On the basis of Law on Telecommunications dated November 23, 2009;
Decree No. Decree No. 25/2011/NĐ-CP dated April 6, 2011 issued by the Government detailing and guiding the implementation of certain provisions of the Telecommunications Law;
Decree No. Decree No. 17/2017/NĐ-CP dated February 17, 2017 issued by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
Implementing Decision No. Decision No. 2269/QĐ-TTg dated December 31, 2021 issued by the Prime Minister approving the Program of Providing Public Service Telecommunication Services until 2025;
At the proposal of the Director of the Department of Planning and Finance;
The Minister of Information and Communications issues this Circular to guide the implementation of support for tablets and public service telecommunication services to use tablets under the Program of Providing Public Service Telecommunication Services until 2025.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
2. Applicability:
This Circular guides the implementation of support for tablets and public service telecommunication services to provide tablets for poor households and near-poor households to serve the study of secondary school students under the Program of Providing Public Service Telecommunication Services until 2025 approved by the Prime Minister through Decision No. 2269/QĐ-TTg dated December 31, 2021.

This Circular applies to agencies, organizations, and individuals participating in and related to the implementation of support for tablets and public service telecommunication services to use tablets under the Program of Providing Public Service Telecommunication Services until 2025.
Article 2. Interpretation of Terms
In this Circular, the following terms shall be understood as follows:
1. The Program refers to the Program of Providing Public Service Telecommunication Services until 2025 approved by the Prime Minister through Decision No. 2269/QĐ-TTg dated December 31, 2021.
2. Tablet is a mobile device with a touch screen, using a mobile operating system, having functions similar to those of a computer, capable of installing additional software, and able to access the Internet.
3. Poor household, near-poor household is a family recognized as a poor or near-poor household according to the multidimensional poverty standard for the period 2021-2025 as prescribed by the Government in Decree No. 07/2021/NĐ-CP dated January 27, 2021.
4. Recipient of tablets is a poor or near-poor household listed in the list of families receiving tablets approved by the People's Committee of the province (hereinafter referred to as the provincial People's Committee).
5. The "Waves and Tablets for Students" program is a program launched by the Prime Minister on September 12, 2021.
6. Household with a member as a secondary school student is a poor or near-poor household having at least one member (listed in the Household Registration Book or in the Certificate of Poverty or Near-Poverty) studying at primary schools, junior high schools, and senior high schools within the national education system as prescribed by the Education Law.
7. Policy beneficiary family is a family having a member who is a direct beneficiary and currently receiving monthly allowances according to the Regulations on Preferential Treatment for Persons Contributing to the Revolution as stipulated in Ordinance No. 02/2020/UBTVQH14 dated December 9, 2020 issued by the Standing Committee of the National Assembly.
8. Social policy beneficiary family is a family having a member currently receiving monthly social allowances, or a family taking care of and nurturing social welfare beneficiaries as prescribed in Decree No. 20/2021/NĐ-CP dated March 15, 2021 issued by the Government regarding social assistance policies for social welfare beneficiaries.
9. Household head is the person named as the head of the household in the Household Registration Book or in the Certificate of Poverty or Near-Poverty of the family.
10. Representative of the household: Is a person listed in the list of families receiving tablets approved by the provincial People's Committee, representing the household to directly receive the handover of tablets provided by the Program. The representative of the household must have full civil capacity according to the Civil Code, be listed in the Household Registration Book or in the Certificate of Poverty or Near-Poverty, or other cases decided by the provincial People's Committee and recorded with the reason in the list of families receiving tablet support.
11. Telecommunication terminal equipment manufacturing enterprise is an enterprise engaged in the production of fixed or mobile telecommunication terminal equipment that can be connected to the end point of the telecommunication network to send, transmit, receive, and process information for users.
12. Public service telecommunication service provider is an enterprise providing services with infrastructure networks licensed by competent authorities to operate at least one (1) telecommunication service included in the list of public service telecommunication services issued in this Circular.
13. Commune with extremely difficult socio-economic conditions is a commune in Region III according to the list issued together with Decision No. 861/QĐ-TTg dated June 4, 2021 issued by the Prime Minister approving the list of communes in Region III, Region II, and Region I in the mountainous and ethnic minority areas during the period 2021-2025, and extremely difficult communes in coastal and island areas according to the list in Appendix II issued together with Decision No. 353/QĐ-TTg dated March 15, 2022 issued by the Prime Minister approving the list of poor districts, extremely difficult communes in coastal and island areas during the period 2021-2025.
