Pursuant to the Law on Organization of the Government dated December 25, 2001;
Considering the proposal of the Minister of Interior and the Chairman of the People's Committee of Ben Tre province,
DECREE:
Article 1. Adjustment of administrative boundaries of communes and wards to establish communes and wards under Mo Cay district, Cho Lach district, and Ben Tre town; adjustment of administrative boundaries of Mo Cay district and Cho Lach district to establish Mo Cay Bac district under Ben Tre province as follows:
I. ADJUSTMENT OF ADMINISTRATIVE BOUNDARIES OF COMMUNES AND WARDS TO ESTABLISH COMMUNES AND WARDS UNDER MO CAY DISTRICT, CHO LACH DISTRICT, AND BEN TRE TOWN
1. Establish Tan Hoi commune under Mo Cay district based on the adjustment of 731.267 hectares of natural area and 6,534 population from Da Phuoc Hoi commune; 136.4 hectares of natural area and 1,555 population from Khanh Thanh Tan commune.
Tan Hoi commune has 867.667 hectares of natural area and 8,089 population.
Administrative boundary of Tan Hoi commune: East borders with Mo Cay town; West borders with Khanh Thanh Tan commune and Tan Binh commune, Mo Cay district; South borders with Da Phuoc Hoi commune and An Thanh commune, Mo Cay district; North borders with Hoa Loc commune, Mo Cay district.
2. Establish Hung Khanh Trung A commune under Cho Lach district based on the adjustment of 1,331.67 hectares of natural area and 8,760 population from Hung Khanh Trung commune.

Mo Cay district has 35,408.07 hectares of natural area and 276,049 population, including 28 direct administrative units, namely communes: Dinh Thuy, Phuoc Hiep, An Thanh, Da Phuoc Hoi, Thanh Thoi B, Binh Khanh Dong, Binh Khanh Tay, An Dinh, An Thoi, Thanh Thoi A, Huong My, Cam Son, Ngai Dang, Minh Duc, Tan Trung, Tan Hoi, Thanh Tan, Thanh Ngai, Tan Phu Tay, Tan Thanh Binh, Thanh An, Phuoc My Trung, Tan Thanh Tay, Tan Binh, Nhuuan Phu Tan, Hoa Loc, Khanh Thanh Tan and Mo Cay town.
- Hung Khanh Trung commune remains 1,024.03 hectares of natural area and 7,334 population (renamed Hung Khanh Trung B commune).
Administrative boundary of Hung Khanh Trung B commune: East borders with Hung Khanh Trung A commune; West borders with Tan Thieng commune and Vinh Thanh commune, Cho Lach district; South borders with Co Chi River, Nhuuan Phu Tan commune, Mo Cay district; North borders with Vinh Hoa commune and Vinh Thanh commune, Cho Lach district.
- Phu Son commune remains 1,316 hectares of natural area and 7,188 population.
Cho Lach district has 18,879.2 hectares of natural area and 128,518 population, including 13 direct administrative units, namely communes: Hoa Nghia, Phu Phung, Son Ding, Vinh Binh, Long Thoi, Tan Thieng, Vinh Thanh, Vinh Hoa, Phu My, Phu Son, Hung Khanh Trung A, Hung Khanh Trung B and Cho Lach town.
- Phu Hung commune remains 1,012.33 hectares of natural area and 10,870 population.
Ben Tre town has 6,742 hectares of natural area and 114,597 population, including 16 direct administrative units, namely wards: 1, 2, 3, 4, 5, 6, 7, 8, Phu Khuong, Phu Tan and communes: Son Dong, My Thanh An, Phu Nhuon, Nhon Thanh, Phu Hung, Binh Phu.
II. ADJUSTMENT OF ADMINISTRATIVE BOUNDARIES OF MO CAY DISTRICT AND CHO LACH DISTRICT TO ESTABLISH MO CAY BAC DISTRICT UNDER BEN TRE PROVINCE
Establish Mo Cay Bac district under Ben Tre province based on the adjustment of 13,419.11 hectares of natural area and 109,575 population from Mo Cay district (including the entire natural area and population of communes: Thanh Tan, Thanh Ngai, Tan Phu Tay, Tan Thanh Binh, Thanh An, Phuoc My Trung, Tan Thanh Tay, Tan Binh, Nhuuan Phu Tan, Hoa Loc, Khanh Thanh Tan) and 2,044.67 hectares of natural area and 14,802 population from Cho Lach district (including the entire natural area and population of Hung Khanh Trung A commune and Phu My commune).
Mo Cay Bac district has 15,463.78 hectares of natural area and 124,377 population, including 13 direct administrative units, namely communes: Thanh Tan, Thanh Ngai, Tan Phu Tay, Tan Thanh Binh, Thanh An, Phuoc My Trung, Tan Thanh Tay, Tan Binh, Nhuuan Phu Tan, Hoa Loc, Khanh Thanh Tan, Hung Khanh Trung A and Phu My commune.
Administrative boundary of Mo Cay Bac district: East borders with Mo Cay Nam district and Giong Trom district; West borders with Cho Lach district; South borders with Vinh Long province; North borders with Chau Thanh district and Ben Tre town.
After adjusting the administrative boundaries of Mo Cay district to establish Mo Cay Bac district:
County Mo Cay retains 21,988.95 hectares of natural area and 166,474 inhabitants (renamed to County Mo Cay South), with 17 subordinate administrative units, including communes: Dinh Thuy, Phuoc Hiep, An Thanh, Da Phuoc Hoi, Thanh Thoi B, Binh Khanh Dong, Binh Khanh Tay, An Dinh, An Thoi, Thanh Thoi A, Huong My, Cam Son, Ngai Dang, Minh Duc, Tan Trung, Tan Hoi, and the town of Mo Cay.
The administrative boundary of Mo Cay South County: East borders Giong Trom County, Ben Tre Province; West borders Tra Vinh Province; North-Northeast borders Mo Cay North County and Giong Trom County; South-Southwest borders Thanh Phu County and Tra Vinh Province.
County Cho Lach retains 16,834.52 hectares of natural area and 113,716 inhabitants, with 11 subordinate administrative units, including communes: Hoa Nghia, Phu Phung, Son Ding, Vinh Binh, Long Thoi, Tan Thien, Vinh Thanh, Vinh Hoa, Hung Khanh Trung B, Phu Son, and the town of Cho Lach.
Ben Tre Province has 235,678 hectares of natural area and 1,358,314 inhabitants, with 09 subordinate administrative units, including counties: Binh Dai, Chau Thanh, Giong Trom, Ba Tri, Cho Lach, Mo Cay South, Mo Cay North, Thanh Phu, and the city of Ben Tre.
Article 2. This Decree shall take effect 45 days from the date of issuance.
Article 3. The Minister of Home Affairs, the Chairman of the People's Committee of Ben Tre Province, and the heads of relevant agencies are responsible for implementing this Decree./.
