Joint Circular No. 09/TTLB-NV-NG on issuing documents for Vietnamese citizens traveling to Cambodia under the Agreement on the Border Regime between Vietnam and Cambodia

JOINT CIRCULAR

Pursuant to Article 13 of the Agreement on Border Regulations between the Socialist Republic of Vietnam and the People's Republic of Kampuchea signed on July 20, 1983 regarding the mutual passage of citizens of both countries;

To unify the issuance of documents for our cadres and people traveling to Cambodia, the Ministry of Home Affairs and the Ministry of Foreign Affairs hereby jointly guide and stipulate as follows:

All Vietnamese citizens traveling to Cambodia for work or personal reasons must have a passport or a document with equivalent value to a passport, issued by the competent authority.

Those individuals who are issued documents by the Ministry of Defense according to point c of Article 13 of the Agreement and by the Ministry of Transport and Posts according to point g of Article 13 of the Agreement are not subject to the provisions of this Circular until there is another agreement between our two countries.

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

II. BORDER CROSSING DOCUMENTS AND ISSUING AUTHORITIES

1. Cadres, civil servants, and workers from all sectors and provinces that are not border provinces with Cambodia traveling to Cambodia for work purposes must have a passport or a document with equivalent value to a passport, issued by the Ministry of Foreign Affairs (as stipulated in points a and b of Article 13 of the Agreement).

2. Cadres, civil servants, and workers from border provinces with Cambodia traveling to Cambodian border provinces adjacent to Vietnam for work purposes must have a border crossing permit issued by the police department of their province. This border crossing permit is only valid for the Cambodian border province of destination (point d of Article 13 of the Agreement) and is issued individually. The holder of a border crossing permit is exempted from Cambodian entry and exit visas according to point d of Article 13 of the Agreement.

In cases where they travel to a province in Cambodia that is not a border province despite residing in a border province with Cambodia, they must follow the provisions of point 1 of this section.

3. Cadres, civil servants, workers, and people nationwide traveling to Cambodia for personal reasons must have a passport or a document with equivalent value to a passport, issued by the Ministry of Home Affairs or the provincial, city, or special zone public security organs where they reside (as stipulated in point e of Article 13 of the Agreement and Decision No. 48/CT dated February 26, 1988 of the Chairman of the Council of Ministers).

Specifically, those who go to visit relatives who are parents, spouses working at diplomatic missions (including subordinate agencies such as trade representatives, military attaché offices, air representatives, press agencies), consular offices, and representative offices of Vietnam at international organizations in Cambodia shall be issued passports by the Ministry of Foreign Affairs (according to Decision No. 193-CT dated June 10, 1987 of the Chairman of the Council of Ministers).

4. Individuals residing in border areas (including communes or equivalent administrative units) traveling to Cambodian border areas to visit relatives or exchange necessary daily goods... must use a border area residence certificate issued by the competent authority. This border area residence certificate is only valid for staying in the Cambodian border area for no more than three days. If they wish to stay longer than three days in the Cambodian border area, they must obtain additional permission from the local commune or equivalent administrative unit authorities or from the nearest Vietnamese Border Guard unit.

In cases where they travel to a place that does not belong to a border area in Cambodia despite residing in a border area, they must follow the provisions of point 3 of this section.

III. PROCEDURES FOR APPLYING FOR BORDER CROSSING DOCUMENTS

1. Individuals who are required to apply for passports or documents with equivalent value to a passport from the Ministry of Foreign Affairs should submit their application to the Consular Department (Ministry of Foreign Affairs) or local foreign affairs agencies officially authorized by the Ministry of Foreign Affairs.

2. Individuals who are required to apply for passports or documents with equivalent value to a passport from the Ministry of Home Affairs or provincial, city, or central special zone public security organs (as stipulated in point 3 of Section II) should submit their application to the public security organ of their place of residence. Specific procedures shall be applied as guided by Circular No. 03/TT-BNV dated May 17, 1988 of the Ministry of Home Affairs regarding the processing of applications for Vietnamese citizens to leave the country temporarily for personal matters.

3. Individuals who are required to apply for border crossing permits (as stipulated in point 2 of Section II) should submit their application to the public security organ of their place of residence, specifically as follows:

- Submit the decision of the competent management agency regarding the dispatch of its cadre to Cambodia for work (according to Regulation No. 37/QĐ-TW dated January 7, 1988 of the Central Committee Secretariat). This decision must clearly state the name and surname of the person being dispatched.

- Each individual must fill out one application form for a border crossing permit according to the pre-printed form of the Ministry of Home Affairs, accompanied by four newly taken photographs measuring 4cmx6cm, half-length, facing forward, without headwear.

- Pay the prescribed fee according to the regulations of the Ministry of Finance - Ministry of Home Affairs - Ministry of Foreign Affairs.

1. The Ministry of Foreign Affairs is responsible for informing the Cambodian side about the types of documents issued to Vietnamese citizens traveling to Cambodia, the competent authorities issuing these documents as stipulated in Section II of this Circular, and guiding relevant local foreign affairs agencies to implement this Circular.

2. The Ministry of Home Affairs is responsible for specifying the format of border crossing permits and border area residence certificates and guiding public security organs at all levels and related localities to implement this Circular.

IV. IMPLEMENTATION

This Circular takes effect from the date of issuance./.
