PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular guides certain contents on diversifying livelihoods, developing poverty reduction models, and supporting workers going to work abroad under contracts within the National Target Program for Sustainable Poverty Reduction for the 2021-2025 period as stipulated in Decision No. 90/QĐ-TTg dated January 18, 2022 of the Prime Minister approving the National Target Program for Sustainable Poverty Reduction for the 2021-2025 period (hereinafter referred to as Decision No. 90/QĐ-TTg), including:
1. Diversification of Livelihoods, Development of Poverty Reduction Models (Project 2).
2. Support for Workers Going to Work Abroad Under Contracts (Sub-project 2 Project 4).
Article 2. Applicability
1. Poor households, near-poor households, newly escaped poor households (within 36 months from the date the competent authority recognizes them as having escaped poverty) throughout the country; workers belonging to poor households, near-poor households, newly escaped poor households; people living in poor districts, particularly difficult communes in coastal areas, islands.
2. Enterprises, cooperatives, cooperative groups, family household groups, community residents.
3. Related organizations and individuals.
Chapter II

Article 3. Support Objectives

Article 4. Methods and Principles of Supportắsupport
1. Methods of Support
Support for diversification of livelihoods and development of poverty reduction models shall be implemented through projects supporting production development linked to value chains, community production development projects, production development projects based on tasks, and special production development projects.
2. Support Principles
a) Ensuring transparency, democracy, gender equality, and the participation and commitment of the people in the construction and implementation of projects.
b) Consistent with local socio-economic development plans and master plans.
c) Consistent with comparative advantages and strengths of each region; meeting market demands and ensuring sustainable effectiveness.
d) Suitable for the conditions, characteristics, and needs of poor households, near-poor households, newly escaped poor households; persons with disabilities without stable livelihoods.
đ) Prioritize support for participation in poverty reduction model projects for workers from ethnic minority poor and near-poor households, poor and near-poor households with members who have rendered meritorious service to the revolution; persons with disabilities, women from poor, near-poor, and newly escaped poor households. Create favorable conditions for vulnerable, easily disadvantaged, and difficult-to-assist individuals to participate in poverty reduction model projects.
e) Prioritize support for poverty reduction model projects implemented in poor districts, particularly difficult communes in coastal areas, islands.
g) Environmental protection.
h) Each project's implementation period shall not exceed three years.
Article 5. Content of Support
1. Training on production techniques, management skills, contract management capacity, chain management, and market development.
2. Transfer and application of new scientific and technological knowledge, implementation of technical processes in production and synchronized quality management.
3. Materials, raw materials, tools, equipment for production, planting seeds, livestock breeds.
4. Promotion and trade facilitation for goods and services.
5. Support for costs to analyze food safety criteria, costs to establish traceability codes for products.
6. Technical training according to the needs of group members, enhancing management and operation capabilities of the group.
7. Support for staff directly visiting households to guide project implementation until results are achieved.
8. Organizing practical learning visits among localities with effective projects at the discretion of the unit head within the allocated budget.
9. Project establishment and management.
Article 6. Establishment and Implementation of Poverty Reduction Model Projects Supporting Production Development Linked to Value Chains
1. Conditions for Project Support
Implemented in accordance with Clause 1, Article 21 of Decree No. 27/2022/ND-CP dated April 19, 2022, issued by the Government, regarding the management mechanism and organization of implementing national target programs (hereinafter referred to as Decree No. 27/2022/ND-CP).
2. Steps for Establishing and Approving Projects
a) Step 1: Survey and Build the Project
The leading unit collaborates with the People's Committee of the district where the project is expected to be implemented to build the project according to Model No. 01 attached as an appendix to this Circular.
Based on survey results and consensus with the People's Committee of the district, the leading unit prepares a proposal for project implementation and a plan requesting support for production development linked to value chains. The content of the project proposal must clearly define: the capacity of the leading unit; production, business, product consumption, and service supply plans; detailed budget estimates by year; key output indicators tied to project implementation milestones; certified copies of contracts or minutes of agreements between the leading unit and associated parties; other contents (if any) as prescribed by the program management agency.
b) Step 2: Review the Project
The leading unit submits the project implementation proposal and the plan requesting support for production development linked to value chains to the program management agency for review.
