JOINT RESOLUTION

       Guidelines for the negotiation process and introduction of candidates
for members of the 15th National Assembly term 2021-2026 and members of People's Councils at all levels
for the 2021-2026 term

On the basis of the Constitution of the Socialist Republic of Vietnam;

Pursuant to the Law on Elections of Deputies to the National Assembly and People's Councils No. 85/2015/QH13;

Pursuant to the Law on Legislative Regulatory Documents No. 80/2015/QH13, which has been amended and supplemented by some articles according to Law No. 63/2020/QH14;

The Standing Committee of the National Assembly, the Government, and the Central Steering Board of the Vietnam Fatherland Front issue this Joint Resolution to guide the negotiation process and introduction of candidates for members of the 15th National Assembly term 2021-2026 and members of People's Councils at all levels for the 2021-2026 term.

PART I

ORGANIZATION OF THE FIRST NEGOTIATION MEETING TO REACH AGREEMENT ON THE STRUCTURE, COMPOSITION, AND NUMBER OF CANDIDATES FOR NATIONAL ASSEMBLY DEPUTIES AND PEOPLE'S COUNCIL MEMBERS

Section 1

REGARDING THE NEGOTIATION AND NOMINATION

OF CANDIDATES FOR NATIONAL ASSEMBLY DEPUTIES

Article 1. Organization of the first negotiation meeting

1. The first negotiation meeting shall be organized within the period from February 3, 2021 to February 17, 2021.

2. The first negotiation meeting at the central level shall be convened and chaired by the Central Steering Board of the Vietnam Fatherland Front and carried out in accordance with Article 38 of the Law on Election of Deputies to the National Assembly and People's Councils.

3. The first negotiation meeting at the provincial level shall be convened and chaired by the Provincial Steering Board of the Vietnam Fatherland Front and carried out in accordance with Article 39 of the Law on Election of Deputies to the National Assembly and People's Councils.

Article 2. Content and procedures for organizing the first negotiation meeting

1. The negotiation meeting shall elect the chairperson from the Central Steering Board of the Vietnam Fatherland Front (for the central-level negotiation meeting) or from the Provincial Steering Board of the Vietnam Fatherland Front (for the local-level negotiation meeting) and the secretary of the meeting.

2. For the first negotiation meeting at the central level, representatives of the Standing Committee of the National Assembly shall present the proposed structure, composition, and number of people from political organizations, the Central Steering Board of the Vietnam Fatherland Front, political-social organizations, social organizations, state agencies, and military units at the central level who will be introduced as candidates for deputies to the National Assembly.

For the first negotiation meeting at the local level, representatives of the Provincial People's Council shall present the proposed structure, composition, and number of people from political organizations, the Vietnam Fatherland Front, political-social organizations, social organizations, state agencies, and military units at the local level who will be introduced as candidates for deputies to the National Assembly based on the proposal of the Standing Committee of the National Assembly.

3. The negotiation meeting shall discuss and agree on the structure, composition, and number of people from agencies, organizations, and units to be introduced as candidates for deputies to the National Assembly, ensuring the surplus number of candidates, the ratio of female candidates, and ethnic minority candidates in accordance with the Law on Election of Deputies to the National Assembly and People's Councils.

In case agreement cannot be reached on any issue, the meeting shall decide to vote by raising hands or secret ballot. The meeting shall appoint a counting team consisting of three to five persons. If voting by secret ballot is decided, the ballots must bear the seal of the Vietnam Fatherland Front at the level of the negotiation meeting. Only delegates present at the negotiation meeting may vote.

4. The meeting shall approve the minutes (in Model No. 01/BCĐBQH-MT attached to this Resolution).

5. The transmission of the minutes of the first negotiation meeting at the central level shall be carried out in accordance with Clause 3 of Article 38 of the Law on Election of Deputies to the National Assembly and People's Councils; at the provincial level, it shall be carried out in accordance with Clause 3 of Article 39 of the Law on Election of Deputies to the National Assembly and People's Councils.

Article 3. Adjustment and guidance on introducing candidates for nomination

1. Based on the results of the first negotiation, the Standing Committee of the National Assembly shall adjust for the first time the structure, composition, and number of people from agencies, organizations, and units at the central and local levels to be introduced as candidates for deputies to the National Assembly in accordance with Article 40 of the Law on Election of Deputies to the National Assembly and People's Councils. The adjustment document shall be immediately sent to the Vietnam Fatherland Front at the level of the negotiation meeting.

