CIRCULAR

GUIDELINES ON THE DEVELOPMENT AND APPLICATION OF STANDARDS

Circular No. 21/2007/TT-BKHCN dated September 28, 2007 of the Minister of Science and Technology guiding on the development and application of standards, which took effect from November 4, 2007, was amended and supplemented by:

Circular No. 29/2011/TT-BKHCN dated November 15, 2011 of the Minister of Science and Technology amending and supplementing certain provisions of Circular No. 21/2007/TT-BKHCN dated September 28, 2007 of the Minister of Science and Technology guiding on the development and application of standards, which took effect from January 1, 2012.

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/NĐ-CP;

Based on Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions

The Ministry of Science and Technology guides the development and application of standards as follows:[1]

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

This Circular guides the preparation of planning, plans, development, review, and publication of national standards; guides the application of national standards, international standards, regional standards, and foreign standards; guides the development and publication of basic standards.

This Circular applies to ministries, ministerial-level agencies, and government agencies (hereinafter referred to as ministries and sectors), organizations, and individuals related to the preparation of planning, plans, development, review, and publication of national standards; the application of national standards, international standards, regional standards, and foreign standards in Vietnam; the development and publication of basic standards.

In this technical regulation, the following terms are understood as follows:

3.1. National standard Basic standards are those developed by the Minister, head of a ministerial-level agency, or head of a government agency, reviewed and published by the Ministry of Science and Technology according to the prescribed procedures and formalities.

3.2. National standard field is a group of related national standard objects (for example: transportation field, agriculture field, chemical field, food field, garment field, metallurgy field, etc.). The national standard field is determined according to the international standard classification framework of the International Organization for Standardization (ISO).

3.3. Acceptance of international standards, regional standards, or foreign standards as national standards, national standards from regional standards or foreign standards. is the publication of a national standard with content completely equivalent or equivalently modified compared to the content of corresponding international standards, regional standards, or foreign standards.

3.4. International standards are standards published by an international standard organization or an international organization operating in the standardization field.

3.5. Regional standards are standards published by a regional standard organization or a regional organization operating in the standardization field.

3.6. Foreign standards are standards published by a national standard organization of a foreign country or a foreign organization operating in the standardization field (professional associations, research institutes, etc.).

3.7. Basic standards are standards published by economic organizations, social-professional organizations, state agencies, public service units, and other agencies and organizations for application in their activities.

3.8. Application of standards is the use of standards in management, production, business of products, goods, services, processes, environment, and other socio-economic activities.

II. GUIDELINES FOR THE DEVELOPMENT OF NATIONAL STANDARDS

1. Preparation and approval of overall planning for the development of national standards

1.1. The Ministry of Science and Technology takes the lead and coordinates with relevant ministries, sectors, and organizations to organize the preparation of draft overall planning for the development of national standards (hereinafter referred to as overall planning).

Overall planning must be systematic, synchronized, and consistent with the national socio-economic development strategy; the strategies and planning of various economic and technical sectors and other fields of activity.

The content of overall planning includes: specialized industries, fields, and objects that need to develop national standards; the total number of national standards for each specialized industry, field, and object; implementation schedule; resources to meet the requirements of developing national standards for each stage; implementation measures.

1.2. The preparation and approval of overall planning are carried out as follows:

1.2.1. Ministries and sectors, based on the development strategy and planning of specialized industries, organize the preparation of draft planning for the development of national standards within the specialized fields under their management (hereinafter referred to as specialized planning) at the request of the Ministry of Science and Technology and submit it to the General Department of Standards, Metrology, and Quality Control.

Specialized planning includes the contents specified in Section 1 of Appendix I attached to this Circular.

1.2.2. The General Department of Standards, Metrology, and Quality Control performs the following tasks:

- Prepare a draft overall planning based on the specialized planning of ministries and sectors and proposals from organizations and individuals.

The draft overall planning includes the contents specified in Section 2 of Appendix I attached to this Circular;

- Send the draft overall planning for comments from ministries, sectors, organizations, and individuals concerned, and announce the solicitation of opinions on the website of the Ministry of Science and Technology and the General Department of Standards, Metrology, and Quality Control. The time for soliciting opinions on the draft shall be at least thirty days from the date of sending the draft;

- Consolidate and process comments on the draft overall planning;

- Take the lead and coordinate with relevant ministries and sectors to complete the draft overall planning and submit it to the Ministry of Science and Technology.

1.2.3. The Ministry of Science and Technology organizes the examination and approval of overall planning, notifies ministries and sectors, and publicly announces it on the website of the Ministry of Science and Technology and the General Department of Standards, Metrology, and Quality Control within thirty days from the date of approval of the planning.

1.3. The overall plan that has been approved may be adjusted or supplemented according to needs or changes in the national economic and social development orientation and strategy and the development strategy and planning of various economic and technical sectors. The procedures and formalities for adjusting and supplementing the overall plan shall be carried out in accordance with the provisions of Point 1.2 of this Clause.

The Minister of Science and Technology decides on the adjustment and supplementation of the overall plan for developing national standards.

2. Establishing and approving five-year and annual plans for developing national standards

2.1. The General Bureau of Standards Measurement and Quality Control shall take the lead and coordinate with relevant Ministries and sectors to organize the drafting of five-year and annual plans for developing national standards.

