Article 1. Position and Function
1. The South Water Resources Planning Institute is established based on the upgrade of the South West Region Survey and Planning Branch under the Water Resources Planning Institute according to Article 1 of Decision No. 341/2005/QĐ-TTg dated December 26, 2005 of the Prime Minister on upgrading the South West Region Survey and Planning Branch under the Water Resources Planning Institute to become the South Water Resources Planning Institute directly under the Ministry of Agriculture and Rural Development.
2. The South Water Resources Planning Institute is a specialized unit for water resources planning with the function of researching and developing water resources planning to regulate, utilize, protect, and sustainably develop water resources and aquatic environments to serve the socio-economic development of southern provinces (mainly the Mekong Delta region).
3. The South Water Resources Planning Institute is a public service entity with income; it has legal personality; it has its own seal; it is allowed to open accounts at the State Treasury and commercial banks in accordance with the law; its name in English is Southern Institute For Water Resources Planning (abbreviated as SIWRP).
Its main office is located in Ho Chi Minh City
Article 2. Tasks of the South Water Resources Planning Institute
1. Organizing the preparation of survey and design projects for water resources planning including:
a. Planning projects:
- Comprehensive planning by river basins and economic regions;
- Water supply and drainage for agricultural, industrial zones, large urban areas, and concentrated residential areas;
- Flood control and disaster prevention;
- Small hydropower development.
b. Environmental surveys and water quality assessments;
c. Topographic, geological, and hydrological surveys to support water resources development;
d. International cooperation projects assigned by the Minister;
e. Transboundary river projects assigned by the Minister.
These planning and design projects shall be carried out in accordance with the Construction Law; Decree No. 08/2005/NĐ-CP dated January 24, 2005 of the Government, and current regulations of the State.
2. Guiding localities within the region in preparing design and planning projects for local water resources infrastructure, participating and coordinating with relevant sectors in developing regional socio-economic plans to ensure the consistency of planning with national socio-economic development.
3. Guiding and supporting localities within the region in implementing approved planning projects, identifying unreasonable aspects and deficiencies to improve and perfect these planning projects.
4. Researching and regularly updating comprehensive schemes for river exploitation, providing up-to-date data on water balance to assist the Ministry in deciding on water resource extraction (surface and groundwater) in river basins as assigned by the Minister.
5. Participating in the review of water resources planning projects prepared by localities and other agencies as decided by the Minister of Agriculture and Rural Development.
6. Participating in the development of strategies for water resources development as assigned by the Minister.
7. Preparing operation programs for major integrated water resources facilities.
8. Surveying water quality for various economic and domestic needs, monitoring and evaluating water quality in river basins, reservoirs, coastal areas, islands, flood-prone areas, and predicting the spread of water pollution to serve water resources planning.
9. Investigating and forecasting the impact of existing and planned water resources projects on the environment and ecology.
10. Implementing basic investigations specifically for water resources planning and water protection such as:
a. Topography, geology, hydrology (surface and groundwater);
b. Water quality and aquatic environmental ecology;
c. Socio-economic conditions related to water use and protection.
11. Participating in the development of procedures, standards, and methodologies for water resources planning and design as assigned by the Minister of Agriculture and Rural Development.
12. Organizing and participating in research programs and topics related to water resources planning, water development and protection, and training and enhancing the expertise of staff in the assigned field.
13. Cooperating with planning agencies under the Ministries of Fisheries, Construction, Transport, Natural Resources and Environment, and other relevant sectors and localities in the rational and sustainable use of water resources.
14. Implementing office work for the River Basin Management Board as assigned.
Article 3. Organizational Structure
15. Implementing international cooperation tasks in the water sector, water environment, and water quality in accordance with the Ministry's and State's regulations.
1. Leadership of the Institute:
The organizational structure of the South Water Resources Planning Institute includes the leadership of the South Water Resources Planning Institute and subordinate specialized units (Departments, Bureaus, Centers, Office).
The Director and Deputy Directors of the South Water Resources Planning Institute are appointed and relieved of their positions by the Minister of Agriculture and Rural Development in accordance with current State regulations.
The Director of the South Water Resources Planning Institute manages and oversees all activities of the South Water Resources Planning Institute, being fully responsible before the Minister of Agriculture and Rural Development and the law for all activities of the Institute.
Deputy Directors assist the Director and are responsible before the Director and the law for the tasks assigned to them.
2. Specialized and operational departments:
a. Institute management block:
- Human Resources and Administrative Department;
- General and Technical Department;
- Planning and International Cooperation Department;
- Finance and Accounting Department;
- Advisory Councils (Science and Technology, Economy, Personnel...).
b. Planning and Design Block:
- Southwest Region Water Resources Planning Department
- Hydrological Survey Room - Water Source;
- Topography and Geology Room;
3. Subordinate units:
a. Water Quality and Environment Center;
b. Consulting and Technology Transfer Center for the Water Sector.
4. Office of Basin Planning Management Board.
a) . Office of Dong Nai River Basin Planning Management Board;
b) . Office of Mekong River Basin Planning Management Board;
These offices are established and operate pursuant to Decision No. 37/2001/QĐ-BNN-TCCB and Decision No. 38/2001/QĐ-BNN-TCCB dated April 9, 2001 of the Minister of Agriculture and Rural Development.
Article 4. Effective date
This Decision shall take effect fifteen days from the date of publication in the Official Gazette; it abolishes previous regulations of the Ministry that conflict with this Decision.
Article 5. Responsibilities for Implementation
1. The Director of the Institute of Water Resources Planning is responsible for transferring the Southern Branch of the Survey and Planning Institute of Water Resources in its current state to the Southern Institute of Water Resources Planning in accordance with the current regulations of the State.
2. The Director of the Southern Institute of Water Resources Planning is responsible for drafting the charter of organization and operation of the Institute to be submitted to the Ministry for promulgation; registering the activities of the Institute with competent state agencies in accordance with the law.
3. The Head of the Ministry's Office, the Director of the Personnel Department, the Director of the Water Resources Administration Bureau, the Director of the Finance Department, the Heads of relevant agencies and units under the Ministry, the Chairpersons of the People's Committees of centrally governed cities and provinces, the Directors of the Institute of Water Resources Planning, and the Directors of the Southern Institute of Water Resources Planning are responsible for implementing this Decision./.
