CIRCULAR

Guidelines on the working regime of vocational teachers

Pursuant to the Education Law (2005);
Pursuant to the Vocational Training Law (2006);
Pursuant to Decision No. 188/1999/QD-TTg dated September 17, 1999 of the Prime Minister regarding the 40-hour workweek;
The Ministry of Labor, Invalids and Social Affairs hereby provides guidelines on the working regime of vocational teachers as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

Regulations on the working regime of teachers teaching at the college, intermediate, and basic vocational levels in vocational colleges, intermediate vocational schools, vocational training centers; universities, colleges, intermediate professional schools, and other educational institutions and enterprises registered for vocational training (referred to collectively as vocational training institutions).

Regular teachers (permanent or contractual with a term of 12 months or more) directly engaged in teaching, and staff involved in management who also teach at public and private vocational training institutions.

3. Provisions on teaching hours, conversion of teaching hours, standard teaching hours, class size

a) Teaching hours, conversion of teaching hours

- Teaching hours within the training plan are calculated in hours;

- One hour of theoretical teaching, which is 45 minutes, is counted as one standard hour;

- One hour of integrated teaching (combining both theory and practice), which is 45 minutes, is counted as one standard hour;

- One hour of practical teaching, which is 60 minutes, is counted as one standard hour.

b) Standard teaching hours are the number of standard hours set for each teacher to teach, specified annually or weekly.

c) A theoretical class shall not exceed 35 students. A practical class shall not exceed 18 students for ordinary trades; not more than 10 students for trades that are arduous, hazardous, dangerous, and particularly arduous, hazardous, and dangerous (as listed by the Ministry of Labor, Invalids and Social Affairs). The principal or director of vocational training institutions shall determine the specific number of students in each class, ensuring it is appropriate for the characteristics of each trade.

II. WORKING REGIME OF TEACHERS TEACHING AT THE COLLEGE AND INTERMEDIATE VOCATIONAL LEVELS

1. Tasks

a) Teaching activities include:

- Lesson preparation: writing lesson plans, outlining lecture outlines, preparing materials and equipment for module and subject teaching assignments;

- Teaching modules and subjects according to the schedule and program regulations;

- Guiding internships, combined internship and production work; coaching students for skill competitions at various levels;

- Evaluating student learning outcomes: preparing exams, conducting inspections; supervising exams, inspections, and evaluations; grading admission and graduation exams; evaluating research results;

- Compiling textbooks and teaching materials. Providing comments on the development of programs, subject contents, and assigned module teaching;

- Participating in designing and building specialized classrooms; designing, improving, and making teaching aids and equipment;

b) Organizing educational and training activities for students.

c) Studying and enhancing qualifications; observing classes, exchanging experiences, improving teaching methods; participating in professional and technical activities.

d) Participating in teacher training as required by the school's professional and technical development needs.

đ) Conducting scientific research, applying scientific and technological advancements or innovations to vocational training and practical production. Guiding students in scientific research activities.

e) Participating in the management of training activities.

g) Performing other tasks as stipulated and required by the school.

2. Working hours and annual leave

a) The working hours of vocational teachers are 44 weeks per academic year, including:

- Teaching and educating students: 32 weeks for college vocational teachers; 36 weeks for intermediate vocational teachers;

- Studying, enhancing qualifications, and conducting scientific research: 12 weeks for college vocational teachers; 8 weeks for intermediate vocational teachers.

In cases where teachers do not fully utilize their time for studying, enhancing qualifications, and conducting scientific research as prescribed, the Principal will allocate the remaining time for teaching duties.

b) Annual leave for teachers is 8 weeks, including summer break, Tet holiday, and national holidays.

Teachers who complete their assigned tasks are entitled to 8 weeks of leave. Staff involved in student management are entitled to leave similar to teachers.

Managers who participate in teaching and complete their professional tasks and meet the standard teaching hours are entitled to 6 weeks of leave.

Summer break, Tet holiday, and national holidays are compensated with full salary and allowances (if applicable) and social insurance and health insurance benefits as prescribed.

Based on the academic year plan and specific conditions of each institution, the Principal will arrange leave for teachers at appropriate times.

3. Standard teaching hours for teachers

a) The standard teaching hours for teachers in one academic year: from 380 to 450 standard hours for college vocational teachers; 430 to 510 standard hours for intermediate vocational teachers.

The Principal will decide on the standard teaching hours for each teacher in one academic year based on the actual situation of the institution, the characteristics of each module and subject, and the teacher's qualifications.

The standard teaching hours for teachers teaching common subjects (National Defense and Security Education, Physical Education, Politics, Law, Foreign Languages, Information Technology) in one academic year are 450 standard hours for college vocational teachers; 510 standard hours for intermediate vocational teachers.

