DECREE

REGARDING THE ESTABLISHMENT OF THE MINIMUM WAGE IN ENTERPRISES

THE GOVERNMENT

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to the Labour Code dated June 23, 1994;

At the proposal of the Minister of Labor, Invalids and Social Affairs,

DECREE:

Article 1. The minimum wage level is set at 180,000 VND/month applicable to workers employed in enterprises operating under the Law on State-Owned Enterprises and enterprises operating under the Enterprise Law.

Article 2.

1. For state-owned enterprises operating under the Law on State-Owned Enterprises, the contribution and benefit levels for social insurance and health insurance for workers and officials shall be calculated based on the salary coefficient stipulated in Decree No. 26/CP dated May 23, 1993 of the Government and the minimum wage level prescribed in Article 1 of this Decree.

2. For enterprises operating under the Enterprise Law, the wage level serving as the basis for contributions and benefits for social insurance and health insurance recorded in the labor contracts shall be recalculated according to the minimum wage level prescribed in Article 1 of this Decree.

Article 3. The Ministry of Labor, Invalids and Social Affairs shall coordinate with the Ministry of Finance to provide guidance on the implementation of this Decree.

Article 4. This Decree takes effect from January 1, 2000.

Article 5. The Minister, Heads of Ministries equivalent to Ministries, Heads of agencies under the Government, Chairmen of provincial People's Committees directly under the Central Government are responsible for implementing this Decree.