The five-year plan for developing national standards must be consistent with the overall plan that has been approved; meet the needs of production and business development, state management requirements, international integration; and be appropriate to the level of scientific and technological development of the country.

The annual plan for developing national standards must be consistent with the five-year plan. The annual plan includes contents on new construction, amendment, supplementation, replacement, and abolition of national standards., amend, supplement, replace, or abolish national standards.

2.2. Five-year plan for developing national standards

The contents of the five-year plan for developing national standards include: specific fields and objects requiring the establishment of national standards; types of standards; the number of national standards to be established; implementation time; budget sources and estimated budget; proposing agencies and individuals.

The establishment, approval, adjustment, and supplementation of the five-year plan for developing national standards shall be carried out through the following steps:

2.2.1. Drafting the five-year plan

- In the second quarter of the last year of the five-year period, Ministries, sectors, and organizations draft and submit their proposed plans for establishing national standards in their specialized fields (hereinafter referred to as the proposed specialized field standard establishment plan) for the next five years along with explanatory documents to the General Bureau of Standards Measurement and Quality Control for review and consolidation.

The proposed five-year specialized field standard establishment plan and its explanatory documents include the contents specified in Section 1 of Appendix II issued together with this Circular.

- Based on the approved overall plan, the General Bureau of Standards Measurement and Quality Control drafts the five-year plan for establishing national standards based on the proposed specialized field standard establishment plans of Ministries, sectors, and organizations.

The draft five-year plan for establishing national standards and its explanatory documents include the contents specified in Section 2 of Appendix II issued together with this Circular.

2.2.2. Soliciting opinions and perfecting the draft five-year plan

The General Bureau of Standards Measurement and Quality Control shall carry out the following tasks:

- Sending the draft five-year plan for establishing national standards to relevant Ministries, sectors, organizations, and individuals for comments, and announcing it on the website of the Ministry of Science and Technology and the General Bureau of Standards Measurement and Quality Control to solicit wide-ranging opinions. The comment period for the draft shall be at least thirty days from the date of sending the draft;

- Consolidating and processing comments on the draft;

- Taking the lead and coordinating with related agencies and organizations to perfect the draft and submit it to the Ministry of Science and Technology.

2.2.3. Approving the five-year plan

- The Ministry of Science and Technology organizes the examination and approval of the five-year plan for establishing national standards, notifying relevant Ministries and sectors and publicly announcing it on the website of the Ministry of Science and Technology and the General Bureau of Standards Measurement and Quality Control within thirty days from the date of approval of the plan.

2.2.4. Adjusting and supplementing the plan

- The five-year plan for establishing national standards may be adjusted or supplemented upon proposal by Ministries, sectors, and organizations.

- The adjustment and supplementation of the five-year plan shall be carried out in accordance with the procedures stipulated in Points 2.2.1, 2.2.2, and 2.2.3 of this Article. paragraph 2.2.1, 2.2.2, 2.2.3 of this point.

2.3. Annual plan for developing national standards

The contents of the annual plan for developing national standards include: names of national standards to be established arranged by standard fields; name of the organization drafting the draft; implementation time; method of drafting the draft (acceptance of international standards; new construction; amendment, supplementation); estimated budget and budget source; proposing agency, organization, or individual for establishing standards; proposed plan for disseminating and guiding the application of standards.

The establishment of the annual plan for developing national standards shall be carried out through the following steps:

2.3.1. Drafting the plan

- In the second quarter of each year, based on the five-year plan, the need for establishing, amending, supplementing, and replacing national standards, and the results of periodic reviews of national standards, Ministries, sectors, organizations, and individuals submit their proposed plans for establishing national standards for the following year along with projects for establishing national standards for specific or group standard objects to the General Bureau of Standards Measurement and Quality Control.

The proposed plan for establishing national standards for the following year is drafted according to the model specified in Section 1 of Appendix III issued together with this Circular.

The project for establishing national standards is drafted according to the model specified in Appendix IV issued together with this Circular.

- The General Bureau of Standards Measurement and Quality Control organizes the review of national standard establishment projects with the participation of representatives from relevant Ministries, sectors, and organizations, and drafts the annual plan for establishing national standards for the following year according to the model specified in Section 2 and the explanatory document for establishing national standards according to the contents specified in Section 3 of Appendix III issued together with this Circular.

2.3.2. Soliciting opinions and perfecting the draft annual plan

The General Bureau of Standards Measurement and Quality Control shall carry out the following tasks:

- Sending the draft plan to relevant Ministries, sectors, and organizations, and announcing it on the website of the Ministry of Science and Technology and the General Bureau of Standards Measurement and Quality Control to solicit opinions. The comment period for the draft shall be at least thirty days from the date of sending the draft;

- Consolidating and processing comments on the draft;

- Taking the lead and coordinating with relevant Ministries, sectors, and organizations to perfect the draft and submit it to the Ministry of Science and Technology.

2.3.3. Approving the annual plan

The Minister of Science and Technology shall examine and approve the annual plan for developing national standards in the first quarter of the year preceding the planning year. The Ministry of Science and Technology shall notify the approved plan to relevant ministries, sectors, and make it public on the website of the Ministry of Science and Technology and the General Department of Standardization, Measurement, and Quality within fifteen days from the date of approval of the plan.