The standard teaching hours for teachers teaching general education subjects in intermediate vocational schools are implemented according to Circular Joint No. 35/2006/TTLT-BGDĐT-BNV dated August 23, 2006 of the Ministry of Education and Training and the Ministry of Home Affairs guiding staffing norms for civil servants in public general education institutions.

b) Minimum standard teaching hours for managers participating in teaching in one academic year are as follows:

- Principal: 30 hours/year;

- Deputy Principal: 40 hours/year;

- Department Head and equivalent positions: 60 hours/year;

- Deputy Department Head and equivalent positions: 70 hours/year;

- Staff of the Training Department: 80 hours/year.

4. Conversion of other specialized activities to standard hours

a) Teaching:

- Simultaneous teaching for multiple classes with the same program and level, from the third class onwards; 1 hour of theory is equivalent to 0.75 standard hours;

- In special cases where permission is required for class: teaching theory for a class with more than 35 students, each hour is equivalent to 1.2 standard hours; with more than 50 students, each hour is equivalent to 1.3 standard hours; maximum not exceeding 60 students;

- Teaching two different subjects or modules interwoven within the same time period: the number of standard hours taught is calculated with a factor of 1.1.

- Time spent on designing, improving, and making teaching equipment (approved at the department level or higher) is converted to standard hours; the Principal shall determine the appropriate number of standard hours based on specific conditions.

- Teaching, guiding, and enhancing the professional skills of other teachers in the school: 1 hour is equivalent to 1.5 standard hours;

- For physical education and national defense education teachers, the time spent on sports activities and military training for staff, teachers, and employees of the school is counted as teaching time.

b) Preparing examination questions, supervising examinations, grading examinations for the semester, end-of-module, and subject examinations:

- Preparing examination questions:

+ One essay-type examination question with answers is equivalent to 1 standard hour;

+ One multiple-choice examination question with answers is equivalent to 1.5 standard hours;

+ One oral examination question with answers is equivalent to 0.25 standard hours;

+ One practical examination question with answers is equivalent to 0.5 standard hours.

- Supervising examinations: 1 hour of supervision (theory - 45 minutes, practice - 60 minutes) is equivalent to 0.3 standard hours.

- Grading examinations:

+ Essay-type and multiple-choice examinations: 0.1 standard hour per paper;

+ Oral examinations: 0.2 standard hours per student;

+ Practical examinations: 0.2 standard hours per student.

c) Preparing final examination questions, supervising final examinations, grading final examinations:

- Preparing examination questions:

+ One essay-type final examination question with answers is equivalent to 2 standard hours;

+ One multiple-choice final examination question with answers is equivalent to 2.5 standard hours;

+ One oral final examination question with answers is equivalent to 0.5 standard hours;

+ One practical final examination question with answers is equivalent to 1.5 standard hours.

- Supervising examinations: 1 hour of supervision (theory - 45 minutes, practice - 60 minutes) is equivalent to 0.5 standard hours.

- Grading examinations:

+ Essay-type and multiple-choice examinations: 0.2 standard hours per paper;

+ Oral examinations: 0.4 standard hours per student;

+ Practical examinations: 0.4 standard hours per student.

d) Guiding internships, internships combined with production work: 1 working day (8 hours) is equivalent to 2.5 to 3 standard hours depending on the nature of the work and specific working conditions.

đ) Time spent preparing students for skill competitions at various levels is counted as teaching time.

e) Compiling textbooks and teaching materials used in the school: 1 page of original authorship is equivalent to 1 standard hour for new compilation, 1 page of original authorship is equivalent to 0.5 standard hours for recompilation or under contract, paid according to current regulations.

g) The Principal shall specify the conversion of other specialized activities and vocational tasks to standard hours for calculating the teaching load for each teacher.

5. Overtime Teaching System

During the academic year, if a teacher completes assigned tasks and the number of teaching hours exceeds the standard teaching hours set by the Principal as stipulated in Clause 3, Section II of this Circular, such excess hours will be considered overtime teaching. The number of overtime hours shall not exceed half of the standard teaching hours for full-time teachers, one-third of the standard teaching hours for part-time teachers, but not more than 200 hours in one academic year. Payment for overtime teaching is made according to current regulations.

