Regulations on the functions, tasks, powers, and organization of the Department of International Cooperation

THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

Pursuant to Decree No. 178/2007/ND-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
At the proposal of the Head of the Department of International Cooperation and the Head of the Department of Organization and Cadres,

DECISION:

Article 1. Position and Functions

The International Cooperation Department is an organization under the Ministry of Home Affairs with the function of advising the Minister of Home Affairs to implement state management over international cooperation activities within the fields of the Ministry's state management.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Perform advisory tasks for the Minister:

a) Drafting and submitting to competent authorities for issuance of legal documents on international cooperation within the fields of the Ministry's state management according to the Minister's assignment;

b) Drafting long-term plans, annual plans, and programs and projects of international cooperation within the fields of the Ministry's state management;

c) Uniformly manage international cooperation activities within the Ministry; take the lead and coordinate with subordinate agencies and units under the Ministry and relevant state agencies to implement approved international cooperation plans; monitor, review, synthesize, evaluate, and report to the Minister for consideration and decision;

d) Submit to the Government for consideration and decision on policies and measures to expand relations with foreign countries and international organizations; negotiate, sign, approve, ratify, accede to, or ensure the implementation of international treaties when the Ministry of Home Affairs acts on behalf of the State or the Government in matters related to the Ministry's administrative management fields;

đ) Organize negotiations and signing of international treaties according to the authorization of competent state agencies and organize the implementation of international treaties where Vietnam is a member within the scope of the Ministry's administrative management fields; sign and organize the implementation of international agreements on behalf of the Ministry of Home Affairs in accordance with the law;

e) Deciding on participation in international organizations according to the Government's assignment;

g) Implementing policies and measures to expand international cooperation that have been approved by the Government;

h) Direct and organize the implementation of international assistance programs and projects of the Ministry; develop and implement regulations on managing programs and projects funded from abroad; take the lead and coordinate with funding agencies and relevant agencies and units in preparing, developing, reviewing, negotiating, and proposing implementing units; organize inspections of international assistance programs and projects within the Ministry's administrative management fields;

i) Manage and coordinate activities of international cooperation in the field of administrative reform. Serve as the focal point for coordinating international cooperation activities in the field of administrative reform. Guide ministries, sectors, and localities in building programs, projects, and cooperative activities with foreign countries in the field of administrative reform, participate in reviewing, submit to the Prime Minister for approval, and monitor and evaluate the implementation;

k) Approving the operation of international conferences and seminars related to the fields of the Ministry's state management;

l) Take the lead, serve as the focal point, coordinate, and participate in ASEAN cooperation activities in the civil service field;

2. Submitting to the Minister for review opinions on the signing of international treaties and international agreements by ministries, sectors, and localities that relate to the fields of the Ministry's state management.

3. Implement the Ministry of Home Affairs' international cooperation plan, organize outbound and inbound delegations according to the state budget decided or approved by the Minister. Coordinate with the Planning and Finance Department to review the use of the state budget for the Ministry's international cooperation work.

4. Coordinate with relevant units under the Ministry to provide advice to the Ministry's leadership on dispatching officials and civil servants of the Ministry abroad. Coordinate with state agencies and subordinate agencies and units of the Ministry to implement conference, seminar, reception, protocol, and diplomatic etiquette regulations.

5. Serving as the permanent assistant to the Management Board and coordinating with projects under the Ministry.

6. Organizing and compiling information on international conferences and seminars:

a) Drafting documents for the Minister to issue to guide government and Prime Minister's regulations on organizing international conferences and seminars related to the fields of the Ministry's state management;

b) Compiling information on the activities of international conferences and seminars of central agencies and localities related to the fields of the Ministry's state management and reporting to the Minister for submission to the Prime Minister;

c) Taking the lead or coordinating with foreign agencies and organizations to organize international conferences, seminars, and other international cooperation activities within the fields of the Ministry's state management;

d) Submitting to the Minister for review opinions on the organization of international conferences and seminars by ministries, sectors, and localities on issues within the Ministry's state management authority.

7. Leading and coordinating with functional departments of the Ministry in the activities of the ASEAN Source Center for Civil Service Management.

8. Lead or participate in scientific research and vocational training in fields under the Ministry's and Department's functions and tasks. Carry out comprehensive statistical work, build databases on international cooperation fields, and coordinate with the Information Center to apply information technology in managing and utilizing information databases to serve leadership and management.

9. Performing other tasks assigned by the Minister.

Article 3. Organization and working regime of the Department

1. The Department has a Director, Deputy Directors, and civil servants.

2. The Director shall be responsible to the Minister for organizing and implementing the tasks specified in Article 2 and shall have the following specific duties and powers:

a) Organizing and directing the Department's tasks and being responsible to the Minister for all activities of the Department;

b) Assigning tasks, supervising, urging, and inspecting the implementation of tasks by Deputy Directors and civil servants in the Department;

c) Sign on behalf of the Minister to respond, clarify, guide professional matters, and request agencies, organizations, and localities to provide information on administrative reform projects and international cooperation activities in the administrative reform field;

d) Implementing information dissemination work for civil servants in the Department according to the Ministry's working regulations;

d) Coordinate with organizations within the Ministry, related agencies in resolving issues related to the functions, tasks, and authorities of the Department;

e) Decide on the contents of reports, reviews, summaries, and recommendations to the Minister regarding policies and solutions in implementing the Department's tasks;

g) Implement the regulations of the Ministry; manage civil servants and assets assigned according to the分级授权 of the Ministry.

3. The Deputy Department Head performs professional tasks and assists the Department Head in managing one or several aspects of work as assigned by the Department Head; is responsible to the Department Head for the assigned tasks.

4. Civil servants carry out specialized tasks assigned by the Director and are accountable to the Director for performing those tasks.

5. The Department operates under a specialist system combined with a chief system; in cases where the Ministry's leadership directly works with the Deputy Department Head or specialists, the Deputy Department Head or specialists shall be responsible for implementing the leadership's opinions and promptly reporting back to the Department Head.

Article 4. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from the date of signature and replaces Decision No. 47/2003/QD-BNV dated August 18, 2003 of the Minister of Home Affairs stipulating the functions, tasks, powers, and organization of the Department of International Cooperation.

2. The Director of the Ministry's Office, the Heads of the Department of Organization and Cadres, the Department of International Cooperation, the Heads of and civil servants of related organizations under the Ministry are responsible for implementing this Decision.