2. On the basis of the first adjustment by the Standing Committee of the National Assembly regarding the structure, composition, and number of people from agencies, organizations, and units to be introduced as candidates for deputies to the National Assembly, the Provincial Steering Board of the Vietnam Fatherland Front at the level of the negotiation meeting shall have the responsibility to notify the relevant agencies, organizations, and units about the number of people they are allocated to be introduced as candidates for deputies to the National Assembly and guide them on the content, procedure, and steps for introducing candidates and preparing candidate files in accordance with the Law on Election of Deputies to the National Assembly and People's Councils and Chapter II of this Resolution.

Section 2

REGARDING THE NEGOTIATION AND NOMINATION

CANDIDATES FOR DEPUTIES TO THE PEOPLE'S COUNCILS

Article 4. Organization of the First Round of Consultation Meetings

The first negotiation meeting at each level shall be organized within the period from February 3, 2021 to February 17, 2021, convened and chaired by the Provincial Steering Board of the Vietnam Fatherland Front at the same level and carried out in accordance with Article 50 of the Law on Election of Deputies to the National Assembly and People's Councils.

Article 5. Content and procedures for organizing the first negotiation meeting

1. The meeting appoints the chairperson from the Standing Committee of the People's Committee of the Vietnam Fatherland Front and the meeting secretary.

2. Representatives of the Standing Body of the People's Council at the provincial, district, and commune levels present the proposed structure, composition, and number of individuals to be recommended as candidates for representatives of their respective People's Councils from political organizations, Vietnam Fatherland Front Committee, political-social organizations, social organizations, military units, state agencies at the same level, public institutions, economic organizations, administrative units below, or villages, residential wards (for the commune level).

3. The meeting discusses to unify the structure, composition, and number of individuals to be recommended as candidates from agencies, organizations, units, and villages, residential wards (for the commune level), ensuring the surplus number of candidates, the ratio of female and ethnic minority candidates for People's Council representatives in accordance with the provisions of the Law on Election of National Assembly Deputies and People's Council Representatives.

In case agreement cannot be reached on any issue, the meeting shall decide to vote by raising hands or secret ballot. The meeting shall appoint a counting team consisting of three to five persons. The sending of the negotiation meeting minutes at the provincial, district, and commune levels shall be carried out in accordance with the provisions of Clause 4, Article 50 of the Law on Election of National Assembly Deputies and People's Council Representatives.

Article 6. Adjustment and Guidance on Introducing Candidates for Nomination

1. Based on the results of the first negotiation, the Standing Body of the People's Council at the provincial, district, and commune levels proceeds to make the first adjustment to the structure, composition, and number of individuals from agencies, organizations, units, and villages, residential wards (for the commune level) to be recommended as candidates for representatives of their respective People's Councils in accordance with the provisions of Article 51 of the Law on Election of National Assembly Deputies and People's Council Representatives. The adjustment document is immediately sent to the Vietnam Fatherland Front Committee at the level of the negotiation meeting organization.

2. On the basis of the adjustments made by the Standing Body of the People's Council at each level regarding the structure, composition, and number of individuals to be recommended as candidates for representatives of agencies, organizations, units, and villages, residential wards (for the commune level), the Standing Body of the Vietnam Fatherland Front Committee at the provincial, district, and commune levels is responsible for informing the agencies, organizations, units, villages, residential wards allocated to recommend candidates for People's Council representatives and guiding them on the content, procedure, and process of recommending candidates and preparing candidate files in accordance with the provisions of the Law on Election of National Assembly Deputies and People's Council Representatives and Chapter II of this Resolution.

Chapter II

AGENCIES, ORGANIZATIONS, UNITS RECOMMENDING CANDIDATES

IN SUPPLEMENTARY ELECTIONS

Section 1

NOMINATION AND INTRODUCTION OF CANDIDATES FOR NATIONAL ASSEMBLY DEPUTIES

Article 7. Agencies, organizations, units conducting the recommendation of candidates for National Assembly deputies

1. The recommendation of candidates for National Assembly deputies by agencies, organizations, and units is conducted within the period from February 24, 2021 to March 11, 2021.

2. Agencies, organizations, and units allocated to recommend candidates for National Assembly deputies implement the recommendation of their own agency, organization, or unit's personnel as candidates for National Assembly deputies according to the following steps:

a) The leadership body of the agency, organization, or unit convenes a meeting to propose individuals from their agency, organization, or unit to be recommended as candidates for National Assembly deputies;

b) Organize a meeting to seek opinions of voters within the agency, organization, or unit regarding the proposed candidates;

c) Based on the comments and trust of the voter meeting where the proposed candidates work (hereinafter referred to as the workplace), the leadership body of the agency, organization, or unit convenes an expanded leadership meeting to discuss and recommend candidates for National Assembly deputies.