2.3.4. Implementation of the Annual Plan

- Based on the approved annual plan for developing national standards, the Minister, the head of a ministry-level agency, and the head of a government agency shall organize the implementation of the plan;

- Every six months, or at the request of the Ministry of Science and Technology, ministries and sectors shall report to the Ministry of Science and Technology (General Department of Standardization, Measurement, and Quality) on the progress and results of implementing the plan;

- The General Department of Standardization, Measurement, and Quality shall monitor and urge the implementation of the annual plan for developing national standards; compile and report to the Ministry of Science and Technology on the progress and results of implementing the plan; provide guidance on standard development procedures; participate in the process of drafting national standards led by ministries and sectors.

2.3.5. Adjustment and Supplement to the Plan

- The annual plan for developing national standards may be adjusted or supplemented based on written proposals from ministries, sectors, and organizations.

- The Ministry of Science and Technology shall decide on adjustments regarding schedule, budget, removal from, or addition to the annual plan for developing national standards.

- The procedure for adjusting and supplementing the plan for developing national standards shall be carried out as follows:

+ Ministries, sectors, organizations, and individuals shall submit written proposals for adjusting and supplementing the annual plan for developing national standards to the General Department of Standardization, Measurement, and Quality for review and compilation.

Proposals for adjusting and supplementing the annual plan for developing national standards must be submitted before October 1st each year.

+ The General Department of Standardization, Measurement, and Quality shall organize the review of adjustment and supplementation proposals; compile and report to the Ministry of Science and Technology for decision-making; notify the adjustment and supplementation of the plan to relevant ministries and sectors and make it public on the website of the Ministry of Science and Technology and the General Department of Standardization, Measurement, and Quality.

- In special cases, due to urgent management requirements or business needs of enterprises, the procedure and formalities for adjusting and supplementing the plan for developing national standards shall be carried out according to the decision of the Minister of Science and Technology.

3. Procedure and Formalities for Developing, Reviewing, and Announcing National Standards

3.1. Procedure and Formalities for Developing, Reviewing, and Announcing National Standards for Draft National Standards Organized by Ministries and Sectors (excluding the Ministry of Science and Technology).

The ministry or sector shall designate an affiliated scientific and technological organization or establish a specialized technical committee (hereinafter referred to as the Compiling Organization) to carry out the drafting of draft national standards according to the following steps:

Step 1: Drafting the Draft National Standard

- The Compiling Organization shall undertake the drafting of the draft and prepare explanatory notes for the draft national standard.

Step 2: Soliciting Opinions and Finalizing the Draft

- The ministry or sector shall send the draft national standard to solicit opinions from relevant agencies, organizations, and individuals, and announce the solicitation of opinions on the website of the ministry or sector and the General Department of Standardization, Measurement, and Quality. The period for soliciting opinions on the draft shall be at least sixty days from the date of sending the draft;

- The ministry or sector shall organize a specialized conference with the participation of relevant parties to discuss and provide comments on the draft;

- The Compiling Organization shall implement the consolidation and processing of comments to finalize the draft national standard, prepare the draft national standard dossier in accordance with Clause 1 of Article 5 of Decree No. 127/2007/ND-CP dated August 1, 2007, and send it to the ministry or sector specified in Point 3.1 of this Clause for organizing a preliminary examination; - The lead agency designated in accordance with Clause 2 of Article 21 of Decree No. 127/2007/ND-CP dated August 1, 2007 (hereinafter referred to as the Lead Agency) shall organize the preliminary examination of the draft national standard dossier to review the completeness and validity of the draft national standard dossier in accordance with Clause 1 of Article 5 of Decree No. 127/2007/ND-CP dated August 1, 2007. - The result of the preliminary examination shall be recorded in a preliminary examination record and attached to the draft national standard dossier to be transferred to the Ministry of Science and Technology for organizing a review.

- The Compiling Organization shall implement:

+ Request the draft national standard preparation team to perfect the draft national standard and dossier based on the preliminary examination record;

+ Submit the completed draft national standard dossier through the Lead Agency to the competent ministry or sector for consideration and decision on transferring the draft national standard dossier to the General Department of Standardization, Measurement, and Quality for review. The draft national standard dossier for review shall be prepared for one or more draft national standards in the same field of standardization.

Step 3: Reviewing the Draft National Standard Dossier

- The General Department of Standardization, Measurement, and Quality shall organize the review of the draft national standard dossier proposed for review by ministries and sectors. If the draft national standard dossier proposed for review does not meet the requirements stipulated in Clause 1 of Article 5 of Decree No. 127/2007/ND-CP, the General Department of Standardization, Measurement, and Quality shall request the relevant ministry or sector to perfect the dossier.

- The General Department of Standardization, Measurement, and Quality shall establish a Review Committee to review the draft national standard in accordance with the provisions of Article 18 of the Law on Standards and Technical Regulations.

The Review Committee shall include representatives of relevant agencies, organizations, national technical committees, and other experts. The Review Committee shall operate on the principle of collective decision-making, majority voting, and must have at least two-thirds (2/3) of the members present.

- The National Standardization Agency establishes an Appraisal Council to appraise draft national standards in accordance with the provisions set forth in Article 18 of the Law on Standards and Technical Regulations.

