CIRCULAR

REGULATIONS ON FORMS IN THE ACTIVITY OF REGISTERING COPYRIGHT AND RELATED RIGHTS

Pursuant to the Intellectual Property Law dated November 29, 2005; the Law Amending and Supplementing Certain Provisions of the Intellectual Property Law dated June 19, 2009; the Law Amending and Supplementing Certain Provisions of the Insurance Business Law and the Intellectual Property Law dated June 14, 2019; and the Law Amending and Supplementing Certain Provisions of the Intellectual Property Law dated June 16, 2022;

Pursuant to Decree No. 17/2023/NĐ-CP dated April 26, 2023 of the Government detailing certain provisions and providing measures to implement the Intellectual Property Law on copyright and related rights;

Pursuant to Decree No. 01/2023/NĐ-CP dated January 16, 2023 of the Government providing for the functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director of the Copyright Office;

The Minister of Culture, Sports and Tourism promulgates this Circular stipulating forms in the activity of registering copyright and related rights.

Article 1. Scope of Regulation

This Circular stipulates forms for Copyright Registration Application Forms, Related Rights Registration Application Forms, Copyright Registration Certificates, and Related Rights Registration Certificates.

Article 2. Applicability

This Circular applies to agencies, organizations, and individuals participating in the activity of registering copyright and related rights.

Article 3. Forms issued together with this Circular

Issued together with this Circular are the following forms:

1. Appendix 1 - Copyright Registration Application Form; Related Rights Registration Application Form:

a) Form No. 01: Copyright Registration Application Form for literary works; scientific works; lecture papers, speech papers, and other speaking papers; data compilations; press works; folk literary and artistic works, and other works expressed in writing or other characters;

b) Form No. 02: Copyright Registration Application Form for applied art works;

c) Form No. 03: Copyright Registration Application Form for computer programs;

d) Form No. 04: Copyright Registration Application Form for musical works;

đ) Form No. 05: Copyright Registration Application Form for fine art works, photographic works;

e) Form No. 06: Copyright Registration Application Form for cinematographic works, stage works;

g) Form No. 07: Copyright Registration Application Form for textbooks, teaching materials;

h) Form No. 08: Copyright Registration Application Form for architectural works, drawings, diagrams, maps, and drawings related to topography, architecture, and scientific projects;

i) Form No. 09: Related Rights Registration Application Form.

2. Appendix 2 - Copyright Registration Certificate; Related Rights Registration Certificate:

a) Form No. 01: Copyright Registration Certificate;

b) Form No. 02: Related Rights Registration Certificate. The forms prescribed in this Article are designed for A4 paper size.

Article 4. Effective date

1. This Circular takes effect from July 15, 2023.

2. Repeal Circular No. 08/2016/TT-BVHTTDL dated July 2, 2016 of the Minister of Culture, Sports and Tourism stipulating forms in the activity of registering copyright and related rights.

Article 5. Transitional Provisions

1. In cases where copyright and related rights registration applications are submitted to competent state authorities before the effective date of this Circular but have not yet been issued Copyright Registration Certificates or Related Rights Registration Certificates, they shall continue to be processed according to the provisions of existing legal documents at the time of application submission.

2. Copyright Registration Certificates and Related Rights Registration Certificates issued before the effective date of this Circular shall continue to maintain their validity.

Article 6. Responsibilities for Implementation

1. Agencies, organizations, and individuals participating in the activity of registering copyright and related rights are responsible for implementing this Circular.

2. During implementation, if any difficulties arise, agencies, organizations, and individuals should promptly report them to the Ministry of Culture, Sports and Tourism (through the Copyright Agency) for research and appropriate amendments and supplements.