Article 8. Meeting of the leadership of the agency, organization, or unit to propose candidates for election to representatives of the National Assembly

1. Participants in the meeting:

a) Leadership body of the political organization for political organizations, Vietnam Fatherland Front Committee, political-social organizations, social organizations;

b) The leadership body of the agency, organization, or unit and the Trade Union Executive Committee for state agencies, economic organizations, and public institutions;

c) The commander of the unit for military units.

2. Procedures and processes for organizing the meeting:

a) Representatives of the leadership of the agency, organization, unit, and the commander of the military unit introduce the purpose and requirements of the meeting, the proposed structure, composition, and number of individuals allocated to recommend candidates, the criteria for National Assembly deputies, and the steps to establish the list of recommended candidates;

b) Participants discuss the proposed recommendation of individuals from their agency, organization, or unit to be candidates for National Assembly deputies to obtain the comments of the voter meeting within the agency, organization, or unit;

c) The meeting approves the minutes (in Model No. 02/BCĐBQH-MT attached to this Resolution).

Article 9. Meeting to Solicit Opinions from Voters at Agencies, Organizations, and Units on Individuals Proposed for Nomination as National Assembly Deputies

1. The organization of meetings to solicit opinions from voters at agencies, organizations, and units on individuals proposed for nomination as National Assembly deputies shall be conducted in accordance with Articles 1, 3, and 4 of Resolution No. 1186/2021/UBTVQH14 of the Standing Committee of the National Assembly.

2. The minutes of the meeting shall be recorded using Model No. 02/HNCT attached to Resolution No. 1186/2021/UBTVQH14 of the Standing Committee of the National Assembly.

3. In cases where the individual proposed for nomination as a National Assembly deputy does not receive trust from more than 50% of the total number of voters attending the voter meeting at their place of work, the leadership of the agency, organization, or unit shall organize the introduction of another person.

The procedures and formalities for reintroducing the proposed candidate for election are implemented in accordance with Article 7 of this Resolution.

Article 10. Expanded Leadership Meeting of Agencies, Organizations, and Units to Discuss and Introduce Candidates for National Assembly Deputies

a) For political organizations, participants include the leadership body and representatives of the heads of subordinate units;

a) For political organizations, the Vietnam Fatherland Front, political-social organizations, social organizations, the participants in the meeting shall include the expanded Executive Board up to the heads of member organizations (if there are no member organizations, the expanded Executive Board meeting shall be held up to representatives of the leadership of subordinate units); the expanded Standing Committee up to representatives of the leadership of subordinate units or the expanded Permanent Standing Committee up to representatives of the leadership of subordinate units;

b) For state agencies, economic organizations, public service units, the participants in the meeting shall include the leadership of the agency and representatives of the Trade Union Executive Committee, and representatives of the leadership of subordinate units;

c) For people's armed forces units, the participants in the meeting shall include the unit commander, representatives of the Trade Union Executive Committee (if any), representatives of military personnel, and commanders of directly subordinate units.

a) Representatives of the leadership of the agency, organization, or unit, and the commander of the people's armed forces unit report on the situation and results of the meeting to seek opinions from voters regarding each person proposed to be introduced as a candidate;

a) Representatives of the leadership of agencies, organizations, units, and unit commanders of people's armed forces units report on the situation and results of the meeting to solicit opinions from voters at their place of work regarding each individual proposed for nomination;

b) Participants in the meeting discuss and express their approval of each introduced candidate through raising hands or secret ballot as decided by the meeting. The meeting shall establish a Counting Team consisting of three to five persons. If the decision is made to vote by secret ballot, the nomination letter must bear the seal of the agency, organization, or unit;

c) The meeting approves the minutes and list of introduced candidates (using Model No. 03/BCDBQH-MT attached to this Resolution).

1. Based on the results of the expanded leadership conference, the agency, organization, or unit has the responsibility to guide its selected and introduced candidates for National Assembly deputies to prepare candidacy application files in accordance with Article 35 of the Law on Elections of National Assembly Deputies and People's Council Deputies and the guidelines of the National Election Council.

1. Based on the results of the expanded leadership meeting, the agency, organization, or unit has the responsibility to guide the individuals chosen and introduced for nomination as National Assembly deputies from their own agency, organization, or unit to prepare their candidacy application according to Article 35 of the Law on Election of National Assembly Deputies and People's Council Deputies and the guidance of the National Election Council.