14. Island commune is a commune recognized by the Prime Minister according to the criteria, conditions, and procedures for recognizing island communes stipulated in Decision No. 569/QĐ-TTg dated April 22, 2014 issued by the Prime Minister promulgating the Criteria, Conditions, and Procedures for Recognizing Island Communes.
15. Island district includes the districts: Cô Tô, Vân Đồn, Cát Hải, Bạch Long Vĩ, Cồn Cỏ, Hoàng Sa, Lý Sơn, Trường Sa, Phú Quý, Côn Đảo, Kiên Hải, Phú Quốc.
16. Difficult area for universal telecommunications service coverage includes villages, hamlets, islands, wards, villages, bon, phum, sóc, and islands where households reside (collectively referred to as villages) meeting the following criteria simultaneously:
a) Villages with electricity in communes with extremely difficult socio-economic conditions, island communes, island districts, and other areas where telecommunications enterprises cannot operate profitably under market mechanisms;
b) As of December 31, 2020, there is no mobile terrestrial telecommunications service or broadband fixed terrestrial Internet access service, or neither of these two services exists.
The list of difficult areas for the universalization of telecommunications services shall be published by the Ministry of Information and Communications.
Article 3. Principles for implementing support for tablets and public telecommunications services to use tablets
1. Regarding support for tablets:
a) The recipient of support is only supported once and with one tablet;
b) Ensure that the correct recipients are supported according to the priority order within the scope of the number of tablets under the Program;
c) There shall be no overlap between the recipients of support from this Program and those supported from other sources under the "Waves and Computers for Children" Program;
d) Ensure transparency and democracy at the grassroots level when proposing specific recipients of support.
2. Regarding support for public telecommunications services:
a) The quality of Internet access services for using tablets must meet the requirements for serving students' learning;
b) Monthly support for subscribers using the service;
c) The level of support for using Internet access services for using tablets shall be specified in accordance with the characteristics of each service.
Chapter II
SPECIFIC PROVISIONS
Section 1
TECHNICAL CONFIGURATION OF TABLETS; LIST, QUALITY AND PRICES OF PUBLIC TELECOMMUNICATION SERVICES FOR USING TABLETS TO SUPPORT STUDYING
QUALITY AND PRICES OF TELECOMMUNICATION SERVICES FOR EDUCATIONAL USE
TABLETS FOR STUDY PURPOSES
Article 4. Minimum technical configuration and quality requirements for tablets
Tablets supported by the Program must meet the following requirements:
1. Meeting the minimum technical configuration and quality requirements as stipulated in Appendix I attached to this Circular;
2. Pre-installed with certain applications to serve online learning, applications to monitor usage volume, and applications to ensure information security.
Article 5. List, quality, and prices of public telecommunications services for using tablets
1. The list of public telecommunications services for using tablets includes the following universal telecommunications services:
a) Internet access service on terrestrial mobile telecommunication networks;
b) Broadband fixed terrestrial Internet access service.
2. Quality of public telecommunications services for using tablets:
a) Internet access service on terrestrial mobile telecommunication networks must comply with the National Technical Regulation on the quality of Internet access services on terrestrial mobile telecommunication networks (QCVN 81:2019/BTTTT);
b) Broadband fixed terrestrial Internet access service (fiber optic Internet access service) must comply with the National Technical Regulation on the quality of broadband fixed terrestrial Internet access services (QCVN 34:2019/BTTTT).
3. Prices of public telecommunications services:
The prices of public telecommunications services as provided for in Clause 1 of this Article shall be issued by the Ministry of Information and Communications.
Section 2
SUPPORTED OBJECTIVES, ALLOCATION OF TABLETS, PRIORITY CRITERIA AND PROPOSAL OF THE LIST OF RECIPIENTS OF TABLETS
CRITERIA FOR PRIORITY AND RECOMMENDED LIST OF ELIGIBLE RECIPIENTS
RECEIVING TABLETS
Article 6. Recipients of tablet support
1. The recipients of tablet support are poor households and near-poor households meeting the following conditions:
a) Having members of the household who are secondary school students;
b) Having a need to receive tablet support under the Program;
c) Not having received computer support (desktop computers, laptops, tablets) for students' learning from other sources under the "Waves and Computers for Children" Program.