The program management agency, within its authority, establishes a project review committee and assigns relevant agencies, units, and departments to assist the committee.
The committee consists of: the Chairman being a leader from a ministry, central agency, provincial People's Committee, or a leader from a subordinate unit of a ministry or central agency, or a department under the provincial People's Committee authorized by delegation; members including leaders from the district People's Committee where the project and plan are located, representatives from state management agencies responsible for investment, finance, industry, and specialized fields, independent experts, or other components (if necessary).
The review must clarify compliance with conditions stipulated in Clause 1, Article 21 of Decree No. 27/2022/ND-CP and the necessity of implementing the project and plan.
c) Step 3: Approve the Project
Based on the review opinions, the Minister or Head of a Central Agency decides or delegates to the Head of a subordinate unit to decide on approving the project and plan; the Provincial People's Committee Chairman decides or delegates to the District People's Committee Chairman or the Head of a provincial department to approve the project and plan.
The approval content includes: project name, plan; implementation period; implementation area; total cost, structure of each source of capital (state budget, capital of the leading unit, participating capital of associated parties, preferential credit capital, integrated capital for implementing policies); content and level of state budget support; anticipated outcomes by fiscal year and at the end of the project and plan; participants; sanctions and mechanisms for recovering state budget support funds if the leading unit breaches commitments; and other related contents (if any).
d) Within ten working days from the date of receiving complete valid documents, the program management agency decides to approve the project; if the project does not meet the required conditions, the program management agency must provide a written response stating the reasons.
3. Content of Support: Implemented in accordance with Clauses 1, 2, 3, 4, 5, and 9 of Article 5 of this Circular.
a) Agencies and units implementing projects shall organize the implementation of projects in accordance with Clause 6, Article 21 of Decree No. 27/2022/ND-CP (amended and supplemented in Clause 12, Article 1 of Decree No. 38/2023/ND-CP) and relevant laws.
a) The leading unit collaborates with the District People's Committee to implement the project:
Notify the content of the approved project to poor households, near-poor households, newly escaped poverty households, disabled persons without stable livelihoods, and other relevant participants in the project.
Implement project activities in accordance with schedule and effectiveness.
Summarize and report project implementation results every six months, annually, and at the conclusion of the project to the program management agency according to Model No. 05 attached as an appendix to this Circular.
The District People's Committee monitors and evaluates project implementation in their jurisdiction; promptly recommend to the program management agency any issues encountered.
b) Agencies and units assigned capital for implementing poverty reduction model projects supporting production development sign contracts with the leading unit to implement the project and plan; supervise, settle, and disburse funds based on the completion of project and plan activities at each stage as determined by the competent authority as stipulated in Clause 6, Article 21 of Decree No. 27/2022/ND-CP.
Article 7. Construction and implementation of poverty reduction model project to support community production development
1. Conditions for Project Support
Implement in accordance with the provisions of Clause 1, Article 22 of Decree No. 27/2022/NĐ-CP.
2. Steps for Establishing and Approving Projects
a) Step 1: Project Development
The community residents shall coordinate and unify with the People's Committee of the commune where the project is expected to be implemented to develop the project according to Model No. 02 attached as an appendix to this Circular and prepare the proposal for implementing the project.
The project proposal includes: Minutes of the community meeting; production, business, and product consumption plans; total project costs, request for financial support from the state budget, contributions from members of the group; project outcomes; methods of circulating physical assets or funds within the community (if applicable); responsibilities of the People's Committee of the commune in managing physical assets or circulating funds; training needs; other contents (if applicable) as prescribed by local competent authorities.
b) Step 2: Review the Project
The community residents submit the project proposal and production plan to the People's Committee of the commune where the project is expected to be implemented for review by the People's Committee of the district.
The People's Committee of the district shall establish a Review Team for the project proposal and production plan and decide on the unit or department to assist the Review Team. The Review Team consists of: The Team Leader being a leader of the People's Committee of the district; members being leaders of the People's Committee of the commune where the community has the project and production plan; leaders of specialized departments under the People's Committee of the district; experts or individuals with relevant expertise and experience in implementing activities to support production development selected by the community (if applicable).
c) Step 3: Approve the Project
Based on the review opinions, the Chairman of the People's Committee of the district decides or delegates the decision to approve the community-based poverty reduction model project to the Chairman of the People's Committee of the commune, the Heads of departments under the People's Committee of the district.
