CIRCULAR

Regulations on the Standards for the Heads of Provincial Inspectorates under Central Cities

Based on the Inspection Law dated November 15, 2010;

Pursuant to Decree No. 65/2008/NĐ-CP dated May 20, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Inspectorate;

Pursuant to Decision No. 82/2004/QĐ-BNV dated November 17, 2004 of the Minister of Home Affairs on issuing standards for Directors of Departments and equivalent positions under provincial People's Committees;

The Government Inspectorate hereby stipulates the standards for the Heads of Provincial Inspectorates under central cities as follows:

Article 1. Position and Responsibilities

The Head of the Inspectorate of a province or a centrally governed city (referred to collectively as the Head of the Provincial Inspectorate) is the head of the provincial inspectorate, responsible for leading, directing, managing, and overseeing the operations of the provincial inspectorate; advising the provincial People's Committee on implementing state management functions regarding inspection work, handling complaints and grievances, and anti-corruption within the province in accordance with the law.

Article 2. Tasks

Clause 1. The Head of the Provincial Inspectorate is accountable to the provincial People's Committee, concurrently accountable to the Chief Inspector General of the Government Inspectorate and to the law in performing state management functions in the field of inspection, complaint resolution, and anti-corruption within the specific area:

Point a) Developing inspection programs and plans to be submitted to the Chairman of the provincial People's Committee for decision and organizing their implementation;

Point b) Drafting and submitting to the provincial People's Committee for issuance local regulatory documents concerning inspection, complaint resolution, and anti-corruption; proposing amendments and supplements to regulatory documents, systems, and policies in the fields of inspection, complaint resolution, and anti-corruption;

Point c) Directing, urging, and inspecting the implementation of national regulations on inspection work, complaint resolution, and anti-corruption by county People's Committees, Department Directors, and units subordinate to the provincial People's Committee;

Point d) Directing inspection work and providing administrative inspection guidance to county inspectorates and department inspectorates;

Point đ) Organizing the collection, statistics, and reporting of information on the activities of the provincial inspectorate under the management of the provincial People's Committee;

Point e) Organizing the review, summary, and experience extraction from inspection activities, complaint resolution, and anti-corruption within the scope of management of the provincial People's Committee, on this basis proposing supplements, amendments, and improvements to regulatory documents already issued by competent authorities; taking the lead or participating in scientific research projects and applications in state management of inspection work, complaint resolution, and anti-corruption activities.

Clause 2. Leading and directing inspections of the implementation of policies, laws, and tasks and powers of county People's Committees, departments, and units directly subordinate to the provincial People's Committee; inspecting state-owned enterprises established by the Chairman of the provincial People's Committee and other cases assigned by the Chairman of the provincial People's Committee within the scope of provincial management.

Clause 3. Advising and assisting the Chairman of the provincial People's Committee in organizing, directing, and implementing tasks related to complaint resolution, grievance handling, and anti-corruption according to the law.

Clause 4. Performing tasks as prescribed in Article 22 of the Inspection Law and guiding documents.

Clause 5. Managing civil servants and inspectors under the provincial inspectorate; effectively managing and utilizing assets and finances allocated according to regulations.

Clause 6. Performing other tasks assigned by the Chairman of the provincial People's Committee or delegated by the Chief Inspector General of the Government Inspectorate in accordance with the law.

Article 3. Qualities

1. Patriotic, politically steadfast, loyal to the Party's and State's political lines and viewpoints, resolute in the renewal path, national independence, and socialism; devotedly serving the people.

2. Work with a sense of responsibility, high efficiency; frugal, honest, impartial, and incorruptible; not opportunistic, not corrupt, firmly struggling against corruption and negative phenomena; practicing thrift to combat waste.

3. Have organizational discipline awareness; be truthful, objective, decisive, and willing to take responsibility; have a spirit of self-criticism and criticism.

4. United and democratic with colleagues, exemplary in morality and lifestyle; closely connected with the people, trusted by the collective of civil servants and inspectors at the workplace and by the local residents.

Article 4. Competence

1. Possess advisory, organizational, and implementation capabilities for the Party's and State's policies on inspection work, complaint resolution, and anti-corruption efforts.

2. Possess research and drafting skills for regulatory legal documents, proposing effective solutions for inspection work, complaint resolution, and anti-corruption efforts.

3. Possess leadership skills for large-scale inspection teams with complex circumstances.

4. Possess management capabilities; have the ability to unite and mobilize cadres and civil servants, harness collective strength, and coordinate well with related organizations to fulfill assigned tasks.

Article 5. Knowledge

1. Proficient in the Party's and State's guidelines, policies, direction, and tasks of the Inspection sector.

2. Proficient in legal knowledge and inspection work practices, complaint resolution, and anti-corruption efforts; have experience in organization, management, and leadership.

3. Understand other relevant specialized fields, economic, political, cultural, and social conditions of the locality and the country.

Article 6. Qualifications

1. Meet the professional standards for Senior Inspector or equivalent and above.

2. Hold a bachelor's degree or higher, suitable for inspection work.

3. Hold a Master's Degree in Political Theory or equivalent.

4. Hold a Master's Degree in Public Administration for Senior Specialist positions or above.

5. Be proficient in a commonly used foreign language at level C or higher. In provinces with a significant number of ethnic minorities, it is encouraged to learn and use ethnic minority languages for work purposes.

6. Be proficient in using computers and office equipment for work purposes.

Article 7. Other Conditions

1. Have practical experience in leadership and management at the Deputy Director of Provincial Inspectorate level or equivalent and above; have five years or more working in the inspection sector or in management roles within Party and Government agencies.

2. Cadres and civil servants appointed for the first time to the position of Provincial Inspectorate Director shall not exceed fifty-five years old for males and fifty years old for females.

3. Not currently undergoing disciplinary action from a reprimand or higher.

4. Cadres and civil servants appointed to the position of Provincial Inspectorate Director must be included in the planning for such appointments or equivalent positions.

5. Must have complete and clear personal files and history without violating Regulation No. 57-QD/TW dated May 3, 2007 of the Politburo on internal political protection of the Party, confirmed by the competent authority.

Article 8. Implementation clause

1. This Circular takes effect forty-five days from the date of issuance and replaces Decision No. 854/QĐ-TTNN dated September 10, 1994 of the State Inspector General (now the State Inspector General Office) regarding the issuance of standards for Provincial Inspectorate Directors.

2. The Chairman of the People's Committee of the province, centrally-administered city is responsible for implementing this Circular./.
