CIRCULAR
Guidelines for the Export of Lime and Calcined Dolomite

Pursuant to Decree No. 62/2013/NĐ-CP dated June 25, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;
Pursuant to Decree No. 24/2016/NĐ-CP dated May/4/2016, 2016 of the Government on management of construction materials;
Considering the proposal of the Director of the Department of Construction Materials;
The Minister of Construction issues this Circular guiding the export of lime and calcined dolomite,
Article 1. Scope of Regulation and Applicability
Article 1. This Circular guides certain conditions related to the export of lime (HS Code: 2522.10.00; 2522.20.00; 2522.30.00) and calcined dolomite (HS Code: 2518.20.00), as well as the documents and procedures that enterprises must follow when exporting lime and calcined dolomite in accordance with the regulations of the Customs authorities.
Article 2. This Circular applies to state management agencies, organizations, and enterprises involved in the exploitation, production, and export of lime and calcined dolomite.
Article 3. Conditions for the Export of Industrial Lime and Calcined Dolomite
Clause 1. Industrial lime and calcined dolomite exported must be produced from industrial facilities located within the Planning for the Development of the Lime Industry until 2020 and Oriented to 2030, which has been approved by competent state authorities (hereinafter referred to as the Planning).
Clause 2. The quantity of lime and calcined dolomite products exported from each production facility shall not exceed the capacity permitted by competent state authorities for investment according to regulations and shall not exceed the capacity recorded in the Planning.
Clause 3. Enterprises must submit copies of mining permits issued in accordance with regulations for the production of lime and calcined dolomite to the Customs authority when exporting.
Article 4. Conditions for the Export of Handcrafted Lime and Calcined Dolomite
Clause 1. Products of handcrafted lime and calcined dolomite exported from production facilities shall gradually decrease according to the schedule for elimination set forth in the Planning and implementation plan issued by provincial People's Committees, ensuring that handcrafted lime and calcined dolomite exports cease after 2020.
Clause 2. Based on the balance between domestic demand for lime and calcined dolomite and exports, opinions of provincial People's Committees, the Ministry of Construction will guide the export of lime and calcined dolomite from handcrafted production facilities.
Clause 3. Enterprises must submit copies of mining permits issued in accordance with regulations for the production of lime and calcined dolomite to the Customs authority when exporting.
Article 5. Conditions for Trading Enterprises Exporting Lime and Calcined Dolomite
Products of lime and calcined dolomite exported must comply with the provisions of Articles 3 and 4 of this Circular.
Article 6. Reports by Enterprises on the Export of Lime and Calcined Dolomite
Clause 1. Enterprises exporting lime and calcined dolomite are responsible for reporting to relevant agencies where they invest in production and business every six months (before February 15 and August 30 each year) or at any time upon request for management purposes.
Clause 2. The content of the report follows Form 1a, 1b attached to this Circular; enterprises bear full responsibility for the accuracy and truthfulness of the reported data and information.
Article 6. Implementation Organization
Article 7. This Circular takes effect from July 25, 2017.
Article 8. In the course of implementation, if there are difficulties, ministries, sectors, localities, organizations, and individuals should promptly reflect them to the Ministry of Construction for consideration and resolution./.
