CIRCULAR

OF THE MINISTER OF HOME AFFAIRS NO. 1/NV DATED JANUARY 7, 1975 GUIDING THE PROVISION OF ASSISTANCE FOR THOSE NEEDING HELP IN DAILY LIVING ACTIVITIES FOR SEVERELY DISABLED WAR VETERANS AGAINST THE FRENCH
DAILY ACTIVITIES FOR SEVERELY DISABLED WAR VETERANS AGAINST THE ENEMY

 

The Interim Regulations on the Treatment of Military Personnel issued by Decree No. 161-CP dated October 30, 1964 of the Council of Ministers stipulates that severely disabled war veterans with disabilities classified as grades 6, 7, and 8 who need assistance in daily living activities shall receive an additional monthly allowance equal to 10% of their basic salary or living expenses.

Recently, the Council of Ministers issued Decree No. 177-CP dated July 17, 1974 supplementing policies for war veterans and families of martyrs, including provisions for supplementary allowances for those needing help in daily living activities for severely disabled war veterans against the Americans classified as grades 6, 7, and 8 residing at home for convalescence, and the Ministry of Home Affairs has issued Circular No. 10-NV dated November 2, 1974 guiding the implementation of this decree. However, severely disabled war veterans against the French have not yet received this allowance.

Now, with the agreement of the Ministry of Finance in Document No. 599-TC/HCVX dated December 2, 1974, the Ministry of Home Affairs guides the implementation of this allowance for severely disabled war veterans against the French residing at home for convalescence as follows:

1. Eligible recipients:

The subjects eligible to receive the allowance for assistance in daily living activities mentioned in this circular are war veterans and those entitled to the same treatment as war veterans (including civilian militia and youth volunteers injured during the anti-French campaign, hereinafter referred to collectively as war veterans) classified as grade 1 and special grade who are residing at home for convalescence.

War veterans classified as grade 1 and special grade against the French currently residing in veteran hospitals or although residing at home but still listed under the management of the hospital and receiving living expenses from the hospital shall not be eligible for the aforementioned allowance.

2. Subsidy amount:

The amount of the allowance for assistance in daily living activities for war veterans classified as grade 1 and special grade against the French is prescribed as follows:

- Grade 1...10 đ

- Special grade...12 đ.

3. Procedures:

a) For war veterans who have returned home before the issuance of this guidance, the Departments and Offices of Veterans and Social Welfare shall examine and propose the People's Committee of cities and provinces to issue new decisions and record specifically in the war veteran's book under the section "change in allowance level":

- Monthly disability allowance...đ

- Allowance for assistance due to need for service...đ

b) For war veterans currently residing in veteran hospitals who have been decided to reside permanently at home for convalescence, the hospital shall be responsible for bringing the war veteran's book along with the decision of the Ministry of Home Affairs allowing the war veteran to reside at home for convalescence to the Department or Office of Veterans and Social Welfare where the war veteran resides to complete the procedures for this allowance before transferring the war veteran out of the hospital. The war veteran will cease to receive living expenses from the hospital from the month they start receiving the disability allowance (at the local rate) and the allowance for assistance in daily living activities from that month.

4. Implementation timeline:

The allowance for assistance in daily living activities for severely disabled war veterans against the French shall take effect from January 1, 1975 onwards.