2. By no later than 17:00 on March 14, 2021, the candidate must complete the submission of the candidacy application for National Assembly deputies.

The submission of the candidacy application of candidates for National Assembly deputies shall be carried out in accordance with Clause 1 of Article 36 of the Law on Election of National Assembly Deputies and People's Council Deputies and the guidance of the National Election Council.

3. The sending of the minutes of the voter meeting at the place of work and the minutes of the leadership meeting of central agencies, organizations, and units shall be carried out in accordance with Clause 5 of Article 41 of the Law on Election of National Assembly Deputies and People's Council Deputies; at provincial level, it shall be carried out in accordance with Clause 5 of Article 42 of the Law on Election of National Assembly Deputies and People's Council Deputies and completed no later than March 14, 2021.

Section 2

THE INTRODUCTION OF CANDIDATES

Article 12. Agencies, organizations, units introducing candidates for People's Council deputies at provincial, district, and commune levels

1. The introduction of candidates for People's Council deputies by agencies, organizations, and units shall be conducted within the period from February 24, 2021 to March 11, 2021.

2. A person introduced as a candidate for a People's Council deputy of a certain locality must be a resident or regularly employed in that locality.

3. Agencies, organizations, and units allocated a number of candidates to introduce shall carry out the introduction of their own candidates for People's Council deputies according to the following steps:

a) The leadership board of the agency, organization, or unit convenes a meeting to propose candidates for People's Council deputies from their own agency, organization, or unit;

b) Organize a meeting of voters at the workplace to gather opinions on the proposed candidates;

c) Based on the comments and trust of the voter meeting, the leadership board organizes an expanded leadership meeting to discuss and introduce candidates.

4. The introduction of candidates from villages, residential wards for commune-level People's Council deputies shall be carried out in accordance with the provisions of Chapter II of Resolution No. 1186/2021/UBTVQH14 of the Standing Committee of the National Assembly.

Article 13. Meeting of the leadership board of the agency, organization, or unit to propose candidates for People's Council deputies

1. Participants in the meeting:

a) Leadership board for political organizations, Vietnam Fatherland Front Committee, political-social organizations, social organizations;

b) The leadership body of the agency, organization, or unit and the Trade Union Executive Committee for state agencies, economic organizations, and public institutions;

c) The commander of the unit for military units.

2. Procedures and formalities for organizing the meeting:

a) Representatives of the leadership of the agency, organization, unit, military personnel introduce the purpose, requirements of the meeting, the proposed structure, composition, number of candidates allocated, the criteria for People's Council deputies, and the procedures to establish the list of candidates;

b) Participants discuss the proposed introduction of candidates from their own agency, organization, or unit;

c) The meeting approves the minutes (according to Model No. 02/BCĐBHĐND-MT attached to this Resolution).

Article 14. Meeting to Gather Opinions of Voters at Workplace on Proposed Candidates for People's Council Deputies

1. The organization of meetings to gather opinions of voters at agencies, organizations, and units on proposed candidates for People's Council deputies shall be conducted in accordance with Articles 1, 3, and 4 of Resolution No. 1186/2021/UBTVQH14 of the Standing Committee of the National Assembly.

2. The minutes of the meeting shall be recorded according to Model No. 02/HNCT attached to Resolution No. 1186/2021/UBTVQH14 of the Standing Committee of the National Assembly.

3. In cases where the proposed candidate for People's Council deputy does not receive the trust of more than 50% of the total number of voters attending the voter meeting at the workplace, the leadership board of the agency, organization, or unit shall organize the introduction of another candidate.

The procedure and formalities for reintroducing a proposed candidate shall be implemented in accordance with Article 12 of this Resolution.

Article 15. Expanded Leadership Meeting of Agencies, Organizations, Units to Discuss and Introduce Candidates for People's Council Deputies

a) For political organizations, participants include the leadership body and representatives of the heads of subordinate units;

a) For political organizations, Vietnam Fatherland Front Committee, political-social organizations, social organizations, the participants in the meeting include the expanded Standing Committee to representatives of the leadership of subordinate units or the expanded Standing Committee to representatives of the leadership of subordinate units or leaders of member organizations. In cases where social organizations do not have a Standing Committee, they shall convene a meeting of the Executive Board;

b) For provincial and district People's Committees, the Chairman of the People's Committee shall convene and chair an expanded People's Committee meeting including representatives of the leadership of subordinate units;

c) For provincial and district People's Councils, the Chairman of the People's Council shall convene and chair a meeting including the Standing Body of the People's Council, Deputy Heads of the People's Council;

d) For commune-level People's Councils and People's Committees, the Chairman of the People's Council shall convene and chair a meeting including the Standing Body of the People's Council, Deputy Heads of the People's Council, and Chairmen, Deputy Chairmen of the People's Committee;