The Appraisal Council consists of representatives of relevant agencies, organizations, national standard technical committees, and other experts. The Council operates on a collective basis, with decisions made by majority vote and at least two-thirds (2/3) of the members present must agree.

- The Appraisal Council shall prepare an appraisal record with specific conclusions and recommendations, and transfer it to the National Standard Measurement Quality Control Department.

Step 4: Announce the national standard

- The National Standard Measurement Quality Control Department shall organize the review of the appraisal results and proceed with the announcement of the draft national technical regulation (TCVN) as follows:

+ The National Standard Measurement Quality Control Department shall notify the appraisal results to the Ministry or sector that requested the appraisal (through the lead agency) to have the drafting organization complete the draft TCVN according to the Appraisal Council's conclusions;

+ After completing the draft national standard, the drafting organization shall submit the draft TCVN file to the competent Ministry or sector (through the lead agency) for transfer to the Ministry of Science and Technology (through the National Standard Measurement Quality Control Department);

+ The National Standard Measurement Quality Control Department shall prepare the draft TCVN file to be submitted to the Minister of Science and Technology for announcement.

- In cases where the Ministry or sector does not agree with the appraisal results, the Ministry of Science and Technology shall report to the Prime Minister for consideration and decision.

3.2. Procedures for drafting, appraising, and announcing national standards for draft national standards proposed by organizations or individuals.

Based on the proposed draft from organizations or individuals, the National Standard Measurement Quality Control Department shall organize the drafting of the national standard draft with the participation of relevant Ministries and sectors in related activities such as joining the national technical regulation committee, contributing opinions to the draft national standard, and participating in the national standard appraisal council.

The procedures for drafting, appraising, and announcing national standards shall be carried out as follows:

Step 1: Drafting the national standard draft

The national technical regulation committee shall perform the following tasks:

- Establish a working group to draft the national standard based on the draft proposed by organizations or individuals;

- Organize the solicitation of comments and discussions within the national technical regulation committee regarding the draft national standard;

- Complete and write explanatory notes for the draft national standard;

- Prepare the draft national standard file to be submitted to the National Standard Measurement Quality Control Department for review.

Step 2: Soliciting opinions and completing the draft national standard

The National Standard Measurement Quality Control Department shall carry out the following tasks:

- Review the draft national standard file submitted by the national technical regulation committee to decide on sending the draft national standard for soliciting opinions;

- Send the draft national standard for soliciting opinions from relevant agencies, organizations, and individuals, and announce the solicitation of opinions on the website of the National Standard Measurement Quality Control Department. The period for soliciting opinions on the draft must be at least sixty days, starting from the date of sending the draft;

- Organize specialized conferences to discuss and provide opinions on the draft national standard;

- Organize the processing and completion of the draft national standard and prepare the draft national standard file in accordance with Clause 2 of Article 5 of Decree No. 127/2007/NĐ-CP. Step 3: Appraising the draft national standard

- The National Standard Measurement Quality Control Department shall organize the examination of the draft national standard file, establish an Appraisal Council to appraise the draft national standard in accordance with the provisions of Article 18 of the Law on Standards and Technical Regulations.

The Appraisal Council shall include representatives from relevant agencies, organizations, and other experts. The Appraisal Council shall operate on the principle of collective decision-making, majority voting, and at least two-thirds (2/3) of the members present must participate.

The National Standard Measurement Quality Control Department shall prepare the draft national standard file for approval.

- The Appraisal Council shall prepare an appraisal record with specific conclusions and recommendations, and transfer it to the National Standard Measurement Quality Control Department.

Step 4: Announce the national standard

- If the draft national standard meets the requirements of the appraisal content, the National Standard Measurement Quality Control Department shall submit it to the Minister of Science and Technology for review and announcement.

- If the draft national standard does not meet the requirements of the appraisal content, the National Standard Measurement Quality Control Department shall organize the processing and completion of the draft national standard before submitting it to the Minister of Science and Technology for review and announcement.

3.3. Procedures for drafting, appraising, and announcing national standards for draft national standards organized by the Ministry of Science and Technology.

The National Standard Measurement Quality Control Department shall assign the corresponding national technical regulation committee to implement the drafting of the draft national standard.

- Establish a working group to draft the national standard.

The procedures for drafting, appraising, and announcing national standards shall be carried out as follows:

Step 1: Drafting the national standard draft

The national technical regulation committee shall perform the following tasks:

Steps 2, 3, and 4 shall be carried out in accordance with steps 2, 3, and 4 of Point 3.2, Clause 3 of this Section.

- Organize the solicitation of comments and discussions within the national technical regulation committee regarding the draft national standard;

- Complete and write explanatory notes for the draft national standard;

- Prepare the draft national standard file to be submitted to the National Standard Measurement Quality Control Department for review.

4. Presentation and storage of the content of the national standard and the draft national standard file.

4.1. The presentation and expression of the content of the national standard shall be carried out in accordance with TCVN 1-2 and related business guidelines of the National Standard Measurement Quality Control Department.

4.2. The draft national standard file shall be stored at the National Standard Measurement Quality Control Department in accordance with current regulations on document storage.

5. Periodic review, amendment, supplementation, replacement, and cancellation of national standards.

5.1. Periodic review of national standards.

5.1.1. Annually, the National Standard Measurement Quality Control Department shall prepare a list of national standards due for periodic review within three years and include them in the annual plan for drafting national standards.

