CIRCULAR

Amending certain Articles of Circulars related to the submission and presentation of household registration books and related documents when performing administrative procedures and providing public services in the field of water resources

Based on the Residence Law dated November 13, 2020;

On the basis of the Law on Water Resources dated June 21, 2012;

Pursuant to Decree No. 68/2022/NĐ-CP dated September 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

At the proposal of the Director of the Water Resources Management Department and the Head of the Legal Department;

The Minister of Natural Resources and Environment issues this Circular amending certain Articles of Circulars related to the submission and presentation of Household Registration Books and related documents when performing administrative procedures and providing public services in the field of water resources.

Article 1. Amending certain Articles of Circulars related to the submission and presentation of Household Registration Books and related documents

1. Amending Point d Clause 1 Article 14 of Circular No. 40/2014/TT-BTNMT dated July 11, 2014 of the Minister of Natural Resources and Environment on groundwater drilling operations as follows:

"d) In cases where the content of the permit is requested to be adjusted, in addition to the documents specified in Points a and c of this Clause, the application for adjustment of the permit's content shall also include documents proving the capacity conditions meeting the scale of operation as prescribed (in cases where the scale of operation is requested to be adjusted)."

2. Amending Point c Clause 4 Article 1 of Circular No. 11/2022/TT-BTNMT dated October 20, 2022 of the Minister of Natural Resources and Environment amending and supplementing certain Articles of Circulars related to business activities within the scope of management functions of the Ministry of Natural Resources and Environment as follows:

"1. Documents for requesting extension and adjustment of the content of the groundwater drilling operation permit include:

a) Application for extension and adjustment of the content of the groundwater drilling operation permit (according to Model No. 04 issued together with this Circular);

b) Summary table of groundwater drilling projects carried out by organizations and individuals during the period of using the issued permit (according to Model No. 05 issued together with this Circular);

c) In cases where the permit holder requests an extension and there is a change in the person responsible for technical matters, in addition to the documents specified in Points a and b of this Clause, the application for extension of the permit shall also include:

A certified copy or a photocopied copy with confirmation from the issuing authority of the qualification certificates of the person responsible for technical matters as prescribed by law and labor contracts for organizations and individuals applying for permission to enter into labor contracts with the person responsible for technical matters; if only a photocopied copy is available, it must be accompanied by the original for verification.

Declaration of professional experience in groundwater drilling activities of the person responsible for technical matters (according to Model No. 02 issued together with this Circular);

d) In cases where the content of the permit is requested to be adjusted, in addition to the documents specified in Points a and b of this Clause, the application for adjustment of the permit's content shall also include documents proving the capacity conditions meeting the scale of operation as prescribed (in cases where the scale of operation is requested to be adjusted)."

Article 2. Effectiveness and responsibility for implementation

1. This Circular takes effect from the date of signature.

2. Transitional Provisions

Applications received fully and properly before the effective date of this Circular shall be processed according to the provisions of existing Circulars at the time of receipt.

3. The Water Resources Management Department and the Legal Department shall be responsible for guiding and implementing this Circular.

4. Ministries, ministerial-level agencies, People's Committees at all levels, Provincial Departments of Natural Resources and Environment under central cities and relevant organizations and individuals shall be responsible for implementing this Circular./.
