Based on the Law on Foreign Trade Management dated June 12, 2017;
Pursuant to Decree No. 98/2017/NĐ-CP dated August 18, 2017, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 69/2018/NĐ-CP dated May 15, 2018 of the Government detailing certain provisions of the Law on Foreign Trade Management;
Pursuant to Decree No. 112/2014/NĐ-CP dated November 21, 2014 of the Government on management of land border gates;
At the proposal of the Director of the Import-Export Department,
The Minister of Industry and Trade issues this Circular to stipulate the implementation schedule for import and export ports through land borders for goods traded under temporary import for re-export and transshipment, and stored in bonded warehouses.
Article 1. Scope of Regulation
This Circular stipulates the implementation schedule for import and export ports through land borders for goods traded under temporary import for re-export and transshipment, and temporarily imported for re-export stored in bonded warehouses.
Article 2. Applicability
1. Business entities participating in activities of trading under temporary import for re-export, transshipment, and storage in bonded warehouses.
2. Organizations and management agencies for activities of trading under temporary import for re-export, transshipment, and storage in bonded warehouses.
3. Agencies, organizations, and individuals related to activities of trading under temporary import for re-export, transshipment, and storage in bonded warehouses.
Article 3. Provisions on import and export ports
1. Goods traded under temporary import for re-export and transshipment, if imported into or re-exported from Vietnam through land borders, shall only be conducted through international border gates and main border gates (bilateral border gates) opened in accordance with Decree No. 112/2014/NĐ-CP dated November 21, 2014 of the Government on border gate management along land borders.
2. The provisions of Clause 1 of this Article apply to foreign goods temporarily imported for re-export stored in bonded warehouses if such goods are imported into or re-exported from Vietnam through land borders.
3. The provisions of Clauses 1 and 2 of this Article shall take effect from 00:00 on January 1, 2021.
Article 4. Effective date
1. This Circular takes effect from June 30, 2020.
2. During the implementation of this Circular, if any difficulties arise, business entities, relevant agencies, organizations, and individuals should report them in writing to the Ministry of Industry and Trade for resolution.