2. Within the scope of the number of tablets allocated to localities under Article 7 of this Circular, the recipients of tablets shall be determined in accordance with the provisions of Article 8 of this Circular.
Article 7. Criteria for Allocation of Tablets under the Program to Localities
1. The Ministry of Information and Communications shall allocate the number of tablets of the Program to each province and centrally-run city (hereinafter referred to collectively as "province") based on the number of poor and near-poor households in each province.
2. The number of tablets allocated to provinces shall be determined according to the following formula:

a) Mtbin: Is the number of tablets (units) of the Program allocated to province i in year n;
b) Mtbn: Is the total number of tablets of the Program implemented to provide support in year n;
c) Hncni: The number of poor and near-poor households in province i (provided by the People's Committee of the province to the Ministry of Information and Communications at the time of determining the data);
d) Mtki: Is the number of tablets supported to province i from this Program in previous years to year n and the number of computers and tablets supported from other sources within the Program "Waves and Computers for Students" (as of the date when the Ministry of Information and Communications allocates tablets to localities);
đ) t: Is the number of provinces with poor and near-poor households.
Article 8. Allocation of Tablets and Proposal of List of Recipients of Tablets at Localities
1. Priority criteria for households receiving tablets:
The general priority criteria for recipients specified in Clause 1, Article 6 of this Circular shall be given tablet support in the following order:
a) Poor and near-poor households that are also policy families of persons who have contributed to the revolution;
b) Poor and near-poor households that are also social policy families;
c) Poor households;
d) Near-poor households.
2. Based on the actual situation in the locality and the number of tablets allocated by the Ministry of Information and Communications, the People's Committee of the province shall be responsible for:
a) Deciding the criteria and method for allocating tablets to districts, counties, towns, and centrally-run cities within the province and communes, wards, and towns within the administrative area;
b) Specifying and supplementing the priority criteria for households belonging to the group eligible for tablet support to receive tablets; stipulating the procedures and directing the work of selecting and proposing lists of households receiving tablets in the locality; ensuring compliance with the provisions of Article 6 of this Circular and the priority criteria;
c) Approving the list of households in the locality receiving tablets and sending it to the Ministry of Information and Communications according to Form No. 01/DSH-MTB, Appendix II issued together with this Circular.
2. The People's Committee of the province shall send the list of households receiving allocated tablets to the Ministry of Information and Communications within 45 days from the date of receipt of the Decision of the Ministry of Information and Communications allocating tablets of the Program to the locality.
Section 3
FORM AND METHODS OF SUPPORT FOR TABLETS
Article 9. Forms of Support for Tablets
1. Form of support for tablets: In kind.
2. Tablets shall be directly handed over to the representative of the household receiving the tablet.
Article 10. Method of Selecting Enterprises Providing Tablets
1. Tendering to select contractors providing tablets in accordance with the laws on tendering for procurement packages of goods using state funds.
2. Enterprises participating in tendering to provide tablets under the Program include:
a) Enterprises producing terminal equipment;
b) Enterprises providing public telecommunications services.
Article 11. Value of the tablet computer
1. The value of the tablet computer supporting the recipients of the tablet computer is the winning bid price according to the tender results.
2. The value of the tablet computer specified in Clause 1 of this Article includes the costs of delivering the tablet computer to the household representative at the commune level and the equipment warranty costs.
Article 12. Responsibilities of the parties involved when delivering the tablet computer to the recipients
1. The People's Committee at the commune level shall be responsible for coordinating with the contractor providing the tablet computer to organize the delivery of the tablet computer to the recipients according to the list approved by the People's Committee at the provincial level.
2. When delivering the tablet computer to the supported recipient, the contractor and representatives of the People's Committee at the commune level, and representatives of the general education institution in the commune must cooperate to establish a Delivery Record accompanied by a Household List of those who have received the tablet computer, with all necessary signatures confirmed according to Model No. 02/BBBG-MTB, Appendix II issued together with this Circular. The record is made in five copies, including:
a) The People's Committee at the commune level retains one copy;
b) Sends one copy to the Department of Information and Communications (for monitoring, compiling, and reporting the implementation results to the People's Committee at the provincial level);
c) The contractor retains three copies (of which two copies are sent to the Inviting Party when completing the acceptance procedures for the tender package).
