Pursuant to Decree No. 54/2003/ND-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology, and Decree No. 28/2004/ND-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/ND-CP;
Considering the proposals of the Directors of the Vietnam Atomic Energy Institute and the Director of the Department of Personnel and Organization,
DECISION:
Article 1. This Decision promulgates the Charter on Organization and Operation of the Vietnam Atomic Energy Institute under the Ministry of Science and Technology.
Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette and shall replace Decision No. 2469/QD-TCCB dated December 23, 1998 of the Minister of Science, Technology and Environment (now the Ministry of Science and Technology) promulgating the Charter on Organization and Operation of the Vietnam Atomic Energy Institute.
Article 3. The Heads of the Office, the Director of the Department of Personnel and Organization, the Director of the Vietnam Atomic Energy Institute, and the Heads of related units are responsible for implementing this Decision.

PART I
FUNCTIONS, TASKS, AND POWERS
Article 1. The Vietnam Atomic Energy Institute is a scientific public service organization under the Ministry of Science and Technology with the function of researching science and developing nuclear technology and atomic energy, serving state management of atomic energy and participating in providing technical support to the State Administration for Radiation Safety and Nuclear Safety.
The international name of the Vietnam Atomic Energy Institute is: Vietnam Atomic Energy Commission (abbreviated as VAEC).
The Vietnam Atomic Energy Institute has legal personality, may use its own seal, and may open accounts at the national treasury and banks.
Article 2. The Vietnam Atomic Energy Institute has the following main tasks and powers:
1. Researching and drafting policies, directions, strategies, planning, and plans for the development of the atomic energy industry in Vietnam, participating in researching and drafting projects and regulatory documents on atomic energy to be submitted to the Minister or for the Minister to submit to the Government for approval. Participating in implementing nuclear policies that have been approved by the Government.
2. Conducting basic research, applied research in nuclear science and technology, reactor technology and nuclear fuel and materials, research and development on radiation safety and nuclear safety, research on technologies for processing and managing radioactive waste to serve national economic development.
3. Implementing activities to develop technology, production, and technical services in the field of atomic energy and related industries to serve socio-economic development.
4. Cooperating in implementing international cooperation activities in the field of atomic energy of Vietnam with other countries and international organizations according to the division of labor of the Ministry of Science and Technology and the regulations of the State. Participating in implementing international treaties related to atomic energy that Vietnam has signed or joined.
5. Providing technical support to the State Administration for Radiation Safety and Nuclear Safety in assessing and evaluating radiation safety and nuclear safety, conducting environmental radiation monitoring, calibrating nuclear equipment and radiation dosimetry devices, providing radiation dosimetry services, developing technical infrastructure to serve the handling of radiation accidents and incidents.
6. Participating in implementing planning, training, and training of scientific and technological personnel in the atomic energy industry according to the regulations of the State.
7. Managing the organization and personnel, budget, and assets of the Institute according to the classification of the Ministry of Science and Technology and the regulations of the State.
Chapter II
ORGANIZATIONAL STRUCTURE
Article 3. The Vietnam Atomic Energy Institute is organized and operates under a directorate system combined with collective discussion.
The Director of the Vietnam Atomic Energy Institute is responsible to the Minister of Science and Technology for all work of the Institute.
The Deputy Directors assist the Director. The Deputy Directors assist the Director in general leadership of the Institute's work, are assigned by the Director to be responsible for certain aspects of the Institute's work, and are responsible to the Director for the work assigned; they have the authority to decide matters within the scope of their assigned tasks.
When the Director is absent, a Deputy Director may be authorized to manage and direct the Institute's operations.
Article 4. The organizational structure of the Vietnam Atomic Energy Institute includes:
1) Functional units:
Office.
Planning and Scientific Management Department.
International Cooperation Department.
2) Research and Development Units:
Institute of Nuclear Science and Technology.
Institute of Nuclear Research.
Institute of Rare Isotope Technology.
Ho Chi Minh City Nuclear Center.
Center for Radiation Technology Research and Application.
3) Enterprises:
Applied and Development Technology Company.
The Minister of Science and Technology issues the Charter on Organization and Operation of the Applied and Development Technology Company.
The Director of the Vietnam Atomic Energy Institute issues the Charter on Organization and Operation of the units specified in Clause 1 and Clause 2 of this Article after obtaining the approval of the Minister of Science and Technology.
Article 5. The Vietnam Atomic Energy Institute's Science, Technology, and Training Council, established by the Director of the Vietnam Atomic Energy Institute, is an advisory body to the Director on important issues related to the Institute's scientific, technological, and training activities.
Chapter III
WORK RELATIONSHIPS
Article 6. The Director of the Vietnam Atomic Energy Institute manages and directs all activities in accordance with the Charter on Organization and Operation of the Institute and the regulations of the Ministry of Science and Technology.
Article 7. The Director of the Vietnam Atomic Energy Institute implements work systems and working relations with the heads of units under the Ministry of Science and Technology according to the operational regulations of the Ministry and other provisions issued by the Minister.
Chapter IV
IMPLEMENTING PROVISIONS
Article 8. The Director of the Vietnam Atomic Energy Institute collaborates with the Head of the Cadre and Civil Servant Organization Department to be responsible for organizing the implementation of this Charter.
Article 9. Any amendments or supplements to this Charter shall be proposed by the Director of the Vietnam Atomic Energy Institute in collaboration with the Head of the Cadre and Civil Servant Organization Department for consideration and decision by the Minister of Science and Technology./.
