of the Diplomatic Academy under the Ministry of Foreign Affairs

Pursuant to the Law on the Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on the Organization of the Government and the Law on the Organization of Local Administrative Bodies November 22, 2019;
Pursuant to Decree No. 81/2022/NĐ-CP dated October 14, 2022, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Foreign Affairs;
Pursuant to Decree No. 60/2021/ND-CP dated June 21, 2021 of the Government stipulating the financial autonomy mechanism for public service units;
At the proposal of the Minister of Foreign Affairs;
The Prime Minister issues this Decision to stipulate the functions, tasks, powers, and organizational structure of the Diplomatic Academy under the Ministry of Foreign Affairs.
Article 1. Position and Functions
1. The Diplomatic Academy is a public service unit under the Ministry of Foreign Affairs, performing the following functions: strategic research; undergraduate and graduate education; professional training; advising and consulting for the Ministry of Foreign Affairs in the fields of foreign relations and international integration.
2. The Diplomatic Academy has its own legal personality and separate bank account, is authorized to use a seal with the National Emblem, and its main office is located in Hanoi, with the English name Diplomatic Academy of Vietnam, abbreviated as DAV.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Diplomatic Academy (hereinafter referred to as the Academy) shall have the following tasks and powers:
1. On scientific research and policy consultation:
a) Conduct scientific research and strategic forecasting on regional and international issues that affect the environment, foreign activities, and national interests of Vietnam;
b) Fulfill the task of providing advice, proposals, and scientific evidence for the Ministry of Foreign Affairs in formulating and implementing foreign policies and other related areas according to assigned functions and when requested;
c) Research, promote, and educate about the history and traditions of Vietnamese diplomacy;
d) Organize research on issues related to the protection of sovereignty, sovereign rights, and jurisdictional rights of Vietnam as prescribed by Vietnamese laws and international law;
đ) Cooperate in research and academic exchanges with organizations and individuals both domestically and internationally on issues related to the environment, foreign activities, and national interests of Vietnam;
e) Advise, compile, and act as a focal point in organizing and managing scientific research, technology, and innovation activities of the Ministry of Foreign Affairs.
2. On undergraduate and graduate education:
a) Offer undergraduate and graduate programs serving foreign relations and international integration, meeting diverse societal needs, aligning with the Academy's development orientation, and complying with legal regulations;
b) Develop educational programs, establish and implement short-term and long-term training plans with various scales, forms, and advanced methods;
c) Apply advanced standards to improve and enhance the quality of education; organize the implementation of quality assurance processes according to domestic and international standards, in compliance with legal regulations;
d) Organize admissions, training, and evaluation of training outcomes, recognize and issue bachelor’s, master’s, doctoral degrees, and other certificates and diplomas in accordance with legal regulations;
đ) Collaborate in training through appropriate forms with academies, universities, and organizations both domestically and internationally within the scope of assigned functions, tasks, and powers;
e) Organize and manage cultural, sports, and aesthetic activities; political and ideological education, enhancing students' awareness of law enforcement and general social ethical standards.
3. On professional training in foreign affairs and language skills:
a) Develop and submit to the Minister of Foreign Affairs for approval annual training programs and plans, and organize their implementation to train and upgrade the knowledge, skills, and language abilities of civil servants and officials in the field of foreign relations and international integration nationwide, in accordance with legal regulations;
b) Organize research on contents serving training and upgrading knowledge, skills, and language abilities in the field of foreign relations and international integration;
c) Upgrade the knowledge, skills, and language abilities of civil servants and officials in the field of foreign relations and international integration, enhancing their capacity to work in an international environment, according to specialized fields and areas managed by the Ministry of Foreign Affairs and assigned by competent authorities;
d) Train, assess, and evaluate the professional expertise, skills, and language abilities of civil servants and officials of the Ministry of Foreign Affairs;
đ) Train management knowledge according to civil servant grade standards and vocational career standards; train knowledge and skills according to job requirements for leadership and management positions and specialized technical positions as stipulated by law and delegated authority;
e) Cooperate with domestic and international partners in training and upgrading according to assigned functions, tasks, and powers and at the request of organizations and individuals.
