On the basis of Decree No. 29/2004/NĐ-CP dated January 16, 2004 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Trade;

Article 1. Amend Rule 6 of Appendix I of Decision No. 1727/2003/QĐ-BTM dated December 12, 2003, issued by the Minister of Trade on the issuance of Certificate of Origin Model E of Vietnam for goods to enjoy preferential tariff treatment under the Framework Agreement on Comprehensive Economic Cooperation between the Association of Southeast Asian Nations and the People's Republic of China (hereinafter referred to as Decision No. 1727/2003/QĐ-BTM), as follows:
"Rule 6: Specific Origin Criteria for Goods
Goods that have undergone substantial transformation in one Party shall be considered as originating from that Party. Goods meeting the specific origin criteria set forth in Appendix V of this Decision shall be deemed to have undergone substantial transformation in one Party."
Article 2. Supplement Appendix V of Decision No. 1727/2003/QĐ-BTM.
Article 3. This Decision takes effect fifteen days after its publication in the Official Gazette. The Heads of the Office, the Director General of the Organization and Cadres Department, the Director General of the Import-Export Department, and the Heads of relevant agencies under the Ministry of Trade are responsible for implementing this Decision./.