đ) For specialized agencies under provincial and district People's Committees and other state agencies, the head of the agency shall convene and chair an expanded leadership meeting including representatives of the leadership of subordinate units (if any) and representatives of the Executive Board of the Trade Union;

e) For public service units, the head of the unit shall convene and chair an expanded leadership meeting including representatives of the leadership of subordinate units (if any) and representatives of the Executive Board of the Trade Union;

g) For economic organizations, the head of the organization shall convene and chair an expanded leadership meeting including heads of departments, divisions, workshops, stations, farms, and representatives of the Executive Board of the Trade Union;

h) For military units, the commander of the unit shall convene and chair a meeting including the commander of the unit, representatives of the Executive Board of the Trade Union (if any), representatives of military personnel, and commanders of subordinate units directly under command;

i) In cases where the head of the agency, organization, or unit is proposed as a candidate for People's Council deputy, the deputy head of the agency, organization, or unit shall convene and chair the meeting.

a) Representatives of the leadership of the agency, organization, or unit, and the commander of the people's armed forces unit report on the situation and results of the meeting to seek opinions from voters regarding each person proposed to be introduced as a candidate;

a) Representatives of the leadership of agencies, organizations, units, and unit commanders of people's armed forces units report on the situation and results of the meeting to solicit opinions from voters at their place of work regarding each individual proposed for nomination;

b) Participants in the meeting discuss and express their approval of each introduced candidate through raising hands or secret ballot as decided by the meeting. The meeting shall establish a Counting Team consisting of three to five persons. If the decision is made to vote by secret ballot, the nomination letter must bear the seal of the agency, organization, or unit;

c) The meeting approves the minutes and the list of proposed candidates (according to Model No. 03/BCĐBHĐND-MT attached to this Resolution).

1. Based on the results of the expanded leadership meeting, the agency, organization, or unit is responsible for guiding its selected and introduced candidates for People's Council representatives to prepare their candidacy application files in accordance with Article 35 of the Law on Election of National Assembly and People's Council Deputies and the guidelines of the National Election Council.

1. Based on the results of the expanded leadership meeting, the agency, organization, or unit is responsible for guiding the selected candidates from their own agency, organization, or unit to prepare the candidacy application dossier in accordance with Article 35 of the Law on Election of Members of the National Assembly and People's Council Deputies and the guidance of the National Election Council.

2. By no later than 17:00 on March 14, 2021, the candidate must complete the submission of the candidacy application dossier for People's Council deputies.

The submission of the candidacy application dossier for People's Council deputies shall be carried out in accordance with Clause 2 and Clause 3 of Article 36 of the Law on Election of Members of the National Assembly and People's Council Deputies and the guidance of the National Election Council.

3. The submission of the minutes of the elector meeting at the workplace, the minutes of the leadership meeting of the organization, unit, and the minutes of the elector meeting in the village, ward shall be carried out in accordance with Clause 6, Article 52 of the Law on Election of Deputies to the National Assembly and People's Councils.

Chapter III

ORGANIZATION OF THE SECOND ROUND OF CONSULTATIVE MEETING TO REACH AGREEMENT ON THE PROVISIONAL LIST OF CANDIDATES FOR DEPUTIES TO THE NATIONAL ASSEMBLY AND PEOPLE'S COUNCILS

Section 1

Article 17. Organization of the Second Consultative Conference

1. The second round of consultative meetings shall be organized from March 15, 2021 to March 19, 2021.

2. The second round of consultative meetings at the central level shall be convened, chaired by the Central Steering Committee of the Vietnam Fatherland Front and carried out in accordance with Article 43 of the Law on Election of Deputies to the National Assembly and People's Councils.

3. The second round of consultative meetings at the provincial level shall be convened, chaired by the Provincial Steering Committee of the Vietnam Fatherland Front and carried out in accordance with Article 44 of the Law on Election of Deputies to the National Assembly and People's Councils.

4. The list of candidates proposed for presentation to the Second Consultative Conference must ensure the necessary surplus to allow the conference to consider and select a preliminary list of candidates for deputies to the National Assembly.

Article 18. Content and procedures for organizing the second round of consultative meetings

1. The Central Steering Committee of the Vietnam Fatherland Front (for the consultative meetings at the central level), the Provincial Steering Committee of the Vietnam Fatherland Front (for the consultative meetings at the provincial level) shall report on the situation of candidate introduction by agencies, organizations, units and self-nomination candidates at the local level (if any).