5.1.2. The National Standard Measurement Quality Control Department shall take the lead and coordinate with relevant Ministries and sectors to organize the implementation of the periodic review of national standards according to the prepared list.

5.1.3. The procedures for periodically reviewing national standards are as follows:

- The National Standard Measurement Quality Control Department shall perform the following tasks:

+ Send the list of national standards requiring review to relevant Ministries and sectors to conduct the review.

+ Organize the review of national standards outside the management scope of Ministries and sectors.

The review shall be conducted in accordance with the business guidelines of the National Standard Measurement Quality Control Department.

- The results of the periodic review along with explanatory notes shall be sent to the National Standard Measurement Quality Control Department for consolidation and processing, specifically as follows:

- The results of periodic reviews accompanied by explanations are submitted to the National Standardization Agency for consolidation and processing, specifically as follows:

+ Reviewing and evaluating the results of the inspections conducted by ministries, sectors, and compiling them into an overall inspection result to seek opinions from relevant ministries, sectors, organizations, and individuals;

+ Compiling comments, establishing a file on the national standard inspection results as the basis for developing the annual plan for national standard development, and reporting to the Ministry of Science and Technology;

5.1.4. The periodic review file of national standards includes:

- A report from the National Standardization Agency on the review results and recommendations;

- A document incorporating comments and opinion letters from related agencies, organizations, and individuals;

- Other related documents (if any).

5.2. Amending, supplementing, and replacing national standards

5.2.1. The amendment, supplementation, and replacement of national standards must be included in the annual plan for national standard development as stipulated in Point 2.3 Clause 2 Section of this Chapter.

5.2.2. The amendment, supplementation, and replacement of national standards shall be carried out according to the procedures and formalities prescribed in Points 3.1, 3.2, and 3.3 Clause 3 Section of this Chapter.

5.2.3. The outcome of amending, supplementing, and replacing national standards is the decision to publish the amended or supplemented national standard or to publish the new national standard that replaces it.

5.3. Revoking national standards

5.3.1. The revocation of national standards based on the periodic review results of national standards as stipulated in Point 5.1 Clause 5 Section of this Chapter shall be implemented as follows:

- The National Standardization Agency bases the approved review results to establish a proposal file for revoking national standards, submitting it to the Ministry of Science and Technology for consideration and decision on publication of revocation. The proposal file for revoking national standards includes:

- The national standard proposed for revocation;

- A summary of opinions from ministries, sectors, organizations, and individuals regarding the revocation of national standards during the review process;

- Other related documents (if any);

- A letter from the National Standardization Agency proposing the specific revocation of national standards accompanied by an explanation.

5.3.2. The revocation of national standards based on proposals from ministries, sectors, organizations, and individuals shall be implemented as follows:

- Ministries, sectors, organizations, and individuals prepare and submit a proposal file for revoking national standards to the National Standardization Agency for examination and organization of assessment. The proposal file for revoking national standards includes:

+ The national standard proposed for revocation;

+ A proposal document from ministries, sectors, organizations, and individuals;

+ An explanatory document (reasons, legal basis, scientific basis);

+ Opinions from related agencies, organizations, and individuals;

+ Other related documents (if any).

- The National Standardization Agency organizes the assessment of the proposal file for revoking national standards and submits the assessment results to the Ministry of Science and Technology for consideration and decision.

5.3.3. The National Standardization Agency announces on its electronic news site (website) about the national standards that have been published for revocation and publishes them in the journal of the National Standardization Agency within thirty days from the date the Ministry of Science and Technology publishes the revocation of national standards.

5.4. The periodic review, amendment, supplementation, replacement, and revocation files of national standards are stored at the National Standardization Agency in accordance with current regulations on document storage. 6. National Standard Symbol

6.1. The national standard symbol consists of the number, year of publication of the standard following the abbreviation TCVN and separated by a colon (:).

Example: TCVN 4980:2006 is the symbol of the national standard with the number 4980, published in 2006.

6.2. In cases where the national standard is completely equivalent to an international standard, the standard symbol includes the national standard symbol and the international standard symbol enclosed in parentheses, separated by a single space character.

Example: TCVN 111:2006 (ISO 15:1998)

The national standard symbol is presented on the cover page as follows:

- Part 1 of the national standard symbol is located at the top including the national standard symbol as specified in Point 5.1 of this clause.

- Part 2 of the national standard symbol is located at the bottom including the full symbol of the accepted international standard.

Example: symbol

TCVN 111:2006

ISO 15:1998

is the symbol of the national standard with the number 111 established based on the complete acceptance of the international standard ISO 15:1998 and published in 2006.

In special cases, when the national standard is established based on the acceptance of international management system standards (ISO 9000, ISO 14000, ISO 18000, ISO/IEC 27000,...), the national standard symbol is sequentially displayed from left to right as follows: the abbreviation TCVN, a space (auto space), the abbreviation of the accepted international standard, a space, the number of the accepted international standard, a colon (:), the year of publication of the national standard and the full symbol of the accepted international standard placed in parentheses.

Example: TCVN ISO/IEC 17011:2007 (ISO/IEC 17011:2004) is the symbol of the national standard established based on the complete acceptance of the international standard ISO/IEC 17011:2004 and published in 2007.