The content of the decision on the project and support plan includes: Name of the project and plan; implementation period; location; target participants; project activities; project cost estimate; sources of funding (state budget support, preferential credit loans, integrated funds for policy implementation, and counterpart funds from participating households (if applicable)); circulation method and level (if applicable); anticipated project outcomes; responsibilities of each leading and cooperating agency; sanctions for breach of commitments (if applicable).
d) Within seven working days from the date of receiving complete valid documents, the Chairman of the People's Committee of the district decides or delegates the decision to approve the project to the Chairman of the People's Committee of the commune, the Heads of departments under the People's Committee of the district; in cases where the project does not meet the required conditions, a written response must be provided with clear reasons.
3. Content of Support: Implemented in accordance with the provisions of Clauses 2, 3, 4, 6, 7, 8, and 9 of Article 5 of this Circular.
a) Agencies and units implementing projects shall organize the implementation of projects in accordance with Clause 6, Article 21 of Decree No. 27/2022/ND-CP (amended and supplemented in Clause 12, Article 1 of Decree No. 38/2023/ND-CP) and relevant laws.
a) The People's Committee of the commune informs the community about the content of the project approved by the competent authority.
b) The community implements the project activities according to schedule and effectiveness; summarizes and reports the project outcomes every six months and annually, and conducts a final summary, submitting to the People's Committee of the commune for consolidation and reporting to the People's Committee of the district according to Model No. 05 attached as an appendix to this Circular.
c) The People's Committee of the commune monitors and evaluates the implementation of the project in its jurisdiction; promptly advises the People's Committee of the district on any issues encountered.
d) Agencies and units entrusted with project funds for poverty reduction models supporting production development shall enter into contracts with community representatives; guide, supervise, settle, and disburse funds based on the acceptance results of each phase of completed project content and activities according to the implementation schedule decided by the competent authority as stipulated in Clause 6, Article 22 of Decree No. 27/2022/NĐ-CP.
Article 8. Construction and implementation of poverty reduction model projects to support production development according to assigned tasks.
1. Conditions for Project Support
Implement as prescribed in Clause 1 of Article 23 of Decree No. 27/2022/NĐ-CP.
2. Construction and approval of the project
a) The agency allocated funds for implementing the poverty reduction model project to support production development shall assign the subordinate agency or unit responsible for the project to conduct surveys, construct the project, including: the name of the proposing unit, type of model, objectives, participating subjects, implementation period, implementation area, contents, budget, and implementation plan according to Model No. 03 of the Appendix issued together with this Circular; submit to the head of the agency allocated funds for decision on approving the project.
b) The subordinate agency or unit responsible for implementing the poverty reduction model project to support production development shall enter into a procurement contract with the contractor or issue a task assignment to the entity tasked with the work.
3. Content of support: Implement as prescribed in Article 5 of this Circular.
a) Agencies and units implementing projects shall organize the implementation of projects in accordance with Clause 6, Article 21 of Decree No. 27/2022/ND-CP (amended and supplemented in Clause 12, Article 1 of Decree No. 38/2023/ND-CP) and relevant laws.
a) The entity receiving the procurement contract or assigned task shall cooperate with the People's Committee at the district level to implement the project:
Notify the content of the approved project to poor households, near-poor households, newly escaped poverty households, disabled persons without stable livelihoods, and other relevant participants in the project.
Carry out the activities of the project in accordance with the target, objectives, schedule, and effectiveness.
Summarize and report the results of the project every six months, annually, and at the conclusion to the agency or unit responsible for implementing the poverty reduction model project according to Model No. 05 of the Appendix issued together with this Circular.
The People's Committee at the district level shall monitor and promptly advise the agency or unit responsible for implementing the poverty reduction model project on any issues encountered.
b) The entity placing the order or assigning the task shall enter into a procurement contract with the contractor or issue a task assignment to the entity tasked with the work; guide, supervise, settle accounts, and disburse funds based on the acceptance results of each phase of completed content and activities according to the schedule approved by the competent authority as prescribed in Clause 4 of Article 23 of Decree No. 27/2022/NĐ-CP.