2. The conference shall discuss and establish a preliminary list of candidates for deputies to the National Assembly based on the following contents:

a) The criteria for National Assembly deputies;

b) The first adjustment results of the Standing Committee of the National Assembly regarding the proposed structure, composition, and number of candidates introduced for election as deputies to the National Assembly by agencies, organizations, and units;

c) The results of the agreement reached at the First Consultative Conference;

d) The files and minutes of the introduction of candidates for deputies to the National Assembly submitted by agencies, organizations, and units;

đ) Opinions and trust of voters where the candidate works regarding the introduction of candidates for deputies to the National Assembly.

3. The meeting shall discuss plans to organize the collection of electors' opinions and trust in the place of residence for candidates introduced by agencies, organizations, and units, and plans to organize the collection of electors' opinions and trust in the place of residence and workplace (if any) for self-nominated candidates (for consultative meetings at the provincial level); raise issues that need verification and clarification for candidates.

4. The meeting shall approve the minutes and provisional list of candidates for deputies to the National Assembly (in Model No. 01/BCĐBQH-MT and Model No. 05/BCĐBQH-MT attached to this Resolution).

5. The submission of the minutes of the second round of consultative meetings at the central level shall be carried out in accordance with Clause 3, Article 43 of the Law on Election of Deputies to the National Assembly and People's Councils; at the provincial level, it shall be carried out in accordance with Clause 3, Article 44 of the Law on Election of Deputies to the National Assembly and People's Councils.

Section 2

NOMINATION AND INTRODUCTION OF CANDIDATES FOR PEOPLE'S COUNCIL DEPUTIES

Article 19. The second round of consultation meetings

1. The second round of consultative meetings at each level shall be organized from March 15, 2021 to March 19, 2021, convened and chaired by the Provincial Steering Committee of the Vietnam Fatherland Front at the same level, and carried out in accordance with Article 53 of the Law on Election of Deputies to the National Assembly and People's Councils.

2. The list of candidates introduced for the second round of consultative meetings must ensure the necessary surplus for the meeting to consider and select the provisional list of candidates for deputies to the People's Councils.

Article 20. Content and procedures for organizing the second round of consultative meetings

1. The Provincial Steering Committee of the Vietnam Fatherland Front convening the consultative meeting shall report on the situation of candidate introduction by agencies, organizations, units, and villages, wards (at the commune level), and self-nominated candidates (if any).

2. The meeting discusses and establishes a preliminary list of candidates for People's Council deputies based on the following contents:

a) The criteria for People's Council deputies;

b) The results of adjustments by the Standing Committee of the People's Council regarding the structure, composition, and number of people introduced as candidates for People's Council deputies from agencies, organizations, and units;

c) The results of the agreement reached at the First Consultative Conference;

d) Candidate nomination dossier and minutes sent by agencies, organizations, and units for deputy candidates to the People's Councils;

đ) The opinions and trust of voters at the workplace regarding the candidates introduced;

3. The meeting shall discuss plans to organize the collection of electors' opinions and trust in the place of residence for candidates introduced by agencies, organizations, and units, self-nominated candidates, and electors' opinions in the workplace (if any) for self-nominated candidates, candidates introduced by villages, wards for deputy candidates to the People's Councils at the commune level; raise issues that need verification and clarification for candidates.

4. The meeting shall approve the minutes and provisional list of candidates for deputies to the People's Councils (in Model No. 01/BCĐBHĐND-MT and Model No. 05/BCĐBHĐND-MT attached to this Resolution).

5. The submission of the minutes of the consultative meeting and the provisional list of candidates for deputies to the People's Councils at the provincial, district, and commune levels shall be carried out in accordance with Clause 3, Article 53 of the Law on Election of Deputies to the National Assembly and People's Councils.

Chapter IV

ORGANIZATION OF MEETINGS TO COLLECT ELECTORS' OPINIONS AND TRUST IN CANDIDATES FOR DEPUTIES TO THE NATIONAL ASSEMBLY AND PEOPLE'S COUNCILS

Article 21. Organizing voter meetings for candidates for National Assembly deputies

1. The Provincial Steering Committee of the Vietnam Fatherland Front shall convene a meeting with representatives of the District and Commune Steering Committees of the Vietnam Fatherland Front where the candidates for deputies to the National Assembly reside and representatives of agencies, organizations, and units with candidates to guide the organization of collecting electors' opinions and trust.

