Guidelines on the structure of civil servants according to occupational titles and staffing levels for personnel working in public service units in the archival sector

Pursuant to Decree No. 63/2022/NĐ-CP dated September 12, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to Decree No. 106/2020/NĐ-CP dated September 10, 2020 of the Government on job positions and staffing levels in public service units;
Pursuant to Decree No. 120/2020/NĐ-CP dated October 7, 2020 of the Government stipulating the establishment, restructuring, and dissolution of public service organizations;
Pursuant to the proposal of the Director of the State Archives and Records Administration,
The Minister of Home Affairs issues this Circular guiding the structure of civil servants according to occupational titles and staffing levels for personnel working in public service units in the archival sector.
Article 1. Scope of Regulation
This Circular guides the structure of civil servants according to occupational titles and staffing levels for personnel working in public service units in the archival sector.
Article 2. Applicability
This Circular applies to the following public service units in the archival sector:
1. Central state historical archives.
2. Provincial state historical archives.
Article 3. Basis for determining the structure of civil servants according to occupational titles and staffing norms
1. The structure of civil servants according to occupational titles in central and provincial state historical archives shall be determined in accordance with Clause 5, Article 3 and Clause 3, Article 4 of Decree No. 106/2020/NĐ-CP dated September 10, 2020 of the Government on positions and staffing levels for personnel working in public service units.
2. The staffing level for personnel working in central and provincial state historical archives shall be determined in accordance with Clause 2, Article 4 of Decree No. 106/2020/NĐ-CP and the following bases:
a) Volume of documents.
b) Quantity and characteristics of sources submitted for storage.
c) Type of documents.
d) Physical condition of documents.
đ) Language characteristics of documents.
e) Requirements for utilizing the value of documents.
g) Requirements for implementing archival business activities.
h) Current status of specialized storage facilities, information infrastructure, and the degree of application of information technology.
3. The staffing level for personnel working in central and provincial state historical archives does not include the number of personnel working in support and service positions.
Article 4. Staffing level for personnel working in central and provincial state historical archives
1. For central state historical archives: the minimum staffing level is 24 people, and the maximum is 90 people.
2. For provincial state historical archives: the minimum staffing level is 15 people. The maximum staffing level for state historical archives under centrally-administered cities is 30 people, and for those under provinces is 22 people.
Article 5. Criteria for determining additional staffing levels above the minimum staffing level
1. For paper archival materials: for every 300 meters of shelving space of archival materials from 2,000 meters of shelving space upwards, one additional person is allocated.
2. For electronic archival materials
a) Storage capacity of electronic archival materials: for every 1,000,000 megabytes, one person is allocated;
b) Number of audio and video recordings: for every 500 hours of listening or viewing, one person is allocated.
3. For woodblock archival materials: for every 1,500 pieces from 15,000 pieces upwards, one additional person is allocated.
4. For historical archives with specialized storage facilities, up to three additional persons may be allocated.
Article 6. Implementation Organization
1. Based on the provisions of Articles 3 and 5 of this Circular, the authorized person examines and decides on the additional staffing levels above the minimum staffing level for central and provincial state historical archives.
2. In cases where the current staffing level exceeds the maximum staffing level stipulated in this Circular, the authorized person decides on the allocation, arrangement, and utilization of civil servants in accordance with the law.
3. Other public service units in the archival sector established by authorized agencies of the Party, political-social organizations, ministries, ministerial-level agencies, government agencies, provincial People's Committees, and centrally-administered city People's Committees in accordance with the law shall consider applying the provisions of this Circular to determine the structure of civil servants according to occupational titles and staffing levels.
4. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented in accordance with the new documents.
Article 7. Effectiveness and Responsibility for Implementation
1. This Circular takes effect from September 15, 2024.
2. The Minister, Heads of ministerial-level agencies, government agencies, Chairmen of provincial and centrally-administered city People's Committees, relevant agencies, organizations, and individuals are responsible for implementing this Circular.
3. During the implementation process, if there are any difficulties, agencies, organizations, and individuals are requested to report to the Ministry of Home Affairs for guidance and resolution./.