Section 4
SUPPORT FOR USING PUBLIC UTILITY TELECOMMUNICATION SERVICES
FOR THE RECIPIENTS OF TABLET COMPUTERS
Article 13. Public utility telecommunications services supported for use and the duration of support for use for the recipients of tablet computers
1. The program to support the cost of using public utility telecommunications services for households that have received tablet computers through only one (1) telecommunications service provider.
2. The program supports the use of one (1) out of two (2) public utility telecommunications services prescribed in Clause 1 of Article 5 of this Circular for households (who have received tablet computers) permanently residing in areas with particularly difficult socio-economic conditions, island communes, island districts, and areas where telecommunications services are widely available. Households may choose the public utility telecommunications service they wish to use.
3. The program supports the use of broadband Internet access services on terrestrial mobile telecommunications networks for households that have received tablet computers residing outside the areas specified in Clause 2 of this Article.
4. The period for calculating the support for using public utility telecommunications services for the recipients of tablet computers (subscribers) is from the day the subscriber begins using the public utility telecommunications service (universal telecommunications service) until:
a) Temporarily suspending the support for using the service as prescribed in Article 18 of this Circular;
b) Removing the recipient from the list of those eligible for support for using public utility telecommunications services as prescribed in Article 19 of this Circular.
Article 14. Level of support and method of implementation
1. The level of support for using public utility telecommunications services: Issued by the Ministry of Information and Communications.
2. In cases where the recipient of the tablet computer starts using the public utility telecommunications service on any day within a month (not a full month), the level of support for the first month provided to the telecommunications service provider is as follows:
a) Households starting to use the public utility telecommunications service from the 2nd to the 10th of the month are supported at 85% of the level of support prescribed in Clause 1 of this Article;
b) Households starting to use the public utility telecommunications service from the 11th to the 20th of the month are supported at 50% of the level of support prescribed in Clause 1 of this Article;
c) Households starting to use the public utility telecommunications service from the 21st to the end of the month are supported at 15% of the level of support prescribed in Clause 1 of this Article.
3. In cases where households require the use of broadband Internet access services with costs higher than the support levels prescribed in Clauses 1 and 2 of this Article, the households are responsible for paying the difference directly to the telecommunications service provider.
4. In cases where the subscriber must pay the difference between the actual cost and the support level of the Program to the telecommunications service provider, the service provider must provide information about the value of the telecommunications services used monthly, the amount of funding supported by the Program, and the amount the subscriber still needs to pay directly to the service provider. The service provider decides the method of providing this information to the subscriber and notifies the method applied to the Ministry of Information and Communications and the Vietnam Universal Service Fund for monitoring and implementation.
5. Method of implementation: The State orders the telecommunications service provider to supply public utility telecommunications services to the recipients of tablet computers.
Article 15. Documents and procedures for requesting support to use public telecommunications services to use tablet computers
In addition to the procedures for signing contracts to use telecommunications services with telecommunications enterprises as prescribed, individuals listed in the approved list by the provincial People's Committee who have a need for support to use public telecommunications services when registering for a subscription must have:
1. A registration form for using public telecommunications services sent to the telecommunications enterprise (subscription registration) according to Form No. 05/ĐK-DVPC, Appendix II issued together with this Circular.
2. A certified copy of the Identity Card (or Citizen Identification Card) of the household head or the representative of the family receiving tablet computer support (with the original for verification);
3. A certified copy of the Certificate of Poverty Household or Near-Poverty Household according to the multidimensional poverty standard for the period 2021-2025 still within the period not yet escaping poverty or near-poverty as prescribed by law.
4. For subscribers currently receiving support to use public telecommunications services, they are responsible for providing a certified copy of the Certificate of Poverty Household or Near-Poverty Household as prescribed by law to the telecommunications enterprise each December to continue the support.
5. For subscribers currently receiving support to use public telecommunications services who wish to change the service provider, they must register the change of service provider according to Form No. 06/CĐ-DVPC, Appendix II issued together with this Circular.
Article 16. Determination of beneficiaries and registration for subscriptions to use public telecommunications services to use tablet computers
1. Beneficiaries receiving tablet computers are new subscribers to public telecommunications services and must meet the following conditions:
a) The household name on the list of recipients of tablet computer support from the Program approved by the provincial People's Committee;
b) The household has not received other public telecommunications service support from the Program.