2. The collection of electors' opinions at the place of residence for candidates for deputies to the National Assembly shall be organized in the village, ward where the candidate resides, convened and chaired by the Commune Steering Committee of the Vietnam Fatherland Front in coordination with the People's Committee at the same level.

The Commune Steering Committee of the Vietnam Fatherland Front shall coordinate with agencies, organizations, and units with candidates introduced to organize the elector meeting.

3. The organization of meetings to collect electors' opinions and trust in the place of residence for candidates for deputies to the National Assembly and electors' opinions in the workplace (if any) for self-nominated candidates for deputies to the National Assembly shall be carried out from March 21, 2021 to April 13, 2021, in accordance with Article 45 and Article 46 of the Law on Election of Deputies to the National Assembly and People's Councils and Chapter I of Resolution No. 1186/2021/UBTVQH14 of the Standing Committee of the National Assembly.

Article 22. Organization of elector meetings for candidates for People's Council deputies

1. Immediately following the second negotiation meeting, the Standing Committee of the Vietnam Fatherland Front Organization shall convene a meeting with the person responsible for organizational and cadre work from agencies, organizations, and units where candidates are nominated; representatives of the Standing Committee of the Vietnam Fatherland Front Organization at the directly subordinate level (for commune level, invite the Heads of the Mass Mobilization Committees in the area); and the Chairperson of the Vietnam Fatherland Front Organization at the commune level where candidates for provincial and district People's Council deputies reside to guide the organization of collecting opinions from voters in their place of residence regarding those candidates listed in the preliminary list, and opinions from voters in their workplace (if applicable) regarding self-nominated candidates and candidates introduced for nomination by villages or wards for commune-level People's Council deputies.

2. The collection of voter opinions at the place of residence regarding candidates for People's Council deputies shall be organized in the village or ward where the candidate resides, convened and chaired by the Standing Committee of the Vietnam Fatherland Front Organization at the commune level in coordination with the People's Committee at the same level.

The Commune Steering Committee of the Vietnam Fatherland Front shall coordinate with agencies, organizations, and units with candidates introduced to organize the elector meeting.

3. The organization of meetings to collect opinions and trust votes from voters in their place of residence regarding candidates for People's Council deputies and from voters in their workplace (if applicable) regarding self-nominated candidates for People's Council deputies and candidates introduced for nomination by villages or wards for commune-level People's Council deputies shall be carried out within the period from March 21, 2021 to April 13, 2021, as stipulated in Article 54 and Article 55 of the Law on Election of Deputies to the National Assembly and People's Councils and Chapter I of Resolution No. 1186/2021/UBTVQH14 of the Standing Committee of the National Assembly.

Article 23. Verification and Response to Matters Raised by Voters Regarding Candidates for National Assembly Deputies and People's Council Deputies

1. The responsibility for verifying and responding to matters raised by voters regarding candidates for National Assembly deputies and People's Council deputies shall be implemented according to the provisions of Article 46 and Article 55 of the Law on Election of Deputies to the National Assembly and People's Councils.

2. By no later than April 13, 2021, verification and response to matters raised by voters regarding candidates for National Assembly deputies and People's Council deputies must be completed.

Article 24. Second Adjustment of the Composition, Structure, and Number of Candidates for National Assembly Deputies

By no later than March 29, 2021, the Standing Committee of the National Assembly shall adjust the second time the structure, composition, and number of personnel from central and local agencies, organizations, and units proposed for nomination as National Assembly deputies according to the provisions of Article 47 of the Law on Election of Deputies to the National Assembly and People's Councils.

Chapter V

ORGANIZATION OF THE THIRD ROUND OF CONSULTATIONS TO SELECT AND ESTABLISH THE LIST OF ELIGIBLE CANDIDATES FOR NATIONAL ASSEMBLY DEPUTIES AND PEOPLE'S COUNCIL DEPUTIES

Section 1

NEGOTIATION AND INTRODUCTION OF CANDIDATES FOR NATIONAL ASSEMBLY DEPUTIES

Article 25. Organization of the Third Round of Consultations

1. The third negotiation meeting shall be held during the period from April 14, 2021 to April 18, 2021.

2. The third negotiation meeting at the central level, convened and chaired by the Central Steering Committee of the Vietnam Fatherland Front, shall be conducted in accordance with the provisions of Article 48 of the Law on Election of Deputies to the National Assembly and People's Councils.

3. The third negotiation meeting at the local level, convened and chaired by the Standing Committee of the Vietnam Fatherland Front Organization at the provincial level, shall be conducted in accordance with the provisions of Article 49 of the Law on Election of Deputies to the National Assembly and People's Councils.