When displayed on the cover page of the national standard, the symbol is shown as follows:

6.3. The symbol of the national standard that replaces another includes the number of the replaced national standard, the year of publication of the replacing national standard separated by a colon (:) and placed after the TCVN symbol.

Example: TCVN published in 2006 to replace TCVN 289:2000 is marked as TCVN 289:2006.

If a national standard replaces multiple national standards or part of another national standard, then the replacing national standard will carry a new number.

6.4. The symbol of the amended version of a national standard includes the word "AMENDED" followed by the sequential number of the amendment and the year of publication separated by a colon (:) preceding the national standard symbol.

Example: AMENDED 1:2006 TCVN 789:2005 is the symbol of the first amended version of TCVN 789:2005, published in 2006. (:) precedes the symbol of the amended national standard.

Example: Amendment 1:2006 TCVN 789: 2005 is the symbol for the first amendment of TCVN 789:2005, published in 2006.

6.5. The symbol and full name of the national standard must be reflected in the decision announcing the national standard.

7. Announcement, publication, issuance, and dissemination of national standards

7.1. Announcement

The National Standardization Agency shall announce the promulgation, amendment, supplementation, replacement, or revocation of national standards on its magazine, website, and other appropriate media within thirty days from the date the Minister of Science and Technology signs the decision to announce such standards.

7.2. Publication and issuance of national standards

7.2.1. National standards shall be published and issued in paper form and may also be published in electronic form.

7.2.2. The content of amendments and supplements to national standards shall be published separately until the standard is reprinted.

7.2.3. The National Standardization Agency shall carry out the publication and issuance of national standards within sixty days from the date the Minister of Science and Technology signs the decision to announce them.

7.2.4. Ministries and sectors may publish and issue national standards they have drafted after reaching consensus with the National Standardization Agency.

Other organizations wishing to publish and issue national standards must obtain the consent of the National Standardization Agency.

7.3. Dissemination of national standards

7.3.1. The Ministry of Science and Technology (National Standardization Agency) shall take the lead and coordinate with relevant ministries and sectors to develop plans for disseminating announced national standards.

7.3.2. Ministries and sectors shall take the lead and coordinate with related agencies and organizations to organize the dissemination of national standards in their respective management areas according to approved plans.

7.3.3. The dissemination of national standards shall be carried out through various forms such as conferences, seminars, training sessions, and other methods.

III. GUIDELINES FOR APPLYING NATIONAL STANDARDS, INTERNATIONAL STANDARDS, REGIONAL STANDARDS, AND FOREIGN STANDARDS IN VIETNAM

1. Methods and measures for applying national standards

1.1. Methods for applying national standards

1.1.1 Direct application

National standards are applied directly without going through any intermediate document.

1.1.2 Indirect application

National standards are applied through other intermediate documents (regulatory legal documents, technical regulations...) that reference these national standards.

1.2. Measures for applying national standards

1.2.1 Promote, disseminate, guide, and train on the application of national standards for relevant entities.

1.2.2 Prioritize the appropriate use of national standards in the development of regulatory legal documents, technical regulations, production, business, services, and other economic and social activities.

1.2.3 Strengthen testing, calibration, inspection, certification, declaration of conformity, and recognition activities based on current national standards.

2. Principles, methods, and measures for applying international standards, regional standards, and foreign standards

2.1. Principles of application

2.1.1 International standards, regional standards, and foreign standards are voluntarily applied by all agencies, organizations, and individuals.

2.1.2 The application of international standards, regional standards, and foreign standards must not contravene laws and harm national security, defense, economic and social interests, and other national interests.

2.1.3 Encourage the application of the latest versions of international standards, regional standards, and foreign standards.

2.1.4 Ensure the application of international standards, regional standards, and foreign standards as stipulated in international treaties to which Vietnam is a party or in bilateral or multilateral agreements between Vietnamese organizations and foreign organizations under the law.

2.2. Methods of application

2.2.1 Direct application

International standards, regional standards, and foreign standards are directly applied in production and business processes, service provision, trade transactions, and other economic and social activities.

2.2.2 Indirect application

Agencies, organizations, and individuals may indirectly apply international standards, regional standards, or foreign standards through the implementation of provisions in technical documents and management documents (regulatory legal documents, technical regulations...) that fully or partially incorporate the content of international standards, regional standards, or foreign standards.

2.3. Application measures

2.3.1 Increase the acceptance of advanced international standards, regional standards, or foreign standards as national standards or basic standards.

2.3.2 Use international standards, regional standards, and foreign standards as a basis for organizing and implementing conformity assessment activities such as recognition, certification, inspection, testing, and calibration.

2.3.3 Organize research and understanding to apply international standards, regional standards, or foreign standards under Vietnamese conditions; actively participate in the activities of relevant international or regional standardization technical committees.

2.3.4 Develop specific plans and investment roadmaps for technology and management to meet the requirements of international standards, regional standards, or foreign standards planned for application.

2.3.5 Organize the dissemination and guidance on the application of international standards, regional standards, or foreign standards.