2. Telecommunications service providers that households register to use public telecommunications services are responsible for:
a) Checking the procedures and documents stipulated in Article 15 of this Circular, the conditions stipulated in Clause 1 of this Article, and implementing the registration of subsidized public telecommunications service subscriptions for households;
b) Registering information of subscribers using public telecommunications services in the list of beneficiaries;
c) In cases where households have already been supported to use other public telecommunications services provided by the enterprise, the enterprise shall implement according to Clause 2 of Article 17 of this Circular.
Article 17. Changing the use of public telecommunications services
1. Cases of changing the use of public telecommunications services to use tablet computers include:
a) Households receiving tablet computers from the Program, which are being supported to use public telecommunications services as stipulated in Clause 2 of Article 13 of this Circular, may change to use one of two services specified in Clause 1 of Article 5 of this Circular provided by the same enterprise and implemented according to Clause 2 of this Article;
b) Households receiving tablet computers from the Program wishing to change the service provider for public telecommunications services shall follow the provisions of Clause 3 of this Article.
2. For the case stipulated in point a of Clause 1 of this Article, the public telecommunications service provider is responsible for:
a) Processing the cessation of support for the current service and processing the registration for a subscription to use one of the two types of services specified in Clause 1 of Article 5 of this Circular (as requested by the subscriber) from the following month; Updating the information of subscribers using public telecommunications services in the list of beneficiaries;
b) The change in the use of services stipulated in point a of this Clause shall be carried out according to the principle of ensuring non-overlapping periods (months of service usage) and full months (the month following the month of ceasing to receive public telecommunications service support).
3. For the case stipulated in point b of Clause 1 of this Article:
a) The subscriber wishing to change the service provider for public telecommunications services under the circumstances stipulated in point b of Clause 1 of this Article must request the current service provider to cease providing the service before registering for a new service from a new provider according to Form No. 06/CĐ-DVPC, Appendix II issued together with this Circular;
b) Based on the request of the subscriber, the public telecommunications service providers are responsible for:
- The current service provider is responsible for processing the termination of the subsidized service subscription contract, confirming in Form No. 06/CĐ-DVPC, Appendix II issued together with this Circular, and updating the information of the subscriber ceasing to use public telecommunications services in the list of beneficiaries;
- The new service provider, upon receiving the request of the subscriber, shall verify the documents according to Article 15 of this Circular and process the registration of a new subscription for the household using public telecommunications services and update the information of the transferred subscriber using public telecommunications services in the list of beneficiaries.
c) The transfer of public telecommunications service subscriptions between enterprises shall be carried out according to the principle of ensuring non-overlapping months of service provision and full months (the start date of service usage by the enterprise receiving the transferred subscriber must be after the month the subscriber ceased using public telecommunications services from the transferring enterprise).
Article 18. Suspension of Support for Public Interest Telecommunication Services Usage
1. The Program shall suspend support for public interest telecommunication services usage for the following subjects in the following cases:
a) Mobile subscribers using public interest telecommunication services without generating traffic (both outgoing and incoming) for two consecutive months;
b) Households with mobile subscribers currently receiving support for public interest telecommunication services who have not provided certified copies of certificates recognizing them as poor or near-poor households as stipulated in Clause 4, Article 15 of this Circular.
2. For the cases specified in point a, Clause 1 of this Article: If the subscriber generates traffic in the month following the suspension month, they will continue to receive support under the Program as prescribed in Clause 1, Article 14 of this Circular.
3. For the cases specified in point b, Clause 1 of this Article, the telecommunication service provider shall suspend support from January of the following year and notify the subscriber. The enterprise will only resume supporting the use of public interest telecommunication services with Program funds from the month when the household provides certified copies of certificates recognizing them as poor or near-poor households (not yet escaped poverty or near-poverty after review according to regulations).
4. The telecommunication service provider enterprises that are contracted to provide public interest telecommunication services shall update information on temporarily suspended support for subscribers in the cases specified in Clauses 1 and 2 of this Article into the list of supported subjects.
Article 19. Removal from the List of Supported Subjects for Public Interest Telecommunication Services Usage
1. The subjects removed from the list of subscribers receiving support for public interest telecommunication services usage include:
a) Mobile subscribers using public interest telecommunication services without generating traffic (both outgoing and incoming) for five consecutive months;
b) Households recognized by competent authorities as having escaped poverty or near-poverty. In this case, the Program will stop supporting the use of public interest telecommunication services for households recognized as having escaped poverty or near-poverty from the next quarter after the provincial People's Committee reports the results of the poverty and near-poverty household review to the Ministry of Labor, Invalids and Social Affairs according to regulations.
