GUIDELINES FOR SAMPLE STAMPS, STAMP ENGRAVING AND MANAGEMENT, USE OF STAMPS OF ECONOMIC ORGANIZATIONS
STAMPS OF ECONOMIC ORGANIZATIONS
Pursuant to Decree No. 56/CP dated March 17, 1996 of the Council of Ministers on the management and use of stamps in agencies, enterprises, and social organizations.
Pursuant to Decision No. 90/HĐBT dated July 19, 1989 of the Council of Ministers supplementing Decree No. 56-CP.
Pursuant to the decrees and decisions of the Council of Ministers stipulating policies for current economic sectors.
The Ministry of Home Affairs issues this Circular guiding sample stamps, stamp engraving organization, management, and use of stamps of economic organizations belonging to all economic sectors throughout the country as follows:
I. ECONOMIC ORGANIZATIONS PERMITTED TO USE SEPARATE STAMPS FOR OPERATIONS (REFER TO PART B OF ARTICLE 2 OF DECISION 90/HĐBT)
INCLUDING:
1. State-owned economic organizations as prescribed in the Factory Regulations of State-Owned Industrial Enterprises issued pursuant to Decree No. 50-HĐBT dated March 12, 1988 of the Council of Ministers.
2. Joint venture organizations as prescribed in the Regulations of Joint Venture Factories in Production, Business, and Services issued pursuant to Decree No. 29-HĐBT dated March 22, 1989 of the Council of Ministers.
3. Organizations jointly established with foreign entities as prescribed in Decree No. 139/HĐBT dated September 5, 1988 of the Council of Ministers detailing the implementation of the Law on Foreign Investment in Vietnam.
4. Collective economic organizations as prescribed in the Provisions on Policies for Collective Economic Units in Agricultural Production, Industrial Services, Construction, and Transportation issued pursuant to Decree No. 28-HĐBT dated March 9, 1988 of the Council of Ministers.
5. Private industrial enterprises (referred to as private enterprises), small-scale industrial households as prescribed in the Provisions on Policies for Individual Economy and Private Enterprises in Industrial Production, Industrial Services, Construction, and Transportation issued pursuant to Decree No. 27/HĐBT dated March 9, 1988 of the Council of Ministers.
6. Production and service organizations of administrative agencies and mass organizations as prescribed in Decision No. 92/CT dated April 22, 1989 of the Chairman of the Council of Ministers regarding administrative agencies and mass organizations engaging in business.
These economic organizations include various types of production bases, business units, services, etc., named as follows:
- Factory, enterprise, integrated enterprises, company, Group Company;
- Public-private joint ventures;
- High-level cooperatives, low-level cooperatives, cooperative groups;
- Private enterprises, private companies, joint-stock companies, private groups;
- Small-scale industrial base, workshop, store;
- Joint venture enterprises, joint venture companies, production centers, service centers, research centers, etc.
These organizations have been authorized by competent authorities according to state regulations to establish or issue production and business licenses, granted autonomy in production and business operations, have separate accounting, and during their economic activities can act in their own name when transacting with state agencies, social organizations, and the public.
II. REGULATIONS ON SAMPLE STAMPS.
1. Shape, size, and border.
All economic organizations belonging to the economic sectors mentioned in Part I of this Circular shall use stamps:
- Shape: Circular
- Size: Diameter 34 mm.
- The stamp has two borders: The outer border consists of two adjacent circles, the outer circle being bold, the inner circle being thin; the inner border is a single circle; the two borders are separated by 5 mm.
2. Content:
- The upper outer ring of the stamp shall be engraved with the establishment decision number or the production and business registration permit number, accompanied by abbreviated letters indicating the economic sector of the organization (if it belongs to the state-owned economic sector, it shall be engraved with ".Đ"; if it belongs to the collective economic sector, it shall be engraved with "K.T.T.T"; if it is a domestic joint venture economic organization, it shall be engraved with "L.D"; if it is a joint venture economic organization with foreign entities, it shall be engraved with "L.D.N.NG", etc.).
- The lower outer ring of the stamp shall be engraved with the name of the locality where the economic organization is headquartered.Article 24There are two small stars separating the upper and lower outer rings.
The name of the economic organization shall be engraved according to the name recorded in the establishment decision or business registration permit.

- AT III. REGULATIONS ON STAMP ENGRAVING AND MANAGEMENT.
1. Handling stamp engraving matters:
Provincial, municipal, and central special zone police forces are responsible for handling stamp engraving matters or issuing introduction letters for economic organizations (including central economic organizations located in localities) to engraving facilities under police management; subsequently, they must register and file copies of the newly engraved stamps before providing them to the organizations for use.
2. Procedures for stamp engraving:
a) For newly established economic organizations (when applying to provincial, municipal, or central special zone police forces for stamp engraving procedures), they must present the original and submit a copy of the establishment decision or production and business registration permit issued by the competent authority as stipulated in the decrees and decisions of the Council of Ministers for each type of economic organization, along with a copy of the identification card of the person directly contacting the engraving process.
b) For economic organizations that have already used stamps and now need to re-engrave them according to the new model specified in this Circular, when applying to the police force for re-engraving procedures, they only need to bring an introduction letter from the organization clearly stating the establishment decision number or the production and business registration permit number issued by the competent authority, along with a copy of the identification card of the person contacting the engraving process.
3. Management of stamps during operation
b) For economic organizations that have already been using seals and now need to carve new ones according to the new model specified in this Circular, when they come to the police agency to handle the seal carving procedures, they only need to bring along an introduction letter from their organization clearly stating the establishment decision number or having a business registration permit issued by the competent authority, accompanied by the identity card of the person handling the seal carving.
3- Management of seals during the course of operation
The head of an economic organization is responsible for strictly managing the use of their unit's seal during operations. When there are changes in name, dissolution, merger, etc., the old seal must be returned to the police agency that issued the permit for seal engraving for management. If the economic organization needs to retain the old seal to resolve existing matters, they must report and request permission from the immediate superior and inform the police agency registering the seal. The period for retaining this seal shall not exceed one month as stipulated in Article 3 of Decision No. 90-HĐBT; the head of the economic organization must strictly monitor and bear responsibility for the use of the old seal during this period.
4- Ink for stamping.
Economic organizations' seals use red ink.
IV- IMPLEMENTATION ORGANIZATION.
1- Based on the guidance provided in this circular, all state-owned and non-state-owned economic organizations (including production and service production organizations under the People's Army and the People's Public Security) must re-engrave their seals according to the new model before January 31, 1990.
Until they have the new seals, these organizations may continue to use the old seals. Upon completion of engraving, they must issue a notice to use the new seal; stop using and return the old seal to the local police agency registering the seal.
As of February 1, 1990, any economic organization still using seals that do not conform to the model and guidance provided in this circular will have no legal validity.
2- This circular provides guidance on the seal model, engraving, and management and use of seals for all state-owned and non-state-owned economic organizations, replacing previous directives from the Ministry of Home Affairs regarding the seal model, engraving, and management and use of seals for state, collective, private, and domestic and foreign joint venture economic organizations.
3- The Ministry of Home Affairs requests the heads of ministries, state councils, other agencies under the Council of Ministers, provincial and municipal chairmen, central special zone chairmen; members of the Fatherland Front, social organizations, etc., to guide subordinate sectors and levels to thoroughly implement the provisions of Decision No. 90 QĐ-HĐBT of the Council of Ministers supplementing Decree No. 56/CP and the contents of this circular to promptly complete the procedures for engraving seals according to the new regulations and continue to improve the strict management and use of seals by economic organizations.