6. Reduced Teaching Hours for Teachers

a) Teachers involved in management duties:

- Class advisors: are entitled to a reduction of 15% of the standard teaching hours;

- Teachers responsible for specialized classrooms: those with dedicated staff are entitled to a reduction of 10% of the standard teaching hours; without dedicated staff, they are entitled to a reduction of 15% of the standard teaching hours;

- Teachers concurrently responsible for the library: are entitled to a reduction of 15% of the standard teaching hours; teachers concurrently serving as head of a department: are entitled to a reduction of 15-20% of the standard teaching hours;

- Teachers serving as department heads, station chiefs, or camp chiefs: are entitled to a reduction of 30% of the standard teaching hours; deputy department heads, deputy station chiefs, or deputy camp chiefs: are entitled to a reduction of 20% of the standard teaching hours.

b) Teachers concurrently engaged in Party and mass organization work:

- Teachers concurrently serving as Secretary of the School Party Committee or Secretary of the School Branch Committee, and Chairperson of the School Trade Union: are entitled to a reduction of 20-30% of the standard teaching hours; teachers concurrently serving as Deputy Secretaries or Deputy Chairpersons of these positions: are entitled to a reduction of 15-20% of the standard teaching hours;

- Teachers concurrently serving as Secretary of the Youth League, Deputy Secretary of the Youth League, Chairperson of the Student Union, or Chairperson of the Young People's Association at the school level: are entitled to benefits and policies according to Decision No. 61/2005/QĐ-TTg dated March 24, 2005, of the Prime Minister regarding benefits and policies for Communist Youth League cadres, Vietnam Student Union, and Vietnam Young People's Association in universities, colleges, vocational schools, and high schools;

- Teachers concurrently holding multiple positions are entitled to a maximum reduction of 45% of the standard teaching hours;

- Depending on the scale of the school and the number of members in each organization, after consultation with relevant organizations, the Principal shall decide on the percentage of reduced hours for each position within the prescribed limits.

c) Reduced Teaching Hours for Other Teachers:

- Teachers teaching practical courses in particularly arduous, hazardous, or dangerous trades (as listed by the Ministry of Labor, Invalids, and Social Affairs) are entitled to a reduction of 10% of the standard teaching hours;

- Teachers during their probationary or trial periods are entitled to a reduction of 30% of the standard teaching hours;

- Female teachers with children under 12 months old are entitled to a reduction of 15% of the standard teaching hours.

III. WORK REGIME FOR TEACHERS TEACHING VOCATIONAL BEGINNER LEVEL

1. Tasks

a) Teaching activities include:

- Preparation for teaching: drafting lesson plans, outlining lecture outlines, preparing materials and equipment for the assigned module teaching;

- Teaching the assigned module according to the plan and program regulations.

- Evaluate students' academic performance: prepare examination questions; supervise examinations, assess results;

- Compile textbooks and teaching materials; provide comments on the development of curricula and module contents assigned for teaching;

- Participating in designing and building specialized classrooms; designing, improving, and making teaching aids and equipment;

b) Organize educational activities and student training;

c) Engage in professional development: participate in specialized and vocational activities (observing classes, exchanging experiences, improving teaching methods, etc.);

d) Participate in teacher training according to the requirements for professional and vocational development of the institution;

đ) Participate in managing training activities;

e) Other duties as prescribed and required by the institution;

2. Working hours and annual leave

a) The working period for primary vocational teachers is 46 weeks per academic year, including:

- Teaching and educating students: 42 weeks;

- Professional development: 4 weeks

If teachers do not utilize all allocated time for professional development, the Director shall arrange the remaining time for teaching activities;

b) Annual leave for teachers is 6 weeks, including summer break, Tet holiday, and other public holidays;

Teachers who complete their assigned tasks are entitled to 6 weeks of leave;

Managers who also teach, upon completion of their professional tasks and meeting the standard teaching hours, are entitled to 5 weeks of leave;

Summer break, Tet holiday, and national holidays are compensated with full salary and allowances (if applicable) and social insurance and health insurance benefits as prescribed.

Based on the academic year plan and specific conditions of each center, the Director shall schedule leave at appropriate times;

3. Standard teaching hours for teachers

a) Standard teaching hours for teachers: 14 standard hours/week;

b) Minimum standard teaching hours for managers participating in teaching in one academic year are as follows:

- Director: 35 hours/year;

- Deputy Director: 45 hours/year;

- Training Department Head: 65 hours/year;

- Deputy Training Department Head: 75 hours/year;

4. Conversion of other professional activities into standard hours; overtime teaching system; reduction in teaching hours for teachers;

The conversion of other professional activities into standard hours, the overtime teaching system, and the reduction in teaching hours for teachers shall be implemented in accordance with the provisions of Clause 4, Clause 5, and Clause 6 of Section II of this Circular;

IV. IMPLEMENTATION

This Circular takes effect 15 days from the date of publication in the Official Gazette and replaces Circular No. 02/2002/TT-BLDTBXH dated January 4, 2002. Any issues arising during implementation should be reported to the Ministry of Labor, Invalids, and Social Affairs for consideration and resolution;