4. Organize foreign relations activities as directed by the Ministry of Foreign Affairs to contribute to the implementation of the Party and State's foreign policy, including:
a) Implement diplomatic activities with foreign government delegations, international organizations visiting Vietnam, and diplomatic missions in Vietnam as assigned by the Minister of Foreign Affairs;
b) Develop a network of partners consisting of research institutes, universities, scholars, journalists, politicians, businesses, individuals, etc., with influence both domestically and internationally; promote relations with this network of partners to serve the common foreign relations mission of the Party and State;
c) Negotiate and sign cooperation agreements with partners within the scope of assigned functions and tasks;
d) Implement bilateral and multilateral diplomatic activities in Vietnam and abroad within the scope of responsibility and as assigned by the Minister of Foreign Affairs;
đ) Organize and coordinate Vietnam's academic cooperation and exchange activities in regional and international academic networks;
e) Organize special foreign relations activities as directed by the Ministry of Foreign Affairs.
5. Information and documentation work:
a) Establish, submit to the competent authority for approval and implementation of the annual program and plan of activities of the International Research Journal.
b) Compile, edit, publish and distribute books, journals, scientific research works, teaching materials, lecture notes, and other publications on foreign affairs, the history of Vietnamese diplomacy and the world, international relations, diplomatic skills, and other fields related to the assigned functions and tasks.
c) Participate in implementing external information work, propaganda of the Party's and State's foreign policy, history, diplomatic traditions, and issues related to national interests of Vietnam.
d) Store, preserve, manage and utilize information and materials within the scope of management and according to the classification level of the Ministry of Foreign Affairs.
đ) Manage, collect, preserve, and display objects related to the history and tradition of diplomacy.
e) Manage, utilize, maintain and repair diplomatic heritage sites authorized by the Ministry of Foreign Affairs.
6. Implement the mechanism of financial autonomy for public service units in accordance with the provisions of the law and the Ministry of Foreign Affairs.
7. Recruit, organize and manage the organizational structure, staff establishment, and number of employees; implement various systems and policies; train and develop; promote and reward and discipline civil servants and workers of the Academy in accordance with the provisions of the law and the Ministry of Foreign Affairs.
8. Organize citizen reception, handle complaints and accusations, implement anti-corruption measures in the Academy's operations in accordance with the provisions of the law and the Ministry of Foreign Affairs.
9. Organize the implementation of administrative reform tasks, digital transformation, application of technology for electronic government and digital government development according to the program, plan, and division of labor by the Minister of Foreign Affairs; implement reporting systems as prescribed by law and the Ministry of Foreign Affairs.
10. Implement state regulations and those of the Ministry of Foreign Affairs regarding administrative work, archival management, state secret protection, ensuring agency safety, and labor discipline; protect and use assigned documents and assets in accordance with the provisions.
11. Provide public services and other activities consistent with assigned functions, tasks, and authorities in accordance with the law.
12. Perform other tasks assigned or delegated by the Minister of Foreign Affairs.
Article 3. Organizational Structure
1. Units under the Diplomatic Academy include:
a) Institute of Diplomatic Strategy Research;
b) Institute of the South China Sea;
c) University and Postgraduate Training Department;
d) Training and Diplomatic Cadre Development Department;
đ) Science, Information and International Research Journal Department;
e) Office;
g) Department of International Politics and Diplomacy;
h) Department of International Law;
i) Department of International Economics;
k) Department of Communication and Foreign Cultural Relations;
l) Department of Foreign Languages.
2. The Minister of Foreign Affairs shall stipulate the functions, tasks, authorities, and organizational structure of these units; appoint and dismiss the heads and deputy heads of these units as provided in Clause 1 of this Article.
Article 4. Leadership of the Academy
1. The Academy Council is the governing body of the Diplomatic Academy, representing the Ministry of Foreign Affairs, established, organized, and operates in accordance with the law. The Academy Council and its Chairman are recognized by the Minister of Foreign Affairs and are responsible to the Minister of Foreign Affairs and the law for performing their assigned responsibilities and tasks.
2. The Academy Management Board consists of the Director and not more than three Deputy Directors appointed and dismissed in accordance with the regulations.
3. The Management Board establishes and submits to the Academy Council for approval the Working Regulations of the Academy; decides within its authority on the establishment, merger, restructuring, and appointment and dismissal of leading and managerial officials of departments, centers, and organizations constituting units under the Academy in accordance with the law and the Ministry of Foreign Affairs' management classification.
Article 5. Effectiveness and Responsibility for Implementation
1. This Decision takes effect from August 15, 2024, and replaces Decision No. 07/2019/QĐ-TTg dated February 15, 2019, of the Prime Minister stipulating the functions, tasks, authorities, and organizational structure of the Diplomatic Academy.
2. The Minister, Heads of Ministries at the ministerial level, Heads of agencies under the Government, Chairmen of Provincial People's Committees directly under the central government, and the Director of the Diplomatic Academy are responsible for enforcing this Decision.
