THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Article 16 of Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Considering the proposal of the Director of the Department of Personnel Organization,
DECISION:
Article 1. Position and Functions
The Financial Department is the advisory and consolidating body assisting the Minister in performing state management functions in the agricultural and rural development sector regarding financial, accounting, and pricing matters within the scope of the Ministry's state management.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Take the lead in drafting mechanisms, policies, and related regulatory documents for finance and pricing in the agricultural and rural development sector to be submitted to the Minister.
2. Take the lead and advise the Minister on implementing laws, ordinances, and related regulatory documents concerning financial, accounting, and pricing matters in the agricultural and rural development sector.
3. Take the lead in directing, inspecting, summarizing, and reporting on public financial reform within the Ministry’s administrative reform program.
4. Take the lead and advise on amending, supplementing, and adjusting regulations pertaining to financial, accounting, and pricing matters relevant to the agricultural and rural development sector.
5. Take the lead in developing medium-term budget expenditure plans for the sector.
6. Guide subordinate agencies and units under the Ministry in preparing annual revenue and expenditure budgets; submit the national budget revenue and expenditure plan and allocation proposals for the annual national budget to the Minister. Approve budget expenditure tasks for subordinate agencies and units in accordance with current standards, norms, and regulations.
7. Take the lead in submitting to the Minister decisions on the use of annual public service funds with investment characteristics for subordinate units.
8. Propose measures for financial handling of urgent expenditure tasks for subordinate agencies and units under the Ministry to be submitted to the Minister.
9. Recommend solutions to issues related to tax for programs and projects to be resolved by the Minister.
10. Regarding state management of state assets at administrative agencies, public service organizations, and project management boards under the Ministry:
a) Take the lead and coordinate with relevant agencies and units in formulating and submitting to the Minister for issuance standards, norms, and regulations on the use of state assets serving specialized activities of units under the Ministry's jurisdiction.
b) Guide and inspect the registration of state asset management rights according to current regulations.
c) Advise and propose asset disposal options (reassignment, recovery, sale, liquidation) for agencies and units under the Ministry according to current regulations.
d) Guide and summarize the results of state asset inventory according to legal provisions.
đ) Take the lead in inspecting compliance with procurement, management, and use of state assets. Summarize and report on the management and use of state assets under the Ministry's jurisdiction to relevant agencies.
e) Guide the management and advise on disposal options for assets of projects funded by the state budget and projects with funds considered from the state budget upon completion.
11. Take the lead in approving and announcing final accounts for budget expenditures (including price subsidies and national reserve goods) for subordinate units. Lead in auditing annual final accounts, auditing and submitting to the Minister for approval of final accounts for Group A projects. Audit and be authorized by the Minister to approve final accounts for Group B and C projects funded by state resources.
12. Take the lead in organizing inspections and supervision of financial and accounting management in the use of the state budget at agencies and units under the Ministry. Recommend to the Minister actions against violations according to the law.
13. Take the lead in guiding, inspecting, and summarizing the implementation of the Law on Thrift and Prevention of Waste in organizations, agencies, and units under the Ministry.
14. Summarize and publicly disclose annual state budget estimates and final account reports according to legal provisions.
15. Participate in drafting strategies, planning, annual plans, and other regulatory documents as assigned by the Minister.
16. Participate in review boards for scientific research programs, development investment projects, basic investigation projects, planning projects, official development assistance loan projects, non-refundable aid projects, etc., in the sector as assigned by the Ministry and as provided by law.
17. Participate with relevant units in investment policy and annual investment capital allocation plans for projects under the Ministry's jurisdiction.
18. Participate in training and professional development for financial and accounting staff in the sector.
19. Provide opinions on the appointment, dismissal, commendation, and disciplinary action of chief accountants or accounting supervisors in administrative agencies, public service organizations, and project management boards within the Minister's authority.
20. Organize the implementation of administrative reform according to the Ministry's program and plans as assigned by the Minister.
21. Participate in international cooperation and economic integration activities related to finance and other relevant matters.
22. Manage state finances of funds established by the Ministry according to the law.
23. Manage civil servants, files, assets, and other resources allocated according to regulations.
24. Perform other tasks assigned by the Minister.
Article 3. Organizational Structure
1. Leadership of the Department: The Department is led by the Director and Deputy Directors appointed and relieved of duty by the Minister of Agriculture and Rural Development according to regulations.
The Director manages the Department's operations and is responsible before the Minister of Agriculture and Rural Development and the law for the Department's activities.
Deputy Directors assist the Director in overseeing certain tasks as assigned by the Director and are responsible before the Director and the law for the tasks assigned.
2. Civil servants of the Department are responsible for performing assigned tasks; they have obligations and rights as prescribed by law.
The Director is responsible for directing the development, issuance, and implementation of the Operating Regulations of the Department; arranging civil servants in accordance with their positions, standards, job descriptions, and assigned tasks.
Article 4. Effective date
This Decision shall take effect fifteen days from the date of publication in the Official Gazette. Decree No. 99/2003/QĐ-BNN dated September 4, 2003, issued by the Minister of Agriculture and Rural Development regarding the functions, tasks, authorities, and organizational structure of the Finance Department, and any previous provisions that conflict with this Decision, are hereby repealed.
Article 5. Responsibilities for Implementation
The Director of the Finance Department, the Head of the Ministry's Office, the Directors of other Departments, the Heads of Bureaus, the Inspector General of the Ministry, and the Heads of related agencies and units are responsible for implementing this Decision./.