Article 9. Construction and implementation of special poverty reduction model projects to support production development
1. Conditions for Project Support
Implement as prescribed in Clause 1 of Article 24 of Decree No. 27/2022/NĐ-CP.
2. Construction and approval of the project
Ministries and central agencies allocated funds for implementing poverty reduction model activities to support production development shall assign the subordinate agency or unit responsible for the project to organize surveys, construct the project, including: the name of the proposing unit, type of model, objectives, participating subjects, implementation period, implementation area, contents, budget, and implementation plan according to Model No. 04 of the Appendix issued together with this Circular; submit to the Minister or head of the central agency for decision on approving the project and send to the Ministry of Labor, Invalids, and Social Affairs for coordination in monitoring the implementation.
The subordinate agency or unit responsible for implementing the special poverty reduction model project to support production development shall cooperate with relevant localities and units to implement the project.
3. Content of support: Implement as prescribed in Article 5 of this Circular.
a) Agencies and units implementing projects shall organize the implementation of projects in accordance with Clause 6, Article 21 of Decree No. 27/2022/ND-CP (amended and supplemented in Clause 12, Article 1 of Decree No. 38/2023/ND-CP) and relevant laws.
a) The subordinate agency or unit responsible for implementing the poverty reduction model project shall cooperate with the People's Committee at the district level to organize the implementation:
Notify the content of the approved project to poor households, near-poor households, newly escaped poverty households, disabled persons without stable livelihoods, and other relevant participants in the project.
Carry out the activities of the project in accordance with the target, objectives, schedule, and effectiveness.
Summarize and report the results of the project every six months, annually, and at the conclusion to the managing agency of the program according to Model No. 05 of the Appendix issued together with this Circular.
The People's Committee at the district level shall monitor and promptly advise the agency or unit responsible for implementing the poverty reduction model project on any issues encountered.
b) The state budget shall ensure funding for the implementation of the project and model in line with the objectives and tasks as decided by the Prime Minister for investment in the program. Ministries and central agencies shall implement the project and model and disburse funds based on the acceptance results of the project and model according to the objectives and tasks approved as prescribed in Clause 3 of Article 24 of Decree No. 27/2022/NĐ-CP.
Chapter III
SUPPORT FOR WORKERS TO WORK ABROAD UNDER CONTRACTS OUTSIDE THE COUNTRY TEXTECONTRACT
Article 10. Subjects of Support
Implement according to the provisions at point b, item 4, Part III of Decision No. 90/QĐ-TTg.
Article 11. Methods of Support
1. For activities supporting workers from poor districts, extremely difficult communes in coastal areas, near the sea, and islands going to work abroad: Enterprises and public institutions when selecting workers from poor districts, extremely difficult communes in coastal areas, near the sea, and islands shall cooperate with local labor, invalids, and social affairs authorities to support workers going to work abroad through bidding mechanisms and placing orders with vocational training centers, language schools, enterprises, and public institutions sending workers to work abroad under contracts.
In cases where workers register to go to work abroad through enterprises and public institutions that have completed advanced language and vocational skill training courses and meet the conditions for departure to work abroad, the labor, invalids, and social affairs authority shall directly provide support to the workers. Enterprises and public institutions sending workers to work abroad under contracts are responsible for assisting workers in providing complete documentation to receive support.
2. Introducing and advising workers and their relatives about working abroad under contracts shall be carried out by the labor, invalids, and social affairs authority according to the guidelines of the Ministry of Finance on managing and using funds for implementing the National Target Program on Sustainable Poverty Reduction for the period 2021-2025.
3. For activities supporting the improvement of foreign language proficiency for workers before going to work abroad under agreements signed between the Government of Vietnam and the receiving country's government, the Ministry of Labor, Invalids, and Social Affairs shall implement according to the legal provisions on bidding, placing orders, and assigning tasks.
Article 12. Principles of Support
1. Provide support to the correct subjects and contents as stipulated at point b, item 4, Part III of Decision No. 90/QĐ-TTg, in accordance with the needs of workers.