4. The list of candidates introduced for presentation at the third negotiation meeting must ensure that the surplus number exceeds the surplus number specified in Clause 6 of Article 57 of the Law on Election of Deputies to the National Assembly and People's Councils.

Article 26. Content and procedures for organizing the third negotiation meeting

1. The Presidium of the Central Committee of the Vietnam Fatherland Front (for the central-level negotiation meetings), the Standing Board of the Provincial Vietnam Fatherland Front Committee (for the provincial-level negotiation meetings) shall report on the situation and results of soliciting opinions and trust from voters regarding candidates at their workplaces and places of residence, including cases that need to be considered due to issues raised by voters and the list of individuals proposed to be recommended as candidates for National Assembly deputies.

Candidates who do not receive the trust of more than 50% of the total number of voters attending the voter meetings at their places of residence shall not be included in the recommendation list for the third negotiation meeting, except in special cases that require clear reporting for the negotiation meeting to consider and decide.

2. The meeting shall discuss, select, and establish a list of individuals who meet the criteria to run as National Assembly deputies.

In case agreement cannot be reached, the meeting shall decide to vote by raising hands or secret ballot. The meeting shall appoint a Counting Team consisting of three to five people. If voting by secret ballot is decided, the ballots must bear the seal of the Vietnam Fatherland Front Committee at the level organizing the negotiation meeting. Only representatives present at the negotiation meeting may vote.

3. The meeting shall approve the minutes and the list of individuals meeting the criteria to run as National Assembly deputies (according to Model No. 01/BCĐBQH-MT and Model No. 05/BCĐBQH-MT attached to this Resolution).

4. Sending the minutes of the central-level third negotiation meeting and the list of individuals meeting the criteria to run as National Assembly deputies shall be carried out according to the provisions of Clause 1, Article 57 of the Law on Election of National Assembly Deputies and People's Council Deputies, and at the provincial level according to the provisions of Clause 2, Article 57 of the Law on Election of National Assembly Deputies and People's Council Deputies, no later than April 23, 2021.

Section 2

NOMINATION AND INTRODUCTION OF CANDIDATES FOR PEOPLE'S COUNCIL DEPUTIES

Article 27. Organization of the third negotiation meeting

1. The third negotiation meeting at each level shall be organized within the period from April 14, 2021 to April 18, 2021, convened and chaired by the Standing Board of the Vietnam Fatherland Front Committee at the same level, and implemented according to the provisions of Article 56 of the Law on Election of National Assembly Deputies and People's Council Deputies.

2. The list of candidates proposed to the third negotiation meeting must ensure a surplus greater than the surplus specified in Clause 3, Article 58 of the Law on Election of National Assembly Deputies and People's Council Deputies.

Article 28. Content and procedures for organizing the third negotiation meeting

1. The Standing Board of the Vietnam Fatherland Front Committee at the level organizing the negotiation meeting shall report on the situation and results of soliciting opinions and trust from voters regarding candidates at their workplaces and places of residence, including cases that need to be considered due to issues raised by voters and the list of individuals proposed to be recommended as People's Council deputies.

Candidates who do not receive the trust of more than 50% of the total number of voters attending the voter meetings at their places of residence shall not be included in the recommendation list for the third negotiation meeting, except in special cases that require clear reporting for the negotiation meeting to consider and decide.

2. The meeting shall discuss, select, and establish a list of individuals meeting the criteria to run as People's Council deputies. 3. The meeting shall approve the minutes and the list of individuals meeting the criteria to run as People's Council deputies (according to Model No. 01/BCĐBHĐND-MT and Model No. 05/BCĐBHĐND-MT attached to this Resolution).

4. Sending the minutes of the negotiation meeting and the list of individuals meeting the criteria to run as People's Council deputies at the provincial, district, and commune levels shall be carried out according to the provisions of Clause 1, Article 58 of the Law on Election of National Assembly Deputies and People's Council Deputies, no later than April 23, 2021.

Chapter VI

IMPLEMENTING PROVISIONS

Article 29. Implementation Provisions

1. This Resolution takes effect from the date of issuance.

2. Vietnam Fatherland Front Committees at all levels shall be responsible for organizing the negotiation process and recommending candidates for the 15th term National Assembly deputies and People's Council deputies for the 2021-2026 term according to the provisions of this Resolution.

3. Relevant agencies, organizations, and units shall cooperate with the Standing Boards of Vietnam Fatherland Front Committees at all levels to implement the tasks stipulated in this Resolution.
