This Circular prescribes the delegation of authority to approve economic and technical reports for construction investment and final accounts for tasks such as maintenance, renovation, upgrading, expansion, and new construction works within projects already constructed by organizations and units under the management scope of the Ministry of Health. This document applies to the heads of the aforementioned organizations and units.

CIRCULAR
Regulating the delegation of authority to decide on approval of economic and technical reports for investment construction and final accounts of completed projects concerning maintenance, renovation, upgrading, expansion, and new construction works in projects already constructed by organizations and units under the management scope of the Ministry of Health
Based on the Law on Organization of the Government No. 63/2025/QH15;

Based on Decree No. 254/2025/NĐ-CP dated September 26, 2025 of the Government regulating management, settlement, and final accounts for projects using public investment funds;
Based on Decree No. 104/2026/NĐ-CP dated March 31, 2026 of the Government regulating the preparation of budget estimates, management, use, and final accounts for recurrent expenditures to implement tasks as provided in Article 40 of the Law on State Budget;
Based on Decree No. 42/2025/NĐ-CP dated February 27, 2025 of the Government regulating functions, tasks, powers, and organizational structure of the Ministry of Health;
In accordance with the proposal by the Director of the Planning-Finance Department,
The Minister of Health promulgates this Circular to regulate the delegation of authority to decide on approval of economic and technical reports for investment construction and final accounts of completed projects concerning maintenance, renovation, upgrading, expansion, and new construction works in projects already constructed by organizations and units under the management scope of the Ministry of Health.
Article 1. Delegation of Authority to Approve Economic and Technical Reports for Investment Construction and Final Accounts of Completed Projects Concerning Maintenance, Renovation, Upgrading, Expansion, and New Construction Works in Projects Already Constructed
For maintenance, renovation, upgrading, expansion, and new construction works in projects already constructed, the heads of organizations and units under the management scope of the Ministry of Health have the authority to approve:
1. Economic and technical reports for investment construction with a budget implementation cost from 500 million dong to 20 billion dong (excluding compensation costs, land acquisition costs, and land use fees).
2. Final accounts of completed projects using recurrent expenditures after the completion of construction works.
Article 2. Effective Date
1. This Circular becomes effective from the date Month Year 2026.
2. For economic and technical reports for investment construction concerning maintenance, renovation, upgrading, expansion, and new construction works in projects already constructed that have been approved by competent authorities before this Circular comes into effect, the approval of such economic and technical reports (if any) and final accounts of completed projects shall be carried out according to the provisions of this Circular.
Article 3. Implementation Responsibilities
1. The Planning-Finance Department, Ministry of Health is responsible for:
a) Coordinating with relevant agencies, organizations, and units to guide and implement this Circular;
b) Monitoring, guiding, and inspecting the implementation of delegated tasks and authorities.
2. The heads of organizations and units under the management scope of the Ministry of Health are responsible for:
a) Implementing procedures, formalities, authority, and time limits as provided by law for the contents delegated to ensure effectiveness, economy, prevent loss and waste, and bear legal responsibility for the content delegated;
b) Reporting regularly or on an urgent basis to the Ministry of Health regarding the implementation of delegated tasks and authorities according to regulations.
In the course of implementation, if there are difficulties or obstacles, units are requested to report to the Ministry of Health (Planning-Finance Department) for research and resolution./.