2. Ensure efficiency, transparency, democracy, and gender equality.
Article 13. Contents of Support
1. Workers from poor households, ethnic minority workers residing in poor districts, extremely difficult communes in coastal areas, near the sea, and islands who wish to work abroad: The content of support shall be implemented according to the provisions of Clause 1, Article 25 of Circular No. 15/2022/TT-BTC dated March 4, 2022, issued by the Ministry of Finance on managing and using funds for implementing the National Target Program on Economic and Social Development in Ethnic Minority and Mountainous Areas for the period 2021-2030, Phase I: from 2021 to 2025 (hereinafter referred to as Circular No. 15/2022/TT-BTC).
2. Workers from near-poor households, newly escaped poverty households residing in poor districts, extremely difficult communes in coastal areas, near the sea, and islands who wish to work abroad: Financial support for improving foreign language proficiency and vocational skills, and other related expenses shall be provided according to Clause 1, Article 25 of Circular No. 15/2022/TT-BTC.
3. Other workers living in poor districts, coastal, near-sea, and island communes who wish to work abroad: Financial support for improving foreign language proficiency and vocational skills.
4. Workers and relatives of workers residing in poor districts, extremely difficult communes in coastal areas, near the sea, and islands: Support for introducing and advising them to participate in working abroad under contracts.
5. Workers participating in foreign language improvement courses to work abroad under agreements signed between the Government of Vietnam and the receiving country's government: Partial financial support for foreign language improvement training costs for workers.
Chapter IV
IMPLEMENTATION
Article 14. Implementation Organization
1. The Ministry of Labor, Invalids, and Social Affairs shall take the lead and coordinate with relevant ministries and sectors to organize the implementation of the Circular:
a) Directing, guiding, and implementing.
b) Inspecting, supervising, and consolidating the implementation situation.
c) Preliminary summarizing, concluding, evaluating, and reporting on the results of implementation.
2. Relevant ministries and sectors shall coordinate with the Ministry of Labor, Invalids, and Social Affairs:
a) Directing, guiding, and implementing diversified livelihood development, poverty reduction model development, and support for workers going to work abroad under contracts according to their assigned functions and responsibilities.
b) Inspecting, supervising, and consolidating the implementation situation.
c) Preliminary summarizing, concluding, evaluating, and reporting regularly every six months and annually on the results of implementing diversified livelihood development, poverty reduction model development, and support for workers going to work abroad under contracts according to their assigned functions and responsibilities to the Ministry of Labor, Invalids, and Social Affairs (Diversified livelihood development and poverty reduction model development reports shall be submitted according to Model No. 06 attached as an appendix to this Circular).
3. People's Committees at all levels
a) Provincial People's Committee
Direct the Department of Labor, Invalids, and Social Affairs to take the lead and coordinate with relevant agencies to guide localities in implementing diversified livelihood development, poverty reduction model development, and support for workers going to work abroad under contracts within their jurisdiction.
Inspect, supervise, preliminary summarize, conclude, evaluate, and report regularly every six months and annually on the results of implementation to the Ministry of Labor, Invalids, and Social Affairs (Diversified livelihood development and poverty reduction model development reports shall be submitted according to Model No. 06 attached as an appendix to this Circular).
b) District People's Committee
Direct the organization to implement diversified livelihood development, poverty reduction model development, and support for workers going to work abroad under contracts within their jurisdiction.
Inspect, supervise, preliminary summarize, conclude, evaluate, and report regularly every six months and annually on the results of implementation to the Department of Labor, Invalids, and Social Affairs.
c) Commune People's Committee
Implement diversified livelihood development, poverty reduction model development, and support for workers going to work abroad under contracts within their jurisdiction.
Inspect, supervise, preliminary summarize, conclude, evaluate, and report regularly every six months and annually on the results of implementation to the District People's Committee.
Article 15. Implementation Provisions
1. This Circular takes effect from July 11, 2022.
2. In the course of implementation, if there are any difficulties or issues arising, they should be promptly reported to the Ministry of Labor, Invalids, and Social Affairs for appropriate amendments and supplements.
