main network, Level I access network, network operation center, and network operation centers (including infrastructure and transmission channel rental costs) to provide free-of-charge services for the agencies specified in Clause 1 of Article 2 of this Decision; ensuring funding for establishing and maintaining centralized management platforms and systems for the entire Specialized Data Transmission Network.

2. Local budgets ensure funding for investment, maintenance, and service usage of the Specialized Data Transmission Network for the agencies specified in Clause 2 of Article 2 of this Decision according to current regulations on state budget management and use.

Chapter III

IMPLEMENTATION

Article 11. Rights and Responsibilities of the Central Post Office Administration

1. Managing, monitoring, and controlling access to the Specialized Data Transmission Network to ensure quality, security, and confidentiality of information.

2. Directly operating the main network, Level I access network, network operation center, and network operation centers.

3. Establishing centralized management platform accounts; transferring them to agencies and organizations using services within their jurisdiction.

4. Leading and coordinating with relevant agencies, organizations, and telecommunications enterprises to implement network connections, technical troubleshooting, and service quality, security, and confidentiality assurance.

5. Receiving funding from the central budget for investment, modernization, upgrading, and maintaining the operation of the main network, Level I access network, network operation center, and network operation centers (including infrastructure and transmission channel rental costs), and centralized management platforms and systems for the entire Specialized Data Transmission Network.

Article 12. Rights and responsibilities of agencies and organizations using the service

1. Agencies specified in Clause 1 of Article 2 of this Decision may use Specialized Data Transmission Network services without paying service fees.

2. Agencies specified in Clause 2 of Article 2 of this Decision use services within the operational scope of the Specialized Data Transmission Network and purchase services according to current regulations on state budget management and use.

3. Conduct security checks for data center safety, information systems, and internal networks before connecting to the Specialized Data Transmission Network and perform periodic inspections as prescribed in Decree No. 85/2016/NĐ-CP and regulations of the Ministry of Information and Communications.

4. Monitor information security, control access to data centers, information systems, and internal networks when connected to the Specialized Data Transmission Network, and share monitoring information as prescribed in this Decision and guidelines from the Ministry of Information and Communications.

5. Ensure stable and continuous operation of infrastructure equipment installed, protect equipment and infrastructure of the Specialized Data Transmission Network located at agencies according to regulations of the Ministry of Information and Communications.

6. Be responsible for the content and information transmitted on the Specialized Data Transmission Network in accordance with relevant laws.

Article 13. Responsibilities of organizations and enterprises related to service provision activities

1. Implement service regulations, connection procedures, information security assurance, and quality as prescribed in this Decision and regulations of the Ministry of Information and Communications.

2. Ensure the operation of transmission infrastructure serving level II access networks.

3. Coordinate with the Central Post Office to implement connections to the Specialized Data Transmission Network ensuring continuous, high-quality, secure, and confidential information services.

4. Coordinate with related units to inspect and handle technical issues, ensure service quality, security, and confidentiality of information.

Article 14. Responsibilities of the Ministry of Information and Communications

1. Develop plans or projects to enhance the design and development of the Specialized Data Transmission Network to improve service quality, meeting requirements at each stage of development.

2. Issue regulations on services, connections, information security assurance, and quality on the Specialized Data Transmission Network and direct the implementation of this Decision.

3. Periodically assess and decide on adjustments to channel capacity to meet usage requirements of central Party and State agencies.

4. Inspect the implementation of legal provisions governing the operation of the Specialized Data Transmission Network.

5. Lead and coordinate with agencies and organizations using the Specialized Data Transmission Network to review and evaluate the implementation of this Decision, propose amendments and supplements, and submit them to competent authorities for decision.

6. Prioritize public investment funds for upgrading and modernizing the Specialized Data Transmission Network.

Article 15. Responsibilities of the Government Cryptographic Agency

Lead and coordinate with related agencies and units to ensure confidentiality for information systems containing classified data on the Specialized Data Transmission Network in accordance with the Cryptographic Law and the Law on Protecting State Secrets.

Article 16. Responsibilities of the Ministry of Finance

Lead and coordinate with the Ministry of Information and Communications to ensure funding from the state budget for the operation of the Specialized Data Transmission Network and the use of its services by Party and State agencies as stipulated in this Decision.

Article 17. Responsibilities of the Ministry of Planning and Investment

Lead and coordinate with the Ministry of Information and Communications to allocate public investment funds for upgrading and enhancing the Specialized Data Transmission Network.

Article 18. Responsibilities of People's Committees of Provinces and Cities under Central Administration

1. Manage the provision and use of services of the Specialized Data Transmission Network within their jurisdiction in accordance with this Decision and relevant laws.

2. Deploy level II access networks in compliance with operational, connection, and information security regulations as prescribed in this Decision and regulations of the Ministry of Information and Communications.

3. Issue Regulations on management, operation, connection, information security assurance, and use of the Specialized Data Transmission Network at the local level.

4. Ensure funding from the local budget for the operation and use of the Specialized Data Transmission Network at the local level.

Chapter IV

IMPLEMENTING PROVISIONS

Article 19. Implementation Provisions

1. This Decision takes effect from June 1, 2023.

2. The Minister, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Committees at all levels, and related agencies, organizations, and individuals are responsible for implementing this Decision.
