GUIDELINES FOR THE IMPLEMENTATION OF FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF PROVINCE AND CITY PUBLIC LIBRARIES UNDER THE CENTRAL GOVERNMENT
Pursuant to the Library Law on November 21, 2019;
Decree No. 93/2020/ND-CP dated August 18, 2020 of the Government detailing certain provisions of the Library Law; 24/2014/ND-CP dated April 4, 2014 of the Government on the organization of specialized agencies under provincial and centrally governed city people's committees;

This Circular guides the implementation of functions, tasks, powers and organizational structure of province and city public libraries under the central government (hereinafter referred to as provincial public libraries). Article 2. This Circular applies to provincial public libraries; agencies, organizations, and individuals establishing, managing, and related to the activities of provincial public libraries. Apply scientific research results and technological development, digital transformation in library activities; build digital information resources, open information resources, and digital libraries in accordance with the law; 9. Participate in international cooperation in the field of libraries, activities of international library organizations; build and receive projects funded by foreign organizations for information resources, library equipment, and training and capacity-building projects for library workers in accordance with the law;10. Article 1. Scope of Regulation and Applicability
1. This Circular guides the implementation of the functions, tasks, authorities, and organizational structure of provincial public libraries under the central government (hereinafter referred to as provincial libraries).
2. This Circular applies to provincial libraries; agencies, organizations, and individuals establishing, managing, and related to the activities of provincial libraries.
Article 2. Functions
Provincial libraries are public service units under the Department of Culture, Sports and Tourism or the Department of Culture and Sports (hereinafter referred to as the Department of Culture, Sports and Tourism), with the function of building, processing, storing, preserving, connecting, and organizing the exploitation and utilization of information resources in accordance with the characteristics and requirements for economic and social development of the locality.
Provincial libraries have legal personality, seals, and are allowed to open accounts at the State Treasury and banks in accordance with the provisions of the law.
Article 3. Duties and Authorities
Provincial libraries perform tasks and authorities as prescribed in Clause 2 Article 11, Article 38, and Article 39 of the Library Law and the following tasks and authorities:
1. Developing activity plans, medium-term and short-term development plans, annual plans of provincial libraries to submit to the Director of the Department of Culture, Sports and Tourism for approval and organization of implementation after approval;
2. Cooperating with specialized departments managing culture under the Department of Culture, Sports and Tourism to advise the Director of the Department of Culture, Sports and Tourism to submit long-term and medium-term projects, plans, and orientations for developing public library networks on the territory to the People's Committee of the province or centrally-administered city;
3. Guiding public libraries on the territory to implement regulations, orientations, and directives on library work from state management agencies on libraries at the central and local levels. Participating in developing library networks, providing professional support to libraries and organizations or individuals who wish to establish libraries on the territory;
4. Participating in building, preserving, and promoting the value of written cultural heritage, rare ancient documents, and special collections of the locality; local publication information resources, writings about the locality, or created by local people;
5. Organizing professional and vocational activities, providing public services in the field of libraries in accordance with the provisions of the law;
6. Implementing socialization, mobilizing organizations and individuals to participate in building and developing libraries and reading culture in accordance with the provisions of the law;
7. Evaluating library activities, information resource usage needs, and library information product and service usage by users;
8. Applying research results and technological development, digital transformation in library activities; building digital information resources, open information resources, and digital libraries in accordance with the provisions of the law;
9. Participating in international cooperation in the field of libraries, activities of international library organizations; building and receiving information resource sponsorship projects, library equipment, and training and capacity-building projects for library workers funded by foreign organizations in accordance with the provisions of the law;
10. Reporting regularly or reporting emergencies on the operation of the library to competent state management agencies in accordance with the provisions of the law;
11. Managing organizational structures and personnel, implementing policies and benefits for civil servants and employees within the scope of management of the library in accordance with the provisions of the law and the division of management authority of the Department of Culture, Sports and Tourism;
12. Performing other tasks assigned by the Director of the Department of Culture, Sports and Tourism.
Article 4. Organizational Structure
1. The leadership of provincial libraries consists of a Director and Deputy Directors as prescribed.
2. Professional and vocational organizations directly under provincial libraries:
Provincial libraries have professional and vocational organizations to implement activities according to the following groups of tasks:
a) Technical-vocational task group: performing tasks related to building, processing, organizing, and preserving information resources; guiding, consulting, and supporting the development of library networks;
b) Technology-communication task group: performing tasks related to the application of information technology, digital transformation; database management, information technology infrastructure, interconnection, sharing of information resources with other libraries; implementing communication, mobilization, socialization, and attracting organizations and individuals to participate in building libraries and developing reading culture;
c) User service task group: performing tasks related to providing information resources through service formats, specific user groups, or types of information resources; developing library information products and services; evaluating information usage needs of users;
d) Administrative-management task group: performing tasks related to statistics, compilation, issuance of library user cards, evaluation of library activities, international cooperation in libraries; administrative business activities, documentation, archives, personnel organization, accounting, and other internal management activities.
The establishment of the organizational structure of provincial libraries must ensure the completeness of the content of the groups of tasks prescribed in this clause and meet the criteria for establishing rooms under public service units in accordance with the provisions of the law on the establishment, reorganization, and dissolution of public service units.
Based on functions, tasks, powers, number of employees, nature, characteristics, and actual conditions, the Director of the provincial library shall submit to the competent authority to specifically define the organizational structure of the library in accordance with the law.
State-owned enterprises that have been assigned by the Ministry of Agriculture and Rural Development to conduct offshore wind power project surveys before the effective date of this Circular shall continue to implement according to the assigned documents; any new matters arising after the effective date of this Circular shall be implemented in accordance with the provisions of this Circular.
1. The Library Department shall be responsible for guiding, urging, and inspecting the implementation of this Circular.
2. The Director of the Department of Culture, Sports and Tourism shall establish the functions, tasks, powers, and organizational structure of the provincial library and submit them to the Chairman of the People's Committee of the province or centrally governed city in accordance with the law.
3. The Director of the provincial library shall determine job positions within the library, assign civil servants and workers in accordance with their qualifications, titles, and professions as stipulated by the law.
Article 6. Implementation Provisions
1. This Circular takes effect from December 1, 2021.
2. From the date this Circular takes effect, Articles 12, 13, and 14 of Circular No. 13/2016/TT-BVHTTDL dated December 9, 2016, issued by the Minister of Culture, Sports and Tourism, which prescribe the model regulations for the operation of provincial, district, and commune public libraries, shall become invalid.
3. During the implementation process, if any issues arise or difficulties occur, relevant agencies, organizations, and individuals shall promptly report to the Ministry of Culture, Sports and Tourism (through the Library Department) for review, amendment, and supplementation to ensure compliance./.