IV. GUIDELINES FOR DEVELOPING AND ANNOUNCING BASIC STANDARDS

1. Requirements and bases for developing basic standards

1.1. Requirements for basic standards

1.1.1 Basic standards must not conflict with existing technical regulations and current legal provisions.

1.1.2 Basic standards should be developed in accordance with the level of scientific and technological progress, meeting the needs of management and production and business operations at the base.

1.2. Bases for developing basic standards

Basic standards are established based on scientific and technological research results, technical progress, experience, practical needs, and capabilities of the entity. National standards, international standards, regional or foreign standards corresponding to them are encouraged for use in establishing or accepting as basic standards.

2. Types and methods of establishing basic standards

2.1. Types of basic standards

Basic standards may include the following types:

- Technical requirement standards;

- Testing method standards, measurement method standards, and calibration standards;

- Labeling, packaging, transportation, and storage standards;

- Process standards;

- Service standards;

- Environmental standards.

Depending on the type, scale of operation, purpose, and internal management requirements, entities may apply the above classification methods or supplement new types of standards to appropriately define the classification of standards for their own entity.

2.2. Methods of establishing basic standards

Basic standards can be established according to the following basic methods:

- Accepting national standards, international standards, regional standards, or foreign standards corresponding to them as basic standards;

- Establishing new basic standards based on using scientific and technological research results, testing results, evaluations, analyses, and experiments;

- Amending and supplementing existing basic standards.

3. Procedures and formalities for establishing and publishing basic standards

3.1. Depending on the scale and type of production and business activities of the entity, the procedures and formalities for establishing and publishing basic standards (hereinafter referred to as TCCS) may include the following steps:

Step 1: Develop a plan for establishing TCCS;

Step 2: Draft the TCCS proposal;

Step 3: Organize feedback on the TCCS draft;

Step 4: Organize a specialized conference on the TCCS draft;

Step 5: Process feedback and finalize the TCCS draft;

Step 6: Prepare the TCCS draft file;

Step 7: Review the TCCS draft;

Step 8: Publish the TCCS;

Step 9: Print the TCCS.

3.2. Publishing TCCS

The head of the entity examines and decides in writing on the publication of TCCS. The TCCS draft file is stored at the entity.

3.3. Content expression and presentation of basic standards

3.3.1. The code of basic standards is expressed as follows:

- The standard number and year of issuance are separated by a colon (:) and placed after the TCCSv symbol;

- The abbreviated name of the entity issuing the standard is placed after the year of issuance and separated by a slash.

Example: TCCS 27:2006/XXX is the code of the basic standard with number 27, issued by a company with the abbreviated trading name XXX in 2006.

3.3.2. The content of basic standards must include the following parts:

- Table of contents;

- Preliminary information section;

- Main part (general section, technical section);

- Supplementary information section.

The framework, model, and expression of the content of basic standards can refer to TCVN 1-2 on the presentation and expression of the content of national standards. 3.3.3. Basic standards need to be presented concisely, clearly, accurately, easily readable, without errors, and not causing confusion or multiple interpretations.

3.3.4. Basic standards may be published individually or in sets of standards by topic or subject matter.

Pages of TCCS need to be numbered and can be printed in loose-leaf form for ease of supplementation, cancellation, or replacement of content. Basic standards may have a cover page or not.

3.4. Based on this general guidance, entities organize the establishment of specific procedures and guidelines for establishing and publishing basic standards suitable for the conditions and scale of the entity.

V. IMPLEMENTATION[14]

1. Ministries, sectors, agencies, organizations, and individuals organize the implementation of drafting national standard proposals, basic standard proposals, and related work according to the provisions of this guidance and relevant regulatory documents.

In cases where the subject of the standard falls within the specialized management domain of ministries and sectors requiring special management requirements or must comply with international practices, the Ministry of Science and Technology will take the lead and coordinate with relevant ministries and sectors to provide specific guidance on the procedures, formalities, establishment, publication, presentation, and expression of the content of national standards based on the provisions of this Circular.

Based on the provisions of point c, Clause 1, Article 20 of Decree No. 127/2007/NĐ-CP, the guidance of this Circular, the Ministry of National Defense will establish and issue specific regulations on planning, planning, procedures, formalities for establishing, reviewing, and publishing national standards in the military defense field applicable only within the Ministry of National Defense after obtaining the consensus opinion of the Ministry of Science and Technology.

This Circular takes effect fifteen days after its publication in the Official Gazette.

3. During the implementation of this Circular, if there are any issues encountered, agencies, organizations, and individuals should promptly reflect them to the Ministry of Science and Technology for study and amendment.

BASIC REQUIREMENTS FOR THE PREPARING ORGANIZATION

The compiling organizations must meet the following basic requirements:

1. Be a unit with the capacity of the Ministry or sector and operating in the specialized field corresponding to the standardization area determined by the Ministry or sector.

2. Have an appropriate organizational structure and resources to ensure stability and continuity in the drafting of TCVN draft proposals as well as monitoring the drafting process of TCVN draft proposals.

3. Have a staff with sufficient qualifications and capabilities to manage and support the implementation of programs and plans for drafting TCVN according to the requirements of the Ministry or sector, be familiar with legal documents on standardization construction, national standardization business practices, and international standardization activities in the assigned field.

4. Have procedures for establishing and maintaining records of TCVN draft proposals during the drafting process of TCVN draft proposals.