2. The telecommunication service provider enterprises that are contracted to provide public interest telecommunication services shall update information on the subscribers specified in Clause 1 of this Article into the list of supported subjects.
Section 5
ESTABLISHING PLANS AND BUDGETS FOR SUPPORTING TABLETS AND ORDERING TELECOMMUNICATION SERVICES FOR PUBLIC INTEREST USE OF TABLETS
TO PROVIDE TABLETS
FOR TABLET USE
Article 20. Establishing Plans and Budgets for Supporting Tablet Provision and Implementing Procurement Procedures for Goods and Services Provided to Tablet Recipients
1. Establishing plans and budgets for providing tablets:
a) Based on the Decision allocating tablets to localities by the Ministry of Information and Communications, within ten days, the Vietnam Universal Service Fund shall establish procurement plans, budgets, and tender selection plans for tablet suppliers to submit to the Ministry of Information and Communications for consideration and approval;
b) Based on the approved plans, budgets, and tender selection plans by the Ministry of Information and Communications, the Vietnam Universal Service Fund shall organize the procurement of tablets in accordance with the legal provisions on bidding for goods procurement using state capital; sign contracts with winning enterprises to implement the provision of tablets to recipients as prescribed.
2. Establishing plans and budgets for ordering public interest telecommunication services provision:
a) Basis for establishing plans and budgets:
- The Decision allocating tablets to localities by the Ministry of Information and Communications;
- The list of households receiving tablet support approved by the provincial People's Committee;
- The price of public interest telecommunication services; the level of support for using public interest telecommunication services issued by the Ministry of Information and Communications;
- The actual situation of enterprises.
b) Enterprises shall establish plans and budgets for providing telecommunication services for public interest use of tablets according to Model No. 04/KH-DV, Appendix II issued together with this Circular and report explanatory plans and budgets to the Ministry of Information and Communications before September 30 of the previous year of the plan. For the 2022 plan, it must be submitted no later than thirty days after the Ministry of Information and Communications issues the Decision allocating tablets of the Program to provinces;
c) The Ministry of Information and Communications shall assign competent agencies to lead and coordinate with relevant agencies to organize reviews and submit for approval by the Ministry of Information and Communications no later than fifteen days from the date of receipt of all reports from enterprises;
d) Within seven working days from the date of approval of the budget plan for supporting the use of public interest telecommunication services by the Ministry of Information and Communications, the Vietnam Universal Service Fund shall enter into orders with telecommunications enterprises to implement the provision of public interest telecommunication services as prescribed in this Circular.
Article 21. Contents of the Order Contract for Provision of Public Telecommunication Services
1. The order contract for provision of public telecommunication services shall be concluded between the Vietnam Universal Service Fund and enterprises providing public telecommunication services (for the entire period but implemented annually).
2. The contents of the order contract for provision of public telecommunication services must include the following main items:
a) Service name;
b) Quantity and volume of products and services;
c) Quality standards of services;
d) Scope of implementation and beneficiaries;
đ) Price, unit price, level of support for provision and use of public telecommunication services;
e) Value of the contract;
g) Implementation time and completion time;
h) Advance payment and settlement;
i) Acceptance and liquidation procedures of the contract;
k) Obligation to report periodically on the progress of contract implementation;
l) Rights and obligations of the ordering party and service provider;
m) Handling of contract violations and dispute resolution procedures;
n) Other agreements of the parties.
3. In addition to the contents stipulated in Clause 2 of this Article, the Vietnam Universal Service Fund and telecommunications enterprises may supplement other contents to meet the requirements for managing the order contract for provision of public telecommunication services as prescribed by law.
4. After signing the order contract for provision of public telecommunication services, the Vietnam Universal Service Fund shall send one copy to the Ministry of Information and Communications for monitoring and supervising the implementation. In cases where additional contents exceed its authority, the Vietnam Universal Service Fund shall report and seek opinions from the Ministry of Information and Communications on the draft order contract before signing.
Article 22. Advance Payment, Acceptance, Settlement, and Final Accounting of Funding for Tablet Computers
1. Advance payment: Implemented according to the provisions of the contract for implementing the tender package.
2. Acceptance of completed volume:
a) The winning enterprise shall prepare a proposal for acceptance of the contract results and submit it to the Vietnam Universal Service Fund no later than 20 days from the last day of the contract implementation period;
b) The acceptance dossier includes:
- A request for acceptance and payment documents according to Model No. 03/BCKP-MTB, Appendix II issued together with this Circular;
- The original handover protocol (including the list of households receiving tablet computers) according to Model No. 02/BBBG-MTB, Appendix II issued together with this Circular.
3. Settlement:
Based on the acceptance protocol, contract liquidation, and payment requests from enterprises, the Vietnam Universal Service Fund shall settle payments to enterprises up to a maximum of 95% of the value already implemented, while recovering the advance funding. The remaining value will be settled after approval by the Ministry of Information and Communications.
4. Settlement:
a) The Vietnam Universal Service Fund shall compile and report to the Ministry of Information and Communications for examination and approval of the final accounting of funding for tablet computers according to each contract for implementing the tender package with contractors. The reporting deadline for final accounting is no later than two months from the last day of the contract implementation period;
b) The final accounting procedure for funding for tablet computers shall be carried out in accordance with the guidelines of the Ministry of Information and Communications in the General Circular guiding the implementation of the Program.
Article 23. Advance payment, acceptance, settlement, and final settlement of funding for the support of using public telecommunications services
The contents regarding advance payment, acceptance, settlement, and final settlement of funding for the support of using public telecommunications services for recipients of tablet computers shall be implemented in accordance with the guidance of the Ministry of Information and Communications in the Circular on general implementation of the Program.
Chapter III
IMPLEMENTATION
Article 24. Responsibilities of ministries, sectors, central agencies, localities, and recipients of tablet computer support
1. The Ministry of Information and Communications:
a) Deciding on the allocation and notifying the People's Committee of each province about the number of tablets to be supported from the Program allocated to each province;
b) Approving plans for procurement, budget estimates, plans for selecting contractors providing tablets, and plans and budget estimates for supporting the use of public telecommunications services; approving final settlements of funds used from the Vietnam Public Telecommunications Service Fund;
c) Directing the Vietnam Public Telecommunications Service Fund to perform tasks as prescribed in this Circular and relevant laws;
d) Taking the lead and coordinating with related agencies to inspect and supervise the implementation of tablet support and public telecommunications service support from the Program;
đ) Resolving issues within the scope of their legal authority;
e) Reporting to the competent authority on the results of implementing the Program on tablet support and supporting the use of public telecommunications services for the use of tablets;
2. The Ministry of Labor, Invalids and Social Affairs:
a) Cooperating and providing to the Ministry of Information and Communications the number of poor households and near-poor households;
b) Cooperating to guide and direct the Departments of Labor, Invalids, and Social Affairs to coordinate with the Departments of Information and Communications to advise the People's Committee of each province to provide the Ministry of Information and Communications and telecommunications enterprises in the locality with lists of poor households and near-poor households according to the multidimensional poverty standard for the period of 2021-2025; the results of annual reviews of poor households as stipulated;
3. Ministry of Education and Training:
a) Cooperating and providing to the Ministry of Information and Communications the number of poor households and near-poor households that have been supported with tablets from other sources under the "Waves and Tablets for Students" Program;
b) Directing general education institutions to cooperate in transferring tablets to recipients and guiding students from households supported with tablets to use the devices for educational purposes;
4. Provincial People's Committees:
a) Implementing the contents as prescribed in Article 8 of this Circular;
b) Cooperating and providing lists of poor households and near-poor households; lists of households that have escaped poverty and near-poverty according to the guidance of the Ministry of Information and Communications in the Circular on general implementation of the Program;
c) Monitoring, inspecting, supervising, or coordinating with the Ministry of Information and Communications to monitor and supervise the implementation of tablet support and provision of public telecommunications services in the locality;
d) Allocating local budget for state management agencies in relevant fields to manage the implementation of the Program at the local level in accordance with the State Budget Law;
5. Recipients of tablets:
a) Creating conditions for students who are members of households to use tablets for learning; using tablets in households to access information for economic development and essential information on the Internet as needed;
b) Selecting public telecommunications services to use tablets and cooperating with telecommunications service providers to fully comply with regulations on file and procedures for developing subscribers, changing service usage, suspending, and removing subscribers from the list of beneficiaries of public telecommunications service support as prescribed in Section 4, Chapter II of this Circular;
Article 25. Effective Date
1. This Circular takes effect from June 30, 2022.
2. During the implementation process, if there are difficulties or obstacles, agencies, organizations, and individuals are requested to report to the Ministry of Information and Communications for clarification and guidance.