5. Commit to fully implement the principles of TCVN construction as stipulated in the Law on Standards and Technical Regulations and good practice requirements for standardization set out in Appendix 3 of the WTO Agreement on Technical Barriers to Trade; comply with the TCVN construction procedures as prescribed by the Ministry of Science and Technology in Circular No. 21/2007/TT-BKHCN and this Circular./.



[1] Circular No. 29/2011/TT-BKHCN amends and supplements certain provisions of Circular No. 21/2007/TT-BKHCN dated September 28, 2007 of the Minister of Science and Technology guiding the construction and application of standards based on the following grounds for issuance:

"BASED ON the Law on Standards and Technical Regulations dated June 29, 2006;

BASED ON Decree No. 127/2007/NĐ-CP dated August 1, 2007 of the Government detailing the implementation of certain articles of the Law on Standards and Technical Regulations;

Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Considering the proposal of the General Director of the Standardization, Metrology and Quality Control Department;

THE MINISTER OF SCIENCE AND TECHNOLOGY hereby promulgates:"

[2] This paragraph has been amended and supplemented pursuant to Point 1.1 Clause 1 Article 1 of Circular No. 29/2011/TT-BKHCN amending and supplementing certain provisions of Circular No. 21/2007/TT-BKHCN dated September 28, 2007 of the Minister of Science and Technology guiding the construction and application of standards, shall take effect from January 1, 2012.

[3] This paragraph has been amended and supplemented pursuant to Point 1.1 Clause 1 Article 1 of Circular No. 29/2011/TT-BKHCN amending and supplementing certain provisions of Circular No. 21/2007/TT-BKHCN dated September 28, 2007 of the Minister of Science and Technology guiding the construction and application of standards, shall take effect from January 1, 2012.

[4] This paragraph has been added pursuant to Point 1.2 Clause 1 Article 1 of Circular No. 29/2011/TT-BKHCN amending and supplementing certain provisions of Circular No. 21/2007/TT-BKHCN dated September 28, 2007 of the Minister of Science and Technology guiding the construction and application of standards, shall take effect from January 1, 2012.

[5] This paragraph has been added pursuant to Point 1.2 Clause 1 Article 1 of Circular No. 29/2011/TT-BKHCN amending and supplementing certain provisions of Circular No. 21/2007/TT-BKHCN dated September 28, 2007 of the Minister of Science and Technology guiding the construction and application of standards, shall take effect from January 1, 2012.

[6] This paragraph has been added pursuant to Point 1.2 Clause 1 Article 1 of Circular No. 29/2011/TT-BKHCN amending and supplementing certain provisions of Circular No. 21/2007/TT-BKHCN dated September 28, 2007 of the Minister of Science and Technology guiding the construction and application of standards, shall take effect from January 1, 2012.

[7] This paragraph has been amended and supplemented pursuant to Point 1.3 Clause 1 Article 1 of Circular No. 29/2011/TT-BKHCN amending and supplementing certain provisions of Circular No. 21/2007/TT-BKHCN dated September 28, 2007 of the Minister of Science and Technology guiding the construction and application of standards, shall take effect from January 1, 2012.

[8] This paragraph has been amended and supplemented pursuant to Point 1.3 Clause 1 Article 1 of Circular No. 29/2011/TT-BKHCN amending and supplementing certain provisions of Circular No. 21/2007/TT-BKHCN dated September 28, 2007 of the Minister of Science and Technology guiding the construction and application of standards, shall take effect from January 1, 2012.

[12] This paragraph has been amended pursuant to Clause 2 Article 1 of Circular No. 29/2011/TT-BKHCN amending and supplementing certain provisions of Circular No. 21/2007/TT-BKHCN dated September 28, 2007 of the Minister of Science and Technology guiding the construction and application of standards, shall take effect from January 1, 2012.

[13] This paragraph has been amended pursuant to Clause 2 Article 1 of Circular No. 29/2011/TT-BKHCN amending and supplementing certain provisions of Circular No. 21/2007/TT-BKHCN dated September 28, 2007 of the Minister of Science and Technology guiding the construction and application of standards, shall take effect from January 1, 2012.

[14] Articles 2 and 3 of Circular No. 29/2011/TT-BKHCN amending and supplementing certain provisions of Circular No. 21/2007/TT-BKHCN dated September 28, 2007 of the Minister of Science and Technology guiding the construction and application of standards, shall take effect from January 1, 2012, and are stipulated as follows:

Article 2. The Standardization, Metrology and Quality Control General Department is responsible for guiding and organizing the implementation of this Circular.

Article 3.

1. This Circular takes effect from January 1, 2012.

2. In cases where legal documents referred to in Circular No. 21/2007/TT-BKHCN dated September 28, 2007 of the Minister of Science and Technology and this Circular are amended, supplemented, or replaced, they shall be implemented according to the new documents.

3. The Director of the Standardization, Metrology and Quality Control General Department, the Head of the Legal Affairs Department, and relevant organizations and individuals are responsible for implementing this Circular./.”

[15] This Appendix has been added pursuant to Clause 3 Article 1 of Circular No. 29/2011/TT-BKHCN amending and supplementing certain provisions of Circular No. 21/2007/TT-BKHCN dated September 28, 2007 of the Minister of Science and Technology guiding the construction and application of standards, shall take effect from January 1, 2012.
